Waste Legislation
"Any substance or object the holder discards, intends to discard or is required to discard" is WASTE under the Waste Framework Directive (European Directive (WFD) 2006/12/EC)
• Vast area, more pieces of legislation than any other environmental sector, even before we include emissions, discharges and hazardous waste. Very big on the environmental agenda
• Have tried to pull together some of the relevant things you need to be aware of and give advice on where to look for further details.
• SBP work closely with the environmental law team at
Blake Lapthorn and if there are any specific worries or questions, can contact the SBP and we will pass on
enquiries
• Familiar to you, but worth having a quick catch up a legislation does change, albeit quite slowly!

Duty of Care
Your Waste Responsibilities
• You are legally responsible for ensuring that waste your business produces or handles is stored, transported, treated, reprocessed and disposed of safely. This is your duty of care.
• The duty of care has no time limit. You are specifically responsible for your waste from when you produce it until you have transferred it to an authorised person. However if you think that your waste is not being managed correctly you must take action to check and prevent this.
• You must keep records of all transfers of your waste.
• Currently under review; looking at making the original producer of the waste responsible for it until end of life – disassembly etc. Report on progress was published in October 2009
WEEE• Electrical and electronic waste is the fastest growing waste stream in
the UK. Around 1.8 million tonnes are generated every year. • The Waste Electrical and Electronic Equipment (WEEE) Regulations
aim to reduce the amount of this waste going to landfill and improve recovery and recycling rates.
• You will need to comply with the WEEE Regulations if you:
• manufacture or import electrical or electronic equipment • distribute electrical or electronic equipment • generate any electrical or electronic waste • collect electrical or electronic waste from your customers for treatment or disposal • operate a waste treatment facility • export electrical or electronic waste.
