Authority of board in appointing committees, rearranging parking spaces

Q. In our association, the board has appointed themselves to various com-mittees concerning various items of

interest, including the insurance committee, landscaping committee and other commit-tees. The board has full control since they will not allow any owners on any of the com-mittees. What can we do?

A. The board has the authority to appoint directors or any owner to certain committees. The only com-

mittee on which a director may not serve is the grievance/fining committee. However, the board may appoint itself to be on other committees. If the owners are so unhappy with the board’s operation and management of the association, the owners may always recall the board with at least a majority of the owners.

Q. The board recently rearranged all of the parking spaces and also con-verted some guest spots into owner

spots, which means that some owners now have two or three parking spaces. Is the board allowed to do this?

A. In order to give an accurate answer, the association’s governing docu-ments need to be reviewed. Some

association’s governing documents allow the board to rearrange the parking spaces while other documents state that the parking space that was originally assigned to a unit when it was built may not be reassigned. However, the act of giving some owners more parking spaces than other owners most likely would not go well for the as-sociation if action is brought by any of the owners.

Q. Our HOA does not have insurance or a fidelity bond for any of the people who control or disburse funds of the

association. Is that illegal?

A. The purpose of insurance or a fidel-ity bond for any of the people who control or disburse funds of the as-

sociation is if any such persons steal money from the association. Under Florida law, the HOA must have insurance or a fidelity bond for this precise reason, unless a major-ity of owners present at a properly noticed and held owner meeting vote to waive such requirement. A person considered to “control or disburse funds of the association” is con-sidered the president, secretary, treasurer, and any other person authorized to sign checks on behalf of the association.

Which neighbor-hoods/areas are your specialty? Not so much an area but a price point. I routinely represent properties priced above $1 million. I now have an office at 1700 E. Las Olas Blvd., so I will be aggressively pursuing market share on the East side.

Describe your work-ing style: Casual but intense. I’m not wearing flip-flops but I’m not really a suit-and-tie guy either. I always answer my phone, and my clients know I am available 24/7. I don’t stop.

What advice do you have for buyers?

Indecision is your enemy. You don’t need to make hasty decisions but if you like something, act.

What advice do you have for sellers? Hire the best and brightest to list your home for sale. Interview more than one agent. Good agents don’t fear competition. Their clients and track record do all the talking.

how does what you’ve learned about real estate help your clients? Tremendously! It allows them to be themselves. They can be calm, cool, collected or complete basket-cases. It doesn’t matter because they have me. I’ve negoti-ated hundreds of suc-cessful transactions. I am tactfully aggressive, with a no-nonsense approach. They understand that I am in complete control of their real estate affairs. It’s all good.

What’s the hottest listing you have right now? We are about to announce a mixed-use

development offering in Mary Brickell Village. I have an assemblage of smaller homes that are located on what will soon be a completely rede-signed area. The forward thrust of new develop-ment in this rapidly grow-ing area is sure to attract a lot of buyer action from investors, builders and long-term speculators. charitable organi-zations? For years I have devoted time and money to relay For Life, Wounded Warrior project, Fisher House Foundation, Humane Society of Bro-ward County and a host of animal charities/shelters as my family and I are passionate about dogs and horses.  

What’s one thing people would be sur-prised to know about you? For as hardcore as I am in the field or at the office when I am working, I really like to read, write, relax and spend time with my family. I am as engag-

ing as any of the guys you see on TV in an agent capacity. But at home, I’m just dad, hanging with my wife and kids, attending my daughter’s equestrian practices and competi-tions, or playing fetch with one of my three dogs.
