1.1 SUMMARY OF CURRENT MONTH’S PROGRESS:

Total Length of Project is 83.3 Km. from 108.700 to 192.000 with total project cost of 1450

cr. (TPC). Appointed date was 08th January, 2007 and the project was completed on 31st May,

2009 and provisional completion certificate issued by IE on 02nd June, 2009. Now the project is in

operation and maintenance stage.

Current Issues and recommended actions by IE:

Recommendation of PD/IE and as per delegation of powers vide Policy Circular No. 144/2014 and

159/2015, the approval of competent Authority is hereby accorded for installation of Weigh in

Motion (WIM) & Static Weigh Bridge (SWB) for NH-8, BOT-1 under Change of Scope amounting to

Rs. 224,23,123/- vide NHAI,RO Gandhinagar Letter No. NHAI/12015/1/2010-RO-

GNR/Tech/Surat(E)/V-B/Vol 43/F-248 dated 21.04.2016. As per Clause 17.2 (C) NHAI Issued written

confirmation vide as mentioned the above Letter No & thereupon the concessionaire shall proceed

with performance of such order and submit the time for the completion of such order which is not at

all submitted by the concessionaire. Now construction of SWB is under progress but construction of

WIM under progress. Vide Authority Letter No. NHAI/PIU-Bharuch/10-E/2017/567 dated 02.05.2017

Authority requested Concessionaire to submit micro Programme to take up the WIM & SWB Work

immediately to IE which is issued to concessionaire by Authority in response of IE Letter no.

CDM/CEI/SO/1415039/937 dated 12.04.2017.

As per Approved annual Maintenance Programme for the year April 2016 to March 2017 the

frequency of inspection defined for the items has to be inspected by the Concessionaire and regular

reports on the same shall be sent to IE with proposed maintenance, repairs and rehabilitation work

found necessary as a result of such inspection as per clause 7.1 of Schedule – L of Concession

Agreement vide IE Letter No. CDM/CEI/SO/1415039/534 dated 11.05.2016(For the month of April-

2016), CDM/CEI/SO/1415039/565 dated 04.06.2016 (For the month of May-2016) &

CDM/CEI/SO/1415039/605 dated 05.07.2016 (For the month of June-2016) for which no action taken

by the concessionaire till date.

There are so many unauthorized access along the highway from Km 108+700 to 192+000 both LHS

and RHS and intimated to take immediate action for removal the unauthorized access. List of

Encroachment in the Project Highway With Video graphs reported to Authority vide Letter No.

CDM/CEI/SO/1415039/531 dated 09.05.2016. Further, IE notified concessionaire new unauthorized

access in progress Vide IE letter no. CDM/CEI/SO/1415039/841 & 854 dated 02.02.2017 &

07.02.2017 respectively and instructed to remove the said unauthorized access on the project

highway and requested to submit the compliance report.

The ECB & CCTV shall be repaired/replaced where ever they are not working and as per authority

instruction vide letter no. NHAI/PIU-Bharuch/10-E/2016/378 dated 03.06.2016 stated that please

explore some other replacement of ECB or find out some circular issued by NHAI. Vide

concessionaire letter no. VBTL/O&M/5062 dated 19.11.2016 concessionaire submitted the proposal

for Migration to Toll Free Emergency Number for management of Rescue Accident Victims in place of

obsolete Emergency Call Box Technology to authority for which authority requested IE to go through

the Concessionaire’s proposal and provide the recommendations/comments on the same vide

authority letter no. NHAI/PIU-Bharuch/10-E/1105 dated 01.12.2016 accordingly IE reviewed the

proposal and recommended to authority vide IE letter no. CDM/CEI/So/1415039/804 dated

06.01.2017. Now, Authority requested IE to submit their clarification on the financial implication

(positive/negative) for the proposed replacement vide authority letter no. NHAI/PIU-Bharuch/10-

E/2017/104 dated 20.01.2017 for which vide IE letter no. CDM/CEI/SO/1415039/858 dated

07.02.2017 IE requested the concessionaire to submit the financial implication for replacement of

ECB technology with Toll Free Emergency number based on GSM networks, including its

maintenance, for IE’s review and onward submission to the Authority for which Concessionaire

submitted the compliance report Vid eVBTL/IE/2017/45Z/113 dated 24.04.2017 for IE’s review

accordingly IE reviewed the Concessionaire Submission and raised some observations over the

concessionaire submission and request the Concessionaire to address the observations/comments

of the IE and resubmit the proposal for IE’s review Vide IE Letter No. CDM/CEI/SO/1415039/958

dated 29.04.2017. Till the approval for the replacement of ECB technology obtained from the

authority, concessionaire obligated to maintain the ECB as in working condition otherwise action will

be taken as per concession agreement.

