The decision is expected to cast a shadow over the Kaipara District Council (Validation of Rates and other Matters) Bill, currently before parliament, and subject of a submissions hearing in Kaipara last week. The Mangawhai Residents and Ratepayers Association applied to the High Court for a judicial review of decisions linked to the debt that led to the Kaipara District Council being dismissed and run by commissioners and to parliament being asked to validate illegal council rates. Justice Paul Heath has dismissed the KDC call for the MRRA application to be struck out and awarded costs in favour of the association, and will hold a case management conference midway through September to arrange for what is expected to be a five-day review hearing at a date to be set. MRRA chairman, Bruce Rogan, said following the court decision that it was possible MPs could push through the Bill to validate council actions but expected public outrage if the government quashed a review that the High Court said had merit. “This would have ramifications for the entire country,” he said. “This is a tremendous vindication of our petition. The judge is clearly saying the council has a case to answer.” The Kaipara District Council has failed in an attempt to have a ratepayer’s court challenge to its decisions struck out and costs have been awarded against it. The Rogan family generations assessing the court decision: from left Mrs Heather Rogan, granddaughter Colette Morrison, Bruce Rogan, Lennox Morrison, son-in-law Scott Morrison and Natalie Morrison Justice Heath’s judgement was published last Friday and recognised irregularities in the rate-fixing processes, “so much so that the Member of Parliament for Northland has promoted a local bill that is designed, if enacted, to validate the council’s actions. “This proceeding demonstrates how badly things can go wrong when a democratically elected council assumes significant financial obligations to an arm’s-length third party without disclosing the extent of the borrowing to its ratepayers.” Mr Rogan said his association members had spent some $100,000 on the case so far. “The commissioners’ position that their rates demands are lawful has been demolished. Both sides agreed in front of the judge that the rates demands were invalid.” Chair of the KDC commissioners, John Robertson said they had received the decision but had not yet had time to review it.” We will be reviewing this in detail over the next few days and will be taking further advice from our legal counsel. “The reason that we sought a strike out of part of the claim was because the law is quite clear with respect to bank debt, that this is a ‘protected transaction’ and therefore a judicial review of this matter is pointless. The judge did not rule on this matter — he said he wanted to hear more arguments from each counsel of this at the full hearing.”

Ratepayers in High Court win

As a result a court review will examine all council decisions that led to the $80 million debt resulting from the ill-fated Mangawhai sewerage scheme at a new five day hearing.

The decision is expected to cast a shadow over the Kaipara District Council (Validation of Rates and other Matters) Bill, currently before parliament, and subject of a submissions hearing in Kaipara last week.

A quilter’s treat

Community helpers

The annual Ray White Dargaville Jean Johnson Realty children’s drawing competition saw an impressive thirty plus entrants this year, all with very high quality submissions.Principal Jean Johnson presented prize bags which contained stationery and various art supplies to the winning three entrants for their excellent art work, based on black and white drawings published in the Kaipara Lifestyler, for children aged 5 to 12.

Kaipara quilters are being treated at the moment with the only display north of Auckland of the Colours of New Zealand national quilt exhibition, on show at the Dargaville Curtain and Sewing Centre in Normanby Street.

Sponsored jointly by Nutex and NZ Quilter Magazine, twenty or more works are on show around the shop until September 13th before moving on to other venues over the next year.Entrants had to have a New Zealand theme, use only New Zealand fabrics and materials and work within one square metre. Dargaville Curtain and Sewing Centre staffer Tina Jensen admires the winning entry.

Behind the scenes in the wide-ranging makeover of Maungaturoto township for the upcoming 150th settlement anniversary celebrations has been the Department of Corrections and its community work scheme. “The help has been invaluable,” says 150th committee chair, Albie Paton. “It has enabled us to make a major clean up on Bickerstaffe Road and the early settlers original landing area. Mr Paton is seen here with Tahu Kena, one of three community work scheme supervisors involved in the project.

Art awards astound again

A gathering of those who donated, helped make the project happen and well-wishers give the new Telehealth unit the big thumbs up at Dargaville Hospital

Dargaville Hospital has taken another hi-tech step into the world of 21st century medicine, with the commissioning of its new Telehealth equipment, enabling a wide range of medical consultations to be done within the hospital.

