The Maungaturoto pioneer landing re-enactment underway in Bickerstaffe Road

More Maungaturoto memoriesOpening a time capsule, a landing re-enactment, a huge parade, pioneer sports, VIP speeches and a good deal of convivial socialising cemented Maungaturoto’s 150th anniversary in local memories last weekend.

“Altogether a great weekend with many old friendships renewed and families getting together. Good weather, great crowds and right up to expectations and beyond,” said the 150th Committee chair, Albie Paton.

“We started with registrations on Friday afternoon and carried on with a meet and greet and wine and cheese evening attended by in excess of 200 visitors and locals.

“During the evening a time capsule which was placed in the wall of the hall when it was built 50 years ago was retrieved by local Donald Cullen and opened to reveal newspaper clippings of the time and a lot of interest was shown in slide shows of old photos and old movies of the centenary and before.

“On the Saturday a crowd of about 500 blocked Bickerstaffe road at the new wharf site to watch a landing re-enactment and Maori welcome followed by a parade of floats and vehicles depicting the last five or six decades which ended at the Country Club”

This was followed by a full afternoon of pioneer sports and activities — wood chopping, hand milking a cow and

shearing sheep with a bicycle powered shearing plant among them.

“Saturday evening the Centennial hall was filled to capacity for a celebratory dinner,” added Albie.

During the evening 11-year-old Haley Linton read a speech that won a Maungaturoto Primary school 150th anniversary contest and guest speaker John Carter spoke about how a lad from Otamatea High School worked his way through the ranks in local government and then through the party political ranks to be a minister of the crown, New Zealand High commissioner to the Cook

Islands and now mayor of the Far North District council.”

Mr Paton said the district should be “proud of the way it has set itself goals and achieved them over the last 150 years. “When things need doing the community spirit is so great.”

On Sunday the Centennial Hall was again filled for a combined church followed by a luncheon and the replacement of the time capsule by the twins and pioneer family descendants Kelly and Emma Huband.

A video compilation of the event is being edited for sale by Christmas.

Bookworms helping out

Farmyard meets schoolyard

A social group called the Pahi Bookworms that meet once a month to discuss and swap books they have read is extending its activities to support local educational facilities. “We pay a small donation each month and as funds arise we are going to be providing school children with books,” says group member, Lea Dodson. Shown here are fellow bookworm Pat Sutton, left, with Lea and Paparoa school pupils Sam Parker and Elsie Holcroft, with the first of the book donations. “Anyone interested in joining the Pahi bookworms can contact me on 09 431 6296,” says Lea.

Kaipara border collie Cooper has become a canine champion with a win in the National Dog Obedience Assembly held in Auckland. “I burst into tears when I heard the judge’s decision,” says proud owner and trainer, Laurel Greaves, of Pahi, seen here with Cooper and ”competition apprentice” puppy, Georgy. “We have been trying for the award for a while, and Cooper has just missed on a couple of points. This time he just put it all together on the day and I’m thrilled to bits.” The NDOA is an annual Labour Weekend event, held in a different town or city each year, and a premier occasion for dog trial enthusiasts.

The playing fields of Te Kopuru School became a temporary home for a bevy of farm animals during the week as the school held its Pet and Project Day. Some children bought their calves, lambs or goats to school and paraded them before a group of interested judges, watched by parents and classmates. While some animals were a little less than perfectly behaved, their young charges showed grace under pressure, receiving applause from all present. Bianca Hines (pictured) won the Harvey Cup for the best overall dairy animal.

New face at library Commission considers options for council reform by Colin Patterson

Dargaville Library custodian, Lisa Salter

Dargaville has a new librarian filling a maternity leave position, but one who will be familiar to many of her customers.

Lisa Salter, from Ruawai, has spent the last 14 years looking after the Ruawai College library after arriving in New Zealand from her native United States 10 years before that.

“I took a number of jobs available in rural New Zealand towns, at a sawmill, and rural dealerships, before I came to Ruawai College,” she says.

“Having become a qualified and registered librarian, I saw this position advertised and I am enjoying being here. There is an excellent collection of books and we have very good customer service and response, as the central point of the five community libraries in the Kaipara.”

“We’re pleased to do all we can to assist our customers.”

Kaipara residents may have to wait a little bit longer to find out how their council might change under local government restructuring.

