PART ONEGeneral

1. Short title

These Regulations may be cited as tht~ "Federal PoliceAdministration Council of Ministers RegulationNo. 86/2003."

2. Definitions

In this Regulation, unless the context requires otherwIse:I) "Police Officer" means that as defined under Article

2 Sub-Article (1) of the Federal Police CommissionProclamation No. 313/2003.

2) "Commission" means the Federal Police Commis-sIOn.

3) "Training Institution" means an educational ins-titution where regular police training is provided.

4) "Medical Institution" means a police hospital, amedical center in the training institution or otherinstitution which provides medical services to thepolice.

5) "Promotion in Rank" means promoting a member ofthe police from the rank he has held to the next higherrank. -

3. Scope of ApplicationThis Regulation shall, with the exception of the Commis-sioner and Deputy Commissioner, and civil servantsemployed by the Commission, be applicable to any policeofficer.

PART TWORecruitment, Employment,Training

Assignment and Transfer

4. Recruitment and Employment1) Any person willing to be recruited as a police officer

shall fulfill the following criteria:-(a) an Ethiopian Citizen;(b) loyal to the Constitution;(c) Having good ethical conduct.

'(d) 18 years of age and above;(e) Not a member of any political organization;(f) Shall at least complete high school;(g) Heal~hy to the extent police recruitment

requIres;(h) Having no criminal conviction record;

2) Notwithstanding Sub-Article (1) of this Article,(a) If equal results are achieved by candidates from

different nations or nationalities, a recruit froma nation or nationality with relatively lessrepresentation, and

(b) Female candidates that have equal results withmale candidates shall be given priority foremployment,

3) The Commission shall make special endeavor toenable women and members of a nation ornationality with less representation to become mem-bers of the commission,

4) The Commission shall determine police recruitmentnotice and process by its directives,

- 5) Any person recruiled to be a police officer inaccordance with Sub-Article (1) of this Article shallsign employment contract made by the Commission.The effective date of the contract shall be specified inthe contract,

6) Any person employed to be a police officershall serve for a compulsory period of seven years.

Training1) Any police officer shall receive basic police training

in a police training institution before his assignmentto regular police duty.

2) The objective of the training is to create professionalpolice officers dedicated to the enforcement of theconstitution.

3) The types of training are categorized into three.These are:-(a) Basic police training,(b) Various professional trainings related with

police service; and(c) Managerial training,

4) The Commission shall determine by its directivesdetailed requirements for the implementation oftraining,

5) Any recruit on a basic police training shall:-(a) be entitled to get food, lodging, clothing,

shoes,stationerymaterialsas wellas a pocketmoney determined by directives of the Com-mission;

(b) receive free medical service for any illness;(c) be obliged to participate in the training

program into which he is assigned;(d) strictly adhere to internal regulations and

directi ves of the training institution into whichhe is admitted;

(e) have the permission of the Commission beforeterminating, changing or extending his field oftraining.

6. Oath1) Any police officer who has completed basic police

training program shall, before commencing hiswork, take the following oath."I solemnly swear that I shall pledge to protectthe Constitution, enforce the law, to prevent crimediligently and serve the public honestly and withintegrity'

,

2) The oath, after duly signed by the police officer, shallbe filed in hIs personal file.

7. Assignment1) The Commission shall assign any trainee, upon

completion of his training, to a position in accor-dance with his area of qualification.

,2) He may be assigned otherwise when it is deemednecessary;

8. Transfer and Temporary Assignment

1) The Commission, Whenever necessary, can tranferany police officer to another similar position of anequal grade and salary or to another place of workwithin its office,

2) any transfer to be madeu!!der Sub-Article (1) of thisArticle shall be carried out on the basis of com-petition wherever there are interested police officerswithin the commission,

3) Notwithstanding the provisions of Sub-Article (1)of this Article, the Commission may temporarilyassign a police officer to a position, for the sake ofwork without affecting his salary but irrespective ofhis postion and grade for not more than a year.

4) Where it is established by a medical certificate thatthe nature of the work and place of work a policeofficer Assigned is not suitable for his health, heshall be transferred to another suitable position orplace of work with:-(a) the same grade where such a vacant position is

available; or(b) a lower grade where a vacant position of the

same grade is not available and if he is willingto be transferred to a position of lower grade

5) Where circumstances so require, a police officer maybe assigned to a higher position in an acting capacityand shall be entitled to acting allowance in accor-dance with the decision of the Commission.

