Sacramento, CA - Member organizations of the Partnership for Sustainable Oceans (PSO) including the SCMA, which rep-resents California’s recreational fishing and boating community, have filed a lawsuit in the San Diego County Superior Court seeking to set aside regulations established by the California Fish and Game Commission in connection with the Marine Life Protection Act (MLPA). The com-mission approved regulations for the North Central and South Coast study regions in August 2009 and December 2010, respectively, es-tablishing marine protected areas – essentially no-fishing zones – in large areas of the state’s coastal

waters. The lawsuit, filed by United Anglers of Southern California, Coastside Fishing Club and Robert C. Fletcher, cites a lack of statutory authority for adopting the regula-tions, and, in the case of the South Coast regulations, numerous violations of the California Envi-ronmental Quality Act (CEQA) in the commission’s environmental review of the regulations.

Well, I don’t know where the time goes. Here we are it is March 2011, the season is upon us and things are starting to get busy. Jim Behun, at Sunroad Marina in San Diego, reports attendance was up and people were starting to part with some of their money. The Brokers I spoke with said business was brisk and boats were being sold. That is great news. Financing rates are low and lenders are ac-tive. Now all we have to do is get that information out to our clients. Spread the word!!!

The CYBA Annual Dinner Dance was just completed on February 12th aboard the Queen Mary. We had over 80 people in attendance and the venue was outstanding. Mother Nature pro-vided us with fabulous weather and Guy Newmark, our committee chairman, did great Job. We had a beautiful setting with a view of the water, great food and wonder-ful company. For those who were there, thank you and I hope you had a great time. For those of you who missed it, you really missed a wonderful opportunity to see old friends and meet new ones.

The Merle B. Parks award winner for 2011 was announced at the Dinner. The award was

presented to Nick Friedman for his outstanding contributions to the CYBA. Congratulations Nick.

Moving forward for 2011, we should all look for new ways of building a “better mousetrap”. Expand your marketing to emu-late what other industries are doing to not only survive but flourish in the current econom-ic climate. If you are still doing what worked in 1990 you might want to consider some updates! Look around; there is Facebook, Twitter, e-mail marketing, new web sites for Brokers only like IYC. If you are not moving for-ward you are backing up as there is no status quo any more.

On the legislative front, ev-eryone should be paying close attention to the SB 623 authored by Senator Kehoe concerning copper in marine paint. This is an item that will really impact everyone in our industry. PAY ATTENTION AND GET INVOLVED. Additionally, we are trying to de-velop a relationship with our new Lt. Governor given his position on boating and his obvious under-standing on the amount of jobs that are related to our industry. His and many others hard work

that the commission relies on do not provide the commission with the authority it needs to adopt these MPAs.

• The privately-funded “MLPA Initiative” process has been conducted in a manner inconsistent with the process the state legislature directed in the MLPA, and meetings held by MLPA planning groups that should have been open meetings were closed to the public.

• The South Coast study region regulations were adopted on the basis of an environmental review process that is in violation of CEQA.

“Our concerns were presented to the commission prior to its December 2010 vote to approve regula-tions for the South Coast,” Fletcher further said. “Ig-noring the information before them, the commission went forward with approving regulations to close 116 square miles of southern California’s coastal waters to recreational fishing. Many of the best sportfishing areas are included in the closures. These closures don’t just disappoint the fishermen – they take away jobs and income for many California small businesses along the coast and elsewhere. Particularly concern-ing are the flaws in a regulatory process that has been fueled with private money from special inter-ests. The end result of this process has been a rush by the commission to adopt regulations without the authority it has to have to adopt them, and without a proper review of the environmental consequences of what they’re doing. That should be a concern for all Californians, whether they fish for fun or for a living, or whether they’ve never been fishing at all.”

“Much of the best fishing areas are now closed under the MLPA process,” noted Dan Wolford, Sci-ence Director for the Coastside Fishing Club. “Anglers in the North Central region are now suffering because of excessive, unnecessary closures that we believe were improperly established. We find it extremely concerning that anglers, who are the original con-servationists, are being taken off the water through a seriously flawed process, while the real threats to the health of our ocean, such as contaminated storm-water runoff and industrial pollutants, are allowed to continue unabated.”

