home On Tuesday January 17, Kankakee City Council will be re-voting for the second time in less than one year on Mr. Russel Jensen’s petition to operate a crematorium on his property at 2450 Grinnell Rd in Kankakee. In August, 2006, Mr. Jensen applied for and received a conditional use permit to build and operate a warehouse on his property. At the same time, Mr. Jensen also applied to the Illinois EPA as River Valley Crematory requesting a permit to construct and operate a crematory. Illinois EPA issued that permit November 1, 2006. Records show Mr. Jensen never applied to the City of Kankakee for a permit to operate a crematorium until 2011. City Council and the residents adjacent to Mr. Jensen’s property became aware of his plans when Mr. Jensen placed a crematory on his property in 2009 without a permit. By that time, Mr. Jensen had accumulated a large file of code violations. According to the documents resulting in an Order of Demolition dated July 27, 2010, Mr. Jensen was dumping car parts and storing his boat on the property, he had never mowed or graded the land which was an eyesore to the residential neighborhood, and had partially constructed a building that was legally ruled unsafe and a hazard that could not be brought up to code. In addition, Mr. Jensen was not responding to the numerous letters sent by the City and he had not complied with the notices to clean up his property. He also did not pay the assessed fines which included the City of Kankakee mowing the property to rid it of health and safety issues. So why in early 2011 did the City of Kankakee and the Planning Board recommend that Mr. Jensen be given a permit to operate a crematorium on his property—property whose 2010 taxes were recently sold for non-payment of the total due of $82.93? Last week, Eric Sadler, Kankakee County Zoning and Development Coordinator, was asked by Kraftdale homeowner Randy Knickerbocker to review a permit request approved by the City of Kankakee Planning Board. If approved by the Kankakee City Council, this permit will allow the building and operation of a crematorium across the street from Kraftdale, a residential subdivision nearly 50 years old, in an unincorporated area of Kankakee County. To Mr. and Mrs. Knickerbocker, that seemed to be a violation of Kankakee County’s zoning law for their neighborhood. At the June 20, 2011 City Council meeting, the Council defeated Mr. Jensen’s request for a permit to operate a crematorium by defeating the motion to place the item on its second reading. The Mayor had not placed the second reading of Mr. Jensen’s Special Use permit request on the agenda for the June 6 meeting. On June 20, it was also not on the agenda. Alderman Hunter made a motion, seconded by Alderman Jones, to amend the agenda to include the second reading on the crematorium issue. Then Alderman Baron, seconded by Alderman Rich Browne, made a motion to table, which did not carry. Mr. Baron voted throughout spring 2011 on Mr. Jensen's petition for a permit to operate a crematorium on his property at 2450 Grinnell Rd in Kankakee. Mr. Baron did not realize his firm was financially involved with Mr. Jensen until it was pointed out at the January 3, 2012 City Council Meeting by Township Supervisor and County Board member Larry Enz. That evening, Mr. Baron abstained on Mr. Jensen's issue, saying he would check into this as soon as possible. Several days later at a public meeting, Mr. Baron said he did not need to recuse himself as Mr. Jensen is an employee. All corporation owners are employees of the corporation as well as owners. Mr. Baron is himself an owner and also an employee of his law firm Deck & Baron. Mr. Jensen is the only funeral director actively working in this small funeral home. If Mr. Baron thinks so little of Mr. Jensen's financial contribution to Brown Funeral Home, why is he voting to allow Mr. Jensen to run a crematorium?     On Tuesday January 17, KankakeeCity Council will be re-voting for thesecond time in less than one year on Mr.Russel Jensens petition to operate acrematorium on his property at 2450Grinnell Rd in Kankakee.

    In August, 2006, Mr. Jensen appliedfor and received a conditional use permitto build and operate a warehouse on hisproperty. At the same time, Mr. Jensenalso applied to the Illinois EPA as RiverValley Crematory requesting a permit toconstruct and operate a crematory. IllinoisEPA issued that permit November 1,2006.

