    THE PRIVILEGE HOUR

    With leave of the House, on motion of Rep.

    Abaya, the Chair declared a Privilege Hour and

    thereafter recognized Rep. Roy V. Seeres Sr. from

    OFW Party-List for his privilege speech.

    PRIVILEGE SPEECH OF REP. SEERES

    Rep. Seeres initially congratulated his fellow

    Mindanaoan, Deputy Speaker Balindong for his

    election as Deputy Speaker from Mindanao. He then

    delivered a speech to rebut the allegation that

    Congress is the epicenter of massive graft and

    corruption in the country by raising the followingpoints, among others: 1) the World Bank estimates

    that about 30 percent or about P500 billion of the

    annual budget goes to graft and corruption; and 2)

    the budget for Priority Development Assistance Fund

    (PDAF), if truly being wasted to massive graft and

    corruption, comprises just a miniscule three percent

    of the amount being announced by the World Bank.

    He added that the Office of the Ombudsman and

    the Commission on Audit should have responded to

    the allegation of the international agency by asking

    them the specific bases of its estimate. He thereaftercommended the neophyte Members of the House for

    initiating efforts to stop graft and corruption,

    particularly for opposing the PDAF and heeding

    public opinion.

    On motion of Rep. Gullas, the Chair recognized

    Deputy Speaker Carlos M. Padilla

    INTERPELLATION OF REP. PADILLA

    After commending the anti-corruption efforts ofthe neophyte solons, Rep. Padilla mentioned that the

    House leadership under the Speaker and himself

    included, had also endorsed the decision of the

    President to abolish the PDAF. He then used the

    more conservative estimate of the Philippine Anti-

    Graft Commission that only 20 percent of the

    national budget is lost to graft and corruption every

    year, to illustrate that the PDAF constitutes a measly

    1.4 percent of the 2013 national budget.

    Reps. Padilla and Seeres agreed on the need to

    institute reforms in public spending and to prosecute

    and convict corrupt officials in all branches of

    government. The former however pointed out that

    there may also be more anomalies made by other

    government agencies which are worthy of greater

    attention than the public scrutiny of the lawmakers

    PDAF.

    On motion of Rep. Gullas, there being noobjection, the Body referred Rep. Seeres privilege

    MANIFESTATION OF REP. LOONG

    Recognized by the Chair on motion of Rep. Gul-

    las, Rep. Tupay T. Loong manifested, for incorpora-

    tion into the privilege speech that he delivered the

    previous day, that the unimplemented provisions of

    Republic Act (RA) 9054 or the Organic Act for the

    Autonomous Region in Muslim Mindanao (ARMM)

    have caused the Moro National Liberation Front to

    believe that it is being ignored by the national gov-

    ernment thus causing the group to continue its strug-

    gle.

    He cited in particular the failure by the govern-

    ment to implement certain provisions of RA 9054 in

    compliance with the 1996 Final Peace Agreement

    including, among others, the ARMM representation

    in central government or national government de-

    partments and offices by election or appointment;

    membership in the Executive department, constitu-

    tional bodies, National Security Council, and gov-

    ernment corporations; appointment of qualified

    ARMM jurists in the Judiciary and to the Judicial

    and Bar Council; creation of the Office of the DeputyCourt Administrator for the ARMM; and the provi-

    sions promoting fiscal autonomy in the region.

    PRIVILEGE SPEECH OF REP. PADILLA

    Rep. Padilla spoke about the mining operations

    in the Province of Nueva Vizcaya and the human

    rights violations besetting the same. Discussing the

    issue within the context of the Ruggie framework on

    business and human rights, he revealed the humanrights violations being committed by Oceana Gold,

    Royalco Resources Ltd. and FCF mining companies

    to the indigenous peoples (IPs) of Nueva Vizcaya,

    and the firms nonpayment of proper excise taxes.

