SATURDAY MAKE-UP: $1.00 premium.

HOLIDAYS: Double the regular rate of pay shall be paid for all work on Sundays and the following

Holidays: New Year's Day, Decoration Day, Fourth of July, Labor Day, Thanksgiving Day and Christmas

Day. If any of the Holidays fall on Sunday, they shall be observed on the Monday following.

OVERTIME: Time and one-half (1 ½) the regular rate of pay shall be paid for all work in excess of eight

(8) hours per day or forty (40) hours per week, whichever is greater, but not both.

Time and one-half (1 ½) shall be paid for all work performed on Saturday, if those employees have not

worked in excess of four (4) working days thirty-two (32) hours during the preceding five calendar days.

The employees have the option of accepting work on Saturday as a make-up day as straight time.

(The Double time rate is listed under Holidays).

NOTE: No overtime work shall be done without the express permission of the Business Representative.

SHIFT WORK: When two shifts are employed, 1st shift shall work (8) hours, the 2nd shall work (7)

hours and thirty minutes for (8) hours pay. When three shifts are employed, the third shift shall work (7)

hours for eight hours pay. The second and third shifts shall, on Friday night, work at straight time rates in

order to complete a full five-day week. (2) ten shifts work - 1st shift will work (9 ½) hours for 10 hours

pay, the 2nd shift will work (9) hours with 10 hours pay. (2) (12) hour shifts are worked, the 1st shift will

work (11 ½) hours with (12) hours pay, the 2nd shift will work (11) hours with (12) hours pay. Under no

circumstances shall an employee work more than one shift in any (24) hour period. On a one shift

operation, if any work must be done exclusively after regular working hours, said workers shall receive

(8) hours pay at the regular scale for (7) hours and (30) minutes shall be at the applicable overtime rate.

SPECIAL PAY: PREMIUM PAY - Any job or project that pays a premium, overtime or a bonus to

recruit men, such bonus, premium or overtime shall continue, to be paid until said job or project is

completed. However, the Union may, at its discretion, waive such pay if the situation warrants.

Ramming and Spading of plastics …. $.50 above regular rate.

Acid or Carbon brick - premium rate for the full day, regardless of the number of hours actually worked

on these materials. Free standings stack work …. $.50 above regular rate.

(From ground level to top of the stack)

Sandblasting, swinging stage and/or scaffold will be at $.50 above regular rate plus bosun chair.

"Hot" work ….. $1.00 above regular rate.

WORK DAY: Eight (8) hours pay for eight (8) hours of work. Regular hours are 7 a.m. to 4:30 p.m. with

a 30 minute lunch break. If job conditions or the cooperation, with other trades warrants same time

worked before 7 a.m., during the noon hour, and after 4:30 p.m. will be at the applicable overtime rate of

pay. If Daylight Saving Time is reinstated in the winter months, the quitting time may be changed to 5:30

p.m. ^

OVERTIME: If job conditions or the cooperation with other trades warrants

same, time worked before 7 a.m. during the noon hour and after 4:30 p.m. will be at one and one-half (1

1/2) times the regular rate of pay, except refractory work, which will be at double time rate. Five days,

Monday through Friday, shall constitute a regular work week.

When and if the normal construction industry trades enact within their contract to allow 4 10-hour days to

comprise a 40-hour week then both parties agree to work out suitable language for this agreement.

SATURDAY MAKE-UP: Saturday will be worked at straight time plus $1.00 premium per hour if a Monday,

Tuesday, Wednesday or a Thursday is lost during the work week due to inclement weather conditions. This shall

apply only to the months of November through April. Working a Saturday make-up day will be at the option of the

employee and the employer. NOTE: The above does not include refractory masons.

PREMIUM PAY: The ramming and spading of plastics and gunniting shall also be paid at the rate of

one dollar ($1.00) above the regular rate. When a man starts on acid or carbon brick he shall be paid the

premium pay for the full day, regardless of the number of hours actually worked on these materials. All

free standing stack work shall be fifty-cents (50¢) per hour above regular scale of wages and ground level

to top of the stack. This will include all brick and masonry cement on industrial and institutional free

standing stacks; also concrete work and exterior masonry from a swinging stage or bosun's chair. Radial

brick, common brick, face brick, and acid brick linings. All sandblasting and the laying of carbon

masonry material in all swinging stage and/or scaffold will be at the rate of fifty cents (50¢) per hour

above the regular scale of wages plus bonus chair.