The Local Government Commission held a series of meetings throughout Northland in August after receiving a reorganisation proposal from the Far North District Council. The commission had received more than 40 submissions regarding the proposal.

After the meetings finished, the commission put out a media statement saying it would release a draft proposal later in the year — sometime after the October 12 local body elections.

Last week, commission spokeswoman Kathryn Street said the commission had yet to set a release date for its draft proposal. “We’re still hoping to meet our pre-Christmas deadline.”

Ms Street says once the commission releases its draft proposal, it will call for further submissions. That will be followed by public hearings. The commission

will consider the information and views received before issuing a final proposal.

Once a final proposal is issued there is a period of 60 days for 10% of the electors of any district covered by it to sign a petition for a poll.

If a poll is held, it will cover the entire area subject to a reorganisation proposal. Unless a majority of those voting oppose the proposal, it will be enacted.

Ms Street says the commission is working toward a proposal that could come into effect in 2015.

If that happens, a transitional authority will be set up with representation from all affected councils.

However, Ms Street says the commission could also decide not to issue a final proposal. If that happens, existing structures will continue unchanged.

Bus key to tourism?Disability no barrierto getting together by Colin Patterson

by Paul Campbell

“If we had a beach bus running from Pouto to Dargaville, we could really boost tourism numbers for Kaipara and on into the north.”

Veteran skipper Terry Somers and his wife Gay have just completed their annual cruise series out of Pahi, taking passengers on a four — hour sea tour of historic sites, winding river-ways, past ancient kauri, and a wide variety of birdlife.

“It’s been great cruising and we will be back next year,” he said. “But there is a limited number of customers connecting to Pahi, so if we had a beach bus operating up the west coast from Poutu to Dargaville, we would bring big tourist numbers up from Helensville, where we tap into the Auckland market.”

The Somers operate the Kewpie Too and have been plying the Kaipara for more than two decades. The vessel is equipped with an extensive shore landing gangway and can land passengers surely and safely on remote Pouto Beach.

“There was a bus operating some years back, but there’s nothing now. If that was back in business, there’d be a steady stream of tourists flowing north along the west coast, to Dargaville,

A social group for Kaipara people with disabilities kicked off on Friday night sponsored by Dargaville’s Greenways Trust.

Greenways’ community facilitator Jenny Blair-Casey says Fabshack was set up following a recent hui at the Dargaville Town Hall. Representatives from The Cube, an Auckland-based organisation that works with young people with disabilities outlined its programmes.

She says people agreed something similar was needed in Dargaville.

Fabshack is likely to start with 30 to 40 people meeting every fortnight. Ms Blair-Casey says it will fill a gap. “Transport issues are huge. People in wheelchairs  feelvery isolated.”

A steering group has come up with ideas for activities. They include dances, mini golf, pool nights, going to the Kai Iwi Lakes and riding quad bikes.

However, these activities will cost money, so fundraising is also planned. Greenways are holding a garage sale on December 5 and 6. Ms Blair-Casey says anyone with surplus goods that are in a saleable condition are most welcome to donate them. Donations can be left at the Greenways office, 16 Edward Street, Dargaville.

For more information about Fabshack call the Greenways office on09 439 8955.

and on to the forest and the Hokianga beyond,” said Terry.

The couple add that meeting travellers and local passengers is the great bonus of their business.

“We had a trip out of Pahi at the weekend, where it turned out many of the passengers were actually related, but did not realise it until they were all aboard and off to visit old family locations,” said Gay.

“Every cruise means a new experience and meeting new and interesting people. We will be back here next Labour Weekend for more.”

Chair of Commissioners

Rubbish and RecyclingCouncil has awarded its Waste and Recyclables Collection and Disposal and Transfer Station Operations Contract to Kaipara Refuse Limited for a period of three years. In July this year tendered this contract.Although nine copies of the tender documents were downloaded by interested parties, Council only received one tender. This tender was from Kaipara Refuse Limited.Kaipara Refuse Limited has a good knowledge of the District having been the litterbin contractor in the District since 2006. It has also had a working relationship with Council for the last 21 years as Kaipara Refuse/Kaurilands Skills Centre.Kaipara Refuse employs approximately 30 staff of which around half live at the Kaurilands Skills Centre. The Centre is a residential facility for intellectually disabled adults. Some of these Kaurilands residents are employed as rubbish collectors and others are employed to sort the recycling that comes back into its Kaipara Refuse premises.Congratulations to the team at Kaipara Refuse for winning this tender. And thank you to those of you who collect our rubbish and sort it all. You do a great job.