    He then recommended: 1) the immediate

    deportation of Oceana Golds general manager for

    acts proved to be inimical to the people of Didipio

    and for the punishment of the security guards

    involved therein; 2) the strict implementation of

    Section 59 of the Indigenous Peoples Rights Act

    (IPRA), pending the enactment of a new law and thecompliance by mining companies with the

    requirements of free and prior informed consent

    before any mining operation is allowed; 3) the

    Presidents adoption of the recommendation of the

    Commission on Human Rights to terminate Oceana

    Golds financial or technical assistance agreement

    (FTAA); 4) the Bureau of Internal Revenues

    investigation of Oceana Gold for violations of the

    Internal Revenue Code; 5) the immediate

    cancellation of the 10-year exploration permit of

    Royalco Resources Ltd.; and 6) the immediate

    implementation of the provisions of Executive Order

    No. 79 on responsible mining.

    REFERRAL OF REP. PADILLAS

    PRIVILEGE SPEECH

    On motion of Rep. Abaya, there being no

    objection, the Body referred Rep. Padillas privilege

    speech to the appropriate Committee.

    PRIVILEGE SPEECH OF REP. ROMARATE

    On motion of Rep. Gerald Anthony V. Gullas Jr.,

    the Chair recognized Rep. Guillermo A. Romarate Jr.

    from the Second District of Surigao del Norte who

    spoke about a standoff between a group of Manobo

    tribesmen demanding mining royalty payments from

    ADNAMA Mining Resources Inc. for their mining

    activities in certain areas of Claver, Surigao del Norte

    which they claimed are part of their ancestral

    domain.

    He thereafter called on the Committee on

    National Cultural Communities to immediately

    conduct an investigation in aid of legislation into the

    matter to establish if the royalty demands and the

    claimants are legitimate, and if the apparent

    intervention of certain local government officials by

    encouraging false claims and acts of extortion, are

    within the purview of the law.

    The Chair then recognized Rep. Bag-ao for herinterpellation.

    INTERPELLATION OF REP. BAG-AO

    Rep. Bag-ao inquired into the status of the inves-

    tigation conducted by the previous Congress regard-

    ing the claim of the Manobos on the revenues from

    the mining operations of the ADNAMA Mining Re-

    sources, Inc., in Surigao del Norte. She expressed her

    support to the call of Rep. Romarate for another con-

    gressional investigation by the Committee on Na-

    tional Cultural Communities on the particular con-cern which she pointed out has been brought before

    the local government of Dinagat Islands. She said

    that it is likewise the concern of other indigenous

    communities in the Caraga region.

    PRIVILEGE SPEECH OF REP. ATIENZA

    Rep. Atienza adverted to the issue of yesterdays

    flooding in Metro Manila to call attention to a

    perennial concern and the absence of governments

    response during a time of calamity. He claimed that

    the heavy flooding had brought the government again

    to a nonreactive state and called to task the traffic

    enforcers from the Metro Manila Development

    Authority (MMDA) for their absence in the streets ofthe metropolis to provide solutions to the ensuing

    chaos and traffic congestion. Considering the adverse

    effects of instant flooding, traffic congestion, and

    peace and order problems in the metropolis, he

    argued for the creation of the position of a Metro

    Manila governor and the creation of a Metro Manila

    government that will address the aforecited perennial

    concerns, including the lack of public accountability

    of government officials to the residents of Metro

    Manila.

    Rep. Atienza informed the Body that he will file

    the requisite measure that will address the concerns

    of Metro Manila residents. He also expressed the

    hope that President Benigno S. Aquino III would take

    action on these concerns.

    Upon resumption of session, on motion of Rep.

    Abaya, the Chair recognized Rep. Edgar R. Erice for

    his interpellation.

    INTERPELLATION OF REP. ERICE

    Rep. Erice stated that being a former employeeof the defunct Metro Manila Commission, he had

    already witnessed the perennial problems of Metro

    Manila. He however admitted to being aware of the

    sacrifices that the present MMDA chair is doing to

    come up with a solution to the gargantuan problems

    that the MMDA is facing. He averred that with so

    much responsibility, the MMDA is lacking in

    authority and resources and instead of being

    criticized, the agency should be given the proper

    funding and authority to be able to fulfill its

    responsibilities.

