I. INCIDENT OVERVIEW:

On July 29, 2014, at approximately 0630 hours, Natasha Jackson and Cody “Havoc” Winters were stopped on the right shoulder of northbound I-515 (US 95) in a stolen white Nissan Altima bearing Nevada plate 346-XYH. Nevada Department of Transportation (NDOT) Freeway Service Patrol worker, Scott Ufert, noticed the Altima on the shoulder of the freeway and stopped to assist. As Ufert approached the vehicle, Winters pointed a black semi-automatic handgun at his head. Winters and Jackson kidnapped Ufert at gunpoint forcing him to drive them off the freeway. Ufert exited onto westbound Tropicana Avenue and dropped Winters and Jackson off in the area of Rollingwood and Autumn. Winters and Jackson exited Ufert’s work vehicle and walked southbound. Ufert immediately left the area and contacted the police. The robbery was documented under LVMPD event 140729-0774.

Winters and Jackson walked to a residence located at 3930 Autumn Street where they knocked on the front door. The homeowner, Richard Ramos, opened the door and the suspects asked to use his telephone. Once inside the home, Winters produced a handgun from his waistband and there was a struggle between Winters and Richard over the gun. During the struggle, Richard’s wife, Julie Ramos, tried to help her husband. Jackson stabbed Julie several times in the back. Winters was able to take control of his handgun. Winters then shot Richard twice.

Following the shooting, Winters and Jackson fled the residence and eventually made their way to 3909 Almondwood Drive, which was one street north of Autumn Drive. The residence was vacant and Winters forced his way inside by breaking a window. LVMPD patrol officers responded and focused their attention on Winters and Jackson who were barricaded inside of 3909 Almondwood Drive. A short time later Winters exited the house through a broken window and pointed his handgun at Officer Moore. Officer Moore fired his rifle twice at Winters, missing Winters with both shots. Winters retreated back into the vacant house and a short time later Jackson exited the house and was taken into custody by officers. Jackson yelled to Winters, who was still in the house, to shoot the officers.

Winters exited 3909 Almondwood Drive by breaking another window on the west side of the house. Winters jumped the west wall into the side yard of 3899 Almondwood Drive, which was just west of 3909 Almondwood Drive. The residence was occupied by Terri Ham and John Hastrich. Winters broke a window on the west side of the residence and confronted Ham and Hastrich at gunpoint. Winters demanded that Hastrich give him a set of car keys. Hastrich complied and after taking the keys, Winters began to walk away when he suddenly turned back around and shot Ham in the stomach. Hastrich exited the front door of his residence and alerted police officers to what just happened.

Winters exited the house, still armed with the handgun and holding onto Ham. Ham became limp and fell to the ground, at which time Officer Rotta discharged his rifle killing Winters. Richard died on the morning of the incident from the gunshot wounds he sustained. On August 21, 2014, Ham also died from the gunshot wound she sustained from the incident.

III. PUBLIC SAFETY STATEMENT:

On July 31, 2014, at approximately 1020 hours, Detective Dosch interviewed Sergeant Auten in reference to the Public Safety Statements he took from Officer Rotta and Officer Moore. The interview took place at the LVMPD Headquarters. Below are the questions asked by Sergeant Auten and the answers provided by Officers Rotta and Moore.

On July 29, 2014, at approximately 1046 hours, Officer Moore provided a walkthrough of the scene in the presence of the above listed subjects. The purpose of the walkthrough was to identify items of evidence and provide a timeline of events. Officer Moore stated he was positioned in the southeast corner of 3909 Almondwood Drive. Officer Moore deployed his rifle and pointed it in a west to southwest direction.

Officer Moore stated he was standing in a small dirt area with Officer Mohler, in the backyard of 3909 Almondwood Drive. While posted up in the backyard, Winters exited 3909 Almondwood Drive through a broken window and entered the backyard. Winters was facing Officer Moore and was holding a firearm. Officer Moore issued verbal commands to Winters to drop his weapon.

Winters refused to drop the weapon and pointed it at Officer Moore. Officer Moore discharged his rifle twice in a west direction, missing Winters. Officer Moore’s rounds struck a brick cinder block wall behind Winters. Winters retreated back into the house. During the walkthrough Officer Moore pointed out the location of his cartridge cases and the south facing window used by Winters to exit and enter 3909 Almondwood Drive.

On July 29, 2014, at approximately 1100 hours, Officer Rotta provided a walkthrough of the scene in the presence of the above listed subjects. The purpose of the walkthrough was to identify items of evidence and provide a timeline of events. Officer Rotta was positioned behind a pickup truck in the northwest corner of the driveway of 3908 Almondwood Drive.

Officer Rotta had his rifle deployed and was facing in a southwest direction towards 3899 Almondwood Drive. Officer Rotta observed Winters and Ham exit the front door of 3899 Almondwood Drive. Ham fell to the ground and Winters continued walking north. Officer Rotta observed Winters holding a black object in his hand that he believed to be a gun.

Officer Rotta fired his rifle three times at Winters. Winters retreated back towards the front door, stopped, and began walking north again. Officer Rotta again discharged his rifle, firing three more times at Winters. Winters fell down and slumped over a rock. Officer Rotta stayed in the same location until Winters was taken into custody.

On July 29, 2014, between 1114 hours and 1315 hours, Officers Mohler, Hibbetts, Santoyo, Cobb, Webber, and K9 Officer Moore provided a walkthrough of the scene in the presence of Lieutenant Plummer, Sergeant Mullin, Sergeant Prosser, Detective Patton, Director McLaughlin, Supervisor Martin, PPA attorney Collins, and PPA representatives Clodt, Nicholas, and Yant. The purpose of the walkthrough was to identify where the witness officers were located when shots were fired, identify possible items of evidence, and provide a timeline of the events that occurred. Refer to the diagram at the beginning of this section for each officer’s location at the time of the shooting, as well as their transcribed statements for detailed information on their involvement in the incident.

VII. PRELIMINARY INVESTIGATION:

On Tuesday, July 29, 2014, at approximately 0630 hours, Natasha Jackson and Cody “Havoc” Winters were stopped on the right shoulder of northbound US 95, just south of the Tropicana Avenue exit. They were in a stolen white Nissan Altima bearing Nevada plate 346-XYH. The Altima was reported stolen under LVMPD event 140708-1252. NDOT Freeway Service Patrol worker, Scott Ufert noticed the Altima on the shoulder of the freeway and stopped to assist Jackson and Winters.

Upon stopping and exiting his vehicle, Ufert observed Jackson seated in the front passenger seat and Winters seated in the driver’s seat. As Ufert approached the Altima, Winters told him they had lost their keys. Winters then pointed a black semi-automatic handgun at Ufert’s head and demanded his car keys, cell phone, and wallet. At the same time, Jackson exited the vehicle and pulled a large sheathed knife, out of a bag. Ufert told Jackson and Winters he didn't have any money and handed Winters his iPhone. Ufert convinced Winters and Jackson he needed to drive his NDOT van or a GPS sensor on the van would alert NDOT personnel who would then alert law enforcement. Winters and Jackson believed Ufert and began loading several items from the Altima into Ufert’s van then left the area. Jackson and Winters instructed Ufert to exit the freeway onto westbound Tropicana Avenue. While westbound on Tropicana Avenue, Jackson and Winters directed Ufert to make the first right into an unknown apartment complex. Ufert was not able to make the turn, so he took the first left he could onto Rollingwood Drive. Ufert turned south on Rollingwood Drive, a few yards south of Tropicana Avenue, and stopped the van. Winters and Jackson took the items they had loaded into the van, including a flat screen television, and exited. Winters told Ufert not to call the police then both Winters and Jackson began walking southbound. Ufert immediately left the area and contacted the police. The robbery was documented under LVMPD event 140729-0774. Jackson and Winters began walking on Autumn Street when a vehicle driven by Julie Keop approached. Jackson and Winters quickly converged on Keop’s vehicle causing her to slow down. Winters told Keop, “Please help us. We need a phone.” Keop did not stop her vehicle and continued traveling on Autumn Street. Winters and Jackson then walked to a residence located at 3930 Autumn Street and knocked on the front door. The homeowner, Richard Ramos, answered the door and Winters asked if he and Jackson could use a telephone. Richard advised Winters to remain at his front door while he got his phone. Richard closed his front door, went into his master bedroom where his wife Julie Ramos was sleeping and retrieved the house phone. Julie awoke and asked what he was doing. Richard explained to her that Winters and Jackson wanted to use the phone. Richard returned to the front door and as he opened the door, Jackson and Winters forced their way inside the residence. Once inside the home, Winters produced a handgun from his waistband and a struggle between Winters and Richard over the weapon quickly ensued. While struggling with Richard over the gun, Winters began pleading with him to let go of the gun. Winters was eventually able to take control of his handgun and while doing so, he fired twice striking Richard in is leg and the back of his right shoulder. Julie heard the gunshots, ran out of her bedroom, and saw Richard and Winters fighting in the living room over a handgun. Julie stepped in to assist Richard however Jackson attacked Julie, and began punching her. After Richard was shot, he and Winters continued to fight and Winters shouted out to Jackson, “Stab the motherfucker!” Jackson reached into a bag she had with her, grabbed an object that resembled an ice pick, and started stabbing Richard in the back. Julie continued fighting with Jackson attempting to get her off of Richard. Jackson turned and started stabbing Julie with

the object from her bag. Jackson then hit Julie and Richard with a heavy metal tool as they continued to struggle. Julie shouted for her son Dominic to help her. Dominic arrived and observed his mom fighting with Jackson. Dominic yelled at his sister to call 911. Dominic pulled Jackson off of Julie. Julie got up, found her eight-year-old son and escaped from the house through Dominic’s bedroom window. Julie carried out onto the street and started shouting for help. and Dominic stayed inside the residence for a brief amount of time before eventually leaving their residence through the same window Julie used to escape. Following the shooting Winters and Jackson fled 3930 Autumn Street through a rear door leading into the backyard where they hopped the north wall into the backyard of 3929 Almondwood Drive. Winters began banging on the sliding glass door of 3929 Almondwood Drive until the homeowner Antonio Amaro appeared. Winters pointed his handgun at Amaro and demanded his car keys. Amaro quickly closed his blinds and told his adult daughter to call 911. Jackson made her way onto Almondwood Drive and located hiding under a large recreational vehicle (RV) parked in the driveway of 3919 Almondwood Drive. Jackson grabbed

leg and pulled her from underneath the RV. Dominic saw Jackson pull his sister from the RV but as he was approaching Jasmine was able to escape from Jackson. After escaping, Dominic and ran away from Jackson back towards their house where patrol officers were beginning to arrive. Winters and Jackson eventually made their way to a vacant house located at 3909 Almondwood Drive. Winters forced his way inside by breaking a window. Patrol officers responded and to where Winters and Jackson were barricaded. Officers Moore and Mohler were located in backyard of 3909 Almondwood Drive. Both officers were posted in a small dirt area on the southeast corner of the residence. Winters exited the south side of the residence to the backyard by breaking a large glass window. Once outside, Officer Moore, armed with his rifle, confronted Winters. Officer Moore gave Winters verbal commands to drop his weapon. Winters instead pointed his gun at Officer Moore who then fired his weapon twice at Winters. Both rounds missed Winters and struck a cinder block wall directly behind him. Winters retreated into the residence while Officers Moore and Mohler jumped the east wall into the backyard of 3919 Almondwood Drive. A short time later Jackson could be heard yelling from inside of 3909 Almondwood Drive asking Winters not to shoot her which lead officers to believe they had a hostage situation. A brief time later, Jackson emerged from the vacant residence and into the backyard where Officer Mohler directed her to his location.