6) It is prohibited to assign any police officer in anacting capacity for more than a year.

7) Where the position of a police officer is cancelled, heshall be transferred to another position of an equalgrade within the Commission.

PART THREEWorking Hours and Leaves

9. Normal Working Hours

1) The Police service shall be continuously rendered for24 hours a day, 7 days a week, 30 days a month and365/6 days a year.

2) Regular working hours of any police officer shall be8 hours a day and shall not exceed 40 hours in aweek. However, he shall be instructed to workadditional hours by the concerned authority duringthe time of emergency and for special police duty. Heshall be granted compensatory time off for theadditional hours he spent on duty.

10. Objectives of Annual Leave1) The purpose of annual leave is to enable a police

officer get rest and resume work with renewedstrength.

2) There shall be no payment in lieu of annual leave.

11. Durationof Annual Leave1) Any policeofficer.hall be entitled to annual leaveof

20 working days for his first year of service.2) A police officer having a service of more than one

year shall be entitled to additional leave of oneworking day for every additional year of service;provided, however, that the duration of the annualleave shall not exceed 30 working days.

3) Previou. servicerendered in any other governmentalorganization shall be considered for the applicationof Sub-Article (2) of this Article.

12. Grantinl of Annual Leave1) Annual leave shall be given on the basis of the

Commission's plan and shall be prepared by givingdue consideration to the interest of the police officerand according .to a schedule known to the policeofficer within the budget year.

2) A Police officer shall be entitled to advance paymentof hi. monthly salary at the time of taking his annualleave.

3) Annual leave shall be granted without interruptionatone time during the budget year unless there isexceptional circumstance or is so requested by thepolice officer and approved by his immediatesuperior.

4) Annuatleave may be postponed due to compellingreasons of work or when security problems arise.

13. Postponement of Annual Leave1) The Superior of a police officer may authorize the

postponement of annual leave for two budget yearswhere the commission, due to compelling reasons, isunable to grant a police officer his annual leavewithin the same budget year.

2) However, the accumulated leave shall be lI'anted tothe police officer in the third budget year.

14. Maternity Leave1) A female police officer who conceives a baby shall

be entitled to:-(a) paid leave for medical examination in accor-

dance with a doctor's recommendation,(b) paid leave before delivery ifrecommended by

a doctor,2) A female police officer who conceives a baby shall

be entitled to a period of 30 consecutive days ofmaternity leave with pay before delivery and 60consecutive days of maternity leave after delivery.

3) If she does not deliveron the presumeddate, the dayssubsequently taken before her delivery shall bereplaced by her annual leave; if she doesn't haveannual leave within the budget year it shalt bereplaced from the next budget year.

4) The officer shall be entitled to sick leave in accor-dance with Article 15 of this Regulation if shebecomessick after completion of her maternity leaveunder Sub-Article (2) of this Article.

15. Sick Leave1) Any police officer shall be entitled to sick leave,

certified by medical institution where he is unable towork due to sickness.

2) The duration of sick leave to be granted to a policeofficer in accordance with Sub-Article (1) of thisArticle shall not exceed eight months in one year ortwelve months in four years, whether countedconsecutively or intermittently starting from the firstday of sickness.

3) Sick leave to be granted in accordance with Sub-Article (2) of this Article shall be with full pay for thefirst three months, with half pay for the next threemonths and without pay for the last two months.

4) Where a police officer is absent from work due tosickness:(a) he shall, as soon as possible, notify the

Concerned office unless prevented by forcemajeure,

(b) he shall produce a medical certificate in case ofabsence from work for three consecutive daysor for more than six days within a budget year,

16. Leave Due to Employment Injury

1) Any police officer who has sustained an employmentinjury shall be entitled to injury leave with pay untilhe recovers and resumes work or until it is medicallycertified that he is permanently disabled; provided,however, that the leave so granted shall not exceed12 months.

2) A police officer who is unable to recover and resumework within 12 months shall be entitled to thebenefits provided under Sub- Article (5) of thisArticle.

3) Where the police officer delays his recovery by notfollowing the treatment properly or by his non-observance of doctors' instructions, his entitlementof the medical benefits and leave under Sub-Article(1) and (2) ofthis Article shaUcease.