For preparation of Planting Activities in Row & Median during forthcoming monsoon

concessionaire has to procure avenue plants, median plants & manures as per IE & Concessionaire

Horticulture Expert Direction & Tree Guards has to be ready before start of planting activities as per

IRC-SP-21-1979.

Land Scaping areas Below Flyovers Shall be maintained as per Schedule-L of Concession

Agreement and IRC-SP-21-1979.

Non functioning of ATCC at km. 134+100 & 175+000 regarding that IE issued cure period notice to

concessionaire vide letter no. CDM/CEI/SO/1415039/636 dated 30.07.2016 as stated in the clause

18.12 of concession agreement.

IE Safety Expert submitted the remedial measures for the black spot observed on the analysis of

accident data vide IE letter no. CDM/CEI/SO/1415039/642 dated 03.08.2016. The Concessionaire

may be directed to immediately attend to these Black Spot locations to comply with the

specifications and Standards of Concession Agreement by doing the rectification recommended by

the Independent Engineer and requested to submit the Compliance Report.

Concessionaire requested to start the pre-monsoon activities like silt removing at pipe culvert, box

culvert, slab culvert, minor bridges and water way clearance of major bridges, unlined longitudinal

drain silt removing, median chute drain damaged and blocked has to be rectified, high

embankment if any settlement or scouring observed has to be rectified immediately and requested

to submit the weekly progress report for IE’s review and onward submission to authority. But, till

today Concessionaire not submitted the weekly progress report as requested by IE.

Status of Change of Scope Proposal:

Concessionaire has submitted 4 nos. Change of scope proposal. Status of change of scope proposal as

listed below briefly.

1. Erection of 1033 sign boards as part of implementation of cashless treatment for accident

victims-

NHAI has issued change of scope order for erection of “167 nos of 1033’signboards vide letter no-

NHAI/PIU-BHARUCH/10-E/2016/572 Dated 25.07.2016 with enclosed Ro-Gandhinagar Letter no.

NHAI/12015/1/2010-RO-GNR/Tech./Vado/Vol.45/F-289 dated 21.07.2016 & NHAI/12011/2/BOT-

1/COS/2013/85871 dated 19.07.2016. Further, PD Bharuch Requested to concessionaire to submit

the details of concessionaire’s Bank account to this PIU at the earliest to issue the cheque of amount

Rs. 19,53,178/- against COS for 1033 Signboards. Further PD instructed IE to submit the certification

in the measurement book for the payment of Rs. 19,53,178/- at the earliest vide PIU-Bharuch Letter

no. NHAI/PIU-Bharuch/10-E/2016/708 dated 27.08.2016. Accordingly, IE Submitted the Certified

measurement book and abstract book to authority vide IE’s Letter no. CDM/CEI/SO/1415039/688

dated 30.09.2016 and payment also released to concessionaire which was conformed by the

authority letter no. NHAI/PIU-Bharuch/10-E/2016/1044 dated 21.11.2016.

2. Construction of additional service road at vemali-

NHAI has issued change of scope notice for construction of additional service road for 500m length

vide letter no. NHAI/12015/1/2010-RO-GNR/TECH/VADO/277 Dated 21/05/2013 and concessionaire

has completed construction of additional service road for 500m length and submitted estimated cost

vide their letter no. L&TVBTL/O&M/3934 Dated 09/03/2015.The submission was reviewed by

previous IE and recommended to NHAI for issuance of change of scope order letter no.

SMEC/Vadodara/NHAI/737 Dated 04/02/2015.The issue of change of order is pending from NHAI. As

per CGM meeting on 13/04/2015 L&TVBTL resubmitted vide L&TVBTL/O&M//4010 Dated

30/04/2015 and present IE return COS estimate to attend necessary corrections immediately during

review meeting of CGM office on 05/05/2015 vide letter no. CDM/CEI/SO/1415039/055 Dated

06/05/2015. Concessionaire resubmitted the COS proposal vide letter no.