Quickly after talking to Jackson, it was apparent to Officer Mohler that Jackson was not a hostage and was in fact a suspect. Officer Mohler placed Jackson in handcuffs and Jackson immediately yelled out to Winters encouraging him to shoot the officers. Winters exited the residence by breaking another window on the west side of 3909 Almondwood Drive and then jumped the west wall into the side yard of 3899 Almondwood Drive. Winters broke a window on the west side of the residence and entered. Terri Ham and John Hastrich were inside of the residence.

Winters confronted Ham and Hastrich at gunpoint and demanded car keys. Hastrich complied and gave Winters a set of keys to a vehicle that was parked in his driveway. After taking the car keys, Winters began to walk away when he suddenly turned back around and fired one round from his handgun striking Ham in the stomach. Hastrich ran out of his front door yelling “He shot my girlfriend! He shot my girlfriend.” Winters exited the house holding Ham as a shield and still holding a handgun. Ham fell to the ground. Winters walked over Hams body towards the driveway. Several officers gave Winters verbal commands to stop and go to the ground, but he did not comply. Officer Rotta, who was positioned across the street, in the driveway of 3908 Almondwood Drive, fired three times from his rifle at Winters. Winters fell back towards the front door, stopped his motion, and again began walking towards the driveway. Officer Rotta fired three more rounds striking Winters, which caused him to fall down onto a large boulder next to the front yard. An arrest team was formed and moved to Winters’ location. Officers moved Winters from the boulder and placed him in handcuffs. Officers then conducted a “downed officer rescue” on Ham. Officers moved Ham to the front yard of 3889 Almondwood Drive for medical treatment. After securing Winters and removing Ham from danger, the arrest team began clearing 3899 and 3909 Almondwood Drive to ensure there were no other victims or outstanding suspects. Upon making the scene safe, supervisors on scene determined further investigation from the Force Investigation Team (FIT) was warranted. Lieutenant Plummer was notified of the call and arrived on scene along with Sergeant Mullin and Detectives Patton, Gillis, Jaeger, Dosch, Jex, Bunting, Pazos, and Colon. Detectives received a briefing from patrol Sergeants Holmes and Auten. Those present for the briefing were:

Detective Gillis was assigned the responsibility of interviewing any possible witnesses at the hospital as well as Scott Ufert.

VIII. DESCRIPTION OF SCENES, SUSPECT BODY, AND VISIBLE EVIDENCE:

A. Description of Scenes Almondwood Drive is an east/west running street and is accessed on the east side from Rollingwood Drive, from the south by Pembroke Street, and on the west from Lancaster Drive. Several single family residences are located on both the north and south sides of Almondwood Drive. LVMPD patrol vehicle SE10477 was facing west and located in front of 3918 Almondwood Drive. LVMPD patrol vehicle SE10525 was facing west and located in front of 3908 Almondwood Drive.

3909 Almondwood Drive 3909 Almondwood Drive was a vacant, green two story, single family residence with bars covering most of the exterior windows. The residence was on the south side of the street and both the front door and garage door faced north.

A metal security door protected the front door and upon detectives’ arrival, both the front door and security door were open. Directly west of front door was a north facing window that was attached to a small bedroom located on the first floor of the house. The window was shattered and broken glass was located on the ground inside of the bedroom as well as on the ground outside below the window. Apparent blood was located on the window’s vertical blinds and on the bedroom floor. The living room was located on the east end of the first level of the residence. Apparent blood was located on the interior surface of the south facing window located in the southwest part of the living room. Both the kitchen and family/dining room were located in the southwest portion of the first level of the residence. The family/dining room windows on the south and west facing walls were broke out. Broken glass was located on the floor inside of the family/dining room as well as outside on the back patio. Apparent blood was located on the floor of the family/dining room, blinds, broken glass, and surrounding window frames.

The stairs leading to the second level of the residence were located on the west wall of the living room directly across from the front door. Apparent blood was located on several of the steps and stairwell railing leading upstairs. The second level consisted of an east/west running hallway leading to a centrally located bedroom on the south side of the hallway as well as the master bedroom. Apparent blood was located on the floor of both these rooms. A southwest and northwest bedroom were located on the west end of the second level hallway. Apparent blood was located on the floor inside of the southwest bedroom. The sliding doors from the closet inside of the northwest bedroom had been removed and were partially blocking the entrance to the northwest bedroom. Apparent blood was located

on the leading edges of those doors. Metal bars located outside of the window protected the north facing window of the northwest bedroom. The window was broken out and glass was on the interior floor as well as the roof of the garage, which was located directly below the window. Apparent blood was located on the metal bars of the window and one (1) cartridge with the head stamp S&B 9mm BRC was laying on top of the garage below the window (Evidence Item 17). A black backpack containing tools, cigarettes, a wallet with several ID cards, a cartridge case with the head stamp S&B 9MM BRC, pills, change, and other miscellaneous items were laying on the floor of the northwest bedroom near the west wall (Evidence Items 18,31,33-36). Two (2) knifes and other items were on the floor surrounding the backpack (Evidence Item 32).

The backyard to 3009 Almondwood Drive was located on the south side of the residence and was accessed by a north facing black metal gate on the west side of the residence. The metal gate was open and had been kicked open by K9 Officer Moore. Apparent blood was located on the concrete slab located just south of the metal gate. Circular concrete spacers lined the ground from the slab south of the gate to the backyard patio. Apparent blood was located on two of the spacers. A Garmin Nuvi GPS, lighter, and Phillips head screwdriver were lying in the rocks just inside and to the west of the metal gate (Evidence Items 21-23). Apparent blood, broken glass, and a damaged window screen were on the ground adjacent to the broken west facing family/dining room window. A covered patio that was attached to the south side of the residence was located in the southwest corner of the backyard. Broken glass and apparent blood was located on the concrete patio in the area adjacent to the broken south facing family/dining room window.

The east side of the backyard, adjacent to the southeast corner of the residence consisted of a raised dirt area. Located in the dirt area near the east part of the back yard were two (2) cartridge cases; one (1) with a head stamp of FC 223 REM (Evidence Item 7) and one (1) with the head stamp LC 10 (Evidence Item 8). Both were ejected from Officer Moore’s rifle after he fired his rifle in a westward direction at Winters.

A cinder block wall was also located on the west side of the backyard. The west cinder block wall separated the backyard of 3909 Almondwood Drive from 3899 Almondwood Drive. Two (2) bullets (from Officer Moore’s rifle) impacted and penetrated the east facing surface of the wall and were marked Y and Z. Penetrating bullet Y was located 6’7” off of the ground and 32’8” south of the north wall of the backyard, adjacent to the side gate. Penetrating bullet Z was located 6’5” off of the ground and 31’8” south of the north wall. Both penetrating bullets were 57’10” from where Officer Moore was standing when he fired. Y and Z were consistent with origination from the area of evidence items 7 and 8. A search for bullets and/or bullet fragments was conducted with negative results.

A pool pump was located against the west wall of the backyard just north of the bullet penetrating impact locations. Apparent blood was located on a portion of the pump and a partial footwear impression was located on the top of the pump. 3899 Almondwood Drive 3899 Almondwood Drive was a tan one story, single family residence with a swimming pool in the backyard. The residence shared a common east property wall with 3909 Almondwood Drive. The entrance to the residence faced north and a covered patio area surrounded the front door. To the west of the front patio was a driveway. Parked in the driveway were two vehicles; a blue Dodge Charger bearing Nevada plate 593-VDU and a white Dodge Stratus bearing Nevada plate LVM-653. The vehicles faced south. The driveway area and both vehicles were unremarkable.

The backyard was on the south side of the residence. A trail of apparent blood extended west from the east cinder block wall, across the patio adjacent to the south facing living room sliding glass door, around the southwest corner of the residence and terminated on the west side near a broken dining room window. Broken glass was on the ground in the surrounding area and apparent blood was located on the vertical blinds just inside the window. On the west wall of the residence, north of the broken dining room window, was apparent blood. Just north of the apparent blood on the wall was a metal side gate, which was open and led to the western side of the driveway.

Broken glass and apparent blood was located on the interior floor of the dining room. A slot machine was located on the floor and an overturned chair and vase containing dried flowers were also located on the same floor. The dining room consisted of an oval shaped table centrally located in the room surrounded by several chairs. On the south side of the room was a kitchen, which had a tile floor. A single drop of apparent blood was located on the kitchen floor.

On the south side of the dining room was an open area that led to a converted garage/den room. The converted garage/den was filled with furniture and was unremarkable. On the southeast side of the dining room was a door which led to the living room. The door was open and had a small drop of apparent blood. On the northeast side of the dining room was an entrance to an east/west entryway on the north side of the residence. A cartridge case with the head stamp Speer 9mm Luger (Evidence Item 14) was located on the dining room floor near the opening to the entryway.

The east/west running entryway consisted of a front door and two (2) large vertical windows. Adjacent to the west vertical window was the west wall. On the west wall was a mirror with an apparent bullet strike. The front door was east of the windows and located on the north side of the entryway. Broken glass, apparent blood, and an overturned metal baby gate were located on the entryway floor and surrounding area. On the north side of the entryway, near the west end, was a laundry room. The door to the laundry room was open. Apparent blood was located on the door frame and the wall just east of the laundry room. The laundry room was unremarkable. An opening to the living room was on the south side of the entryway. Two (2) large, south facing chairs were located side-by-side in the northwest corner of the living room. One (1) bullet fragment (Evidence Item 15) was located in the back of the east chair. One (1) bullet fragment (Evidence Item 16) was located on a white comforter on the floor in the northeast corner of the living room, north of the television. In the south side of the living room was a south facing sliding glass door and vertical blinds. Apparent blood was located on the blinds and on the interior side of the sliding glass door. The rest of the living room, including a sunken fireplace area in the southwest corner of the room, was unremarkable. The eastern half of the hallway east of the front door, consisted of a north bedroom, a northeast bedroom in the northeast corner, an east bathroom, and a southeast master bedroom. The bedrooms and bathroom were accessed by an east/west hallway. The doorframe and door to the northeast bedroom was damaged. The damage was the result of a door kick performed by officers who cleared the residence. A closet door in the same room was located on the bedroom floor. The north bedroom, east bathroom, and master bedroom were unremarkable. The north facing entrance to the residence led outside into a covered patio area. The area consisted of a north/south running sidewalk with landscape rocks on either side, and large decorative rocks on the west side approaching the driveway. A metal security door was

located on the front door to the residence and a metal gate was located farther out on the patio, near the front yard. One (1) black semi-automatic handgun (Evidence Item 11) with apparent blood was lying on the sidewalk along the west edge, just inside the metal gate. One (1) damaged handgun magazine containing three (3) cartridges with the headstamp “SPEER 9MM LUGER” (Evidence Item 12) was lying on the east edge of the sidewalk adjacent to the tile area near the front door. One (1) cartridge with the headstamp “SPEER 9MM LUGER” (Evidence Item 13) was on the west edge of the sidewalk near the handgun magazine’s location.

Apparent blood was located throughout on the sidewalk and surrounding area. Swabs of apparent blood were collected from the sidewalk (Evidence Item 9) and from the interior entryway floor (Evidence Item 10). There were two (2) apparent bullet holes to the west, north facing vertical window. There was an apparent bullet hole to the east fixed portion of the metal gate, along the west side and adjacent to the door. A set of keys with apparent blood were located on the sidewalk just north of the metal gate. The keys were later returned to owner John Hastrich. There was an apparent bullet hole and an apparent bullet penetration to the north side of the wood pillar located in the northeast corner of the front patio. Four (4) bullet trajectories were documented in the area surrounding the front patio. The trajectories were labeled A, B, C, and D.