Recycling is importantRecycling is easy — we can all become recycling advocates. We can look after our environment and feel good about doing it. As you recycle, think about those residents from Kaurilands Skills Centre who may be sorting through your recycling and do the right thing — wash/clean out all recyclable items before putting them in Council’s yellow bag.Remember, buy two bags — a yellow one for your recycling and a blue one for the rest of your rubbish. It is also important to understand just what items can and cannot be recycled. If you are not sure what is recyclable go to www.recycle.co.nz.

Kaipara District PlanThe Commissioners are pleased to be able to report that on 01 November 2013 Council’s Proposed District Plan became operative.

This plan defines rules for property development, and is expected to last for about ten years. The Plan has been in the making for some four years. There were a number of appeals against parts of the Plan. Only one remains. The Commissioners consider the settlement of the appeals through the mediation process rather than Court hearings to be a great achievement by Council staff.

Kaipara District Licensing CommitteeCouncils all around New Zealand are establishing a District Licensing Committee as required by the Sale and Supply of Alcohol Act 2012. The Commissioners are pleased to announce the appointment of Kaipara District Licensing Committee (DLC) to take responsibility for local decisions relating to the sale and supply of alcohol. From 18 December 2013 all local-level liquor licence decisions — new and renewal of premises licences, managers’ certificates, special licences and temporary authorities — will be made by the DLC.The Committee will be chaired by Commissioner Peter Winder. The other committee members comprise Commissioner Colin Dale, Mr Mark Farnsworth, Mr Gordon Lambert, and Mr Mark Vincent who will share the decision-making responsibilities.Mr Farnsworth lives in Mangawhai and is a former Chair of the Northland Regional Council and a Resource Management Act Hearings Commissioner, Mr Lambeth lives in Dargaville and is a former Police Officer, and Mr Vincent lives in Paparoa and for several years managed the liquor licensing service for Council. The appointment of the DLC results from the significant changes made to New Zealand’s alcohol laws last year. Expressions of interest in DLC membership were called for in August/September with a total of eight candidates indicating their interest in the positions. On behalf of the Commissioners I would like to thank all those who put their application in for consideration.

Aboard the sand barge by Andrew Kenny

A common enough sight on the Kaipara Harbour is ‘the sand barge’ which makes a daily run from Helensville to Pouto Point, collecting fine sand for the Auckland construction industry.

It’s actually very hard to miss — at 50 metres long and 17 metres wide.

But it is not often that one gets a close-up and personal look at the behemoth. I was recently invited aboard by skipper, Pete Cullen, who was aware of my coastguard training courses, and the experience was an eye-opener.

After an early morning start, it soon became apparent that the 560-tonne Kaipara Karrier V1 was a far cry from the small boats I am used to. It was rock steady through the water as we made 8-1/2 knots, outbound with the tide.

On site, the sand suction process was pretty much automated, and there was time for me to drop a line over the side. The result — several fat trevally, and a gurnard or two. Hove to off Pouto, there was barely a movement of the great hull as it took on its cargo. Time for lunch and a chat with the skipper, who has been at the helm of big craft more than two decades

Then loaded up, we set out for the long voyage home with the incoming tide and just making some seven knots, fully laden.

We were back ashore about nine hours after starting out, tired perhaps from a good intake of sea air. Not an exciting life perhaps, but a vital link in the construction chain, and it was an unique opportunity for a small boat driver to see at close hand a machine that, until now, had always just caught my eye in the distance.

Kaipara Karrier V1 was a new experience for Andrew Kenny — inset

Race gives boatiesbig river experience by Colin Patterson

A bunch of lucky sailors will race from Ruawai to Dargaville this weekend in a race organised by the Northern Wairoa Boating Club.

Boats on the River on Saturday November 9 is an event for small dinghies, says club commodore Kelly Hansen.

He says the event will be run over 15 nautical miles from Ruawai Wharf to the boating club’s headquarters in Dargaville.

This is the first time the event has been held. Mr Hansen says the club is hoping for at least 20 entries. “We’ve got six so far. People are just waiting for the weather.”

He says scrutinising will take place at 12 noon with the race kicking off at 1pm. He says the fastest boats will make it to Dargaville between two and two and a half hours, while the slowest should finish in about three hours. “We’ve planned it so

the sailors benefit from incoming tidal patterns.” Safety is paramount and launches will act as safety boats. The Wairoa River is sheltered so is ideal for younger yachties.

