1. ANNUAL LEAVE• EDUCATORS• Regarded as being on leave

during school closure periods

days school holidays & 5 days leave)

2. NORMAL SICK LEAVE

• EDUCATORS• 36 Days from 2013-

2015 (3yr cycle)• Sick leave 1-2 days can

be submitted without M/C

• 3 days onwards M/C is compulsory

• 8 week rule – if employee has been absent from work on more than two occasions during an 8 week period, regardless of duration, submit a medical certificate

• Numerous short term absences may be indicative of abuse and M\C may be required

3. TEMPORARY INCAPACITY LEAVE

• If employee exhausts 36 days before the expiry of 3 year cycle must apply for Temporary Incapacity Leave for every sick leave application

• Annexure A- 1 to 29 days of leave with M/C (compulsory)• Annexure B- 30 and more sick leave days with M/C

(compulsory)• It is the responsibility of the employee to ensure that these

forms are completed timeously• HR sends it to Thandile Health Risk Management for

assessment and recommendation• Approval lies with the Department

4. PERMANENT INCAPACITY LEAVE

• If incapacity has been declared permanent in nature

• Processes of Ill-Health Retirement are initiated

5. LEAVE FOR OCCUPATIONAL INJURIES

• Also known as Injury on Duty (IOD)• Compensation Commission is involved in

making a decision • Special leave is granted in such cases

6. MATERNITY LEAVE

• Employees are entitled 4 consecutive months • Preferable if leave starts at least 2 weeks or 1

month prior to the expected date of delivery

6.1 PRE-NATAL LEAVE- Employees are entitled to 8 working days pre-

natal leave per pregnancy

7. ADOPTION LEAVE and SURROGACY LEAVE

• 45 days - adopts a child that is younger than 2 yrs

• Can extend by applying for up to 184 days unpaid leave

• Requirements: written proof of adoption/surrogacy proof of the number of days applied for

8. FAMILY RESPONSIBILITY LEAVE & SPECIAL LEAVE FOR UPA

8.1 Educators• 3 days if • child, spouse or life partner is sick or• employee’s spouse or life partner gives birth• 5 days if• Child, spouse or life partner dies or• Employee’s immediate family member ( parents/adoptive, parents-

in-law, grand-parents, siblings, grand parents and grand children) dies• The total number of frl (8) and upa(4) taken shall not exceed 12 days

in a year• Capped leave / annual leave may be used• Unpaid leave to a maximum of 184 days• Proof is required• 12 days max Special leave

9. LEAVE FOR UNION OFFICE BEARERS

• Max of 15 working days per annum• Applications must be submitted in writing &

supported by necessary by documentation• For every 7 hours of leave taken a leave form

must be submitted• Ordinary members have 8 hours per annum

for union activities

13. SPECIAL LEAVE FOR SPORTING, CULTURAL & OTHER EVENTS

• Participating in sports, cultural etc. – representation of a country, province, or other comparable level as an actual participants, referee, adjudicator, course or group leader etc.

• Service delivery requirements will be taken into consideration

• Documentary evidence must accompany the application

TO NOTE

• Proper records must be kept by the supervisor.• The supervisor needs to report any absence to the HR

department• For non-compliance proper procedures need to be

followed• Incapacity leave is not an entitlement, it is a benefit

granted at the discretion of the employer. There is no legal obligation on the part of the employer to grant incapacity

• ALL ABSENCES MUST BE REPORTED AND LEAVE FORMS SUBMITTED
