THE LEGAL AND REGULATORY FRAMEWORK WITHIN WHICH WE OPERATE IS REGULARLY EXAMINED FOR IMPACT ON IMPERIAL’S OPERATIONS.

Systems and control processes are designed and implemented to ensure compliance, and reports on compliance are made to the relevant board committees, noting any areas of concern and any rectification required.

In our engagement with government and regulatory bodies, our key concerns are:

> To stay abreast of legislative changes

> To maintain legal compliance

> To discuss issues of mutual concern, optimise opportunities and minimise risks of regulation and non-compliance

> To anticipate and assess potential policy and regulatory impact

> To share our industry expertise and contribute to policy formation

The divisions comply with all relevant regulations and, where relevant, systems are audited to ensure that we meet the requirements of the legislation in force. Where we believe legislation or regulations affecting us can be improved, we engage with the relevant government body through industry bodies such as the Retail Motor Association (RMA), the Independent Dealer Association (IDA), the Southern African Vehicle Rental and Leasing Association (SAVRALA), the South African Motor Body Repairers’ Association (SAMBRA), the National Automobile Association of South Africa (NAAMSA), the Road Freight Association (RFA) and the National Business Initiative (NBI).

Areas covered in these interactions include a range of issues relevant to our business. During the financial year, engagement covered areas such as road safety, where there is frequent and ongoing interaction with South African government departments and with the police through the Imperial Road Safety programme.

Engagement also took place on regulation affecting the financial services business, such as the Protection of Personal Information Act (POPI), Treating Customers Fairly (TCF) and the National Credit Act (NCA), as well as on the planned introduction of carbon tax legislation in South Africa.

In our European operations, we participated extensively during the year in representations made by the sector in relation to minimum wage requirements for drivers in Germany, to ensure that new regulations reflect a practical approach for drivers operating transit routes through the country.

Our Logistics Africa division participated actively in public debate relating to issues of concern to the healthcare industry in Africa, see the case study examples alongside and overleaf.

Imperial Health Services shared insights on the potential benefits of the harmonisation of drug regulations in Africa at the second Africa Pharmaceutical Summit and Exhibition, held in Accra, Ghana.

The summit aims to promote investment into, and build collaborative relationships within, the pharmaceutical industry across the public and private sectors. Issues discussed included regulatory harmony, counterfeit medications, local manufacture and private public partnerships.

Imperial’s interventions at the summit drew attention to the costs associated with the current lack of harmony in regulatory processes among African countries. As a result of inconsistencies in regulation, many drug companies are not registering medicines in African countries, and these products are then unavailable to patients in need. Regulatory harmony is a priority that has also

been identified by both the African Union and the World Health Organisation (WHO).

In a roadmap proposed by the African Union in 2014, the organisation prioritised regulatory harmonisation, and noted that the foundations needed to be laid for a single African regulatory agency. The WHO recently launched the African Medicines Registration Harmonisation Initiative with a range of global partners.

To support effective and harmonised regulation, Imperial Health Sciences is actively involved in the issue of counterfeit pharmaceuticals and serialisation. Imperial Health Services processes ensure that medicines entering African countries through its channels are genuine. It is also assisting companies to serialise their products, so that from the point of production to the point of usage, there is a chip, barcode or traceability measure to verify that the product is genuine and not counterfeit.

During the year, Logistics Africa sponsored the second International ‘People that Deliver’ conference in Copenhagen, Denmark. The event was co-hosted by the United Nations Children’s Fund (UNICEF) and helps countries to plan, finance, develop, support and retain the workforces necessary for the effective, efficient and sustainable management of health supply chains.

The People that Deliver conference brought together over 150 supply chain professionals and health experts representing international development partners, governments and donors from 20 countries. It is one of the highest profile events focusing on human resources in healthcare, and is attended by the leading role players in healthcare supply chains, including benefactors, multi- nationals, implementing partners and the private sector.

Imperial Health Sciences contributed to the presentations and training sessions at the conference and facilitated workforce development sessions. It is a board member of the People that Deliver initiative.

The third annual People that Deliver conference will take place in 2016.