L&TVBTL/O&M/4115;dated 13/06/2015, and reviewed by IE and recommended to the authority vide

IE’S letter no. CDM/CEI/SO/1415039/128;dated 22/06/2015. Vide PIU Bharuch Letter no. NHAI/PIU-

Bharuch/10-E/2016/708 dated 27.08.2016 PD instructed the Concessionaire please refer

observation made by General Manager (Gujarat) Communicated vide letter no. NHAI/12011/2/BOT-

1/COS/2013/73695 dated 28.10.2015 and stated that in point no (iii) – “An arrangement for

Construction, Operation & Maintenance of common area has been proposed for which a Tripartite

Agreement to be signed by Concessionaire of Vadodara Bharuch section and Concessionaire of

Ahmadabad Vadodara section is drafted. The consent of both the Concessionaire i.e. M/S IRB and

M/S L&T for entering in to Tripartite Agreement is required”. For which Concessionaire till not

entered in to the Tripartite Agreement. Hence Concessionaire instructed to sign the Tripartite

Agreement and submit the signed original copy to this PIU for onward submission of Compliance

report. For which vide VBTL/O&M/T:A/2016/001; dated 12.09.2016 Concessionaire submitted the

signed copy of Tripartite Agreement to Project Director. Vide PIU-Bharuch, PD letter no. NHAI/PIU-

Bharuch/10-E/2016/838; dated 24.09.2016, Authority requested IE, Please Convey your opinion

regarding considering this tripartite Agreement accordingly IE verified the signed Tripartite

Agreement with draft Tripartite agreement submitted to CGM-RO-Gandhinagar vide NHAI/PIU-Surat

(Expressway)/10-E/2015/5284; dated 19.10.2015 and submitted IE comments to PD Bharuch vide IE

letter no. CDM/CEI/SO/1415039/745; dated 05.11.2016 and requested, Authority may instruct the

Concessionaire to resubmit the Tripartite Agreement as same like as draft Tripartite Agreement, duly

signed by the Authorized representative of Concessionaire (L&T VBTL) for onward submission to

NHAI-RO-Gandhinagar. Now, vide VBTL/O&M/5058; dated 17.11.2016, Concessionaire resubmitted

signed Tripartite Agreement to IE and while reviewing the signed Tripartite Agreement IE found that

sr. No. (e) left as Blank and subsequently made discussion with cluster head of L&T VBTL on

24.12.2016 at site accordingly IE returned the original Tripartite Agreement through courier dated

26.12.2016 for necessary correction as discussed with L&T VBTL – cluster head on 24.12.2016. but,

till now, Concessionaire not submitted the signed Tripartite Agreement.

3. Installation of WIM & SWB Under Change of Scope.

4. Provision of Public Toilet Blocks at Toll Plazas to implement Swatch Bharat Mission of Government of India. PD Communicated IE, vide letter no NHAI/PIU-Bharuch/10-E/2016/633 ;dated 05.08.2016,with

enclosure of RO Gujarat letter no. NHAI/14011/1/2011-RO-GNR/Misc./Vol24/F-639; dated

25.07.2016 And instructed submit the estimate as per NH SOR for the Construction of Toilet Blocks

and allied services like provision of water supply, Provision of Electricity supply etc.

Accordingly IE instructed the Concessionaire vide letter no. CDM/CEI/1415039/652 To submit COS

proposals with drawing and estimate with current SOR for construction of Toilets, Parking, display

sign board depicting Swatch Bharat Mission. Further PIU Bharuch Letter no. NHAI/PIU-Bharuch/10-

E/2016/668 dated 12.08.2016 forwarded General guidelines with Tentative drawing for toilets for

further suitable necessary action for which concessionaire submitted the cost estimate vide

concessionaire letter no. VBTL/O&M/4946 dated 23.09.2016 accordingly IE reviewed the proposal

and recommended to authority to issue change of scope notice for the amount of 29,74,307/- + all

statutory taxes as applicable vide IE letter no. CDM/CEI/SO/1415039/687 dated 29.09.2016. Further,

during CGM visit on 30.09.2016 CGM instructed Concessionaire to make some correction in the

Layout plan of Toilet for which concessionaire submitted the revised Layout plan of toilet and revised

cost estimate for IE review vide letter no. VBTL/O&M/5079 dated 26.11.2016 accordingly IE reviewed

the proposal and recommended to authority for the amount of Rs. 30,93,979.62/- vide IE’s letter no.