More than 100 people packed the Kauri Museum at Matakohe for the presentation night of the second annual Gilmore Brown Kaipara Community Art Awards exhibition.

Around 80 pieces of art from all over the Kaipara were on display at the prestigious and well regarded event, along with works from the two anchor arts societies of Mangawhai and Dargaville.

Dargaville Arts Secretary, Pauline Gough said the awards exhibition was born out of a Kaipara District Council initiative about five years ago when it was held at the council chambers. The Mangawhai and Dargaville Art Associations took over the presentation, moving eventually to the Kauri Museum as the event expanded.

“The weekend’s event was the fourth since its inception, the third under the combined auspices of the two arts associations and the second time the event has been held at the Kauri Museum under the current sponsorship arrangement.”

Pauline said the awards span five categories, including painting and drawing, photography and print-making, 3D which covers sculpture, pottery, metal and glass work, adornment — including jewellery and clothing, and wood.

“The area has some truly talented artists and while many are involved with the Mangawhai and Dargaville Art Associations, others are just out there

The $17,000 suite of equipment means patients and staff will be able to consult with specialists in Whangarei and even further afield, by means of a high quality video conferencing link from the hospital.

There are already around thirty variations of Dargaville’s unit being used all over Northland and more than 200 consultations have taken place so far this year, cutting down on expensive travel and providing much faster patient care.

Dargaville Hospital operations manager, Jen Thomas says the equipment does not replace visits by specialists but it does mean quicker service.

“Eventually we want to follow Kaitaia’s plans to link it into the Whangarei emergency department and ICU, but for now, we are delighted to

have this stage of the equipment up and running.”

Ms Thomas says the equipment also has a networked iPad and digital camera to extend after hours capability and work outside of the hospital.

“We would not have this marvellous addition without the huge support of our community and thanks must also go to The Freemasons, Fonterra, so many local clubs and organisations, Little Theatre, Countdown, Lions and Rotary and so many wonderful individuals who made this happen.”

Kaipara Community Health Trust chief executive Debbie Evans says many Dargaville and district people can't afford to take a whole day off work to attend a 15 minute appointment in Whangarei and then make repeated journeys for medical consultations, so the new equipment will be invaluable.

Energise Mr SpockRest home staff earn qualificationsAn energy conference with an eye on the future is being held this weekend in Kaiwaka — and everyone is hoping the sun will be shining.

The Renewable Energy School of New Zealand (RESONZ) is hosting the Northland Solar Energy Conference at its new centre in Kaiwaka, with the aim of bringing all that’s new in solar energy to householders, architects, builders and local bodies.

Environmental engineer and spokesperson Eric Jansseune says the conference will be a great learning experience around an exciting energy concept, which he says is growing in New Zealand.

“The conference will increase awareness and knowledge of energy efficiency measures and the smart use of solar energy in buildings.

“The conference is open to people interested in energy savings and offers a fantastic learning opportunity to discover everything you wanted to know about the solar potential of New Zealand.

Eleven staff at the Norfolk Court Rest Home in Dargaville have been presented with certificates after qualifying across a range of NZQA approved training programmes around aged care.

At the ceremony, five other of the 40 strong staff were also recognised for long service at the 64-bed rest home, which has been going for 21 years.

Bronwyn Collins, Raewyn Watson, Promise Wyllie, Anne Burke and Lillian Nesbit totalled more than 65 years service between them.

“The focus of this conference will be on actions that can be implemented right now.”

Mr Jansseune says topics covered will include energy efficiency in the house… how to reduce your electricity bill by up to 30%, solar basics, solar hot water (SHW), how to shower every hour, qualitative comparison of SHW, avoiding the solar blunders, and solar electricity — whether to contribute to the grid or not.

“This series of sessions will engage people actively and encourage open communication with the speakers. A range of solar technologies will also be demonstrated.”

A $50 charge will apply for the day-long conference at the Kaiwaka Hall, Kaiwaka-Mangawhai Road, opposite the Four Square. Reservations are necessary and can be arranged via [email protected].