It entered the pillar at a descending 1° angle and a left to right 70° angle. B – Perforating bullet trajectory in the north side of the wood pillar location in the northeast corner of the front patio, located 4’4” off the ground and 8’10” east of the west wall of the patio. The driveway was located on the southwest corner of the property and the front door to the residence faced south. A white 2005 Ford F-150 bearing NV plate 762-TLV was parked on the far west portion of the driveway and faced north.

A north/south cinderblock wall was located west of the white Ford F-150. The wall separated 3908 Almondwood Drive from 3898 Almondwood Drive. Six (6) cartridge cases with the head stamp ‘FC 223 REM’ were located on the driveway between the Ford F-150 and the cinderblock wall. (Evidence Items 1-6)

B. Description of Cody Winters Body Clark County Coroner Michael Murphy and Coroner Investigator Shawna Shields responded and reported Cody Winters official time of death to be 1545 hours. The body of Cody Winters was lying on the north/south sidewalk, just north of the metal security gate and east of a large decorative boulder/rock. The body was covered with a white sheet that was later removed by Coroner Murphy. Winters’ body was lying primarily on his right side and facing down. Winters head was pointing north and both of Winters’ hands were handcuffed behind his back. His knees were slightly bent with his left leg lying on top of his right leg and his feet were facing south. There were signs of medical intervention on Winters’ left shoulder, right tricep, and lower left abdomen. Winters body was clothed in a white tank top and red suspenders underneath a long sleeve black tee shirt, dark colored plaid shorts secured with a brown belt, and black high top tennis shoes. Medical personnel cut Winters’ two shirts and suspenders in an effort to apply medical pads to his body. Winters had several tattoos in many different locations on his body and large holes in both of his earlobes which held gauge earrings however the earrings were missing from his ears.

On August 22, 2014, at approximately 0900 hours, Doctor Dutra conducted a complete autopsy on the body of Terri Ham under Clark County Coroner’s case number 14-07844. The autopsy was performed by Doctor. Timothy Dutra. Doctorr. Dutra determined the cause of death was a gunshot wound of the abdomen, and the manner of death was homicide.

X. INVESTIGATION/FOLLOW-UP:

Per LVMPD Policy 6/002.04, Post Use of Force Procedures, an Involved Officer may provide a recorded statement to FIT investigators. If given, Involved Officer statements are taken at least 48 hours after the incident unless waived by the Involved Officer. Lieutenant Plummer contacted Officer Moore and Officer Rotta individually to ask them if they wanted to provide a statement to FIT detectives. Officer Moore and Rotta each declined to give investigators a statement. On July 29, 2014 at approximately 0912 hours, Detective Gillis obtained a recorded statement with Marcus Wymer in the parking lot of Sunrise Hospital. The following is a summary of the statement. Wymer was working as a paramedic for Medicwest Ambulance Company when he was dispatched to 3930 Autumn Street, along with his partner Jessica Martin. Their call was reference a shooting with one individual suffering from a gunshot wound to the shoulder.

Upon their arrival, Wymer observed Clark County Fire Department personnel carrying an adult male, Richard Ramos, on a backboard to their ambulance. Wymer stated Ramos was rushed out to them because the firefighters heard additional gunshots. While transporting Ramos to Sunrise Hospital, Wymer asked him what happened. Ramos was able to provide his name, date of birth and social security number to Wymer who observed Ramos to have a gunshot wound to his right armpit area. Ramos told Wymer he was the homeowner and a victim of a home invasion. When he confronted the person he was shot with a black Glock 9mm or .45 caliber handgun. Ramos became unable to talk after that and did not say anything else to Wymer

On July 29, 2014 at approximately 0956 hours, Detective Jaeger obtained a recorded statement from Julie Ramos in an unmarked LVMPD vehicle parked in front of 3915 Autumn Street. The following is a summary of the statement. For complete details refer to the transcribed statement. Julie Ramos lived with her husband Richard Ramos and their children, 19-year-old son Dominic, 16-year-old daughter and 8-year-old son Julie’s husband Richard worked from home for EA International. Richard sold plastic packaging to large retail stores. Richard worked for EA International and has worked from a home office for the last seven years. Richard was normally up early because he had clients all over the world.

Between 0630 and 0700 hours on July 29, 2014, Julie was in bed sleeping when she heard the doorbell ring. Richard walked into their bedroom and said that someone was at the door, their phone wasn’t working, and they needed to borrow their house phone. Richard took the cordless phone from the bedroom and walked out of the room. A few seconds after Richard left, Julie heard a gunshot and ran out of the bedroom to see what was going on. Julie saw her husband and an unknown male, Cody Winters, fighting in the house over a handgun. Julie stepped in to assist Richard when a black female, Latasha Jackson, began attacking Julie by getting on top of her and punching her. After Richard was shot, he and Winters continued to fight and Winters shouted out to Jackson, “Stab the motherfucker!” Jackson reached into a bag she had with her, grabbed an object that resembled an ice pick, and started stabbing Richard in the back. Julie continued fighting with Jackson attempting to get her off of Richard. Jackson turned and started stabbing Julie with the object from her bag. Jackson then hit Julie and Richard with a heavy metal tool as they continued to struggle. Julie shouted for her son Dominic to help her. Dominic arrived and pulled Jackson off of Julie. Julie got up, found her son and escaped from the house out of a window that was in the east bedroom. Julie felt that Jackson was trying to kill her. and Dominic stayed inside the residence with Richard and both suspects. Julie carried out onto the street and started shouting for help.

Julie was only able to describe Winters as a white male adult “Tweeker looking” with blond hair, a mustache and “angry looking.” Julie got a good look at his face but couldn’t see his clothing because Richard was on top of him.

Julie described Jackson as “crazy looking” and really muscular. Julie got a good look at her face, but wasn’t able to describe her clothing “because everything happened so fast.”

After the interview, Detective Jaeger conducted a Show-up with Julie. Detective Jaeger read Julie the Show-up Witness Instructions, which she acknowledged. Julie was driven to where Jackson was in custody. Julie identified Jackson as the female who was inside of her house. Julie said she was “100% plus, with God as my witness, she is the one who tried to kill me and my husband.”

On July 29, 2014 at approximately 1040 hours, Detective Jex obtained a recorded statement from Antonio Amaro at the intersection of Almondwood Drive and Pembroke Street. The following is a summary of the statement. For complete details refer to the transcribed statement. Amaro was inside of his residence and observed a white male adult, Cody Winters, was in his backyard. He was unable to describe what clothing Winters was wearing. Amaro thought that Winters might be from the power company, there to read the meter so he went to the rear sliding door of living room and opened the door. Winters walked up to the door, pointed a black semi-automatic handgun at Amaro’s chest, and told him to give him his car keys. Amaro quickly shut the door, locked it, and pulled the drapes closed. Amaro left the living room area but continued to watch the sliding door and yelled for his daughter to call 911.

Winters started to bang on the sliding glass door, with what Amaro thought was a handgun, in an attempt to break the glass. The glass did not break. Winters went to Amaro’s kitchen door that led to the backyard and again began to bang on it in an attempt to break the glass. The glass did not break. Winters was yelling but, Amaro could not tell what he was saying.

Winters ran around the corner of the house. Amaro lost sight of him but believed he went into the yard of the house directly west of his. Amaro indicated that the house next door was abandoned. Amaro went to the front door where he was met by a police officer. The officer asked to go into Amaro’s backyard and Amaro led him through the house into the backyard. Amaro observed other officers across the street getting into different positions.

Amaro heard two shots fired out in front of his house and a homeowner from two houses west running down the street yelling that his wife had been shot. Another officer came to Amaro’s front door and told them to evacuate their home. Amaro did not evacuate and stayed inside his home until police again contacted him after the incident was over.

Amaro’s daughter, Kimi Amaro, her husband Joshua Coombs and their son Jeffrey Guerrero also live in the house with him. On July 29, 2014 at approximately 1049 hours, Detective Jaeger obtained a recorded statement from Dominic Ramos in his unmarked LVMPD vehicle parked in front of 3915 Autumn Street. In the early morning hours of July 29, 2014, Dominic was awakened by his mother Julie screaming for help. Dominic exited his room and found Julie fighting with a black woman, Natasha Jackson, and his father Richard fighting over a gun with an unknown male, Cody Winters, a few feet inside the front door. Dominic told his sister to call 911.

Dominic grabbed Jackson and pulled her off of Julie. Once Jackson was pulled off, Julie was able to get away, grab Dominic’s younger brother and flee the residence. Winters and Richard were still on the floor of the residence struggling over a handgun. Winters started negotiating with Richard saying he wasn’t going to hurt anyone, but they weren’t going to leave without the gun. Both Winters and Jackson had a clear path to leave the residence out the front door but refused to leave without the gun. Richard kept his grip on the gun and was struggling with Winters. Winters was able to get on top of Richard and started stabbing him in the back with a yellow handled screwdriver to make him let go of the gun. Dominic saw the screwdriver puncture his dad’s back at least two times. Dominic shoved Winters off of Richard. Winters was able to regain control of the gun and pointed it at Dominic demanding his car keys. Dominic could not find any car keys, so Winters told him, “Go find them.” Dominic looked out the front window of the house and could see his mother and brother in the street. Dominic used looking for the keys as an excuse to escape from the house. Dominic told his sister to come with him and they both fled the residence through his bedroom window.

Dominic and ran north on Pembroke Street then west on Almondwood Drive and hid under a large RV parked by an abandoned house. While hiding they could hear Winters voice coming in their direction. Dominic climbed out from under the RV and saw Jackson walking on the sidewalk. Dominic approached her and asked “Where is my mother?” Jackson replied, “I don’t know” and walked away from Dominic and towards location. Dominic watched Jackson as she grabbed leg and pulled her out from her hiding spot. was able to fight away from Jackson and run to Dominic. Dominic and ran back towards their residence and to an arriving police officer.

Dominic was able to describe Winters as white, tall, skinny, with blond shaved spikey hair, wearing all black clothing. Dominic thought he had a tattoo on his lower leg.

Dominic described Jackson as black, with shoulder length black hair, carrying a purse. Dominic could not remember her clothing but knew what her face looked like.

Dominic had never seen Winters or Jackson before, and did not know who they were. On July 29, 2014, at approximately 1100 hours, Detectives Bunting and Colon obtained a recorded statement from John Hastrich at the corner of Almondwood Drive and Pembroke Street. Hastrich had resided at 3899 Almondwood Drive for seven years with his girlfriend Terri Ham. He had two vehicles, a blue 2007 Dodge Charger and a white 2002 Dodge Stratus, which were parked in the driveway. At approximately 0640-0650 hours, while sleeping in his master bedroom, Hastrich heard loud banging noises, which appeared to be coming from his spare bedroom in the northeast corner of the residence. Simultaneously he heard what appeared to be breaking glass from the residence next door to the east. Hastrich exited his front door in an effort to see what was happening. After exiting his house, Hastrich continued to hear the sound of breaking glass

coming from the house next door. Hastrich observed two police officers in tan uniforms at the northeast corner of his residence. One officer was carrying a rifle. A third officer was across the street on the north side of Almondwood Drive also with a rifle. An officer told him to get back in the house and head toward the west end of his residence.