    Records show Mr. Jensen neverapplied to the City of Kankakee for apermit to operate a crematorium until2011. City Council and the residentsadjacent to Mr. Jensens propertybecame aware of his plans when Mr.Jensen placed a crematory on hisproperty in 2009 without a permit.

    By that time, Mr. Jensen hadaccumulated a large file of codeviolations. According to the documents

    Last week, Eric Sadler, Kankakee County Zoning and DevelopmentCoordinator, was asked by Kraftdale homeowner RandyKnickerbocker to review a permit request approved by the City ofKankakee Planning Board.

    If approved by the Kankakee City Council, this permit will allow thebuilding and operation of a crematorium across the street fromKraftdale, a residential subdivision nearly 50 years old, in anunincorporated area of Kankakee County. To Mr. and Mrs.Knickerbocker, that seemed to be a violation of Kankakee Countyszoning law for their neighborhood.

    But Mr. Sadler said, Theres nothing I can do for you.

    Maybe not, but according to the Countys own statutes and the Stateof Illinois Statutes, that is one of Kankakee Countys jobs.

    Chapter 121 ZONINGArticle I In GeneralSec. 121-2. Purpose.(1) Promoting and protecting the public health, safety, comfort,morals and general welfare;(7) Assuring orderly growth in the Countyby providing that:b. Existing residential areasbe protected against intrusionwhich will interfere with decent living conditions.

    Residents of Kraftdale adjacent to Mr. Jensens Kankakee propertyreceived certified letters notifying them of Mr. Jensens request. Thathappened because the City Of Kankakee Municipal Code (and alsothe Illinois Municipal Code) requires:

    For each zoning lot abutting the subject zoning lot, includingpublic rights-of-way, the applicant shall notify the owners ofrecord (City of Kankakee Zoning Ordinance/1995 Chapter 12Administration page 12.7.)

    This applies irrespective of the propertys status as an unincorporatedarea or or as an area located in a bordering municipality.

    The Knickerbockers pay taxes to Kankakee County to provide themwith services that include establishing zoning laws and protectingthem against violations of that zoning.

    So why isnt the City of Kankakee who makes zoning laws andissues permits in Kankakee hearing from Kankakee County theKraftdale governing body who makes zoning laws and issues permitsin Kraftdale?

    George Washington Jr., the County Board member for District 17which includes Kraftdale, is the likely government official to take theKraftdale residents request for review to the County Board and to theCounty Planning Department. But last week, the Knickerbockers didnot even know who their County rep was.

    And since Mr. Jensens recent permit request in early 2011, not one ofthe government bodies or individual representatives have mentionedthe process for objecting to a permit that is incompatible with theabutting area. Kraftdale residents only heard, Theres nothing I cando for you.

    Mr. Knickerbocker said maybe thats OK. If the County doesnt haveany way to defend their own zoning laws, then I could put a pig farmon my property and theres apparently nothing the County could doabout it!

    He went on to say that if the City of Kankakee across the street thenobjects, the County is telling him by their actions, there is nothing theycan do about that either.

    But there is something the Kraftdale residents can do without Mr.Sadler and Mr. Washington, Jr. If the Kankakee City Council approvesMr. Jensens request tomorrow at the January 17 meeting, theKraftdale residents can appeal to the state of Illinois. Illinois CompiledStatutes indicate that Kraftdale residents have a legal say in what isbuilt across the street from their property affecting the homes in theirsubdivision. No arbitrary city and county boundaries interfere withthose property rights.

    According to the Illinois Municipal Code (65 ILCS 5/11-13-15),property owners have the right to file a lawsuit:

    any owner or tenant of real property, within 1200 feet in anydirection of the property on which the building or structure inquestion is located who shows that his property or person will besubstantially affected by the alleged violation.

    And any amendments to zoning ordinances are not final until 90 daysafter approval by the municipal body, allowing time for Judicial Reviewto settle disputes.

