    True to form, instead of real izing GSH meansbusiness in this contest , th e Agency, through th eoffice o f th e U. S. Attorney, ha s chosen to re lyupon th e old watergate st ra tegy: stonewalling.Unfortunately for. GSW, th e judge in the case ap

    parently thinks this is just another ho-hum c iv i laction, of more nuisance than of any perceptiblebenefit to the pub li c 's r ight to know. Otherwise,why di d he so glibly dismiss Gersten's.multipage,documented motion in favor o f th e Agency's countermotion that Gersten be restr icted to f i l ing astatelll!nt "ref lecHng what, i f any, withheld documents ar e s t i l l being sought"?

    For the answer to tha t question, we' l l probably have to await th e defendant's (and th e judge 's) response to th e following "Reply to ~ . S.Attorney's? Opposition to File ou t of Time," submitted by-Gersten on June 18 , 1979:

    "The defendant has pursued, during the l a s t30 years, a policy of deception an d dishonesty

    with respect to UFO information. This deceptioncontinues throughout th i s l i t iga t ion . The dishonesty pervades th e Stipulation and Order f i ledSeptember IS , 1978.

    "The Stipulat ion and Order f i led September15 , 1978, is a sham: the perpetration of a fraudupon, the pla in t i ff and the court. Pla in t i ff cannot comply with a fraud. Pla in t i ff is requiredto bring th i s fraud to th e Court's at tent ion.

    -Defendant's aff idavi ts did not deta i l ' a l lmaterials withheld' (see plaintiJ 'rTs 'IIOtion adjUdging defendant and i t s employee in c iv i l contempt of this court ' - a t paragraph 18). Plaint i f f cannot possibly f i le a statement ' ref lect ingvha t , i f any, wi thheld documents ar e s t i l l beingsought ' when the defendant has not complied withth e Stipulation and Order.

    released, through the Freedom of Information Act, 3000 pages ofdocuments on the subject of what is commonly referred tI l as 'uni-dentlf ied flYIng objects' o r UFOs. The Departments of State, Army,Navy, Air Force; the Federal Bureau of Investlgation, the CentralIntellIgence Agency, the National Secunty Agency and the DefenseIntellIgence Agency have all released prevIously claSSIfied docu-ments Involving UFOs, which, inCIdentally, most demed posse-ssing a t one time o r another.

    My client, Citizens Against UFO Secrecy (CAUS), a publicinterest group organized t I l hnng about greater publIc awarenessconcermng UFOs and tins govennent 's polICIes and practlcesregarding them, has reviewed these documen ts . After an In tensi veanalYSIS, CAUS can now report that the documents expose the policyof this government t I l debunk. reports of UFO sIghtlngs by the publicand of thereby succeedIng in minImIZIng theIr sIgmficance.     The government's official pOSItion IS that 1) no UFO reported,investigated, and evaluated by the AIr Force has ever gIven anyindIcatlOn of a threat to our natlonal seC.ln ty; 2) there has been noevidence submitted to o r discovered by the Air Force that sIghtingscategonzed as "unidentified" represent technohgIcal developments o r

    pnnciples beyond the range of present day scientlfic knowledge; and 3)there has been no evidence indIcating that sightmgs categonzed as"umdentlfied" are extraterrest ial vehIcles. (Document C)

    Though the documents contain no evidence concernIng the identltyo r origin of UFOs, there is evidence that some UFOs perform beyondthe range of present day technologIcal development. More Importantly,the documents reveal that some UFOs may pose a threat to our nationalsecunty.

    The documents dIsclose this government's widespread andcontinuing interest in the subject of UFOs contrary to OffICial denials.Th e documents which cover the past thirty-two years, reveal hundredsof UFO sightings around the world by scientists, military personnel, lawenforcement officers and other reliable, responsible and credible people.

    Defense Intelligence Agency documents reveal that on September 19,1976 American made F-4 Iranian jets encountered several UFOs over Iran.During the encounter one F-4 jet, upon approaching a UFO, los t all instrumentation and communication functions. Furthennore, the F-4 ' s weapon controlpanel became inoperable when the pilot attempted to fire at the UFO.(Document M ) The recently released DIA evaluation refers to tlns incidentas "an outstanding report" in that the object was seen by many witnesses;the creChbility of the witnesses was rugh; the visual sightings were confirmedby radar; s imilar electromagnetic effects were reported by three separateaircraft; and physiological effects were reported by some of the crewmembers. Furthermore, the UFOs displayed an "inordinate amount ofmaneuverability". (Document N) Though the documents indicate that follow-

    - up reports on the Incldent were to be forwarded to the DIA, all government

    agencies deny the eXIstence of any further documents.

    Other recently released State Deparonent documents show thatUFOs were reported over Morocco about five hours prior to the Iranianincident. The UFOs were sighted by at leas t one Moroccan official as wellas civilians. Though a CIA document indicates that some government officialpersonally requested an immediate investigation, (Document 0 ) the CIAdenies the existence of any further reports.

    Still another State Department document reveals that dunng November1978, a ser ies of UFO sightings caused the Government of Kuwait to appOIntan investJgato:ry commItte of experts from the Kuwait Institute for SCIentlficResearch. According to the document (Document P) the UFO which f irstappeared over the northern oil fields seemingly dld strange things to theautomatic pumping equipment.     The evidence leaves 1 ittle doubt that UFOs, which have unlimitedand unrestr icted access to our most sensitive nuclear installations andwhich can cause electromagnetic effects that render inoperable theinstrumentation and communication of American made jets o r that shutdown and res ta r t sophisticated pumping e q u i p m e n ~can pose a threat toour national secunty.

    These and other sighting reports, many confirmed by radar(Documents F, G, I, M, Q) o r other tracking devices, describe unconventional aerial objects that exhibit advanced performance characteristicsinvolving maneuverability, speed, size and shape.

    Due to the government's withholding of UFO information.Citizens Against UFO Secrecy has been forced to ask the Federal Courtfor assistance. During the coming week CAUS will be filing two lawsuitsin the United States DistrIct Court for the District of Columbia: 1)a lawsuit against the National Secunty Agency to compel i t to release its -UFO files including the 18 documents i t has acknowledged withholdingand the Cuban incident report i t has refused to either confirm o r deny;and 2) a lawsuit against the Air Force to compel i t to release its reportsof 'unknown tracks'. Furthermore. wi thin thirty days. as pa r t of theGround Saucer Watch lawsuit against the Central Intelligence Agency, I

    will be asking the U. S. District Court in Washington to enjOin the CIAfrom withholding the 57 documents i t refuses to release.