Hastrich returned to the master bedroom and woke up Ham, then directed her toward the northwest corner of the residence. Both Ham and Hastrich looked out the window and observed the same two officers at the northeast corner of his house were now standing between his two vehicles in the driveway and yelling toward the northeast corner of his house. Both he and Ham began walking toward the front door to the residence. Hastrich heard a loud banging noise coming from the west side of his residence. Seconds later Ham yelled out, “He’s got a gun!” Hastrich turned and observed a white or Hispanic male, Cody Winters approximately 6’0” tall wearing all black clothing, rush toward them with a black semi-automatic handgun in his right hand. Winters placed the gun close to Hastrich’s forehead and yelled, “Where are your keys? I want your fucking keys!”

Hastrich immediately grabbed the keys to his Dodge Charger from a clear and red colored ashtray in his entryway. After handing Winters his keys, Winters yelled, “Where’s your fucking car?” Hastrich told him the vehicle was in the driveway. Winters headed back to the west portion of the residence, suddenly stopped and turned around, and fired one round from his handgun, which struck Ham in the right abdomen. Hastrich immediately began tending to Ham and did not see where Winters went. Hastrich began yelling for help, telling the officers outside his girlfriend had been shot. He then exited the residence to find help and was told by officers to run eastbound down Almondwood Drive. While running down the street, Hastrich could hear officers yelling commands at Winters, but was unable to determine what they were saying. Approximately three houses down the street, Hastrich heard an unknown number of gunshots fired. He looked back toward his residence and observed two officers pull Ham from the residence and render aid. On July 29, 2014, at approximately 1130 hours, Detective Jaeger obtained a recorded statement from in his unmarked LVMPD vehicle parked in front of 3915 Autumn Street. Ufert worked for the Freeway Service Patrol section of NDOT, driving an emergency service van along the freeway assisting motorists. Ufert was traveling northbound on US 95 when he saw a white Nissan Altima stopped on the side of the road. Ufert decided to stop and see if the occupants of the Altima needed assistance. Ufert approached the Altima and saw a black female, Natasha Jackson, in the front passenger seat and a white male, Cody Winters in the driver seat. He contacted Jackson who stated they had lost their keys. Winters exited and came along the side of the vehicle, pulled out a black semi-automatic handgun, and pointed it at Ufert’s head. Winters demanded Ufert’s keys, cell phone, and wallet. Jackson pulled a large knife, enclosed in a sheath, out of her bag. Ufert told Winters and Jackson that he didn't have any money and handed Winters his iPhone. As Winters and Jackson loaded items from the Altima into the van, which included a large flat screen TV, and a large duffel bag, Ufert convinced Winters and Jackson that he needed to drive the van or a GPS sensor would alert NDOT and a call would be made to the police. Winters and Jackson believed Ufert and ordered him to drive northbound on US 95. Winters and Jackson ordered Ufert to exit westbound onto Tropicana Avenue. Winters then ordered Ufert to make the first right turn into an apartment complex. Ufert was unable to make the right hand turn so he took his first left turn onto Rollingwood Drive. Ufert pulled the van over and Winters and Jackson got out and unloaded their possessions. Winters told Ufert not to call the police and he and Jackson walked southbound. Winters was carrying the flat screen TV but dropped it on the sidewalk. Ufert believed Winters stomped on the TV several times and threw it into the first yard past the block wall on Rollingwood Drive. Ufert left the area and called 911.

After being advised of her Miranda Rights, Jackson stated she and her boyfriend, Cody Winters, where driving home from Lake Las Vegas when they ran out of gas on the freeway. Winters produced a handgun and ordered Ufert into his vehicle. Jackson stated she and Winters gathered their belongings which included a TV and got in to Ufert’s vehicle and ordered him to drive and get off the freeway.

Ufert turned into a neighborhood near 3908 Autumn Street. Jackson and Winters exited Ufert’s vehicle and walked to the address of 3908 Autumn Street. Winters told Jackson “Get ready” and then produced a 9mm handgun before approaching the front door. Jackson waited near the street watching out for police because they just, “Carjacked” someone and she expected the police to be coming. Jackson stated Winters confronted a Hispanic male, Richard Ramos, at the residence of 3908 Autumn Street and entered the residence where Richard and Winters started to fight over Winters gun. Jackson stated she entered the residence to help Winters and told Richard to give Winters the keys to his vehicle. Jackson stated a female who lived at the residence, Julie Ramos, grabbed her, so Jackson grabbed Julie by her hair. Jackson also talked about the kids being in the residence. Jackson described the gun going off and she and Winters exited the residence by breaking the rear sliding glass door.

Jackson described going over walls behind the Ramos residence and eventually entered an abandoned house. Jackson stated she followed Winters into the abandoned residence because if she did not he would kill her. Jackson stated the police arrived and she exited the abandoned residence and surrendered to police. After being taken into custody she yelled to Winters to shoot the police. Jackson stated for the past two weeks Winters had said he was not going back to prison and was going to shoot it out in the streets and would not be taken alive.

On July 29, 2014 at approximately 1425 hours, Detective Jex obtained a recorded statement from Officer Myrold at SEAC. Also present during the statement was PPA representative Bryan Yant. The following is a summary of the statement. For complete details of the interview refer to the transcribed statement. Officer Myrold was at lunch with Officer Moore when he heard a broadcast over his radio that a subject had been shot. Both officers went en route to the area. It was broadcasted the suspect had gone into a vacant residence on Almondwood Drive. The officers arrived on Almondwood Drive and parked their vehicle east of the target residence located at 3909 Almondwood Drive.

Officer Myrold exited his patrol vehicle and deployed his shotgun from the patrol vehicle. Officer William Moore deployed his rifle.

Officer Myrold used the cover of his patrol vehicle and covered down on the target residence. He observed a subject in front of the upstairs, front north facing window. Officer Myrold could not tell if the subject was a male or female. He heard the upstairs window break then Officer Rotta, from across the street, give verbal commands to the subject to exit the residence. From inside the residence, Officer Myrold heard a female, Natasha Jackson, screaming to officers not to shoot and that they could not come out.

Officer Myrold observed a male suspect, Cody Winters, at the front north-facing window, throw a black unknown object out of the window and onto the roof of the garage. Winters then put both hands out of the window, between the security bars. Officer Myrold observed Winters hands were empty and covered in blood. Winters then pulled his hands back inside and went back into the room. He observed Winters carry a white door to the window and attempt to block out the window. The door did not stay up by the window and Officer Myrold observed Winters again go back into the room.

Officer Myrold heard glass break from the rear of the target residence followed shortly by two gunshots. It was broadcasted over the radio that Officer William Moore had fired shots at Winters and Winters had gone back inside the target residence.

Officer Myrold heard glass break on the west side of the target residence followed shortly by glass breaking at the residence just west of the target residence. Officer Myrold moved to a vehicle in the driveway of 3899 Almondwood Drive. He observed a male, John Hastrich, run from, 3899 Almondwood Drive yelling that Winters had shot his girlfriend. Hastrich ran to officers across the street. Officer Myrold heard more glass break on the west side of 3899 Almondwood Drive and then Winters exited near a gate by the front door. Officer Myrold described Winters as a white male adult, dark hair, tattoo on his left ear, and dark clothing. He gave verbal commands to Winters to drop the gun but did not see any weapons. Winters ducked back into the residence. Officer Myrold and Officer Santoyo backed away from the driveway and took cover behind a large RV parked in the street just west of 3899 Almondwood Drive. Officer Myrold could not see the front door from his position but heard Officer Rotta from across the street say Winters was again at the front door. Officer Rotta gave commands to Winters to drop the gun and exit the residence. Officer Myrold then heard two shots fired from the direction of Officer Rotta. Officer Rotta continued with verbal commands then Officer Myrold heard three more rounds fired from Officer Rotta’s location.

Officer Rotta broadcasted Winters was down on the ground and crawling away from the front door. Officer Rotta then broadcasted Winters had stopped moving. Officer Myrold heard Officer Rotta continue to give verbal commands to Winters for several minutes. An arrest team was assembled to the east of 3899 Almondwood Drive. Officer Myrold provided lethal coverage for the arrest team as they moved to Winters location and placed him into handcuffs.

After Winters was in custody, Officer Myrold and four other officers moved to the vacant residence and cleared it. Officer Myrold observed blood in several of the rooms. Inside an upstairs room he observed a black backpack and knife. No other victims or suspects were found inside the residences. Officer Myrold secured his shotgun in his patrol vehicle and was assigned to Officer William Moore as a Witness Monitor.

On July 29, 2014 at approximately 1426 hours, Detective Jaeger obtained a recorded statement from Officer Shoemaker at SEAC. Also present during the interview was PPA representative Scott Nicholas. The following is a summary of the statement. For complete details refer to the transcribed statement. On the morning of July 29, 2014, Officer Shoemaker was working as a uniformed patrol officer riding with Officer Weber. Officers Shoemaker and Weber were on a vehicle stop near the intersection of Flamingo Road and Swenson Street when Dispatch broadcasted a residential burglary working on SEAC radio channel. The details of the call stated a person had been shot during the burglary. Officer Shoemaker switched his radio to SEAC channel and could tell additional officers were needed. Officer Shoemaker assigned his patrol unit to the call. When Officers Shoemaker and Weber arrived in the area of the call, they parked at the intersection of Autumn Street and Pembroke Street. Other officers informed them the suspects, Cody Winters and Natasha Jackson, had jumped a wall and were running southbound. Officers Shoemaker and Weber ran southbound on Almondwood Drive and established a perimeter position along beside Sergeant Auten behind an RV parked in front of 3919 Almondwood Drive. Officer Cobb was armed with a rifle, along with K9 Officer Moore and Officer Weber. Officer Shoemaker relieved Sergeant Auten from acting as a spotter for Officer Cobb. While at the RV other officers broadcasted updates over the radio that Winters was down and laying over a large rock in front of 3899 Almondwood Drive. Officer Shoemaker was not able to see Winters from his position because a large bush obstructed his view of the area.

Officer Shoemaker could see other officers positioned a few houses west of his location by an RV, which was parked in the street. Sergeant Auten formed an arrest team to take Winters into custody and evacuate an injured citizen, Terri Ham. The arrest team moved from the RV to the northeast corner of 3909 Almondwood Drive. From that corner they moved to the front of 3899 Almondwood Drive where Officer Shoemaker observed Winters lying over a rock and Ham lying in the entryway of the residence. Officer Shoemaker stepped over the bodies of Winters and Ham and posted up on the doorway to 3899 Almondwood Drive in case there was another suspect inside the residence. Officer Weber placed handcuffs on Winters then Sergeant Auten and Officer Weber picked Ham up and carried her to a position of cover behind a small wall west of the residence.

Officer Shoemaker and other officers cleared the inside of 3899 Almondwood Drive looking for additional suspects and victims. Officer Shoemaker remembered seeing a Glock handgun and magazine on the ground by Winters near the front door of 3899 Almondwood Drive. The magazine had a bullet hole in it and live rounds close to it. The blinds in front of the rear sliding door inside of 3899 Almondwood Drive had apparent blood smears on them.

After 3899 Almondwood Drive was deemed safe, the arrest team noticed there was an apparent blood smear on the west side window of 3909 Almondwood Drive. The arrest team made entry into 3909 Almondwood Drive through a west window. Once inside of 3909 Almondwood Drive, Officer Shoemaker remembered seeing a room upstairs that looked like someone attempted to barricade inside the room. There was a closet door placed next to the

door in an attempt to keep it from opening. There was also a backpack, rope, and several knives seen inside the room. After 3909 Almondwood Drive was deemed safe Officer Shoemaker was positioned in the front of 3899 Almondwood Drive to preserve the scene until he was relieved.