    So if a pig farmer with a permit from unincorporated Kankakee Countymoves across the street from your home in the city of Kankakee, learnto like it, at least until you get to circuit court.

    But there is something the Kraftdaleresidents can do without Mr. Sadler andMr. Washington, Jr. If the Kankakee CityCouncil approves Mr. Jensens requesttomorrow at the January 17 meeting, theKraftdale residents can appeal to thestate of Illinois. Illinois Compiled Statutesindicate that Kraftdale residents have alegal say in what is built across the streetfrom their property affecting the homes intheir subdivision. No arbitrary city andcounty boundaries interfere with thoseproperty rights.

    According to the Illinois Municipal Code(65 ILCS 5/11-13-15), property ownershave the right to file a lawsuit:

    any owner or tenant of realproperty, within 1200 feet in anydirection of the property on which thebuilding or structure in question islocated who shows that his propertyor person will be substantiallyaffected by the alleged violation.

    And any amendments to zoningordinances are not final until 90 daysafter approval by the municipal body,allowing time for Judicial Review to settledisputes.

    So if a pig farmer with a permit fromunincorporated Kankakee County movesacross the street from your home in thecity of Kankakee, learn to like it, at leastuntil you get to circuit court.

    At the June 20, 2011 City Council meeting, the Council defeated Mr.Jensens request for a permit to operate a crematorium by defeating themotion to place the item on its second reading.

    The Mayor had not placed the second reading of Mr. Jensens Special Usepermit request on the agenda for the June 6 meeting. On June 20, it wasalso not on the agenda.

    Alderman Hunter made a motion, seconded by Alderman Jones, to amendthe agenda to include the second reading on the crematorium issue. ThenAlderman Baron, seconded by Alderman Rich Browne, made a motion totable, which did not carry.

    The Motion to amend the agenda to place Mr. Jensens conditional usepermit request on second reading passed seven ayes to six nays and wasplaced under unfinished business.

    When the meeting moved to unfinished business, the Mayor asked, Do Ihave a motion to place this item on its Second Reading?

    Alderman Hunter responded, Motion to defeat this matter, seconded byAlderman Carl Brown, to not place the item on its second reading.

    The motion to not place the item on its second reading carried with theAldermen voting as follows:Aye: Brown, C; Hunter; Thompson; Tall; Stokes; Jones; Cox (7);NAY: Browne, R.; Baron; Faford; Swanson; Osenga; Linneman (6);ABSTAIN: Davidson (1)In the past, according to one Alderman, City Attorney Bohlen had explainedthat this procedure adding an agenda item and voting on it at the samemeeting was legal. This procedure is followed in Kankakee City Counciloccasionally throughout the year.

    Kankakee Police Detective Richard Cox, President of the local FraternalOrder of Police, felt this violated the 48 hours public notice requirement ofthe Illinois Open Meetings Act. On July 26, 2011, he submitted a Requestfor Review to the Office of the Attorney General. The state responded asfollows:

    The undisputed facts in this matter demonstrate that the Council tookaction on the Jensen Special use permit without providing the requiredpublic notice. Therefore, in order to remedy this violation, the Councilis directed to post the motion for the Jensen Special Use permit on itsnext meeting agenda, to discuss the matter in open session, and to re-vote on the matter.From Matthew C.     On Tuesday January 17,Kankakee City Council will be re-voting for the second time in lessthan one year on Mr. RusselJensens petition to operate acrematorium on his property at2450 Grinnell Rd in Kankakee. InAugust, 2006, Mr. Jensen appliedfor and received a conditional usepermit to build and operate awarehouse on his property. At thesame time, Mr. Jensen alsoapplied to the Illinois EPA as RiverValley Crematory requesting apermit to construct and operate acrematory. Illinois EPA issued thatpermit November 1, 2006.Records show Mr. Jensen neverapplied to the City of Kankakee fora permit to operate a crematoriumuntil 2011. City Council and theresidents adjacent to Mr. Jensensproperty became aware of hisplans when Mr. Jensen placed acrematory on his property in 2009without a permit.By that time, Mr. Jensen hadaccumulated a large file of codeviolations. According to documents