    REFERRAL OF REP. ATIENZAS

    PRIVILEGE SPEECH

    On motion of Rep. Banal, there being no

    objection, the Body referred the privilege speech of

    Rep. Atienza and the interpellation thereon to the

    PRIVILEGE SPEECH OF REP. UMALI (R.)

    Rep. Umali delved into a truthful assessment of

    how far the promised reforms of the Electric Power

    Industry Reform Act (EPIRA) of 2001 have gone and

    how much benefits and returns have been realized

    from investments in the reformed and restructured

    power industry.

    At this juncture, Deputy Speaker Balindong

    relinquished the Chair to Rep. Banal.

    He stated that when the EPIRA was passed in

    the 11th Congress, it was widely taunted as the

    solution to the chronic shortages in power supply and

    the answer to the unstable and high power rates.

    Unfortunately, he lamented that the objectives of the

    EPIRA have not been attained as the power

    landscape is littered with rulings, orders, decisions

    and administrative issuances of the Energy

    Regulatory Commission (ERC) that would fall short

    of the promise to protect and promote consumer

    interest. Furthermore, he added that there are sectors

    in the power industry that are undergoing unbundling

    and restructuring of their generation, transmission,

    distribution and supply systems resulting to power

    rate increases and frequent brownouts in Mindoro

    and Mindanao.

    With the EPIRA falling short of its promise for a

    stable and reliable power supply at a reasonable

    price, Rep. Umali urged his colleagues to revisit and

    immediately review the EPIRA as Congress has to

    enact policies that would genuinely address theconcerns of the energy sector.

    huge debt of the power industry; 2) entice the private

    sector to join in the business of power generation;

    and 3) enable the Department of Energy to perform

    its task of managing power plants and providing

    proper business environment in the power sector. He

    thereafter expressed his support to the proposal of

    reviewing and amending the EPIRA.

    INTERPELLATION OF REP. ATIENZA

    Recognized by the Chair, Rep. Atienzas queries

    focused on the increasing rate of electricity in the

    country as compared to other nations, given the fact

    that the Malampaya Fund is adequate enough to

    subsidize power cost or develop energy resources.

    He thereafter expressed hope that said fund would be

    properly used even by the next administration to

    address the countrys power requirements, andsuggested a study on the use of coal-powered plants

    to lower the cost of electricity.

    The Chair thereafter recognized Rep. Terry L.

    Ridon for his interpellation.

    INTERPELLATION OF REP. RIDON

    Rep. Ridon discussed with Rep. Umali (R.)

    certain issues regarding the need for a comprehensive

    review of the EPIRA to attain the laws objective of

    generating lower and reasonable power rates which

    they agreed would result in the protection and benefit

    of power consumers and industries and make the

    economy more globally competitive. They also

    tackled the benefits that would redound to the public

    with the broadening of the ownership base of power-

    generation companies, the fair and non-

    discriminatory treatment of public and private sector

    entities in the process of restructuring the power

    industry and the creation of an independent

    regulatory body.

    INTERPELLATION OF REP. BIAZON

    Recognized by the Chair, Rep. Rodolfo G.

    Biazons questions focused on two major issues

    which are the concerns of the resolutions that he had

    filed before the House: 1) the urgency of reviewing

    the EPIRA; and 2) the exploration of other energy

    sources, specifically coal which is being hampered

    by concerns on climate change, the prior consent of

    the affected communities, and food security. Rep.

    Umali (R.) assured his colleague that the Committeeon Energy which he heads will prioritize the review

    of the EPIRA and that Rep. Biazons second concern

    will be given preference in the agenda of the

    Committees next hearings.

    not an oil-producing country. They also talked about

    the issue of the location abroad of the headquarters of

    foreign oil explorers doing business in the country.
