Motion by Alderman McCarthy, second by Alderman Carnell to approve the May 21, 2019 meeting minutes as presented. Motion carried unanimously.

Jacqueline Flood did not appear (for the second time).
Motion by Alderman McCarthy, seconded by Alderman Jurken, to table the license. Motion carried unanimously.

a. Resolution regarding an applicant for an Original Alcohol License:

Shawn DeMain and Luke Larson appeared before the Committee. Alderman Mahkorn stated that Class B liquor licenses are “near and dear” to the City.
However, the presentation made from the applicant at the last meeting gave a better sense of what this business does. Alderman Blumer stated this is a unique
business to have. If the location isn’t here, it will go elsewhere. He pointed out that the building is behind a major frontage road, though. Mr. DeMain stated that
he would like signage to the east and north. Alderman Carnell asked if walk-ins are encouraged (without a reservation to golf). Mr. DeMain replied, yes, they will
serve that client, however, the primary service will be for golf. Simulations will be the largest driver for sales as well as lessons and club sales.
Motion by Alderman McCarthy, seconded by Alderman Jurken, to approve
the Reserve Class B Beer & Liquor license for Skylark SL LLC, d/b/a X-Golf Brookfield, at 12565 W. Feerick St., Agent – Shawn M. DeMain. Motion
carried unanimously.

b. Ordinance amending Subsection 5.24.060 B of the Municipal Code
regarding restrictions on granting premises licenses.
City Attorney Jenna Merten stated that our current code prohibits applicants from being considered for a license unless they own or lease the premises. The
statutes prohibits municipalities from engaging in the sale of alcohol beverages so the City itself could not obtain the required license for the Brookfield Conference Center.
The City and North Central Group do not have a landlord-tenant relationship; instead, North Central Group has authority to operate the premises through a management
agreement. Accordingly, the language in the Code needs to be expanded to include management agreements.
Motion by Alderman McCarthy, seconded by Alderman Blumer, to approve the Ordinance amending Subsection 5.24.060 B. of the Municipal Code regarding
restrictions on granting premises licenses. Motion carried unanimously.

5g. ADDENDUM - New Business g. Consider non-renewal of Class B Beer & Liquor License and directing staff to
issue Summons and Complaint to WB Hotels LLC, d/b/a Residence Inn at 765 S. Pinehurst Court for a non-renewal hearing.
Attorney Merten stated that the building was torn down in 2017 with the intent of it
being rebuilt in 2018. The license was renewed in 2018 and expires June 30, 2019. However, the progress of the rebuilding has been slow as there are only
footings to date. No alcohol has been sold at the location since 2017. Attorney
Merten stated that she will prepare a Summons to begin a non-renewal hearing. Once the construction is completed, Residence Inn can re-apply for a new liquor
license (a non-reserve license) utilizing the provisions of the Code for premises under construction.
Motion by Alderman Blumer, seconded by Alderman Carnell, to direct staff to
issue a Summons to WB Hotels LLC, d/b/a Residence Inn, at 765 S. Pinehurst Court, for a non-renewal hearing. Motion carried unanimously.
Editor’s Note: Staff has been instructed to call the applicant to request it to surrender
its Alcohol license and reapply under the Code for premises under construction.
Motion by Alderman McCarthy, second by Alderman Blumer to adjourn the Legislative & Licensing Committee meeting. Motion carried unanimously.

Brookfield, WI 53005 Re: Annual Renewal of Liquor License for TGI Fridays at 17430 Bluemound Rd Dear Ms. Michaels: This letter is intended to address the recent liquor violation at the TGI Fridays at 17430 Bluemound Road. The liquor law violation occurred on March 14, 2019 and involved “serving without a licensed bartender”. As General Manager, I want the City to know that we take these allegations extremely seriously and have enacted the following plan to ensure compliance with the City’s licensing regulations going forward. With this plan, we will ensure that our staff are trained in the required serving procedures to deliver a safe environment for our guests. All Managers who work at the Brookfield location will have a Bartender license and will complete training prior to making application for a license. In addition, we maintain a copy of each provisional license to validate that all of our team members comply with the licensing regulations. Once they receive the Operator License, that will be included in the binder, as well. We will require all bartenders to apply for their Bartender license during the orientation process. We have added that process to our training plan and will require that the General Manager and the Director of Operations sign off to validate this process before the bartender is allowed to work. If a Bartender transfers to Brookfield, they will be required to take their original city license to the City to request transfer of the license to our location. With these procedures in place, I am confident we can ensure compliance with the licensing regulations of the City and be a good business partner within the Brookfield community. I will attend the hearing on Tuesday evening to address any questions.