4) A police officer who has sustained permanent totalor partial disability due to employment injury shallbe entitled to benefits provided in the relevantpension law..

5) Where an employment injury resulted in the death ofthe police officer his survivors shall be entitled to.survivors' pension gratuity payable under therelevant pension law.

6) For the purpose of thl~ .~ulation, "Employmentinjury" refers ~ the definitioo..given in the labourproclamation

17. Maniage LeaveAny police officer shall be entitled to three working daysleave with pay when he conducts his marriage.

18. Mourning Leave1) Any police officer shall be entitled to leave with pay

for three consecutive days in the event of the death ofhis spouse, descendant, ascendant or any otherrelative up to second degree, by consanguinity oraffinity,-

.

2) A policeofficer shall be entitled to leave with pay forone day in the event of the death of his close relativeor friend other than those specified in Sub-Article (1)of this Article; provided, however, that such leaveshall not exceed six days within a budget year,

19. Special Leave with Payany police officer shall be entitled to special leave withpay where:1) he is summoned by a court or any other competent

authority, for the time utilized for the same purpose,2) he. participates in the election of government of-

ficials, for the duration of the voting period,3) he gets educational opportunity at home or abroad

according to the commission's plan.

20. La", Without PayWhere a police officer, upon sufficient ground, appliesfor a special leave without pay, his superior mayauthorize the grant of such leave if it does not affect theinterest of the Commission.

PART FOUR

Salary and Medical Benefit

21. Salary and Allowances1) Any police officer, as determined by the state, shall

be paid:-(a) a Salaryfor a position he is assigned to;(b) allowances for rations, transportation and

other allowances that may be determined asthe situation requires; .

2) Any Police officer's salary shall be paid at the endof every month.

3) Any police officer is entitled to borrow his two-month's salary. However, he shall pay it backwithineighteen months startingfrom the date of theloan.

4) A police officer with good performance report isentitled to a salary increment to be made every twoyears in his present rank,

22. Salary Scale1) The Commission shall undertake studies on salary

scales applicable to police officers and submit to theMinister and supervise their proper implementationupon approval by the Council of Ministers.

2) Salary scales shall contain the minimum andmaximum pay and steps indicating periodical in-crements for each grade.

23. SalaryIncrement1) Police officers' salary increment is implemented

according to the time limit determined by theCouncil of Ministers.

2) The salary increments to be made to police officerswith satisfactory,above satisfactory and outstandingperformances shall vary accordingly.

3) The provisionsof Sub-Article (1) of this Article shallnot be applicable to a police officer whose perfor-mance is unsatisfactory.

24. Withholding and Deduction of Salary1) The salaryof a police officer may not be withheldor

deducted except in accordance with:(a) the consent of the police officer;(b) court order; or(c) the provisions of the law.

2) Monthly deductions from the salary of a policeofficer to be made pursuant to Sub-Article (1) (b)or(c) of this Article shall not exceed one third of hissalary.

25. Medical Benefits1) A police officer shall have the right to. get medical

services free of charge in police medical institutions,2) The Commission shall cover necessary medical

expenses incurred by a police officer due to em-ployment injury.

3) A police officer shall have the right to get freemedical services, in police medical institutions forhis spouse and minor children,

4) Regarding the medical benefits of this regulation thecommission shall determine the amount of con-tribution to be made by police officers with direc-tives.

5) The Commission in regard to:-(a) retired police officers, and(b) other individuals outside the commission shall

have detailed directives about the rendering ofmedical service with a certain amount ofpayment.

PART FIVEPreservation of personal file of police officers

26, Personal File1) The Commission shall keep personal file containing

all relevant information regarding each police of-ficer.

2) A police officer shall have access to all informationcontained in his. personal file or to have a copythereof.

) any police officer other than the concerned adminis-trative staff shall not have access to the personal tileof another police officer unless authorized by theCommissioner or the Deputy Commissioner,

4) It is prohibited to file any document in the personalfile of a police officer without his knowledge,

21, Statistkal Data

The Commission shall have the duty to collect andcompile statistical data regarding police officers.