SHIFT WORK: When two shifts are employed, the first shift shall work eight (8) hours, the second

shift shall work seven (7) hours and thirty (30) minutes for eight hours pay. Where three shifts are

employed, the third shift shall work seven (7) hours for eight hours pay.

The second and third shifts shall on Friday night work at straight time rates in order to complete a full

five-day week. When two(2) ten (10) hour shifts are worked, the first shift will work nine and one-half (9

1/2) hours with ten hours pay, the second shift will work nine (9) hours with ten hours pay. When two

twelve (12) hour shifts are worked, the first shift will work eleven and one-half (11 1/2) hours with twelve

hours pay, the second shift will work eleven (11) hours with twelve hours pay. Under no circumstances

shall an employee work more than one shift in any twenty-four (24) hour period.

WORK DAY: Eight (8) hours pay will be received for eight (8) hours of work. The eight hours will be

worked between 7 a.m. and 4:30 p.m. with a 30-minute lunch break.

OVERTIME; Overtime rates for the first two hours worked before, after, or accumulative of

HOLIDAYS: All work performed on Labor Day, Memorial Day, Fourth of July, Thanksgiving,

Christmas, New Year's Day and Sunday shall be paid at two (2) times the regular rate of pay.

MARKET RECOVERY: No market recovery rate.

OVERTIME: All work performed in excess of eight hours per day on the first

shift or in excess of seven and one-half (7-1/2) hours per day on the second and third shifts shall be paid

at the rate of one and one-half (1-1/2) times the regular rate Monday through Friday All work performed

on Saturday will be paid at one and one-half (1-1/2) times the regular rate.

SHIFT WORK: No shift work will be allowed unless the men employed on second and third shifts

receive the full eight (8) hour pay: half shifts and skeleton crew will not be allowed to complete the job,

but the men on the first or second shift shall finish the remaining work over eight (8) hours at the

overtime rate, if there is not sufficient work for a full second or third shift. When working more than one

shift, those employed on the second and third shift shall be paid the regular rate governing their

employment, provided that the hours do not exceed forty (40) hours in any one week or eight (8) hours in

any one day. Second and third shifts to work seven and one-half (7-1/2) hours for eight (8) hours pay.

SPECIAL CONDITIONS: Men who report on the job as requested and are not put to work shall be

paid two (2) hours' reporting time, unless previously notified not to report for work. If men start to work,

they shall be paid a minimum of four (4) hours and if they work over four (4) hours they shall be paid at

least a day's pay.

SECTION 3: Two dollars ($2.00) per day shall be paid to finishers when applying colorshake. A dust

mask shall be furnished by the Employer per OSHA. (A) Swing scaffolds up to fifty (50) feet, twenty-

five (.25¢) per hour above the Journeyman scale. Swing scaffolds over fifty (50) feet, thirty-five (.35¢)

per hour additional.

TRAVEL : Any mileage rate for Travel Expense and/or compensation will be an item negotiated

between the Employer and Employee. If men are required to stay out of town overnight. The Employer

recognizes the responsibility to pay expenses that will be mutually agreed upon in writing.

WORK DAY: Eight (8) hours shall constitute a day's work. The starting time shall be between 7 a.m.

and 8 a.m. (This pertains to a total Cement Mason crew. If men are called before 7 a.m., time shall start at

the time specified by the contractor for them to report or on the time of arrival if it is later. If the men are

called after 7:30 a.m., the time for starting will be 8 a.m. provided the men get there not later than 10 a.m.

If they report after 10 a.m., their time will start on their arrival.

SHIFT WORK: 1st shift 8 hours work for 8 hours pay. 2nd shift 7-1/2

REPORTING PAY: Employees reporting but not put to work for reasons other than weather or strike

receive 2 hours pay.

GUARANTEED HOURS: Men starting work and requested to remain on the job regardless of weather

receive 4 hours pay, if they work over 4 hours they receive 8 hours pay. Men who leave a job due to

weather without orders from the contractor are paid for actual hours worked.

PAID MEAL - men received 3/4 of 1 hour pay for meal period worked.

GUARANTEED HOURS: If an employee works 4 ½ hours past starting time, he shall receive 8 hours

pay except for adverse weather.

DOUBLE TIME - Sundays and holidays. When work on building alterations or maintenance cannot

be performed during the day hours without interrupting production, such overtime and all work performed

from 4:30 p.m. Friday until 8 a.m. Monday shall be paid at time and one-half rates.

SHIFT WORK:

1st shift 8 hours work for 8 hours pay.

2nd shift 7 ½ hours work for 8 hours pay.

