June Ludie Article: It is just hard to believe that half of the year is almost over. My advice for you this month is to stay away from the news, it can be just too depressing to listen to. Someone is always doing something to somebody out there and when the media can’t find something to talk about, then they tell us what basic right we are going to lose next month. Have you heard that light bulbs are going to change and we won’t be able to buy the ones we have used forever, but what got me is how much the new ones will cost? Hopefully someone out there creates a cheaper ver-sion or it looks like candles are in my near future. That’s just one more reason you shouldn’t listen to the news very often. Now let’s get on with this month’s story.
Tony Tradwick walked into Diamond Realty & Investments and was greeted by Polly Diamond. He explained that his company was transferring him to another city and he wished to sell his home. Tony stated that the house was custom built, had hardwood floors throughout, and he when on to state that the selling price would include the shutters and draperies that had been custom made for the house. He also stated that he would like to continue to occupy the house for 90 days while he and his wife looked for another home at their new location. He agreed that Polly Diamond could show the house during the time he was out of town without making special appointments for each visit. Accordingly, Polly Diamond advertised the house and showed it to a number of prospective buyers. She obtained a purchase con-tract from Roxy Hightower shortly after her ad appeared in the local homes magazine. Polly advised Roxy that the building specs were not available as Tony could not find them. After negotiations, the property closed 90 days later and the Tradwicks moved out and the Hightowers moved in. On the day that Roxy moved in, when she saw the house for the first time in its unfurnished condition, she quickly ob-served that hardwood flooring existed only on the outer rim of the floor in each room that had been visible beyond the edges of rugs when she inspected the house, and that the areas that had been previously covered by rugs in each room were of subflooring material. She complained that Polly Diamond, the listing broker, had misrepresented the house in her advertisements and in the description included in her listing which had specified “hardwood floors throughout.” Polly pointed out that the house had been fully furnished when it was listed and the seller, Tony Tradwick, had stated that the house had hardwood floors throughout. Mr. Tradwick acknowledged that he had so described the floors, but said the error was inadvertent since he had the house built and lived in it for ten years. He explained that in his discus-sion with the contractor on the house specifications, the contractor had pointed out various methods of reducing con-struction costs, one of which was limiting the use of hardwood flooring to the outer rim of each room’s floor. Since he had planned to use rugs in each room, he had agreed, and after ten years of living in the house with the subflooring covered by rugs, he had “simply forgotten about it.” Polly explained, however, that Tony Tradwick’s description, which she had accepted, had resulted in misrepresentation to the buyer. “But it’s a small point,” said Tony. “She’ll probably use rugs too, so it really doesn’t make any differ-ence.” After further pressure from Polly for some kind of adjustment for Roxy, Tony concluded, “It was an honest mis-take. It’s not important. I’m not going to do anything about it. If Roxy Hightower thinks this is a serious matter, let her sue me.” Polly explained her seller’s attitude to Roxy Hightower, saying that she regretted it very much, but under the circum-stances could do nothing more. It was at this point that Roxy Hightower filed a complaint with the local association. The complaint was reviewed by the Grievance Committee and forwarded to the Hearing Panel of the Professional Standards Committee, during which all of these facts were brought out. I feel sorry for this broker, she took the seller’s word that the hardwood floors were throughout the house and it turned out they weren’t. Too bad we can’t discipline the seller, poor Polly. What do you think the panel should do with this one? The panel found the Respondent, Polly Diamond, had acted in good faith in accepting the seller, Tony Tradwick’s de-scription of the property. While Article 2 prohibits concealment of pertinent facts, exaggeration, and misrepresenta-tion, Polly gave the Complainant, Roxy Hightower, the information given to her by her seller, Tony Tradwick. They went on to state that there were no obvious reasons to suspect that hardwood floors were not present throughout the home, as Tony Tradwick had advised her. The found the Respondent, Polly Diamond, not in violation of Article 2.
