additional document in part I online. ii. The Geo referenced digital map of area proposes for CA uploaded Jnline at

column 13 (ii) of Part-II is not correct. Correct DGPS map 0:' Cit may be uploaded giving geo-coordinates at all comer points in shape fle alongwith hard copy of original digital map signed by DFO.

13. State Government through Nodal Officer has submitted complete informati0n on 09.05.20117.

14. During discussion, the User Agency explained the committee about 12.75 ha non forest land which was wrongly mentioned in the instant proposal. The User agency has given an undertaking that they have no private land use in this project and it is a PWD project not private.

15. Mter deliberations, the committee recommended Stage-I approval after submission of following information! documents:

i) Undertaking by the concerned DFO hat diversion of forest land does not belong to irrigation department and owned by the PWD.

ii) Submission of single KML fIle of the proposed project. iii) Change of applicants' category from 'Private to Government'.

The proposal envisages diversion of 6.53 ha forest land in favor of Executive Engineer Central Works Division PWD B&R Abohar for widening of 4-lane from KM 375.800 to KM 382.00 of NH-10 Section Abohar-Fazilka road Passing through Abohar Town under Forest Division Faridkot and Distd:::t Fazilka, Punjab.

2. The proposal involves felling of 739 trees and 1270 plants. 3. Compensatory Mforestation is proposed on 13.060 ha forest land it: Sukhchain

Disty O-defence road R/ s (Lambi Range) district Fazilka and L1uktsar. In addition, 2,540 tall plants (6-10 feet high) shall be planted (2.54 .:J.a) and the user agency will bear the cost of this plantation also.

4. The legal status of the forest land proposed for diversion is Protected Forest. 5. As the project envisages for widening of 4-lane from KM 375.800 to KM 382.00

of NH-10 Section Abohar-Fazilka road passing through Abohar to"m, there is no other alternative possible for the project avoiding forest land.

6. The proposed alignment is not passing through any National Puk, Wildlife Sanctuary, Elephant /Tiger Reserve.

7. The requirement ofland is unavoidable and barest minimum. 8. No violation of Forest (Conservation), Act is there as per DFO's site inspection

report. 9. No rare /endangered/vulnerable and endemic species of flora and fau::la have

been found/ recorded in the area. 10. No sacred grove or very old growth trees/forests exists on the site ar:.d the forest

14. While examining the documents as uploaded on web portal, the committee observed that the Sukhchain Disty O-defence road R/ s (Lambi Range) district Fazilka 3Jld Muktsar has enough space for target plantation i.e. 13.060 ha.

15. After detiberations, the committee recommended Stage-I approval subject to the fcUowing conditions:

(A) i) COSlt of compensatory afforestation as per CA scheme may be realized from the

use::- agency; ii) Cost c:f additional compensatory afforestation as per add!. CA scheme may be

realized from the user agency. "I

iii) Net Present Value (NPV) of the forest land being diverted for non-forestry pUr:?o3e may be realized from the user agency, as per Ministry's directions issUjec. vide letters No. 5-3/2007-FC dated 5th February 2009 and Hon'ble Sup-e:ne Court of India's Order dated 30th October 2002, 28th March, 2008, 24th E.pril, 2008 and 9th May 2008;

iv) The User Agency shall deposit payments only on Ministry of Environment, Forest and Climate Change web portal http/ /forestsc1earance.nic.in OR http/ / efc1earance.nic.in;

v) All th~ funds received from the user agency under the project, except the funds realized for regeneration/demarcation of safety zone, shall be traLsfsrred to Compensatory Afforestation Fund Management and Planning Aubo:ity (CAMPA) in Saving Account pertaining to the State concerned;

(B) The following conditions shall also be complied with after the fmal approval is accorcea:

i) Legal status of the forest land will remain unchanged; ii) Efforts should be made to fell minimum number of trees and in any case,

not more than 739 trees and 1270 plants will be removed. iii) The trees should be felled under strict supervision of the State Forest