3rd shift 7 hours work or 8 hours pay.

PAID LUNCH -The lunch period shall be one-half (1/2) hour starting at 11 am and completed by 1:30

pm. In the event the job conditions do not allow one-half (1/2) of uninterrupted lunch period the worker

shall receive time and one-half the straight time rate. Employees then shall take their 30-minute lunch

period at the first available opportunity.

TRAVEL PAY: No traveling expenses for employment within Cuyahoga County outside the area costs

will be negotiated between employer and employee.

PARKING: Employer shall pay an amount not to exceed five ($5.00) with RECEIPT, per day per worker

when no free parking is provided within one-fourth (1/4) mile of the jobsite.

WORK DAY: 8 hours, 8 am - 4:30 pm, ½ hour unpaid lunch scheduled midpoint of the work shift. 40

hours with shift work, the work week begins with the 1st shift on Monday and ends with the 3rd shift on

Saturday. Employers may establish an 8-hour work day between the hours of 6 am - 4:30 pm.

4-10's: The Contractor shall have the option of scheduling work on a basis of four (4) ten (10) hours days

Monday through Thursday except Friday can be scheduled as a makeup day, in the event of lost time due

to inclement weather, material shortage or any other conditions beyond the Contractor's control. When

employees are scheduled to work on a four (4) ten (10) hour day schedule time then one and one-half (1

½) shall be paid for all hours over ten (10) in one day. The Contractor must notify the Union no later than

the preceding Friday that a four (4) ten (10) hour work week will be implemented.

SHIFT WORK:: 1st shift, 8 a.m. - 4 p.m.

2nd shift, 4 a.m. - 12 p.m.

3rd shift 12 p.m. - 8 a.m.

All extra shifts, 7 hours work for 8 hours pay, if pay rate is premium then paid only for hours worked. All

shifts include ½ hour meal period, 7 ½ hours work for 9 hours pay. DOUBLE TIME paid for all work in

excess of shift hours, work through meal period. SPECIAL RATES: $35 per hour premium - swing

stage, underground and tunnel work, grinders. $.25 per hour premium - work performed in operating

enterprises after regular work hours. Overtime (1 ½ times) paid after seven (7) hours.

REPORTING/SHOW-UP TIME: Employees reporting but not put to work or unable to work due to

weather receive 2 hours pay. Employees working less than 2 hours receive 2 hours pay, 2-4 hours are paid

for 4 hours; 4-8 hours are paid for 8 hours. If weather causes interruption then 4-6 hours work receives 6

hours pay, 6-8 hours work receives 8 hours pay.

TARGETED JOBS PROGRAM: Parties to contract agreed to meet and negotiate a targeted jobs

program to assist employers in becoming more competitive with non-signatory contractors.

TRAVEL PAY: Lucas, Wood, Hancock, Putnam, Fulton, Henry, Defiance, Paulding and Williams:

Using the Toledo Court House as the starting point, a radius of 40 miles shall be known as a free zone.

40-60 miles = $10.00

61-100 miles = $15.00

Beyond 101 miles = The IRS rate will be paid.

WORK DAY/WEEK: Eight hours, starting time 7:30 (April 1 - September 30) 8 a.m. (October 1 -

March 31) 30 minute lunch after four hours work. Employee may schedule eight hours between 7 a.m. - 5

p.m.^

REPORTING PAY: When ordered out and are not put to work, they shall receive two (2) hours pay, if

they start working, they shall receive four (4) hours pay.

APPRENTICE SCALE

60% for first 500 hours 80% of next 500 hours

65% for next 500 hours 85% of next 500 hours

70% for next 500 hours 90% for next 500 hours

75% for next 500 hours 95% for next 500 hours

HEIGHT PAY: It is agreed that all employers shall adapt by reference and be

bound by the Cement Masons International Agreement for stacks, chimneys and silos and pay the

premium rate applying thereto.

OVERTIME: First 4 hours of overtime paid at time and one-half (1-1/2), after first 4 hours of overtime -

double time. Saturdays: time and one-half (1-1/2) for first 12 hours, over 12 hours - double time. Sundays

and holidays paid at double time.

SPECIAL PAY: Height Pay: It is agreed that all employers shall adopt by reference and be bound by the

Cement Masons International Agreement for stacks, chimneys and silos and pay the premium rate

applying thereto.

WORK DAY/WEEK: 8 hours per day. Hours between 7:30 a.m. to 4:30 p.m., Monday through Friday

with 30 minutes for lunch between 12:00 noon and 12:30 p.m. ^