The petition is the second lawsuit involving the MLPA by members of the PSO. In May 2010, Fletcher filed suit against the MLPA Blue Ribbon Task Force and Master Plan Team – also known as the Science Advisory Team – for failing to respond to a Public Records Act request, as state agencies are required to do. These groups claimed that they were not required to make their records available to the public on the ground that they are not “state agencies.” Last Octo-ber, a California Superior Court ruled that the Blue Ribbon Task Force and the Science Advisory Team are

indeed state agencies and therefore are compelled by California’s Public Records Act to share information that they were withholding from public view.

“The good intentions of the MLPA have been de-railed by private interests and political motivations,” said Fletcher. “We urge anglers, outdoors enthusiasts and anyone who supports good government and the public’s right to know what its government is doing, to visit www.oceanaccessprotectionfund.org and donate what they can to help us to continue to fight this flawed process in the courts.”

San Diego employment has increased modestly over the past year:

• Professional and business services lead job gains with 4,100 new positions

• Professional, scientific and technical services added 800 jobs over the past 12 months

• San Diego’s unemployment fell to 10.1% in December, down .2% from a year ago

• Tourism should add to the local economy in 2011 as investments in a new cruise ship terminal begin to pay off

Over the past year, four industries have led the jobs recovery in Los Angeles:

• Information added 19,900 jobs with 71% of the gain coming from motion pictures and sound recording

• Leisure and hospitality added 11,200 jobs mostly in accommodation and food service industries

• Education & health services combined added 8,300 positions.

The above-listed organizations are opposed to AB 108 because it would “loan” the General Fund $17 million from the Harbors and Watercraft Revolving Fund (HWRF). The Fund is supported by boaters and, therefore, should only be used for boating purposes. Boating is a critical element in our State’s economy and the HWRF plays an important role in securing the future of boating.

Recreational boating facts:• More than 4 million people participate in recreational boating • Recreation boating added $1.2 billion to Gross State Product (GSP)• $1.6 billion is spent on boats, accessories, and repairs; and $1.4 billion on boating trips,

including meals, groceries and lodging.• Direct impact on 24,200 jobs with labor income of $750 million• 1,600 boating businesses employ 11,100 people

The HWRF is critical to the programs of the Department of Boating and Waterways:• DBW is responsible for statewide public access, safety and education, and consumer and

February 2011 provided us with some real positive outlook regarding increase in activity over the same month in 2010. The super yacht industry saw more yachts sold, new launches and new orders placed. With an increase of about 29% on vessels over 78’ however the other side of the table the values declined by 40% on a year-to-date basis.

I do believe it is evident that the progressive and forward thinking yacht brokers understand that the same business model that was very effective four or five years ago, no longer holds true. The manner in which we present our products and the things we had been saying to our clients then are for the most part now - obsolete.

The destruction that Japan has suffered as we all know will have far reaching consequences, here in California alone it has been estimated that statewide damage from the surge exceeds $40 million dollars. The damage in Santa Cruz Harbor alone stands at an estimated $17 million dollars. With the Department of Boating & Waterways funding in jeopardy where will the funds come from to re-build those damaged marinas? That is why I believe it is so important for all of us to get behind and support those individuals in the political arena that we believe have the yachting industry’s best interest at heart. If you know of anyone that the yachting community should be supporting, please bring it to the attention of your association.

The San Diego Boat Show was from the feed-back that I have received from brokers and dealers, was certainly in-line with what we are hearing from our East Coast parts. The number of attendees at the show was certainly up and I have talked with at least 3 broker/dealers that have now closed transactions directly related to the shows success. One of the dealers credits 7 boat deals afterwards from people they met at the show. I understand that the on-land display did very well also and there was plenty of great food provided by some local vendors – the weather once again cooperated – don’t know how long that rabbit’s foot Jim Behun carries around with him is going to last but I for one am glad he has it.

The section “ALONG THE WATERFRONT” in the newsletter is getting great response so remember this is a great way for your company to get the word out on changes at your office whether it be new personnel, new product-line, or maybe a new or relocation of your office. Class A Motorhome Shipments Increase for 5th Straight MonthStatistical Surveys recently reported that whole-

sale shipments of Class A motorhomes steadily in-creased, showing year-over-year improvement from August to December 2010. Shipments had fallen from 32,900 units in 2007 to 14,900 in 2008, and then bottomed out in 2009 with only 5,700 Class A motorhomes shipped to US dealers. The increase to 12,900 units in 2010 reflects the rise in consumer demand and is continuing into 2011, with January shipments reportedly up 22.2% over January 2010.