On July 29, 2014 at approximately 1426 hours, Detectives Bunting and Colon obtained a recorded statement from Officer Weber at SEAC. Also present during the interview was PPA Attorney Kathryn Collins. The following is a summary of the statement. For complete details refer to the transcribed statement. Officer Weber was operating as marked patrol unit 1N9 in South Central Area Command (SCAC) along with his partner Officer Shoemaker. While clearing from a car stop at Flamingo Road and Palos Verde Street, they heard Dispatch broadcast a burglary in SEAC where someone was possibly shot. Dispatch began assigning SCAC units to the call at which time they assigned themselves and switched to SEAC channel.

Officers Weber and Shoemaker arrived in the area and noted that the radio traffic was “chaotic” and heard the suspect, Cody Winters, was hopping walls, breaking windows, and there had been shots fired. Officer Weber parked at the intersection of Autumn Street and Pembroke Street and then ran north to Almondwood Drive where he and Office Shoemaker teamed up with Officer Cobb. Officer Cobb was posted up behind an RV, which was parked in the driveway of 3919 Almondwood Drive. Officer Weber had a visual of the target residence, 3899 Almondwood Drive, but a large bush in the front yard obstructed his view of the front door.

Other officers who were posted on the north side of Almondwood Drive across from 3899 Almondwood Drive, advised them that Winters was on the ground and there was a female victim, Terri Ham, who tried to crawl back into the house. Officer Weber heard officers on the west side of 3899 Almondwood Drive give commands to Winters to crawl away from the house and to show his hands, however Winters was unresponsive and not moving.

Officers Weber, Shoemaker, Cobb and K9 Officer Moore formed an arrest team and stacked on the northeast corner of the target residence. They could see Ham on the ground in the doorway moving around. Officers gave verbal commands to show their hands with no response. Officers posted on the north side of the street advised the arrest team that Winters was down behind the bush and Ham was in the doorway. Officers Weber, Shoemaker, Cobb and K9 Officer Moore approached the front door of the target residence where Officer Moore covered down on Winters who was lying face down and leaning against a boulder. Officer Weber approached Winters and placed him in handcuffs. Sergeant Auten came up from the west side of the residence to Ham’s location and carried her to a neighboring front yard with Officer Weber’s assistance. Officer Weber rendered aid to Ham by using her socks to apply pressure to a possible gunshot wound to her abdomen. After medical units took control of Ham, Officer Weber joined a few other Officers and cleared the backyard of the target residence.

Officer Hibbetts was working as a uniformed patrol officer riding with Officer Santoyo. Officers Hibbetts and Santoyo were driving in SEAC when they were dispatched to a residential burglary call. The details of the call stated the suspect, Cody Winters, was still inside the residence being held down by the victim. Officers Walt and Urena were the first officers to arrive on the call and when Officers Hibbetts and Santoyo arrived they parked on Almondwood Drive just west of Pembroke Street and were directed to go to the back of a residence. Officer Santoyo deployed his patrol rifle. Officers Rotta and Cobb joined officers Hibbetts and Santoyo. A citizen exited 3919 Almondwood Drive and informed the officers he saw Winters jump the wall from his backyard, into the backyard of the vacant house west of his. The citizen then saw Winters go into the house. Officer Hibbetts could hear glass breaking and screaming coming from inside 3909 Almondwood Drive. Officer Hibbetts took a position next to a large blue dumpster located on the north side of Almondwood Drive across from 3919 Almondwood Drive with Officer Rotta who was armed with his rifle. Officer Hibbetts assumed the role of Officer Rotta’s spotter and saw Winters moving on the second floor of 3909 Almondwood Drive.

Officer Hibbetts could hear a female, Natasha Jackson, shouting “Don’t shoot! Don’t shoot!” Officer Hibbetts saw Winters come to the window of the second floor and stick his hands out between the bars of the window like he was giving up. Officer Hibbetts thought Winters and Jackson were going to surrender, however Winters grabbed the bars like he was trying to pull them off the window. Winters dropped a large metal object that Officer Hibbetts thought was a gun, out of the window onto the roof of the garage. Winters went back into the house and started pulling off the closet doors and stacking them in front of the window as if he was trying to get cover so he could shoot it out with the police. Winters could not get the doors to stay in a position to block the window. He disappeared from view into the house.

A few minutes later Officer Hibbetts heard two gunshots from the rear of 3909 Almondwood Drive. Officer Hibbetts later learned the gunshots were Officer Moore shooting at Winters. After hearing Officer Moore’s shots, Officer Hibbetts saw Winters come to the front of 3909 Almondwood Drive and open the front door. Winters quickly closed the door and disappeared back into the vacant residence. After Winters disappeared back into 3909 Almondwood Drive, Officer Hibbetts heard over the radio that he had taken Jackson hostage.

A few minutes later Officer Hibbetts heard a single gunshot from inside of 3899 Almondwood Drive. A white male, John Hastrich ran out of 3899 Almondwood Drive screaming, “He shot my wife! He shot my wife!” Officer Hibbetts saw a female, Terri Ham crawling out of the doorway of the residence and collapse. Winters exited 3899 Almondwood Drive, stepped over Ham, and shouted, “I’m going to kill her!” Officer Rotta fired three rounds at Winters from his rifle. Winters stumbled back a few steps and then started walking towards the officers again. Officer Rotta fired three more shots at Winters causing him to collapse over a large landscaping rock next to the front door.

After Officer Rotta fired the shots, Officer Hibbetts advised the arrest team that Winters was down and not moving. The arrest team moved up to the front of 3899 Almondwood Drive to evacuate Ham. Officer Weber placed handcuffs on Winters then both Sergeant Auten and Officer Weber picked Ham up and evacuated her to a yard west of the residence. The remaining members of the arrest team made entry into the house to search for more suspects and/or victims.

On July 29, 2014 at approximately 1500 hours, Detective Jex obtained a recorded statement from Officer Urena at SEAC. During the statement PPA representative Bryan Yant was present. The following is a summary of the statement. For complete details refer to the transcribed statement. Officers Urena and Walt were in their patrol vehicle near Chaparral High School when they heard a broadcast of an unknown trouble call. The details of the call stated there were intruders, Cody Winters and Natasha Jackson, inside a home. Officer Urena assigned them to the call. Officers Urena and Walt arrived at the corner of Autumn Street and Pembroke Street and exited their vehicle. As they exited, a female, Julie Ramos, came running toward them screaming her husband had been shot inside the residence and pointed to 3930 Autumn Street.

As Officer Urena was getting information from Julie, he observed two children, later identified as and come from the east side of 3930 Autumn Street.

yelled Winter and Jackson were running to the west in the back yard. Another patrol vehicle arrived and Officer Urena gave them information on Winters and Jackson.

Officers Urena and Walt made entry into 3930 Autumn Street. Inside the door was a male victim, Richard Ramos, laying on the floor. Officer Urena called for medical to respond then he and Officer Walt cleared the residence. While they were clearing the residence Officer Urena heard a broadcast that Winters and Jackson had gone into a vacant residence. Medical personnel arrived and began to render aid to Richard. While Officer Urena was inside the residence with medical personnel, he heard two gunshots, followed by a broadcast from Officer Moore stating shots had been fired. Prior to being transported, Richard gave Officer Urena his name and told him Winters came into the house and shot him. Richard was transported to the hospital by medical personnel. Officer Urena took Julie, and across the street to a neighbor’s residence. Officer Urena returned to 3930 Autumn Street and stayed there to protect the crime scene. Officer Urena did not see Winters and Jackson during the incident.

On July 29, 2014 at approximately 1518 hours, Detectives Bunting and Colon obtained a recorded statement from Officer Mark Walt at SEAC. PPA Attorney Kathryn Collins was also present during the statement. The following is a summary. For complete details refer to the transcribed statement. Officer Walt was working as a marked two man patrol unit with Officer Mohler when they were apprised by Dispatch of a home invasion call, involving a male and female suspect, Cody Winters and Natasha Jackson. Winters was described as a white or Hispanic male adult with black spikey hair, facial hair and wearing all black clothing. Jackson was described as a black female. Further radio traffic stated a male victim had been shot, a stabbing had occurred, and both Winters and Jackson were last seen northbound jumping a wall.

Upon arrival at the scene, Officers Walt and Mohler met up with Sergeant Auten and Officer Cobb, who had deployed his rifle. They were located at the second house west of Pembroke Street. Officer Walt could hear glass breaking at 3909 Almondwood Drive. He also observed Officers Santoyo, Hibbitts and Rotta posted up on the north side of Almondwood Drive near a large blue dumpster. Officers Santoyo and Rotta had their rifles deployed. The officers provided information over the radio that Winters breaking a window on the second story of 3909 Almondwood Drive and throwing an unknown metal object out of the window onto the roof of the garage.

Officer Mohler left the group and went to the backyard of 3909 Almondwood Drive to meet up with Officer Moore to operate as his spotter. Officer Walt evacuated a home east of the residence Winters and Jackson were located in while Officers Santoyo and Walt crossed the street west of the vacant residence to obtain a better visual. Officer Walt heard glass breaking from the downstairs area, then heard radio traffic that Winters had Jackson hostage and was in possession of a firearm. Officers Walt, Santoyo, and Myrold traveled to the northwest corner of 3909 Almondwood Drive. Officer Walt could hear Officers Moore and Mohler giving Winters multiple verbal commands stating, “Drop the gun! Let her go!” Officer Walt heard two gunshots, followed by Officer Moore advising over the radio he shot at Winters and missed.

After Jackson was taken into custody, it was determined to treat the situation as a barricade and SWAT was notified. Officer Walt heard a male’s voice, John Hastrich, coming from the front door of 3899 Almondwood Drive asking if everything was okay. Officer Walt told Hastrich, to return inside and move to the west side of his residence.

A short time later, Officer Walt heard a loud bang and a window break at 3899 Almondwood Drive. Approximately thirty seconds to a minute after hearing the sound of glass breaking, Officer Walt heard a single gunshot come inside 3899 Almondwood Drive. Hastrich exited his residence and ran into the street where he yelled for help and declared his girlfriend had been shot. Officer Hibbetts told Hastrich to run down the street and get away from the house. Officer Walt heard a loud crashing noise on the west side of the residence. Officer Myrold moved to the rear of the white 2002 Dodge Stratus parked in the driveway of 3899 Almondwood Drive to keep an eye on the front door. Officer Walt observed Winters approach the gate on the west side of the residence which divided the front yard from the backyard. Winters turned back around toward the inside of the house and Officer Walt observed a black semi-automatic handgun in the left lower back area of Winters waistband. Officers Walt and Myrold moved further west behind an RV parked in the street just west of 3899 Almondwood Drive. Officer Walt heard from officers that Winters was standing at the front door over the female victim, Terri Ham. Officer Myrold stood with Officer Santoyo at the front driver side of the R.V. and Officer Walt stood at the rear passenger side of the RV.

Officer Walt then heard multiple gunshots, but was unable to see Winters or the shooting officer at the time the shots were fired due to his location. Radio traffic was broadcast that Winters fell on his stomach and was not moving. Sergeant Auten and an unknown officer approached Ham and carried her to the neighbor’s yard just west of 3899 Almondwood Drive.