CDM/CEI/SO/1415039/768 dated 02.12.2016 and concessionaire already started the construction of

toilet block on LHS and RHS as per the submitted Layout plan. Now, Vide Authority Letter No.

NHAI/PIU-Bharuch/10-E/2017/115 dated 24.01.2017, A change of scope order is also hereby issued

in pursuant to close 17.3 of Article XVII of the Concession Agreement for the construction of 02 nos.

Public Toilet blocks at Bharthana toll plaza for the amount of Rs. 29,18,282.70/-.

1.3 Project Overview

National Highways Development Programme (NHDP) is the first and foremost task mandated to

NHAI. It comprises of widening and strengthening of National Highway stretches connecting four

metros namely Delhi, Kolkata, Chennai and Mumbai (Golden Quadrilateral), the North South and East

West corridor development project. The project Independent Engineer Services for Six lanning of

Vadodara – Bharuch Section (Km 108+700 – Km 192+000) of NH-8 during operation and maintenance

period is part of NHDP Phase-V and comes in the State of Gujarat.

L&T Vadodara – Bharuch Tollway Limited is the Concessionaire for this Project. CDM Smith India Pvt.

Ltd. has been awarded for the Independent Engineer Services during Operation & Maintenance stage

for the same.

12.08.2016 forwarded General guidelines with Tentative drawing for toilets for further suitable necessary action for which concessionaire submitted the cost estimate vide concessionaire letter no. VBTL/O&M/4946 dated 23.09.2016 accordingly IE reviewed the proposal and recommended to authority to issue change of scope notice for the amount of 29,74,307/- + all statutory taxes as applicable vide IE letter no. CDM/CEI/SO/1415039/687 dated 29.09.2016. Further, during CGM visit on 30.09.2016 CGM instructed Concessionaire to make some correction in the Layout plan of Toilet for which concessionaire submitted the revised Layout plan of toilet and revised cost estimate for IE review vide letter no. VBTL/O&M/5079 dated 26.11.2016 accordingly IE reviewed the proposal and recommended to authority for the amount of Rs. 30,93,979.62/- vide IE’s letter no. 1.10 Monitoring of Operations & Maintenance Obligations:

1.10.1 Maintenance Status during Construction Phase: Not Applicable as the project was already completed and obtained completion certificate now the project

is in operation & Maintenance stage.

1.10.2 Maintenance Status during Operation & Maintenance Phase (If Applicable): As per Concession Agreement Schedule L Clause 4.4.2.1 – During Operations Period all the road works and pavements contained in the Project Facilities (including those in the ancillary facilities) shall be maintained in traffic-worthy condition as per the intervention levels 1 & 2 as provided in the Table L-2 through the various maintenance activities.

Accordingly, As described in Table L-2 concessionaire obligated to maintain the project highway.

1. Concessionaire completed the BBD test and submitted the report vide concessionaire letter no. L&T

VBTL/O&M/4531 dated 18.02.2016 to IE, accordingly IE reviewed the report and raised the observation as per

IRC-81-1997 and instructed the concessionaire to resubmit vide IE letter no. CDM/CEI/SO/1415039/483 dated

26.03.2016. But, concessionaire till not submitted the BBD Test Report. Further, As per approved maintenance

programme for the year April -2016 to March-2017 BBD test has to be completed on or before October-2016

which is not at all complied by the concessionaire. For which IE Instructed the concessionaire vide letter no.

CDM/CEI/SO/1415039/752 & 808 dated 16.11.2016 & 09.01.2017 respectively and reported to authority vide

letter no. CDM/CEI/SO/1415039/773 dated 06.12.2016. Now, Concessionaire commenced the BBD test on

22.03.2017 and completed on 06.04.2017 (Conduction of BBD Test delayed 141 days as per approved annual

maintenance programme for the year April 2016 to March 2017). Soil sampling to obtain the OMC for every

Km has to be taken along with IE.