Robert W. Baird & Co., market analysts that fol-low the RV industry, reported retail demand rose 20% in the forth quarter of 2010. The Recreational Vehicle Industry Association (RVIA) confirms more Americans were RVing in 2010, as RV parks, camp-grounds, and the National Park Service indicated reservations increased 5% in 2010 from 2009, which was one of the best years for campgrounds as consumers chose to vacation closer to home.

seeing an increase in activity as well. Historically the marine industry has lagged about six months be-hind the RV industry in recovery cycles. If this trend holds true, boat and yacht sales should noticeably improve during the 2011 selling season.

Along The WaterfrontSimpson Yacht Sales Has Expanded:

Chris Simpson and his wife Amy are excited to an-nounce they have just opened their second broker-age office on the Delta, located in Discovery Bay. With more than 3500 homes on deep water with private docks, Discovery Bay is a boating-oriented community that provides a lot of opportunity for an effective brokerage. Chris started in the boat business in the year 2000 selling brokerage boats for a Broker in the Delta. Af-ter a few years, Amy and he decided it was time to give it a try on their own. They bought Antioch Yacht Sales in 2003 and found quick success at that loca-tion. Renaming the brokerage in 2009 to Simpson Yacht Sales proved to help make the transition to a multi-office brokerage much smoother. Then, a few months ago, Chris and Amy were presented with the opportunity to obtain the Discovery Bay office and jumped on it.

To help with the work load, Chris and Amy brought

on a sales person to help out at both locations. The Antioch office continues to provide a lot of opportu-nity for success and, with its covered slips, dedicated trailer-able boat sales yard, and easy access to boating related facilities, will compliment the Discovery Bay location very nicely.

The newest location is right on the Boardwalk at Discovery Bay Yacht Harbor at 5901 Marina Road #6, Discovery Bay, CA 94505.

Is It Déjà’ Vu All Over Again?By: Bill Krauss

New year; new legislative session; new members of the legislature; new governor; same old budget problems, but will we see the same old “smoke and mirrors” to solve our problems?

Last year was interesting, to say the least. The state continued to face a severe budget crisis and eventually responded to it the same way they had in previous years: A little smoke reflected in a foggy mirror and…voila’…a state budget. The boating community was generally untouched by the budget, but faced an intense attack by the State Water Resources Control Board to make marina operators “marina cops” patrolling their marinas for water quality problems. In the end, we were able to ward off challenges in the budget, by the regulators, and attacks in the Legislature.

While we were able to protect ourselves last year, there remains the ever-present concern that the state will look to snatch the boaters’ dollars that fund the Department of Boating and Waterways to help reduce the statewide deficit. As reported in this space on many occasions, our state budget has been held together by bubble gum and bailing wire for many

years now and I continue to be amazed at how we can get through another year without running into the proverbial financial “brick wall.”

Although the problem is the same, we are at a new beginning following the election of a new Governor and several new members of the Legislature. While the political composition of the Legislature remains the same with Democrats firmly in control, the wild card is our new Governor. He campaigned on a promise that he could solve the problems because he was “too old to care” about political allegiances and, therefore, could focus on finding solutions.

The first salvo in his efforts was just recently fired. In early January each governor must release a proposed budget for the next fiscal year. As required, Governor Brown released his plan in which he addresses the current and next fiscal year deficit of approximately $25.4 billion. In broad strokes, he plans to cut $12.5 billion from the budget with reductions to most of the major programs in the state, including but not limited to $1.7 billion to Medi-Cal, $1.5 billion to California’s welfare-to-work program, $1 billion to the University of California and California State University, $750 million to the Department of Developmental

Services, and $580 million to state operations and employee compensation. There is also some borrowing and transfers, which include $1.8 billion in borrowing from special funds, $1.7 billion in property tax shifts, $1.0 billion from Proposition 10 reserve to fund children’s programs, and $0.9 billion from Proposition 63 moneys to fund community mental health services. Although the cuts are severe in many program areas, the Governor has made it a priority to protect education, which will not be cut and is planned to get a modest increase in funding.

Cuts only solve half the problem, however. The other half is covered by extending several temporary recently enacted taxes, including the recent vehicle license fee increase, that are set to expire for another five years to make up the difference.