Officers Walt and Myrold, Sergeant Auten, a K9 officer, and another unknown officer cleared 3909 Almondwood Drive. While attempting to gain entry to the residence, the K-9 officer, kicked open a gate to the west side of the yard.

On July 29, 2014 at approximately 1540 hours, Detective Jaeger obtained a recorded statement from Officer Cobb at SEAC. Also present during the interview was PPA representative Scott Nicholas. The following is a summary of the statement. For complete details refer to the transcribed statement. Officer Cobb was working as a uniformed patrol officer riding with Officer Rotta. Officers Cobb and Rotta were at 4300 Boulder Highway when they were dispatched as a secondary unit on a residential burglary in progress. The details of the call stated there were two suspects involved, Cody Winters and Natasha Jackson, and the homeowner had pinned one of the suspects on the ground inside the residence. Officers Cobb and Rotta went en route to the call with their emergency lights and siren activated. While en route, the call was updated that a hysterical female, Julie Ramos was contacted in the street in front of her residence. Julie stated that someone had been shot inside her residence and both Jackson and Winters had fled the residence on foot. The first arriving officer requested the next arriving officers set up north of Julie’s residence to start establishing a perimeter to contain Winters and Jackson.

When Officers Cobb and Rotta arrived, they saw two juveniles running southbound on the west side of Pembroke Street. Officer Cobb parked his vehicle on Almondwood Drive west of Pembroke Street. Officers Cobb and Rotta went on foot westbound on Almondwood Drive looking for Jackson and Winters. Antonio Amaro exited 3919 Almondwood Drive and said someone was in his backyard and just jumped the west wall into the backyard of 3909 Almondwood Drive. Officers Cobb and Rotta positioned themselves behind an RV parked on the west side of the driveway located at 3919 Almondwood Drive. From their position they could see a broken window west of the front door of 3909 Almondwood Drive. The blinds behind the broken window had apparent blood on them and were moving back and forth leading officers to believe someone had entered the vacant residence through the window. Officers Cobb and Rotta quickly returned to their patrol car and retrieved their rifles. Officers Cobb and Rotta then positioned themselves back at the RV. As more officers arrived in the area a perimeter was established to contain Jackson and Winters.

Officer Cobb advised responding officers he knew Jackson and Winters were now inside 3909 Almondwood Drive. From the front of the RV Officer Cobb could see movement in the second story west window and could hear Winters and Jackson’s voices. Officer Cobb gave verbal commands identifying himself as Metro Police and asked Jackson and Winters to show their hands and to put them out of the window. Officer Cobb could hear Jackson scream, “Please don’t shoot me! Don’t shoot!” Officer Cobb saw Winters inside 3909 Almondwood Drive, pull the blinds open, breakout the window, and rip the screen off the window. Winters put his hands out of the security bars covering the window and dropped what looked like a handgun onto the roof the garage. Officer Cobb believed Winters was being compliant with his commands until he disappeared back into the residence.

It was broadcasted over the radio that Officers Mohler and Moore had set up in the backyard of 3909 Almondwood Drive. Officer Cobb gave Winters and Jackson verbal commands to exit the vacant residence through the front door. Winters disappeared into the residence for a few seconds then Officer Moore announced over the radio, “The suspects are exiting the residence from the back door” followed by, “He’s pointing his gun at me.” Officer Cobb heard two shots that sounded like shots from a rifle, from the backyard of 3909 Almondwood Drive. Seconds after the shots were fired, Officer Moore announced over the radio that he fired shots at Winters, but missed and hit the cinder block wall behind Winters. After being shot at, Winters retreated back into 3909 Almondwood Drive with Jackson and was seen moving through all the rooms of the residence.

Winters exited out of the front door for a few seconds with Jackson and again disappeared from view back into the residence. Officer Moore announced over the radio he saw Winters exit the rear door with a gun to Jackson’s head. Officer Moore broadcasted over the radio; “I’ve got sights on him, should I take the shot?” Officer Cobb never heard Moore take another shot. A citizen, John Hastrich, exited 3899 Almondwood Drive to see what was occurring next to his house. For his safety Hastrich was instructed by officers to go back inside his house. Winters was going in and out of 3909 Almondwood Drive for several minutes before it was announced over the radio that Jackson had been taken into custody.

After Jackson was taken into custody, Winters jumped the west block wall separating 3909 Almondwood Drive from 3899 Almondwood Drive. Winters broke a window out of 3899 Almondwood Drive and entered the residence, which was occupied, by Hastrich and his girlfriend Terri Ham. Once Winters was inside, Officer Cobb heard one gunshot. After the gunshot was heard, Hastrich ran out of the front door of his residence screaming “He just shot my girlfriend!” Hastrich was directed to run east to stay out of the line of fire. Officer Cobb learned there was an injured female, Ham, crawling out the front of 3899 Almondwood Drive and Winters was behind her. Officer Cobb’s view of the front door was blocked by a large bush. Officer Cobb was only able to make out outlines of people through the bushes. He did not have a clear line of sight so he was unable to engage Winters. Officer Cobb heard Officer Rotta fire shots at Winters. Officer Rotta fired three rapid shots, and then a few seconds later fired another two or three shots. Officer Cobb advised over the radio that Winters was, “Down.” An arrest team was formed consisting of Officers Cobb, Shoemaker, Weber, K9 Officer Moore, and Sergeant Auten. The arrest team moved west from the RV to the front of the 3899 Almondwood Drive. Winters was found slumped over a large rock and appeared to be deceased. Officer Weber placed handcuffs on Winters then helped Sergeant Auten carry Ham to safety. Officer Cobb could see a Glock style handgun with a bullet hole in the handle and one or two live rounds on the ground near the doorway just south of Winters body. Officer Cobb and other unknown officers entered the residence looking for other victims or suspects. No victims and/or suspects were discovered inside of 3899 Almondwood Drive.

Officer Cobb then moved to 3909 Almondwood Drive with Officers Shoemaker, Santoyo, Weber, K9 Officer Moore. They entered the residence through a window on the west side of the house. While inside the house Officer Cobb saw broken glass and apparent blood trails throughout the house. Officer Cobb remembered seeing knives on the floor and doors removed from the hinges. No other victims or suspects were discovered in the residence.

On July 29, 2014 at approximately 1545 hours, Detective Gillis conducted a recorded interview with Officer Millard Walt at SEAC. PPA representative Bryan Yant was also present for the statement. The following is a summary of the statement. For complete details refer to the transcribed statement.

Officer Walt was operating as a marked patrol unit when he heard a broadcast of a home invasion call at 3930 Autumn Street. The details stated the person reporting was fighting with a person who had broken into a residence. Officer Walt was the third unit to be dispatched to the call. When Officer Walt arrived he parked south of the intersection of Autumn Street and Pembroke Street. Officer Walt immediately heard a female screaming and running towards their vehicle. The female identified herself as Julie Ramos, the homeowner of 3930 Autumn Street. Julie was screaming, “Please help! They broke into our house, they attacked us and the guy has a knife and a gun.” Julie further informed Officer Walt there were two suspects, Cody Winters and Natasha Jackson, who tried to rob them and forced their way into their home through the front door.

Julie further stated that Winters and Jackson had knocked on their door asking to use the telephone. The family had opened the front door just enough to hand them a cordless telephone when they forced the door open and began fighting with her husband Richard Ramos. Julie fought with Jackson and Richard fought with Winters who had shot him in the back. Julie described Winters as a white or Hispanic male. Julie then advised Officer Walt that Winters was armed with a Glock handgun and Jackson was armed with a knife or possibly a screwdriver. Julie stated during the struggle with Jackson she was hit in the head with an unknown object. Julie told Officer Walt that Richard had been shot and was also possibly stabbed.

Officer Walt entered 3930 Autumn Street and observed Richard inside of the front door lying on the floor of the living room. Officer Walt observed that Richard had a single gunshot wound to his right rear shoulder and was able to communicate. Richard was able to describe Winters to Officer Walt as being a Hispanic male wearing a black t-shirt, and described Jackson as a black female.

Two of Julie’s other children returned to the residence and informed Officer Walt they saw Winters and Jackson shoot their father. Winters and Jackson then chased them out the back sliding glass door. Officer Walt observed the back sliding glass door to be broken and a ladder on the ground just inside the front door and apparent blood inside the residence.

On July 29, 2014 at approximately 1613 hours, Detective Gillis obtained a recorded statement with Officer Stephen Mohler at SEAC. PPA Representative Brian Yant was also present during the statement. Officer Mohler was operating as a marked patrol unit along with his partner Officer Mark Walt when they heard a 911 disconnect call broadcasted over the radio. They did not respond to the call until the first arriving unit stated they were out with a victim who was suffering from a gunshot wound at 3930 Autumn Street. Officer Mohler assigned them to the call and responded with their lights and siren activated. Officers on scene updated the event that the suspects, Cody Winters and Natasha Jackson, jumped over a wall north towards Almondwood Drive.

Upon arrival, Officer Mohler went west on Autumn Street turned north on Pembroke Street, and parked on the west side of the street. As they were leaving, Sergeant Auten asked Officer Mohler to go to the backyard and assist Officer Moore who had deployed his rifle. Officer Walt stayed on Almondwood Drive with other officers. Officer Mohler ran south on Pembroke Street then west on Autumn Street to the second house west of the intersection, 3920 Autumn Street. The homeowner of the residence, Toni Silver, unlocked the gate for him and Officer Mohler continued into the backyard until he joined Officer Moore who was posted up on the back wall of Silver’s residence. The residence both officers were covering down on was 3909 Almondwood Drive.

Officer Mohler heard yelling and breaking glass while in the backyard of 3920 Autumn Street. Officer Moore yelled to the male suspect, Cody Winters, to drop his gun. Officer Moore felt after yelling commands at Winters their position may have been compromised. Officer Moore turned to Officer Mohler and told him that they needed to change positions. Both officers looked for a better position but quickly determined that all the houses around them were one story and the target house was two story. Officer Moore got on top of a table and heard additional sounds of glass breaking. Officer Moore told Officer Mohler he could see Winters along with a female, Natasha Jackson. Officers Mohler and Moore thought Jackson was a hostage. Officers Moore and Mohler decided to move their position and jumped into the backyard 3909 Almondwood Drive. Officer Mohler ran north near the east side of the house. Officer Moore was moving tactically around the corner of the residence, “Cutting the pie” when he saw Winters at the sliding glass door of 3909 Almondwood Drive. Officer Mohler was unable to see Winters from his position. Officer Moore gave Winters verbal commands to drop the gun and step out of the residence. Winters argued back at Officer Moore, pointed his gun at him, and told Officer Moore to put his gun down. Officer Moore fired two shots from his rifle at Winters. Both shots missed Winters and Winters retreated into the residence.

After Winters went in inside, Officers Mohler and Moore moved to another location. Both officers jumped over the east wall into the backyard of 3919 Almondwood Drive. Officer Moore told Officer Mohler Winters had a gun pointed at Jackson. Officer Moore began to yell and motion to Jackson to come over to his location at the wall. While looking over the west wall, Jackson made her way outside and ran towards Officer Moore’s voice. Officer Mohler got on top of some bricks and was able to pull Jackson over the wall. Officer Mohler stated he never heard a broadcast of a second female suspect and believed Jackson had been Winters hostage.

While talking to Jackson, Officer Mohler stated she was completely uncooperative. Jackson stated, “Don’t shoot him! I love him.” Jackson stated she had only known Winters for a week and did not know his name. Jackson also stated that Winters wanted to shoot it out with the cops, and “Cody” wanted to suicide by cop, and, “Today was the day he was going to take somebody out.”