The year-long national certificate courses are delivered by the Aged Care Programme (ACE) administered by Health Ed Trust, a not-for-profit organisation and students are assessed by an on-the-job assessor, gaining fully recognised qualifications covering dementia and aged care.

Norfolk CEO Stuart House said the facility was in the process of expanding, converting the existing hospital section into a full rest home hospital with 22 beds and 24 hour nursing staff, adding to the current rest home and specialised dementia care facilities.

Five Kaipara residents have thrown their hats into the electoral ring in a bid to win the one available seat on the Northland Regional Council.

Some fantastic milestones have been achieved on the Northpower Fibre Ultra-Fast Broadband network being built in Whangarei.

Not only do we now have 1000 customers connected and the highest uptake rate of any Local Fibre Company in New Zealand, more than 80% of our network build is complete.

At the end of August our network had passed 16,345 premises which means 15,507 residents and businesses in Whangarei can connect to the fastest broadband in town.

So our fibre crews have a busy time in the lead up to Christmas to ensure we are on track to complete Whangarei’s UFB network early next year.

The CBD and Crawford Crescent areas will be released shortly, followed by Whau Valley and the Fisher Terrace vicinity around late September/early October.

On the electricity front, here is our latest update:

• All preliminary line work has been completed to allow construction of the new Maunu Road intersection, while sub-trans work continues in readiness for the major change-over on completion

• Work continues on maintenance in the rural areas of Pipiwai, Three Mile Bush, and Ruatangata, where access is limited to roadside only

• Switch replacement projects have been completed at Hikurangi, Pipiwai and Tikipunga

• Totara Park subdivision has continued during August with the running of cable as the highlight

• The streetlight projects for Mander Park and Northport have been completed

• Warkworth crews continue with network maintenance work in the Southern parts of the Northpower electricity Network

• Underground crews are gearing up for some night work in parts of Whangarei’s CBD and industrial areas of Whangarei to alleviate the need for day time shutdowns - thus not affecting power supplies to businesses

• The Northpower Fibre teams continue to lay the backbone fibre in the Kamo area

• A large Network maintenance project is set to start in Onerahi which will involve changing rotten conductor, along with old hardware on existing structures

• Small to medium-sized customer-generated projects continue to increase

• Maungaturoto crews continue with Network maintenance projects in the Hakaru and Ararua areas

• A big push in maintenance around Ruawai has been the focus for Northpower’s Dargaville crews throughout August. This has involved the replacement of badly leaning poles due to wet conditions and large drains along the roadside.

They are five out of thirty-two candidates contesting nine seats on a new look council at the October 12th election.

Candidate Rochelle Butt says she believes the ratepayer’s voice is not being heard. She says councils must be held to open, transparent, and democratically accountable principles adding that Kaipara needs strong leadership from those willing to lead and prepared to be independent thinkers acting with budgets in mind and in the best interest of the community.

Long-time identity Bill Guest says rather than specific issues, he believes voters must ask which candidate will bring transparency, strong knowledge and the ability to do the job effectively. He says those in the past have not delivered. Mr Guest says it’s not about personalities likes or dislikes, but ability. He says he welcomes a strongly contested election and urges voters to become involved to ensure the Kaipara has a strong voice. He says he believes he has these qualities.

Jonathan Larsen says the role of regional Council requires strong governance that he can provide. He says he can grasp big concepts and can recognise when a hard decision is required. “I am prepared to be up front; challenging the hard issues. I will communicate clearly and regularly to ratepayers. Our challenge is to bring the ‘local’ back to local government. What Kaipara needs is a regional councillor who can deliver. I can do that.”

Incumbent Councillor Graeme Ramsey has a short, succinct statement to voters. He says “I am standing for re-election to continue the work I have started, getting Northland working together and delivering results for the Kaipara.” Mr Ramsey is a former Kaipara District Council Mayor and is chief executive officer of the Problem Gambling Foundation.

My KDC experience puts me in a strong position to represent Kaipara on the NRC. Kaipara’s issues need to be fully acknowledged and our youth provided with the opportunities which they deserve. I bring a strong voice for Kaipara.