2tt Pu~ of Performance Evaluation1) The purpose of performance evaluation shall be to

enable police officers to:(a) effectively discharge their duties in accor-

dance with the expected level, quality stan-dards and time;

(b) identify their strengths and weaknesses;(c) improve their future performances and de-

velop self initiative;2) Performance evaluation shall be transparent and

shall be carried out with the collective participationof police officers working together,

3) Performance evaluation shall be carried out inaccordance with directives issued by the Commis-sion.

PART SIXTerminationandExtension of Service

29. Resignation1) Any police officer may, giving a one-month prior

notice in writings, resign at any time.2) Where the service of the police officer is indispen-

sable and he can not be replaced easily, the Commis-sioner or deputy Commissioner may delay hisrelease for a period not exceeding three months,

3) A policeofficer who has applied for resignationpriorto completing the period of his obligatory service orwho has received special training and has notrendered the required service shall reimburse theCommissionall corresponding expences incurredonhim.

30. Termination due to I//ness or employment injury

1) Where a police officer is unable to resume workwithin the time specified under Article 15(2)of thisRegulation, he shall, without requirement of amedical certificate, be deemed unfit for service andbe discharged.

2) In accordance with Article 16(1) of this Regulation,where a police officer who has sustained em-ployment injury is medically determined to' bepermanently disabled his service shall forthwith beterminated.

31. Terminationon Groundsof Inefficiency1) The service of a police officer may be terminated

where his peaformanceevaluation result is unsatis-factory for two successive evaluation periods des-pite exerting all his knowledge and ability toaccomplish his work.

2) Notwithstanding the provisions of Sub-Article (1)of this Article. a police officer whose peaformanceevaluation result is above satisfactory for successivefive YeaR may not be dismissed on grounds ofiadf.ciency unless his peaformance result becomes..nufi,f~ for the following three successiveev~ periods. .

Article (l) of Article 54 of this Regulation isimposed on him; and

(b) the penalty is not canceled on appeal madeunder this Regulation,

2) Where the penalty is mitigated or canceled onappeal, the police officer shall be entitled to thepayment with out interest of his salary wj~Jdduring the appeal period.

33. Retirement1) Unless a police officer's service year is e~

beyond the retirement age, his service shalt beterminated without any additional formality OBmelast day in which he attained the retirement. .determined by law.

2) The policeofficer shall be notified of his r.~in writing three months prior to his retirement.

34. Certificateof ServiceWhere the serviceof a policeofficer is terminated for .anyreason or where he so requests. he shall be provided witha certificateof service indicating the type and duration ofhis se~vice,his salary and the reason for the termination,

1) The service years of a police officer may beextended beyond his retirement age for a period ofup to five years at a time and for a period notexceeding ten years in total.

39. Ethical Conduct of Police Officer.5

Any Police officer shall adhere to the provisions of thispartandotherdirect1vesissued by the Commission on theethidih:onduct of police officers,

40. Obedience.

Any police officer shall:-1) Perform his duties to his best knowledge and

ability; and discharge the usual duties of hisposition as well as other similar duties;

2) Notwithstanding the provisions of the Penal Code,obey any lawful the orders of his superior. Hissuperior shall be responsible for the orders he h:J"given.

41. SecrecyAny police officer shall not disclose;-1) Notwithstanding other relevant laws, classified in-

formation that might endanger the security of thestate and the public.

2) Information which has been declared secret unless

such a person who is officially permitted to knowsuch matters or the police officer is ordered by theconcerned superior.

42. Gifts

Any Police officer shall not demand or accept any gift in,

return for services rendered or expected to be rendered byhim.

43. Declaration of Income

In accordance with the directives to be issued by theCommission, any police officer shall declare all hisincome other than his salary.

44. Conflict of Interest

1) Any police officer shall report in writing to his

superior the case in which conflict of interestbetween his private interest or that of his relative orfriend and his duties has arisen.

2) Where the case stated in Sub-Article (1) of this

Article arises the superior to whom the same isreported shall take appropriate measures to resolvethe conflict of interest in order to accomplish thetask.

3) Any police officer, while executing his duty, shall

not favour or show partiality to political parties.

45. Prohibition of Holding <1notherJob

1) Any police officer shall not engage in any other job

which might impair his service or be in conflict withhis duties or inconsistent with his position as a policeofficer.

2) Without prejudice to the provisions of Sub-Article(1) of this Article, a police officer may, after in-

forming his otTice, engage in any other work duringhis leisure time.