    resulting in an Order of Demolitiondated July 27, 2010, Mr. Jensenwas dumping car parts and storinghis boat on the property, he hadnever mowed or graded the landwhich was an eyesore to theresidential neighborhood, and hadpartially constructed a building thatwas legally ruled unsafe and ahazard that could not be broughtup to code.In addition, Mr. Jensen was notresponding to the numerous letterssent by the City and he had notcomplied with the notices to cleanup his property. He also did notpay the assessed fines whichincluded the City of Kankakeemowing the property to rid it ofhealth and safety issues.So why in early 2011 did the Cityof Kankakee and the PlanningBoard recommend that Mr. Jensenbe given a permit to operate acrematorium on his propertyproperty whose 2010 taxes wererecently sold for non-payment ofthe total due of $82.93?Kankakee County Treasurerproperty search.

    Alderman Dennis Barons law firm Deck &Baron is the Corporate Agent for BrownFuneral Home of Manteno, LTD where Mr.

    Russel Jensen is part-owner.

    Mr. Baron voted throughout spring 2011 on Mr. Jensens request tothe City of Kankakee for a permit to operate a crematorium. Mr.Jensens property is at 2450 Grinnell Rd, Kankakee, IL.

    Mr. Baron did not realize his firm was financially involved with Mr.Jensen until it was pointed out at the January 3, 2012 City CouncilMeeting by Township Supervisor and County Board member LarryEnz.

    That evening, Mr. Baron abstained on Mr. Jensens issue. He saidhe would check into this as soon as possible. Several days later at apublic meeting, Mr. Baron said he did not need to recuse himself asMr. Jensen is an employee.

    All corporation owners are employees of the corporation as well asowners. Mr. Baron is himself an owner and also an employee of hislaw firm Deck & Baron.

    Mr. Jensen is the only funeral director actively working in this smallfuneral home. If Mr. Baron thinks so little of Mr. Jensens financialcontribution to Brown Funeral Home, why is he voting to allow Mr.Jensen to run a crematorium? Why isnt Mr. Baron instead insistingon the demolition which could have been completed more than oneyear ago?

    Mr. Baron seems to be saying that the following people have not toldthe truth or are uninformed about special nuances of corporateownership:

    Mr. Russel JensenAttorney Jerry ShapiroAlderman Rich BrowneJournal reporter Lee ProvostFuneral Home Owner Bruce Schreffler

    These five people are in agreement and all have said in publicduring 2011 that Mr. Jensen is owner or part-owner of Brown FuneralHome of Manteno, LTD. It is too late to undo the results of cityofficials presenting this information as Mr. Jensens main credential.This information was expressed to show that Mr. Jensen is aresponsible businessman able to manage and maintain thecomplicated requirements of running a crematorium.

    The aforementioned five individuals made these statements in avariety of public places including: Kankakee City Council; variousmeetings attended by City of Kankakee Aldermen; in the presence ofthe Daily Journal of Kankakee who reported this information at leastfive times; at a City of Kankakee Planning Board where the membersaccepted without question Mr. Jensens experience; at severalneighborhood meetings; and in answer to inquiries regarding Mr.Jensens abilities.

    In 2012, we have been forced to acknowledge that corporations arepeople. It follows that people are also corporations when theyperform all the duties necessary to the ongoing business.

    We applaud Mr. Baron for looking into this and know he will dowhatever is necessary so that Mr. Jensen does not have to repeatthis process for a third time due to another administrative error.

    Why is the City of Kankakees contract with Allied so high compared toBourbonnais, Bradley and other towns* in Illinois? Or is it?

    At the Kankakee City Council Meeting November, 1, 2010, Mr. RichardSimms, Superintendent of Environmental Services Utility, explained thatwhat the City was paying ABC Disposal, Inc. in their 2010 contract worksout to a monthly per-household rate of around $17.00.