Nor thlanders are currently represented by eight regional councillors elected from three constituencies, however this year, voters will choose nine regional councillors representing seven, smaller constituencies across

the North. The regional council’s chief executive officer Malcolm Nicolson says one of the reasons behind the change was a desire to strengthen the representation of Northlanders at the council table.

Quake policy re-visitedThe Kaipara District Council has completed its regular review of its policy around earthquake-prone public buildings and in the process, has found one of its own buildings requires a warning sticker to be displayed.

Council’s corporate services manager, Barbara Ware, says the old council chambers in Hokianga Road now has a notice advising that it is earthquake prone and that there is a risk involved.

Ms Ware says while the Kaipara area is classified as a very low earthquake risk, the survey is timely in light of the number of recent earthquake episodes around the country.

“When the old council building was built 90 years ago, the building codes were very different, and while the building is still structurally sound, it simply does not meet today’s very strict codes and so we have to advise people of that.”

Under the Building Act, the council has to review the policy every five years and has been using their own inspection team to survey any buildings deemed to be at risk. Ms Ware says the council is looking at all public buildings over two stories high, older buildings obviously, but also any structure with street-facing parapets or cantilevered verandas.

The 90 year old former council chambers in Hokianga Road, now has an earthquake advisory sticker

“If a building is found to have an issue, we notify the owners who then must supply a detailed report addressing our findings and what will be done. They then have 15 years to rectify any areas of concern and bring the building up to standard.”

She says while little has changed since the last review, minor changes have been made around the threshold that determines what actually constitutes an earthquake-prone building.

Anyone with property affected has until this Friday to lodge submissions, and full details on how to comment are available via the council’s website.

and the social impact here in the Kaipara.My family has been associated with the Kaipara since

before 1910 when my Grandfather had a business, and lived, in Dargaville, and raised his 5 boys here. I also live in the Kaipara.

If you believe that this move to amalgamate with the Far North areas will have no effect on the social life of the Kaipara then you are sadly mistaken. Cutting costs is one thing but giving control to a greater power is just not going to benefit the Kaipara area in the long run, you may as well give it to the ARC as Whangarei & the Far North do not give a toss about the Kaipara and only see it as a side track to the main event being the Great Far North area and “their” progress in trade and tourism.

Do you really want them to look after your own backyard from the other side of the hill, I certainly do not.

Kaipara needs to look after itself even if it comes at a cost to rates of those who live here, the Mangawhai debacle is just that and a one off, you will not get rid of it by going over the hill, the grass is NOT greener there, you have to be in control of your own destiny otherwise you may as well give up all hope for a future in the Kaipara, or have you already done that.

You can still work with the other councils for the development of the North without opening your gate to their ownership.

Don’t give away your backyard to bureaucrats who only think big is better, small is good too, if you control it, you the rate payer. Would you want your Doctor to live in Whangarei when you have a problem? Remember with an amalgamation your rates will not stay here in the Kaipara.

Volunteers hit the ton

When it became obvious back in 1910 that fire was the biggest menace for a Dargaville township built mostly of highly flammable kauri timber, a bucket brigade was formed. Fire chief Samuel Powell had his headquarters near Central Hotel in Dyers Community Hall.

It was only a stopgap measure. Forester’s Hall had already gone up in smoke in Hokianga Road, half of

A total of two hundred and twenty one firemen, three new fire stations and many fire appliances over the last one hundred years. That is the score so far for Dargaville Volunteer Fire Brigade.

Victoria Street’s north side, including Dyers Hall, burned down and in 1908 Stallworthy’s Printing Works on the other side was destroyed.

On August 6th 1913 a public meeting decided to form Dargaville Fire Brigade with a ten-man crew. A corrugated iron shed and a bell tower was organised on the town wharf. Equipped with a two horse Merryweather Steam Pump and two hundred and fifty metres of hose, all donated by Dargaville Borough Council, it was ready to go. Donations from town folk bought uniforms and helmets.