46. Handling and Use olProperty

Any police offic.~r shall have the responsibility toproperly handle and use the equipment and materialprovided to him to carry out his duties.

47. ExtentofLiability

Any police officer shall be liable for the damaIJe or loss ofe

equipment and materialsprovided to him to carry out hisduties, where such damage or loss is caused by hisnegligence or intentional act.

Any police officer shall not-1) lend his uniform and fire arms to any other person.2) collect any contribution for aid without the permis-

sion of the Commission,3) wearanyjewelry while he is in unifrom.However, if

he ismarried. he may wear a wedding ring.4) engage in any strike and demonstration.

PART EIGHTDiscipline

51. Objectiyes of DisciplinaryMeasures

The objective of disciplinary mcasurcs sh~11Ihe torehabilitate a police officer who Commits disciplinarybreaches by making him learn from his hreach andenable him to perform his duties properly or todischarge him from service if he becomes recalcitrant.

52. Types and ClassificationofDisdplin",y PemlltiesI) Depending of the gravity of the offence. (Inc (If Ihe

following penalties may be imposed on ~Ipoliccofficer for breach of discipline:(a) verbal warning:.(b) written warning;(c) fine upto one month's salary;(d) fine upto three month's salary;(e) demotion from his rank and salary;

<0 dismissal;2) The penalties specified under Sub-Article (1) (a). (b).

(c)of this Article shall be classified as simplepenalties.

3) The penalties specified under Suh-Article (I)(d),(e),(t), of this Article shall he classified asrigorous penalties.

55. Taking Disciplinary Measures1) Before imposing a disciplinary penalty on any poli4:e

officer, he shall be informed of the alleged offence inwriting and be given the opportunity to defendhimself,

2) Rigorous disciplinary penalty shall be given by theCommission Disciplinary Committee,

3) 'Simple disciplinary penalty shall be given by hisimmediate superior,

4) Without prejudice to the provision of Sub-Article (5)of Article 7 of the Federal Ethics and Anti-Corrup-t.ion Commission establishment Proclamation No.23512001discipHnarymeasures may be taken irres-pective of any court proceedings or action. -

56. Suspension from Duty1) A police officer may be suspended from duty by with

holding his salary for a period not exceeding onerndDth if that course of action is believed to beimportant for the execution of thejob.

2) A police officer shall be suspended if he is fonnallycharged with a criminal or disciplinary offence forwhich his dismissal is to be expected.

57. Right of Appeal1) An appeal may b'e lodged against the decision on

simple disciplinary measures to the next highersuperior. The decision of such superior shall be final.

2) An appeal maybe lodged against the decision ofrigorous disciplinary penalties to the Commissioner.The decision of the latter shall be final.

58. Period of Limitation1) Disciplinary measure shall not be put into effect

~ainst a police officer who has committed anoffense entailing simple disciplinary penalty unlesssuch measure is taken within three months, ex-cluding the time required for investigation from thetime the breach of discipline is known.

2) Disciplinary measure shall not be put into effectagainst a police officer who has committed anoffense entailing rigorous disciplinary penaltyunless such meassure is put into effect within a yearfrom the time the commission of the offense isknown.

3) The Gfficial who has failed to take the. measuresspecified under Sub-Article (1) or (2) of this Articleshall be held responsible.

4) The effectiveness of penalty imposed under thisRegulation shall not exceed one-year. The Commis-sion shall issue directives on period of limitation toeach of disciplinary penalty.

59, A Police Officer Accused of a Crime Related to His Duty

Where the Commission's Management Committee isconvinced that a police officer has committed the offencefor which he has been accused of being forced by theprevailing condition while discharging his duties; without prejudice to disciplinary measures:1) The policeofficer shall be on his duty and receive his

full salary provided he is granted bail by the court.2) Where the accused police officer is denied the right

63. Period of stay in a RankA Police officer shall cover the period of stay assi~nedto each rank as shown on the table below before ne ispromoted to the next higher rank.

64. Rank Promotion1) Any Police officer shall be eligible for promotion in

rank:(a) Whenever there is a vacant position for appoint-

ment(b) Who fulfils educational requirement, work

experience and effciency as required by th.evacancy.