At one point Jackson yelled towards Winters, “Shoot them Cody!” She also asked Officer Mohler if the “Highway Patrol” guy, Scott Ufert called Metro and said something about their car running out of gas and Winters had pulled a gun on someone.

Jackson refused to give Officer Mohler Winters name or say if there were any other people still inside the vacant residence. Jackson stated Winters was a “White Supremist,” and was mad at himself for falling in love with her. Officer Mohler asked Jackson if Winters was high and Jackson told Officer Mohler, “No, that’s the problem. He isn’t high.” Jackson refused to identify herself to officers which caused Officer Mohler to place her in handcuffs and detain her until the incident was over.

On July 29, 2014 at approximately 1624 hours, Detectives Bunting and Colon obtained a recorded statement from K9 Officer Moore at SEAC. Also present during the interview was PPA Attorney Kathryn Collins. The following is a summary of the statement. For complete details refer to the transcribed statement. K9 Officer Moore was operating as marked unit K95 and was in the area of I-15 and Windmill when he heard a code red on SEAC and heard there were possible subjects running. Officer Moore assigned himself and responded with his lights and siren to the area of the incident. While en route, Officer Moore heard there was one victim shot and at least one suspect possibly being held hostage. Officer Moore also learned that the suspect, Cody Winters, was at 3909 Almondwood Drive.

Officer Moore arrived and parked on the west side of Pembroke Street, south of Almondwood Drive. As he exited his vehicle, Officer Moore heard what he thought to be five or six gunshots fired from a rifle. Officer Moore retrieved his heavy vest and tactical helmet but did not deploy his dog. Officer Moore proceeded on foot northbound Pembroke Street and then westbound on Almondwood Drive. Officer Moore arrived along side four to five other officers posted behind an RV one house east of 3919 Almondwood Drive. From both the radio traffic and officers on scene, Officer Moore learned Winters was down at 3899 Almondwood Drive, two houses west from his current location, along with a female victim, Terri Ham, who was located on the ground behind Winters.

Officer Moore and the other officers formulated a plan to rescue Ham. Officer Moore took the lead because he was wearing heavy armor. They reached the northeast corner of 3899 Almondwood Drive. Officer Moore was still not able to see Winters due to a bush obstructing his view but could partially see Ham. Officer Moore gave verbal commands to Winters to crawl towards him but he did not respond. Officers posted on the north side of the street, across from Winters location, advised Officer Moore that Winters was unresponsive and had not moved for several minutes.

Officer Moore advised he would approach Winters and cover down on him so they could be responsible for covering the house and removing Ham. As Officer Moore got closer he observed Winters lying down against a large rock. Officer Moore reached down and grabbed Winters right sleeve while a second officer grabbed the left sleeve and handcuffed him. Officer Moore then told two other officers to carry Ham out of the area. Officer Moore and the other officers then cleared 3899 Almondwood Drive and 3909 Almondwood Drive. Officer Moore kicked open the gate on the west side of 3909 Almondwood Drive and saw a large window on the west wall of the house that had been kicked out, and there appeared to be apparent blood on the glass. Officers made entry through the broken window and cleared the residence.

On July 30, 2014 at approximately 1044 hours, Detectives Patton and Dosch obtained a recorded statement from Sergeant Auten at LVMPD Headquarters. The following is a summary of the statement. For complete details refer to the transcribed statement.

Sergeant Auten heard a call that came out initially as a burglary but was soon updated that weapons were involved. Since patrol officers were in manual mode (without use of their computers), Sergeant Auten was unable to see how many people were on the call. Sergeant Auten assigned himself to the call over the radio and responded Code 3. While en route, Sergeant Auten heard that the suspect Cody Winters, had dropped a gun. Sergeant Auten drove where the original call came out and asked an officer where Winters and Natasha Jackson, were located. Sergeant Auten was told that Winters and Jackson jumped a fence so Sergeant Auten made his way to the next street over, Almondwood Drive. When he got out of his car, Sergeant Auten observed Officer Cobb had deployed his rifle and was with another officer.

Sergeant Auten heard Officer Moore say he was in a backyard but Sergeant Auten was unsure which backyard. While posted behind the RV Sergeant Auten heard several shots south of his location but did not know who fired the shots. The radio was breaking up severely and when he attempted to broadcast, it was not transmitting.

Sergeant Auten ordered Officer Mohler to stay with Officer Moore. A short time later, Sergeant Auten saw Jackson run to the east wall where Officer Mohler was located and watched Officer Mohler grab Jackson and pulled her over the wall. Sergeant Auten then noticed Officer Santoya was in the middle of the street and was not in a position of cover or concealment, so Sergeant Auten directed him to a new location that was behind him and behind cover.

Sergeant Auten felt Winters was moving west so he directed a two-man team to take the west perimeter. While doing so, Sergeant Auten noted that he did not believe he was recieving all of the radio traffic being broadcast and did not think his radio traffic was being broadcasted either. Sergeant Auten heard screaming, glass breaking, and several shots fired. A white male, John Hastrich, ran out of 3899 Almondwood Drive where the shots came. Sergeant Auten observed apparent blood on Hastrich and heard him yelling that someone had shot his girlfriend, Terri Ham, and that Winters had tried to take his keys. Sergeant Auten ordered Hastrich to get out of the line of fire and move down the street.

While this was happening, Sergeant Auten saw movement at the front of 3899 Almondwood Drive and heard someone say, “He has her hostage!” Sergeant Auten was looking at Officer Rotta when he heard three shots and saw the muzzle flash from Officer Rotta’s rifle. Sergeant Auten looked over at Winters and saw him stumble backwards. Winters moved forward again but Sergeant Auten was unable to see him due to a large bush in the front yard. Sergeant Auten asked Officer Rotta if he was the only one that shot and if Winters was “Down.”

Officer Rotta advised Sergeant Auten he fired and Winters was “Down.” Sergeant Auten formed an arrest team comprised of the officers near him. Sergeant Auten assigned who he thought was a SWAT officer, K9 Officer Moore, at the head of the arrest team. Sergeant Auten asked over the radio for confirmation that Winters was down and not moving.

Winters was lying on a large boulder in front of 3899 Almondwood Drive. Sergeant Auten noted that Ham appeared to be moving near the entrance of the house. As they approached

Winters body, Sergeant Auten observed Winters take what he described as his last breath. The arrest team put Winters in handcuffs and Sergeant Auten went over to provide aid to Ham. Sergeant Auten and another officer picked Ham up and carried her out of the area to the yard west of 3899 Almondwood Drive.

When Sergeant Auten returned the second time to help his officers clear 3899 Almondwood Drive, he observed a handgun lying just south of Winters body. Sergeant Auten also observed a large amount of blood near Winters face and head area.

On July 30, 2014 at approximately 1100 hours, Detective Jex obtained a recorded statement from Officer Santoyo at LVMPD Headquarters. The following is a summary of the statement. For complete details refer to the transcribed statement.

Officers Santoyo and Hibbetts were riding together and were in the area of Vegas Valley Drive and McLeod Drive when a call was broadcasted of a burglary in progress. The officers were assigned and drove Code 3 to the area. When they arrived at Autumn Street and Pembroke Street they made contact with Officers Walt and Urena and were given information the suspects, Cody Winters and Natasha Jackson, were on foot moving northwest. Officer Santoyo observed Officers Rotta and Cobb running north on Pembroke Street toward Almondwood Drive. He followed the officers and parked on Almondwood Drive.

The officers exited their vehicle and Officer Santoyo deployed his rifle. Officer Rotta broadcasted over the radio that Jackson and Winters were inside a vacant residence located at 3909 Almondwood Drive. Officer Santoyo took cover behind a red vehicle parked across the street from 3909 Almondwood Drive. Officer Santoyo was able to see the front of 3909 Almondwood Drive from his location. Officer Santoyo observed Winters at a window on the second floor. Winters broke the window out and threw an object onto the roof of the garage he believed was possibly a handgun.

Winters put both hands out of the window through the metal grates and held them for a moment then pulled them back inside the window. Officer Santoyo heard Jackson scream “Don’t shoot!” from inside the target residence. Officer Santoyo was unsure if there was possibly a hostage situation. Winters was then observed propping a white door against the window in an attempt to cover the window.

Officer Santoyo heard the sound of breaking glass coming from the rear of 3909 Almondwood Drive. He knew that Officer Moore was in the backyard and heard him broadcast Winters had exited the target residence and was holding Jackson hostage. Officer Santoyo then heard two gunshots but did not know at the time where the shots came from. Officer Santoyo heard more glass breaking on the west side of the target residence and moved up to the northwest corner of the garage where he could see down the walkway along the west side of the residence but did not see Winters.

Officer Santoyo did not like his position so he moved back toward the sidewalk and took cover behind a power box, but he could still see partway along the west side of 3909 Almondwood Drive. While in this position, Officer Santoyo observed Winters break the window on the west side but could only briefly see Winters arm with the handgun in his hand. Officer Santoyo felt Winters was going to barricade or engage the officers at the side gate. Officer Santoyo remained behind the power box watching the gate. While in that position a male subject, John

Hastrich, exited from 3899 Almondwood Drive, which was the next residence west. Officers advised him to go back into his residence. A few minutes passed and Officer Santoyo heard a gunshot from inside of 3899 Almondwood Drive. Officer Santoyo moved his position to a large RV parked in front of 3899 Almondwood. Hastrich again exited the house and advised officers his girlfriend, Terri Ham, had been shot. Officer Santoyo directed Hastrich toward him but Hastrich continued to walk eastbound down the street. Officer Santoyo continued to cover the front of the 3899 Almondwood Drive. Officer Santoyo heard Officer Rotta advised Winters was now at the front door and holding Ham hostage. A few moments passed and Officer Santoyo heard Officer Rotta fire five or six times and Officer Rotta advised Winters was on the ground and Ham was behind him on the ground. Officer Santoyo could not see Winters from his location but he began giving verbal commands to Winters to show his hands and come to the street. Winters did not respond to the verbal commands. An arrest team was established and moved up from the east. As they moved, Officer Santoyo provided cover. Winters was handcuffed and officers removed Ham from the front patio of her residence and moved her to a yard to the west for medical attention. On July 30, 2014, at approximately 1645, Detective Dosch contacted Gloria Goodman over the telephone. The following is a summary of the conversation which was not recorded. During the past two weeks Goodman’s daughter, Natasha Jackson, has been associating with a white male, Cody Winters. Goodman could not recall Winters name but believed he went by a moniker or street name. Goodman described Winters as approximately 26 to 27 years of age, 5’9” to 5’10”, thin build, with blonde hair in a Mohawk. Winters had tattoos on his arms, shoulders, neck and legs. Winters believed himself to be a tattoo artist. Detective Dosch asked Goodman if the male went by the street name of “Havoc” and she said that it was a possibility.

Jackson had not been acting normal for the past two months. Goodman suspected her daughter was using methamphetamine. Goodman did not know Jackson to carry a gun, but she did carry knives. Jackson had been in the same bedroom since the family moved into the apartment, which was three years ago. Jackson’s bedroom had the number seven on the door. Winters did live in the apartment.

On July 31, 2014 at approximately 1235 hours, Detective Gillis obtained a recorded statement from Toni Silver at her residence, 3920 Autumn Street. The following is a summary of the statement. For complete details refer to the transcribed statement. Silver stated in the early morning hours of July 29, 2014, she observed Julie Ramos, her next-door neighbor in the street of yelling and screaming. Julie had two of her children with her. Silver contacted Julie and Julie stated someone had hurt Richard and she did not know if he was alive or dead. Julie further stated the unknown persons had beaten and stabbed her as well. Silver could not see any obvious injuries to Julie.