But fighting fires was difficult. After firemen were called by the big bell the horses had to be readied with at least eight minutes needed to build up engine steam. Water was a problem too. There was no town supply so that it had to be drawn from the river, easy enough if it was full tide. Dargaville Borough had water laid on in 1917.

Ten fires tested the new brigade in that first twelve months. Over the years there have been lots more call outs with many buildings saved and some  lost. Of recent memory was the old Wairoa

Stores owned by Fosters Home Decorating. In a 1961 blaze similar to that early Victoria Street disaster but on the opposite side, Dargaville Fire Brigade was again able to prevent the town burning down completely.

Sawmills were always liable to catch fire. In 1916 the Brigade took their appliances up river by steamer, launch and barge to save most of the timber at Hoanga Mill. Grateful owner Woolsey Allen sent the firemen £10 for services rendered. Tangowahine mill burnt the same year.

Anderson’s Dargaville mill on the site of Countdown supermarket had outbreaks three times in 1928. In 1926 the two-storied Aurega House was lost. Built by Edmund Hillary’s grandfather in Victoria Street, it stood near today’s Caltex petrol station. Maybe disgruntled former students were responsible for two Dargaville Primary school fires and in 1937 the Dargaville High School burned to the ground.

A new two storied station complete with a central pole for firemen to slide down was built over the river at the end of Kapia Street in about 1920. Superintendent Charles Shaw retired and Percy Hayward took over to finally retire in 1954, one year after moving into their present day station in Normanby Street. Hayward had been a fireman for forty-four years, thirty-three of them as Chief Officer.

Names of the original firemen such as Shaw, Brady, Dunn, Hayward, Gould, Plummer, Neild, Goodall, Reynolds and Haines read like a who’s-who of Dargaville society of the day.

As with all civic endeavours war made it difficult to keep going. During World War Two, with most able-bodied men away, the Brigade was staffed completely by women of the town.

During the 1914 Great War it was kept going although every Dargaville Fire Brigade member, except a too old Chas Shaw, went to war. Three of them were awarded a Military Medal for bravery. Perhaps that gives a clue about the type of man that becomes a volunteer fireman.

Fosters managing director, Arron Foster well remembers that fateful day in January 2009 when an arc in copper wiring inside a fuse box caused the town’s biggest blaze in 40 years and shut down the Fosters business.

The five-alarm blaze was attended first by the Dargaville fire party, and ultimately by about 100 firefighters from all over the Kaipara. But Just eight months after the fire which devastated

their business, and four other shops, Fosters Home Decorating was not only back in business and planning expansion — the company was also winning accolades from its business peers.

Mr Foster added it was not only the firemen who were heroes — there was massive support from the wider community as well.

“When fire devastated our store in 2009 the local fire brigade swung into action, preventing greater loss of property. Their heroic efforts averted an immense disaster, conquering in the biggest fire seen here for a century.

“Without the efforts of our volunteer firefighters we as a community would be at a huge loose end. But today, we as a business are bigger and better, we offer our heartfelt thanks to all the volunteer firefighters.”

When the business re-opened after the blaze he said he and his staff “were overwhelmed.

“We expected many people to come but the whole town was here and I never

saw so many people in the shop. As a matter of fact, I wasn’t able to get back outside for the press of customers.

“The tills were ringing and the eftpos machine couldn’t keep up. Sales were simply the best we had ever had.

“Outside there was a bouncy castle for kids and a sausage sizzle. The organisers from Media Works came with 250 sausages and ran out and had to get more.

“We had the fire brigade, the Dargaville Pipe Band, the Dargaville Intermediate Marimba band, the Dargaville Primary School and their ukuleles. Look, it was all pretty overwhelming.

“Without the efforts of our volunteer firefighters, we as a community would be at a huge loose end.”

It’s not every day you get to go for a ride in an 87-year-old car you last saw as a child, but the other day, Bruce Waterworth from Taupo was in town to visit his daughter and grandchild and just happened to call by in his beautifully restored 1926 Ford “New Beauty” Model T tourer.

We were in the presence of motoring royalty. Known globally as the Tin Lizzie, the T was the world’s first mass-produced ‘affordable’ car, and after 19 years in production, was eventually named the most influential car of the 20th century.