Mr Hansen says the club will hold a prize giving after the end of the race. Later in the evening the fireworks will be on next door in the gardens.

“The clubrooms are an ideal place to watch it. We’ve got a special licence, so we’ll be open to the public.”

Anyone interested in taking part in the race should call Mr Hansen on 021 122 8136. Entries cost $10 for a boat with up to two people.

Additional passengers are $5 a head with a maximum of four people per boat.

Local race meeting promises a good day out by Colin Patterson

Dargaville Racing Club secretary Basil Smith holds the trophy for the winner of the Northland Cup. The trophy was made by local sculptor Peter McKenzie

Hooves will pound the track and turnstiles will click at the Dargaville Racing Club at its next meeting on November 15.

One of the country’s smaller clubs will be holding one of just two race days it hosts each year. That makes it a big event for a club whose history dates back to the 19th century.

The man bringing everything together is club secretary Basil Smith. He formerly ran Dargaville’s Commercial Hotel and has had a long-time interest in racing. About eight years ago the previous secretary stood down and Mr Smith took over.

For much of the year Mr Smith’s job is ‘very part-time’. “I do it as a hobby. I only get busy when the races come up.”

The November 15 race meeting has eight races on the card, including the Northland Cup which has a stake of $8,000. Mr Smith expects between 1,500 and 3,000 people through the gate and an on-course turnover between $110,000 and $150,000. “We get coaches from Kaitaia, Mangonui, Taipa, Whangarei and Warkworth.”

Mr Smith says there will be two good food outlets and four bars will be operating. There will be entertainment for all ages and a Fashion in the Field competition for the best dressed.

He says the track is in perfect condition. “Our track manager has put hours and hours into getting it right. I wish we were racing today.” All other arrangements are in place. The only

uncertainties are the weather and the horses.

Nominations close on Tuesday and acceptances are issued on Wednesday, meaning fields will not be known until 48 hours before racing begins.

Recent weather has been good. “But on race day it’s all in the lap of the gods.”

While racing has struggled in recent years, Mr Smith says it has a bright future. “Racing is still holding its own — it’s hanging in there. There’s something about horse racing that people love. And it’s a really great day out.”

Museum gets fresh lick of paint

Best blooms go on display in two towns

One of Kaipara’s most visited attractions is getting a fresh new look thanks to local tertiary students and a big name in paints.

Gardeners in Mangawhai and Ruawai are testing their green fingers with the best flowers and roses going on display as the two towns host garden shows.

Dargaville Museum opened in 1985. But 28 years later much of its exterior paintwork is original and has started to fade.

Museum manager Pene McKenzie says people do notice the faded exterior. But with the museum largely reliant on volunteers and community funding, there was no money in the budget to do anything about it.

However, she successfully applied to a nationwide Resene Paints scheme that donates paint to community groups. Local Dargaville company Fosters Home Decorating also helped out.

The paint is being applied by NorthTec painting and decorating students. Tutor Mathew Watti says they became involved after NorthTec put an ad in the paper seeking work experience opportunities for its students.

He says there are 14 students involved in the project. They will continue on the job until their course finishes in early December. A fresh intake of students will return next year to finish the job.

Ms McKenzie says the museum’s roof which has the words ‘Dargaville Museum’ painted on it is in good condition and will not be repainted.

Mangawhai Flower Show organiser Margaret Walshe says the event takes place on Friday November 15 in the Mangawhai Library Hall, corner of Moir and Insley streets.

She says entries can be dropped off at the hall between 7pm and 8pm on Thursday and from 8am to 10am on Friday. “Judging starts at 11am so all entries must be received and on display before that time. Anybody at all can enter.”

Meanwhile, competition is hotting up for the best flowers and roses in Ruawai as the local Garden Club holds its annual Rose and Flower Show on Saturday (November 9).

Noelene Gatehouse from the club says anyone can enter.

The event will take place at the War Memorial Hall which will open to competitors at 9am so they can drop off their entries. Judges will then do their judging before the event opens to the public at 11am.

Pioneer farm shows how settlers fared by Colin Patterson

Pamela Parkinson wants 21st century people to understand the hardships pioneer settlers of this country endured.