After speaking with Julie, Silver noticed that police officers had arrived. She saw a uniformed police officer through her back patio window jump over the wall between Julie’s home and hers. Silver saw the police officer grab her small patio table in the backyard and place it against her back northwest wall. After jumping up on top of the table, the officer discharged his weapon in the direction of a green two story residence and began to give commands of “Drop

it,” “Put it down,” and “Freeze.” While Silver was out with Julie speaking to the arriving officers, Silver heard Julie describe the suspects as a white male and a black female.

On July 31, 2014 at approximately 1258 hours, Detective Bunting obtained a recorded statement from Raymond Deadrick at his residence, 3915 Autumn Street. The following is a summary of the statement. For complete details refer to the transcribed statement.

At approximately 0630-0700 hours, Deadrick was cleaning his pool when he heard what he thought was a single firecracker exploding. He then heard someone screaming, “I need help Leon!” Deadrick walked to his front yard through the gate on the west side of his residence.

Deadrick observed a young boy, approximately 11 to 12-years-old, running eastbound in the middle of Autumn Street. Two officers had arrived and were speaking with the boy’s mother in front of 3930 Autumn Street. Deadrick approached the officers and the boy’s mother to see if he could be of assistance. Deadrick then escorted the mother and her three children to his house to remove them from any danger. Deadrick had never met the family members and did not know their names.

The mother, Julie Ramos and her children relayed what had taken place. Julie stated a white male and black female, Cody Winters and Natasha Jackson, came to their residence and asked to use their phone, then Winters shot her husband Richard Ramos and Jackson stabbed him. Julie said Jackson was killing her husband, so she attempted to move Jackson away from Richard. Jackson then stabbed her with a screwdriver or other similar shaped object. After the family had entered his house and while receiving the story of the incident, Deadrick heard two gunshots. Deadrick never saw Winters or Jackson. On August 6, 2014 at approximately 1130 hours, Detectives Williams and McCarthy obtained a recorded statement from Julie Keop at the Michael O’Callaghan Federal Hospital. The following is a summary of the statement. For complete details refer to the transcribed statement. Keop left for work at approximately 0635 hours on Tuesday, July 29, 2014. She traved east on Autumn Street approaching Rollingwood Drive when she saw two people, Cody Winters and Natasha Jackson, standing in the middle of the street. Keop could not pass them easily and drove slowly. Winters said, “Please help us. We need a phone” and they each came to either side of her car. Keop did not stop and drove past them and continued on to work. She later learned of the events that took place in her neighborhood and realized she needed to contact police. SEARCH WARRANTS:

1555 E. Rochelle Avenue, Building 3, Apartment 147

On July 30, 2014, FIT detectives assisted Homicide detectives in serving a telephonic search warrant that was granted by the Honorable District Court Judge Tim Williams. The location of the search warrant was at Natasha Jackson’s apartment at 1555 E. Rochelle Avenue Building 3, Apartment 147, where she lived with her mother and grandmother. During the service of the warrant, detectives took several pictures, documented Jackson’s room, and recovered one of Jackson’s writing journals.

Cell Phone and Facebook On August 6, 2014, Detective Dosch obtained search warrants for Cody Winters cell phone and Facebook account, as well as Natasha Jackson’s Facebook account. The search warrants were signed by the Honorable District Court Judge Nancy Allf. The cell phone search warrant was forwarded to the LVMPD Computer Forensics Lab (CFL) for execution.

XI. OFFICERS WEAPON COUNTDOWNS:

On July 29, 2014, Officers Moore, Rotta, Santoyo, Cobb and K9 Officer Moore had their rifles counted down at SEAC. Present during the countdowns were, FIT Detective Jex, CIRT Detective Golgart, CSA Fletcher, PPA representative Yant and PEAP peer counselor Causey. The involved officers, witness officers, and their counted down weapons were photographed by CSA Fletcher for identification and appearance.

A. Officer William Moore

Officer Moore was dressed in the standard LVMPD short sleeve summer uniform. His shirt had LVMPD patches on each shoulder and a LVMPD badge on his left chest. He wore a black duty belt with various issued tools and equipment attached as part of his related position in patrol. Officer Moore’s handgun was carried on the left side of his body and secured inside a holster. Officer Moore carried his department issued rifle into the room inside a hard sided rifle case. His handgun was not counted down.

Prior to the countdown of his rifle, Officer Moore advised he carried 28 cartridges in the magazine used during the incident. After inserting the magazine into the rifle he loaded one round into the chamber and did not top off the magazine. Following the shooting, Officer Moore returned to his patrol vehicle, took the magazine out of the rifle and the chambered round. He then put the rifle, magazine, and loose round inside the rifle case.

All of Officer Moore’s ammunition was department issued duty .223 Federal hollow point. Officer Moore’s rifle was a department issued Smith & Wesson, M&P 15, serial number

There was no aftermarket items mounted to the rifle. The rifle was equipped with a sling. Officer Moore did not carry any extra magazines on his person during the incident. The countdown of the rifle showed one round in the chamber and 25 rounds in the magazine. Based on Officer Moore’s countdown it appeared he fired two times during the incident. The rifle was photographed and impounded by CSA Fletcher.

B. Officer Ryan Rotta

Officer Rotta was dressed in the standard LVMPD long sleeve summer uniform. His shirt had LVMPD patches on each shoulder and a LVMPD badge on his left chest. The countdown of the rifle showed one round in the chamber and 21 rounds in the magazine. Based on Officer Rotta’s countdown it appeared he fired six times during the incident. The rifle and magazine was photographed and impounded by CSA Fletcher.

C. Officer Michael Santoyo

Officer Santoyo was dressed in the standard LVMPD short sleeve summer uniform. His shirt had LVMPD patches on each shoulder and a LVMPD badge on his left chest. He wore a black duty belt with various issued tools and equipment attached as part of his related position in patrol. Officer Santoyo’s handgun was carried on the right side of his body and secured inside a holster. Officer Santoyo carried his department issued rifle into the room for the countdown. Officer Santoyo carried an extra 20 round magazine on his duty belt during the incident. Officer Santoyo indicated he carried 18 rounds in the extra magazine. The countdown confirmed 18 rounds in the magazine. Based on Officer Santoyo’s countdown it appeared he did not fire his rifle during the incident. The rifle was photographed by CSA Fletcher and released to Officer Santoyo.

D. Officer Thomas Moore

Officer Moore was dressed in the standard LVMPD green BDU uniform. His shirt had LVMPD patches on each shoulder and a LVMPD patch badge on his left chest. He wore a black duty belt with various issued tools and equipment attached as part of his related position as a K-9 officer. Officer Moore’s handgun was carried on the right side of his body and secured inside a holster. E. Officer Benjamen Cobb

Officer Cobb’s rifle was a department issued Smith & Wesson, M&P 15, serial number Mounted on the rifle frame was a Fenix TK22 flashlight that was operational. The rifle was equipped with a flip up rear sight. The rifle was also equipped with a sling and bi-pod. Officer Cobb did not carry any other extra magazines during the incident. The countdown showed 27 rounds in the magazine and one round in the chamber. Based on Officer Cobb’s countdown it appeared he did not fire his rifle during the incident. XII. FIREARM EXAMINATIONS:

On August 18, 2014, Detective Patton submitted a Request for Forensic Examination Form to the LVMPD Forensic Lab requesting an examination be performed on Officers Rotta and Moore’s weapons. Detective Williams from LVMPD’s Homicide Section submitted a separate request form for the examination of the firearm possessed Cody Winters. Below are the results of the examinations.

On November 25, 2014 Forensic Scientist (FS) Anya Lester, PN 13771, of the LVMPD Firearms/Toolmarks Unit, completed the request for examination of the firearms and firearms related evidence recovered during the investigation under LVMPD Lab Case 14-09708.2. Below are the results of the examination. A. FIREARMS

Officer Moore’s Smith & Wesson, model M&P-15, .223 caliber, semi-automatic rifle, serial number: (Lab Item 1) was examined, test fired, and found to be operational with no noted malfunctions. This rifle has a barrel length of approximately 17 7/16 inches, an overall length of approximately 32 7/16 inches, and a trigger pull of 5 3/4 – 6 1/4 pounds. The submitted magazine (Lab Item 2) was inserted into the rifle and used in the test firing of the weapon. The magazine functioned properly and had a capacity of 31 cartridges.

Officer Rotta’s Smith & Wesson, model M&P-15, .223 caliber, semi-automatic rifle, serial number: (Lab Item 3) was examined, test fired, and found to be operational with no noted malfunctions. This rifle has a barrel length of approximately 17 7/16 inches, an overall length of approximately 32 7/16 inches, and a trigger pull of 6 1/2 – 7 pounds. The submitted magazine (Lab Item 4) was inserted into the rifle and used in the test firing of the weapon. The magazine functioned properly and had a capacity of 31 cartridges.

Suspect Cody Winters Glock, model 19, 9mm, semi-automatic pistol, serial number:

(Lab Item 14) was examined; test fired, and found to be operational with no noted malfunctions. This pistol has a barrel length of approximately 4 inches, an overall length of approximately 7 3/8 inches and a trigger pull of 5 ¼ - 5 ½ pounds. This pistol is chambered for the 9mm Luger cartridge but it will also chamber and fire 9mm Corto/.380 Auto ammunition. During testing, when the .380 auto ammunition was fired in this pistol, the slide had to be cycled manually to extract and eject the fired cartridge cases and to chamber the next round. Due to damage, the submitted magazine (Lab Item 15, also seen in a photograph on pages 3 and 4 of this report) could not be inserted into this pistol and was found to be nonfunctional. A different Glock, 9mm, magazine, which is stored and maintained by the LVMPD Firearms Lab, was used to test fire this pistol.

B. CARTRIDGE CASES, BULLETS, AND BULLET FRAGMENTS

The evidence cartridge cases and bullets were examined and microscopically compared to the test fired cartridge cases and bullets with the following results: Six of the cartridge cases (Lab Items 5, 6,7,8,9, & 10) were identified as having been fired in Officer Rotta’s Smith & Wesson M&P-15 rifle. Two of the cartridge cases (Lab Items 11 & 12) were identified as having been fired from Officer Moore’s Smith & Wesson M&P-15 rifle. The remaining three cartridge cases (Lab Items 16, 18, & 19) and the three bullets (Lab Items 13, 17, & 20) shared a similar general overall appearance and some limited corresponding microscopic information with the 9mm Lugar cases and bullets from the submitted Glock handgun; however due to insufficient microscopic detail a definitive identification of these items to the submitted Glock handgun could not be determined.

After reviewing the Forensic results on January 15, 2015, Detective Patton contacted FS Lester in enquire as to why other pieces of evidence were not examined, for example a 9mm Luger Cartridge Case and other bullet fragments recovered from the crime scenes. FS Lester explained that the LVMPD Forensic Scientists work on a request basics and due to LVMPD Policy as well as LVMPD Accreditation standard, Forensic Scientists need written permission from detectives to examine evidence that they find is not listed on the examination request form.

On January 15, 2015, Detective Patton submitted a new Forensic Examination Request Form requesting the aforementioned evidence be examined.

detail, a conclusive identification to or elimination from either rifle could not be determined.

The metal fragments (Lab Items 22,23,25,26, and 27) contain no markings of value for microscopic comparisons.

well as metal fragments which are not consistent with bullet fragments.