The linchpin to the budget is his proposal to

realign many state services back to local governments. Since the passage of Proposition 13 much of the decision making and program management has flowed to the state. This has resulted in increased cost and reduced efficiency due to the “arms length” nature of the relationship between the provider and

the recipients.

His plan is to put the burden of decision-making back on the locals, but to also give them the necessary funding and much more flexibility with their resources to generate efficiencies. The theory is that these new efficiencies will lead to reduced costs. A good example of the type of realignment he is talking about is the elimination of all redevelopment agencies, which are funding with local property taxes. In the first year the saving will accrue to the state general fund, but in out years the locals will get that money back with no strings attached, freeing it up to meet other budget demands.

Because of the complexity, the Governor estimates the transition returning control back to the local level will take 5 years to complete. Appropriately, he proposes that the tax extension only be extended for this 5-year period as well. Once the transition is completed, presumably, the increased revenue will not be required due to the increased efficiencies and any shortfall should be made up by the then-growing economy.

If that does not happen, we will be back on the verge of collapse, again.

increases to solve the immediate problem. Much like the last Governor, it is predicated on future action and requires us to place our trust in the Legislature, which is hard to do given their history. It also, in my opinion, has a low chance of success, much like past solutions. Getting the votes to put a tax increase on the ballot is a big “if” and even if it does reach the ballot, it could easily be rejected by the voters.

However, unlike past gimmicks such as moving one state employee payday one day so it falls into the next fiscal year to “save” billions of dollars, this plan appears to be based on real dollars and cents, and that is a move in the right direction.

In terms of our particular interests, if this plan starts to fall apart due to partisan bickering, then the natural instinct of policy makers will be to again look for revenue from other sources. It is in those moments that we become vulnerable, particularly since this budget already calls for some borrowing from special funds, meaning the precedent has been set.

While it remains to be seen if the budget will move in a more positive direction, the legislative process will likely be a very different dynamic. For the last 8 years we have had a divided process, with Democrats controlling the Legislature, but also a Republican Governor who was not afraid to veto their legislation. This created a balance that allowed us to often solve problems given the threat of a possible veto at the end. However, with Democrats controlling both the executive and legislative branches, it could usher in a return to the Gray Davis era when we say very aggressive, progressive legislation. That is good news for some, but is usually bad news for the business community, which thrives in a low tax, minimally regulated environment.

Our efforts to educate key legislators will be even more important than ever so that when we see troubling legislation we will have an opportunity to make our case. This education must happen in Sacramento, but I urge all members to get to know their local legislators. Legislators are usually very approachable and can be found at many local events, and most would probably enjoy a boat ride or tour of your facility. And, remember, as Tip O’Neill, former Speaker of the House of Representatives, once said: “All politics is local.” You never know when that one relationship could make the difference on a critical vote.

The CYBA is sad to report the passing of two of our Past Presidents this winter. We ask that you take a minute to remember these men and to appreciate the contributions each made to the yacht brokerage industry in California.

Joe Spotts, (CYBA President 1997) 67, passed away on January 5, 2011, following a sudden illness. Joe was born in Keyser, West Virginia, and moved to Oakland during WWII. He met Julia Rogers at Castro Valley High, and they were married for 48 years. They raised two daughters, Janeen Zuniga and Jana Spotts, and moved to Brentwood for their retirement years. Joe lived an extraordinary life. He owned and operated Marine Emporium at Bethel Island for 36 years. Joe was active in the Northern California Marine Association as well as the California Yacht Brokers’ Association. He also served on various city, county, and state boards. He was happiest outdoors: boating, skiing, hunting, fishing, hiking, scuba diving, garden-ing, enjoying his cabin at Lake Tahoe, and flying his two airplanes. Joe traveled extensively throughout the world, and reached his dream of bow hunting in South Africa. He was a friend, mentor, competitor, leader, and a gentleman to many of us in the yacht brokerage field. He will be missed. Jim Crutchfield, (CYBA President 1983) passed away recently in Arizona. Jim was a long time San Di-ego yacht broker and dealer, reaching back to the late

1970’s when he was a San Diego Sea Ray dealer. As the owner/broker of Crutchfield Yacht Sales, and later affiliated with United Yacht Sales, Jim was an early supporter and member of the CYBA. Jim had moved to Arizona several years ago for health reasons.