So Mrs Parkinson and her husband Less have turned Honeycroft, their 11-acre block 12 km southeast of Dargaville into a recreation of a pioneer farm. There she hand milks her seven cows, makes cheese, and tries to live a colonial lifestyle.

“We’re 21st -centur y pioneers,” she says. “It’s based on a crofting lifestyle in Scotland where my descendants came from. I was always fascinated how they could eke out a living.”

When the Parkinsons bought their Arapahoe property it was part of a quarry. While her husband built a barn that became a garage and ultimately their home, Mrs Parkinson set to work clearing away rocks in the hope their land could be turned into pasture. “I shifted rocks for three weeks solid. It was hard labour — like being a convict.”

But the hard work paid dividends. They bought a herd of cows that eventually numbered 10, all of them hand milked

Dargaville and Kamo high schools. “People ring up and ask if they can bring groups along. They come and have a ball. The school kids love it.”

She says our urban society means many people have never been on a farm. Recently, she hosted a group from Colorado in the USA. But her cows had been moved to other

pastures. “Members of the group were disappointed they couldn’t see the cows. Some of them had never seen cows.”

Opening her property is sometimes inconvenient. “But it helps us hugely financially. It means we can have a standard of living we couldn’t otherwise afford.”

every day by Mrs Parkinson. But last summer’s drought encouraged them to cut back. “We’ve now got seven head of stock. They’re our meat, our milk and our pets.”

Mrs Parkinson started accepting visitors in 2006, as an offshoot of cheese-making classes she ran at

Independent contract milkersDairy farmers employing contract milkers and having proceeds paid directly to the contract milker through their dairy companies, could find that their contract milkers are employed and bound under the 1937 Sharemilking Agreements Act which was introduced by statute of Parliament.

This lower order Sharemilking Agreements Act allows men and women to be independent contractors without having to own dairy cows to enter into the New Zealand dairy industry. Many over the years have purchased their own farms.

A dairy farmer employing a contract milker as an independent contractor, who receives his remuneration by so much a kilogram of milk solids (this is called a Walsh agreement), could if a dispute arises over the terms of the engagement, come under the jurisdiction of the 1937 Sharemilking Agreements Act and its terms.

There is also the risk of the IRD not accepting that the employees are deemed as independent contractors and have sought PAYE reimbursement payments from farmer employers who have entered such agreements.

There is a big difference between the status of an independent contractor and that of an employee.

The independent contractor must meet the control tests, the independence test, the organisation or integration test, the intention of the parties and the business test or the economic reality test.

This involves whether the independent contractor works for other people or clients, supplies his or her own tools or equipment, has direct responsibility for the profits and risk of the business, hires or fires whoever he or she wishes to help do the job, pays accounts for taxes and government and professional fees and most importantly, advertises and produces a GST invoice directly to the farmer for the work that has been done.

Any dairy farmer engaging an independent contractor to milk the cows or to do work on the farm, should ensure

that payments are made directly to the contractor on the presentation of a GST invoice and the contractor provides a payment receipt.

The intention of the parties is important. This test looks at the intention of each party to the agreement regarding the nature of the relationship. The fact that a written contract states that a person is an employee or an independent contractor, may indicate the intention of the parties but is not determinative. If the actual circumstances point to an employment relationship, then simply labelling it an independent contract will not alter the actuality.

The fundamental test looks at factors such as whether the type of business or the nature of the job justifies or requires using an independent contractor. Is there a time limit for completing a specific project.

Can the worker be dismissed. Who is legally liable if the job goes wrong. Usually, an independent contractor agrees to be responsible for his or her work. He or she cannot usually be ‘dismissed’, although the contract can be terminated if it is broken.

Dairy farmers using contract milkers under the Walsh agreement, do so in an endeavour to circumvent the 1937 Sharemilking Agreements Act, because they feel that under the variable order the cost of labour is too high, particularly under 300 cows or less where a minimum of 22% milk price only, must be payable to the sharemilker.

Walsh agreement payments have ranged from as low as $1 per kilogram of milk solids upwards, and in many cases this is  notsustainable remuneration.

Farmers of New Zealand encourages dairy farmers looking for managerial employees to use the Sharemilking Agreements Order 2011.

It is still the best way to encourage the next generation into farm ownership with the support of the banks and the farmer retains management control and it specifies the relationship and the obligations that must be carried out by the dairy farmer employer and the sharemilker.

Farmers of New Zealand provide free contracts and professional advice to our members.