With a very basic four cylinder 20 hp motor that developed a surprising 2.9 litres, a hand-operated windscreen wiper and a single transverse spring front and rear so the huge, 30 inch wooden-spoke wheels had plenty of room to move on the rough tracks that passed as roads, the car was like today’s all-terrain vehicle.

Being just a year off the end of the model, Bruce’s car sported an electric starter, although the crank handle was still there, just in case.

The car could run on petrol, kerosene or even ethanol and had a top speed of 70 kph. Bruce says the car is very

reliable, but with a hand throttle, transmission brakes and no self-returning on the steering, it requires what he calls a “preventative driving style” based on moderate actions.

The ride is tall but not uncomfortable and the steering wheel seems impossibly high, but apart from that, the car feels remarkably normal as we cruise around the back of the old dairy factory, the very slow revving motor distinctively percolating away.

The trickiest parts would be the hand throttle and two-speed gearbox, which while being efficient, requires way more space to explain than we have here. It is best described as an automatic in today’s parlance, and is accessed via three different foot pedals and means the car can literally go from forward to reverse as fast as you can stop.

As Bruce says, it requires a lot of practice and understanding that almost everything you know about clutches and accelerators, conventional brakes and

modern driving goes entirely out the window, in a quirky world of fun and nostalgia that is the 1926 Model T New Beauty. Price when new? $US260.

New livery for St John

The new high visibility colour is all about safety, but when the Dargaville fleet will change colour is unclear as the nationwide change will take a long time to complete.

The programme is designed to improve safety for staff, patients and the public and the organisation says yellow vehicles are the most noticeable on the road, particularly in poor lighting conditions.

The change is also influenced by the fact that yellow is the most visible colour for people with colour blindness which affects an estimated one in 12 or 8% of men and one in 200 or 0.5% of women.

The emergency fleet also has a new, bolder design and carry extra reflective signage and distinctive green striping is also known to maximise visibility.

“Finding ways to improve the quality and safety of our care and services is really important to St John and having our ambulances and other frontline vehicles yellow and with this new design, is one way we can make them safer and more visible on the road,” said St John operations director, Michael Brooke.

“We’re expecting to see an improvement in the public noticing and giving way to St John vehicles as they travel to and from treating patients.” The process will be slow, as the organisation sees the change happening over the next

Earlier this month, a group of 20 senior students from Ruawai College visited the Outdoor Pursuits Centre at Tongariro National Park for a week long field trip of caving, white-water rafting, high ropes, tramping and orienteering.

White water and weta!In the Okupata caves, we squeezed

through dark passages with nothing but head torches and glow-worms to see by and screams as students encountered a family of weta.

The white-water rafting was adrenalin-pumping, bouncing through the rapids before a plunge into the icy cold waters of the Tongariro River, marvelling at the creative names the instructors gave the various rapids, the most favoured being ‘Grandad’s Green Undies’ and ‘The Cheese Grater’.

Scarier still were the high ropes — suspended 12 metres above the ground. This was a trust activity fully relying on our peers to keep us safe. There were tears as students were certain they were going to die, much to the amusement of the instructors.

Near week’s end, we had two overnighters away from the chalets. Two groups on two different paths with plenty of warm clothes, food and socks. One group had to build their own shelter from scratch, with nothing but their bare hands and the white mantle of Mt Ruapehu.

On the first night, the second group slogged five and a half hard hours up Mt Tongariro and back to camp at the head of the Mangatepopo stream. On the second night, group one set up camp in the swamp using just tarpaulins and sticks and were only about 400 metres away from the OPC chalets.

Group two had to tramp nine hours through tussock and heather, and, after what felt like forever, we finally reached camp at the hub, 20 minutes away from the OPC resource centre. By the last day, many students were delighted to have hot showers and a flushing toilet.

OPC challenged us and pushed everyone outside their comfort zones. It was a character building expedition we all thoroughly enjoyed and our thanks to Mr Paniora and Ms Smith and the OPC instructors Tim and Simon for their support and guidance.

The Conservation Services Manager will lead a team of 14 Rangers, carrying out planned work across biodiversity, recreation and historic heritage.