2. Concessionaire completed the Road Roughness test and submitted the report vide concessionaire letter no.

L&T VBTL/O&M/4852 dated 27.07.2016 to IE, accordingly IE reviewed the report and requested the

concessionaire to clarify the following observations noted by IE in the report vide IE letter no.

CDM/CEI/SO/1415039/665 dated 30.08.2016 for which Concessionaire submitted the clarification vide Letter

no. VBTL/O&M/5138 dated 22.12.2016. Further, As per approved maintenance programme for the year April -

2016 to March-2017 Road Roughness test has to be conducted in the month of November-2016. Now,

Concessionaire started the Road Roughness test on 07.02.2017 onwards (Conduction of Road Roughness Test

delayed 68 days as per approved annual maintenance programme for the year April 2016 to March 2017)

through Gujarat Engineering Research Institute (GERI) as per the authority Instruction. Non conduction of Road

Roughness test as per frequency and Stipulated time period mentioned in the annual approved maintenance

programme for the year April -2016 to March-2017 and as per concession agreement clause 4.4.2.2 of

schedule –L will be considered as a event of default by the concessionaire. Now, Submitted the Road

Roughness test reports Vide concessionaire letter no. VBTL/IE/2017/10C/73 dated 21.03.2017 was reviewed by

IE and submitted the comments to Authority Vide IE Letter No. CDM/CEI/SO/1415039/959 dated 29.04.2017.

Further, As per approved maintenance programme for the year April -2017 to March-2018 concessionaire

obligated to conduct Road Roughness Test in the month of April 2017.

Status of maintenance of main carriageway, Service Road and paved shoulder -

1. Alligator Cracks : - IE observed Alligator cracks on the project highway and notified to concessionaire

vide IE letter no. CDM/CEI/SO/1415039/632 dated 29.07.2016 and Instructed to rectify the Alligator

cracks immediately as per the concession agreement.

IE observed Alligator cracks on the project highway and notified to concessionaire vide IE letter no. CDM/

CEI/SO/1415039/647 dated 09.08.2016 and Instructed to rectify the Alligator cracks immediately as per

the concession agreement.

Now, Concessionaire started the rectification of alligator cracks, BC left over portion over flyover and

narrow bridge deck portion, permanent restoration of Pot holes formed during rainy season and defects

observed by IE by proper milling and BC laying as per approved mix design during periodic overlay time.

Status of major maintenance – Periodic overlay completed and completion certificate issued by

previous IE vide Letter no. SMEC/Vadodara/L&T/400 dated 27.06.2014. As per concession Agreement

next Periodic overlay will be completed on or before 02.06.2019.

O&M of all Communication , control & administrative systems

1. ECB :- In the Project Highway 82 Nos. Emergency Call Box Installed. In that lot of E.C.B.’S (45 Nos.) are

not working as reported by IE vide IE Letter no. CDM/CEI/SO/1415039/915 dated 24.03.2017.

2. ATCC : - Non functioning of ATCC at km. 134+100 & 175+000 regarding that IE issued cure period notice

to concessionaire vide letter no. CDM/CEI/SO/1415039/636 dated 30.07.2016 as stated in the clause

18.12 of concession agreement.

Further, Vide Letter No. CDM/CEI/1415039/784 dated 15.12.2016 IE’s Toll Expert Stated that “Both ATCC

#1 (km 134) and ATCC #2 (km 175) were found in operation when checked at their location. While ATCC

#1’s online data could not be seen at the HTMS Control centre, which the Concessionaire explained was

due to cuts in the Optic Fibre communication link, ATCC #2’s online data could be seen at the Control

Centre. However,it was found that, no vehicle was detected on Lane #2 on on ATCC #1. While this was

also the case with ATCC #2, a further defect observed was the inadequate vehicle classification accuracy.