    He went on to say that the new January 1, 2011 Allied Waste contract isabout $200,000.00 less per year for year number one.** He then talksabout how the rest of our solid waste payment is going somewhere else.

    Officials may not be using this extra money for their personal legal fees orfor gambling parties on a Mississippi riverboat. But a garbage bill shouldbe a garbage bill not a fund to go somewhere else, perhaps to covererrors or hidden problems.

    Our neighboring cities seem to follow best practices in this regard. Soshould the City of Kankakee. The extra $12.50 charge per month that goessomewhere else should be labeled separately and accounted forseparately, showing what the City is doing with our money.

    Contract Details

    Allied Waste of Momences Contract Agreement with the City of Kankakeeis not on the Citys website. Fortunately, Bourbonnais and Bradley talkedwith the Daily Journal about the details of their contracts with Allied Wasteand their previous haulers.

    Bourbonnais residents, in 2010, were paying ABC Disposal $14.25 permonth for solid waste. Effective April 1, 2010, the Village of Bourbonnaischanged to Allied Waste of Momence for solid waste and recycling pickup.The Daily Journal reported on March 25, 2010**that the billing with AlliedWaste will be $16.25 for the first year, with a 5 percent annual increaseover the life of the five-year contract.

    Bradley residents, according to the Daily Journal October 11, 2011 ,**were paying an even $15 per month for waste removal. [to UnitedDisposal of Bradley for garbage and recycling]. Under the new contract[with Allied Waste of Momence], residents will pay $17.62 a month, andthat will rise to $22.16 a month by the end of the contract.

    Kankakee residents paid for ABC Disposal, Inc. $15.50 monthly in 2007for solid waste, and $23.50 in 2008 and 2009 for solid waste andrecycling. In 2010, the monthly increased to $29.50. (based on a review ofmonthly billing). But on November 1, 2010, Mr. Simms said at KankakeeCity Council that the actual monthly household rate worked out to about$17.00.

    So why is Kankakee paying over 12 dollars a month more for garbagethan our neighboring cities when Mr. Simms says the contract with AlliedWaste of Momence is about $200,000.00 less per year for 2011, yearnumber one of the contract?

    Kankakee River Valley Prescription Pill &Drug Disposal program

    This program is funded by a $20 assessment levied against persons whocommit specified drug offenses.

    Municipalities and state governments dont have to pay, says Paul Ritter,ecology teacher and director of the National Prescription Pill and DrugDisposal Program (P2D2).

    P2D2 keeps pharmaceuticals out of the water supply by using drop-offboxes. The drugs are out of the reach of children, and inappropriate useby criminals is avoided. The EPA (Environmental Protection Agency) hasasked communities to stop flushing unwanted medications down the drain.

    Kankakee County, in cooperation with the local police agencies and theIllinois EPA, began this Medication Disposal Program in 2009. In 2011,high school students helped pass the landmark legislation that providesthe funding.

    In a year marked by a record number ofnatural disasters, its shocking thatHouse and Senate Republicans thinkthey can get away with playing politicswith disaster relief.Recently, they have even threatened tohold federal disaster relief hostageunless further spending cuts were madeelsewhere in the budget.Just a few days ago, SenateRepublicans delayed the Senate fromdebating from simply debating abill to provide disaster relief funding todevastated communities across thenation by staging yet another all-too-common filibuster.Republicans have been all too willing torun up unprecedentedly high bills formillionaires tax cuts and wars in Iraqand Afghanistan, but when it comes toactually protecting Americans at home,they throw up all sorts of roadblocks.We cant let them get away with this and I need your help.Over the past several months, weveseen an unusually high number ofdestructive floods, hurricanes,earthquakes, tornadoes, and now,wildfires.The Federal Emergency ManagementAgency (FEMA) has been on theground to save lives and assist victimsin many of these situations.