(c) Provided he completes training for the post,2) Notwithstanding Sub-Article (l) of this Article,

promotion from one level of rank to another shall becaITied out on the basis of competition and ex-amination.

3) Notwithstanding the period of stay required forAssistant Inspector in accordance with Article 63 ofthis Regulation, any police officer in a lower ranklevel is entitled to compete for the rank of assistantinspector provided he fulfils the requirements of thePolice College.

4) Any police officer who has rendered special con-tribution in his work and who has outstandingefficiency report may be eligible for an acceleratedpromotion provided under Article 63 of thisRegulation.

68. Disclpline CommitteeHereby is established a discipline Committee which shallhave the powers to investigate and decide on disciplinaryoffences entailing rigorous penalties,

69. Organization and Accountability of the discipline com-mitteeI) The discipline committee shall comprise of five

Federal Police officers assigned by the Commis-sioner, and shall have a chairpcIson and a secretaryelected by the committee.

2) The Committee shall have at least one femalerepresen tati ve.

3) The Committee shall be ~ab8e to the Commis-sIoner.

4) The term of office of the Committee shall be two4years.

70. Power to prepareRules of~The discipline Committee shall ~ its own rules ofprocedure, and submit the same to the Commissioner forapproval and implement upon approval.

71. Establishment of Promotion CoraraiftMHereby is established a promotion oommittee which shallexamine and submit rerommeadatioft Oft policepromotion to the commission.

72. Members of the Promotion Coramittee1) The Promotion Committee members shall be as

follows:-(a) Deputy Commissioner as chair person(b) Four members elected from among the

3) The Committee shall have two female represen-tatives who are elected from the various depart-ments.

4) Members of promotion committee shall be electedfrom police officers honoured for their discipline,fairness and work efficiency and at least served forfive years in the police.

73. Powers and Responsibilities of the Promotion Commit-teeThe Committee shall be accountable to the Commis-sioner and shall:1) Ensure that the registration of competitors has been

carried out properly and perfectly in accordance withthe notice issued;-

2) Examine the accuracy of the competitors'documents and work experience;

3) Conduct competition of the applicants for promotionto the position available in accordance withrequirements, and put them in order of their result;particulars of grading shall be determined by direc-tives;

4) Select an applicant or applicants with the highestresult and submit to the Commissioner with recom-mendations;

5) Inquire departments for relevant information toinvestigate matters related to promo~ion if it isnecessary;

6) Cany out the functions necessary for its activitiesentrusted to it by this regulation.

74. Rules of Procedure of the CommitteeThe reults of procedure of the Committee shall be asfollows:I) Presence of above 2/3 of the members at any meeting

shall constitute the quorum.2) Any matters shall be decided by majority vote of the

members present at the meeting.3) In case of a deadlock, the side for which the

chairperson has voted shall be the final decision.4) Whenever decisions of the Committee are made by

majority vote, the opinions of the minority shall berecorded with their reasons of exception in theminutes.

5) The Committee may lay down other rules ofprocedure in addition to that stated in this Article asmay be necessary.

PART TWELVEEQUIPMENT, EMBLEM AND IDENTITY CARD

75. Distribution of Equipment and UniformThe equipment and unifrom to be provided for any Policeofficer shall be determined by directives to be issued bythe Commission.

76. Content of EmblemThe Commission shall have its own emblem which shallreflect compliance with the law. law enforcement and itsdevotion to public service.

77. Utilization of the Emblem1) The emblem of the Commission may be used on

police identity card. caps. Police vehicles, and on anyother place and in a manner determined by theCommission.

2) Various departments of the Commission may havetheir own emblems that show the nature of their workin addition to that of the Commission.

3) Colours selected by the Commission shall be thoso.which help the society to easily identify the Police.The Commission shall detennine types of thecolours by directives. .

78. Identity Card and Identification Number

1) Any Police officer shall have an identity card issuedby the Commission that indicates his membership ofthe Commission.

2) The Commission's Identity card..hall have:-(a) The emblem of the Commission;(b) full name, responsibility, blood type and iden-

tification number of the Police officer;3) Any Police officer has the duty to show his identity

card while enforcing the law.

Issuing Directives

The Commission shall issue directives for the im-plementation of this regulation.

80. Effective Date

This regulation shall be effective on the date of itspublication on the Negarit amta.