Key Issues and recommended action by IE

1. Recommendation of PD/IE and as per delegation of powers vide Policy Circular No. 144/2014 and

159/2015, the approval of competent Authority is hereby accorded for installation of Weigh in Motion

(WIM) & Static Weigh Bridge (SWB) for NH-8, BOT-1 under Change of Scope amounting to Rs. 224,23,123/-

vide NHAI,RO Gandhinagar Letter No. NHAI/12015/1/2010-RO-GNR/Tech/Surat(E)/V-B/Vol 43/F-248 dated

21.04.2016. As per Clause 17.2 (C) NHAI Issued written confirmation vide as mentioned the above Letter No

& thereupon the concessionaire shall proceed with performance of such order and submit the time for the

completion of such order which is not at all submitted by the concessionaire. Now construction of SWB is

under progress but construction of WIM under progress. Vide Authority Letter No. NHAI/PIU-Bharuch/10-

E/2017/567 dated 02.05.2017 Authority requested Concessionaire to submit micro Programme to take up

the WIM & SWB Work immediately to IE which is issued to concessionaire by Authority in response of IE

Letter no. CDM/CEI/SO/1415039/937 dated 12.04.2017.

2. As per Approved annual Maintenance Programme for the year April 2016 to March 2017 the frequency

of inspection defined for the items has to be inspected by the Concessionaire and regular reports on the

same shall be sent to IE with proposed maintenance, repairs and rehabilitation work found necessary as a

result of such inspection as per clause 7.1 of Schedule – L of Concession Agreement vide IE Letter No.

CDM/CEI/SO/1415039/534 dated 11.05.2016(For the month of April-2016), CDM/CEI/SO/1415039/565

dated 04.06.2016 (For the month of May-2016) & CDM/CEI/SO/1415039/605 dated 05.07.2016 (For the

month of June-2016) for which no action taken by the concessionaire till date.

3. There are so many unauthorized access along the highway from Km 108+700 to 192+000 both LHS and

RHS and intimated to take immediate action for removal the unauthorized access. List of Encroachment in

the Project Highway With Video graphs reported to Authority vide Letter No. CDM/CEI/SO/1415039/531

dated 09.05.2016. Further, IE notified concessionaire new unauthorized access in progress Vide IE letter no.

CDM/CEI/SO/1415039/841 & 854 dated 02.02.2017 & 07.02.2017 respectively and instructed to remove

the said unauthorized access on the project highway and requested to submit the compliance report.

4. The ECB & CCTV shall be repaired/replaced where ever they are not working and as per authority

instruction vide letter no. NHAI/PIU-Bharuch/10-E/2016/378 dated 03.06.2016 stated that please explore

some other replacement of ECB or find out some circular issued by NHAI. Vide concessionaire letter no.

VBTL/O&M/5062 dated 19.11.2016 concessionaire submitted the proposal for Migration to Toll Free

Emergency Number for management of Rescue Accident Victims in place of obsolete Emergency Call Box

Technology to authority for which authority requested IE to go through the Concessionaire’s proposal and

provide the recommendations/comments on the same vide authority letter no. NHAI/PIU-Bharuch/10-

E/1105 dated 01.12.2016 accordingly IE reviewed the proposal and recommended to authority vide IE

letter no. CDM/CEI/So/1415039/804 dated 06.01.2017. Now, Authority requested IE to submit their

clarification on the financial implication (positive/negative) for the proposed replacement vide authority

letter no. NHAI/PIU-Bharuch/10-E/2017/104 dated 20.01.2017 for which vide IE letter no.

CDM/CEI/SO/1415039/858 dated 07.02.2017 IE requested the concessionaire to submit the financial

implication for replacement of ECB technology with Toll Free Emergency number based on GSM networks,

5. For preparation of Planting Activities in Row & Median during forthcoming monsoon concessionaire has

to procure avenue plants, median plants & manures as per IE & Concessionaire Horticulture Expert

Direction & Tree Guards has to be ready before start of planting activities as per IRC-SP-21-1979.

7. Non functioning of ATCC at km. 134+100 & 175+000 regarding that IE issued cure period notice to

concessionaire vide letter no. CDM/CEI/SO/1415039/636 dated 30.07.2016 as stated in the clause 18.12

of concession agreement.

8. IE Safety Expert submitted the remedial measures for the black spot observed on the analysis of

accident data vide IE letter no. CDM/CEI/SO/1415039/642 dated 03.08.2016. The Concessionaire may be

directed to immediately attend to these Black Spot locations to comply with the specifications and

Standards of Concession Agreement by doing the rectification recommended by the Independent

Engineer and requested to submit the Compliance Report.