In addition to the passing of our two Past Presi-dents, we are sad to note the passing of two long-time yacht brokers from the Newport Beach area:

Vince Arrigo passed away peacefully On Sun-day February 6th, 2011. He was 81 years old. Vince entered the boating business working at Columbia Yachts, at one time the largest fiberglass boat builder in the U.S. Later, he founded Yacht and Ship Brokers International, and also worked as a broker at The Crow’s Nest and Chuck Hovey Yachts, all in Newport Beach. His wife Carol, two sons Michael and Steven, and five granddaughters survive him.

Michael Pearlman, 65 died recently. Mike was a long-time captain on a number of yachts owned by the Christie family, all named HAPPY DAYS. Mike also ran the old Balboa Marine Shipyard, and worked as a broker for The Crow’s Nest. Always happy to take a minute to sit down and talk, Mike was a true gentle-man and a stalwart figure in the Southern California boating scene.

The CYBA and the California yacht brokerage community send our sincere condolences to the families and friends of these four men.

Annual Dinner A Great SuccessA great time was had by all this year at the CYBA An-nual Dinner aboard the incomparable Queen Mary in Long Beach, Ca. The event planning committee, lead by Guy Newmark, works all year long to ensure that our members have a great experience at this event. This year’s venue was aboard the venerable luxury liner, Queen Mary, recently refurbished and a wonderful setting for the CYBA’s premiere event.

With many attendees staying aboard, and with no shortage of bars and restaurants, as well as tours of the ship, those in attendance were able to have a memorable getaway weekend, without much travel or expense. Holding true to year’s past, many of us were on hand until closing, holding court and dancing to a great live band in the ship’s classic and renowned art deco lounge, The Observation Bar.

DJ music, a scrumptious dinner, open bar, special awards and announcements and, most important.. dancing - all took place in one of the most coveted dining and party areas of the regal ship, the First Class Verandah Grill night club.

The 2011 Board of Directors was also introduced and you can view their info at www.cyba.info. In addition, members got the opportunity to mingle and reconnect with fellow leaders in the California Boating Industry.

Congratulations go out to Nick Friedman who re-ceived the Merle P. Parke Award which celebrates individuals who provide outstanding service to the yachting community. No mention of the evening would be complete without a very special thank you to all our sponsors for the evening,

Social committee is already working on the 2012 lo-cation and entertainment. For members who attend, it is great opportunity to rekindle old friendships, make new ones, and to socialize with your peers.

The committee is finalizing the final details and should have the updates ready to send out next week.

ETHICS AND BYLAWS COMMITTEE: Dean West Dean West gave a brief review:The committee’s goal will be to review and update the CYBA Bylaws this year. They will send out a notice soliciting input from members. Some of the topics that may be addressed: review reinstatement fees – are the amounts current for 2011?, update bylaws to say only 1 endorsement signature is needed for a new member application. The committee will begin the process in detail in March.

INTERNET AND MEDIA COMMITTEE: Jack Buckley, Laurie MorrisonJack Buckley gave a brief review:The committee has a lot of items ready to go. Jack will follow up with Laurie Morrison to get a list to Bob Gorman so that we can get a quote from Doris as to what it will cost to make the changes. The committee is also going to arrange that 1 or 2 members are trained and have access to make minor changes/updates ourselves such as proposed members, etc.

CPYB/CAC: Lon Bubeck, Nick Freidman, and Dick AngelNick Friedman gave a brief review:There is a concern as to a recent transaction that involved a current CYBA Board Member and their dealings with a Broker in Florida, who is also a member of the FYBA and a CPYB. More information from our member will be forwarded to President, Tom Trainor and CPYB Chairman, Lon Bubeck. And after review, they will contact the FYBA and the CPYB for assistance with this matter. It was discussed that the original purpose of all of the mentioned Associations working together was so that we would not run in to the type of problems that our member has ran in to. An update regarding the outcome of these discussions will be reported at a later meeting.

LEGAL SEMINAR: Wayne Rodgers, Tom RussellBob Gorman gave a brief review:Legal Seminar is scheduled for June 15, 2011 at the Southwestern Yacht Club in San Diego. Jim Johnson will check with the yacht club to see if the can accommodate us for the Board Meeting the evening of June 14th. He will report back.