L1epartment; iv) The CA will be carried out over 13.060 ha forest land as per the CA

s::;heme and the funds will be provided by the user agency. The r;iantation will be done within one year from the date of issue of this letter. In addition, 2,540 tall plants (6-10 feet high) shall be planted (2.54 hal and the user agency will bear the cost of this plantation also.

v) The forest land will not be used for any other purpose than that mentioned in the proposal;

vi) The forest land proposed to be diverted shall under no circumstances be tFansferred to any other agency, department, or person without approval of the Central Government;

vii) The layout plan of the proposal shall not be changed without the prior approval of the Central Government;

viii) The user agency shall raise strip plantation on both sides and central vsrge of the road at the project cost as per IRC specifications with " maintenance of seven to ten years;

ix) No damage will be done to the adjoining forest land; x) No labour camp shall be established on the forest land;

xi) The user agency shall pay additional amount of NPV as and when increased on the order of Hon'hIe Supreme Court;

xii) The user agency shall carry out muck disposal at pre-designE.ted sites in such a manner so as to avoid its rolling down and should be taken up as per the scheme approved by the Forest Department;

xiii) The required soil conservation measures should be taken up by :he user agency for which fund should be provided as per the current rate of works;

xiv) The User Agency shall provide fIrewood preferably alternate fuels to the labourers and the staff working at the site so as to avoid any c.amage and pressure on the nearby forest areas;

xv) The boundary of the forest land being diverted shall be derr-arcated on ground at the project cost, using four feet high RCC pillars, each pillar inscribed with the serial number, GPS coordinates, fo~,all'"d and backward bearings and distance from pillar to pillar etc.;

xvi) The User Agency shall ensure that because of this project, nc damage is caused to the flora and the wildlife available in the area;

xvii) The user agency will assist the State Government in conservation and preservation of flora and fauna of the area in accordance with the plan prepared by the Chief Wildlife Warden of the State.

xviii) Any other condition that this Regional Office may stipulate, from time to time, in· the interest of conservation, protection and deve~op:nnent of forests & wildlife;

xix) The User agency shall submit the annual self compliance re:port in respect of the above conditions to the State Government ful.d to the concerned Regional OffIce of the Ministry regularly;

xx) It will be the responsibility of the State Government/User A~ncy to obtain all other prior approvals/clearances under all other :elevant Acts/Rules/ Court's Rulings/instructions, etc., including environmental clearance, as applicable to this proposal;

After receipt of the compliance report on fulfl.1ment of the conditions under para-IS (A), above, [mal approval order under Section-2 of the: Forest (Conservation) Act, 1980 shall be given. The use of forest land will not be allowed till final approval is accorded

xv) The boundary of the forest land being diverted shall be demarcated on ground at the project cost, using four feet high RCC pillars, each pillar inscribed with the serial number, GPS coordinates, forward and backward bearings and distance from pillar to pillar etc.;

xvi) The User Agency shall ensure that because of this project, no damage is caused to the flora and the wildlife available in the area;

xvii) The user agency will assist the State Government in conservation and preservation of flora and fauna of the area in accordance with the plan prepared by the Chief Wildlife Warden of the State.

xviii) Any other condition that this Regional Office may stipulate, from time to time, in the interest of conservation, protection and development of forests & wildlife;

xix) The User agency shall submit the annual self compliance report in respect of the above conditions to the State Government and to the concerned Regional Office of the Ministry regularly;

xx) It will be the responsibility of the State Government/User Agency to obtain all other prior approvals/clearances under all other relevant Acts/Rules/ Court's Rulings/instructions, etc., including environmental clearance, as applicable to this proposal;

After receipt of the compliance report on fulfilment of the conditions under para­14(A), above, [mal approval order under Section-2 of the Forest (Conservation) Act, 1980 shall be given. The use of forest land will not be allowed till imal approval is accorded