9. Concessionaire requested to start the pre-monsoon activities like silt removing at pipe culvert, box

culvert, slab culvert, minor bridges and water way clearance of major bridges, unlined longitudinal drain

silt removing, median chute drain damaged and blocked has to be rectified, high embankment if any

settlement or scouring observed has to be rectified immediately and requested to submit the weekly

progress report for IE’s review and onward submission to authority. But, till today Concessionaire not

submitted the weekly progress report as requested by IE.

Concessionaire established their project office at Toll Plaza (Km. 157+750). The Organization Chart for IE and Concessionaire are attached as Appendix–A. In addition to that other resources provided are as attached in Appendix–B.

2.2. OPERATIONS: There is only one Toll Plaza in the project road and that was constructed at Km 157+700. There are total 9 nos. of lanes in

(LHS) direction& 8 nos. of lanes in (RHS) direction. This also includes the lane for oversized vehicles. For oversized vehicles,

width between two booths is 4.5m and for other vehicles width is kept 3.5 m.

Toll rate for the users is attached as Appendix – C. Toll collection during the month of April-2017 is attached as Appendix

– D. For smooth and safe traffic flow along the project road, Concessionaire has provided efficient Highway Traffic

Management System and it comprises to following sub-systems to collect/disseminate information about traffic, Incident

management for the safety of users.

i) Emergency Communication System

ii) Mobile Communication System

iii) Variable Message Sign System

iv) Meteorological Data System

v) Automatic Traffic Counter-Cum-Classifier System

All the above outdoor equipment’s are connected to the control center which is located near the Toll Plaza. Therefore the

user making an emergency call from ECBS can be provided the assistance of ambulance, crane and/or highway patrol unit

depending upon the type of emergency.

2.3. MAINTENANCE: Maintenance shall include inter-alia, routine, periodic and special maintenance of all the highway facilities, civil works, electrical/mechanical works and assets created under the Concession Agreement. Frequency of maintenance inspection is attached as Appendix - F.

The maintenance carried out during the month is attached as Appendix – G.

2.4. SAFETY OF PROJECT HIGHWAY: Concessionaire had provided following facilities on the Project Highway.

i) Ambulance - 02 nos.

ii) Patrol Vehicle - 03 nos.

iii) Crane - 02 nos.

All the above services are connected with the control center and mobile communication system.

Observation: As per above Inspection Schedule for the Month of March-2017 Visual Inspection, Close Inspection, Through Inspection for the Items

defined above inspection reports not Submitted by the Concessionaire as per the concession agreement clause 7.1 of Schedule – L stated that The

periodicity of inspections for maintenance activities by the Concessionaire shall be set out in the O&M Manual and regular reports on the same

shall be, sent to the Independent Consultant. Where required, the Concessionaire shall carry out any maintenance, repair or rehabilitation works

found necessary as a result of such inspections.

Hence, In view of above clause IE instructed the Concessionaire to submit the Inspection report and maintenance required to NHAI and

Independent Consultant for Review.

Observation/Recommendation:

Vide Letter No. NHAI/PIU-Bharuch/10-E/2016/350 dated 30.05.2016 Authority Instructed the Concessionaire that Concessionaire are

requested to immediately inform to this PIU regarding fatal accident & other major accidents only, along with a copy to Team Leader, M/s CDM

Smith India Pvt. Ltd. Through control room, as usual practice. In Due course of time, the detailed accident report will be send by Project Manager of

M/s L&T VBTL to this PIU with copy to IC.

Further, as per Schedule X- B. Operation phase-5.Accident Reports as stated As soon as practicable and in any event no later than 7

days following the Occurrence of any accident on the Project Highway involving a fatality or serious personal injury or substantial property damage,

the Concessionaire shall investigate the circumstances of such accident and submit to the NHAI and Independent Consultant a report setting out

details of such accident and, to the extent they are known, the causes of such an accident, and the Concessionaire shall thereafter promptly report

to the NHAI and/or Independent Consultant any additional details of such accident or its causes which become known to it.

Hence, In view of above Concessionaire shall submit the report as per Authority instruction and as per Schedule X to NHAI and IE from

June-2016 Onwards.
