Official Plan:
The subject lands are designated “Prestige Employment” by the new City of Vaughan Official Plan 2010 (VOP 2010), which was approved, in part, by the Ontario Municipal Board on February 3, 2014. The proposal conforms to the policies of the Official Plan.
Comments:
The Owner has submitted phased Draft Plan of Condominium File 19CDM-11V005. The first phase includes Buildings ‘B’ and ‘C’; the second phase includes Building ‘A’. Phase 1 of the application was approved by Vaughan Council on June 26, 2012. The owner has submitted Draft Plan of Condominium File 19CDM-13V014, which is scheduled for the June 3, 2014 Committee of the Whole meeting, for consideration by Vaughan Council. On June 28, 2012 the Committee of Adjustment approved Minor Variance application A174/12 to permit a total of 234 parking spaces for the entire subject lands, whereas 353 spaces were required. On May 23, 2013 the Committee of Adjustment approved Minor Variance Application A140/13 to permit a total of 234 parking spaces for the entire subject lands, whereas 376 spaces are required. On August 29, 2013, the Committee of Adjustment approved Minor Variance Application A235/13 to permit a total of 234 parking spaces for the overall site, where 388 spaces were required, and 150 spaces for Buildings B & C, where 278 spaces were required. This was the result of an increase of

382.50 m2 in gross floor area over three (3) units on the second floor of “Building C”. The subject application is to permit 234 spaces on the overall site where 394 spaces are required, and 150 spaces for “Buildings B & C”, where 306 spaces are required. This is the result of an increase of 93.2 m2 in gross floor area on the second floor in unit 30 of “Building C.” The Vaughan Development/Transportation Department has no objection to the proposed variance, and accordingly, the Vaughan Planning Department has no objection. The Planning Department is of the opinion that the proposal is minor in nature, meets the intent of the Zoning By-law, and is desirable for the appropriate development of the land.
Recommendation:
The Planning Department supports Minor Variance Application A097/14.

By-Law Requirements:

Comments: The total number of parking spaces is consistent with the previous
approved study for the Variance Application A235/13 prepared by Cole Engineering, dated November 8, 2007. In order to estimate the parking demand of the subject development, the study utilized following studies/surveys:
• Detailed parking survey at Piazza Villagio, (Weston Rd/Rutherford Road n/w corner)
• Detailed parking survey Maple Centre (Major Mackenzie Drive/Jane St)
• Detailed parking survey at Tuscany Place (Vaughan Mills) The total number of parking spaces is also appropriate based on the preliminary findings of City of Vaughan’s Draft Parking Standards completed by IBI Group. Furthermore, the study also looks at the shared parking spaces to provide opportunity to take advantage of the different peaking characteristics. Since City of Vaughan New Official Plan (VOP2010) would promote a non-auto modal splits to encourage more sustainable travel; therefore, we have no objection with the reduction of parking supply as recommended in the study. Accordingly, the Development Transportation /Engineering Department has no objection to this application.

We have reviewed the proposed Variance Application and have no comments or objections to its approval.

PowerStream has received and reviewed the proposed Variance Application. This review, however, does not imply any approval of the
project or plan.
All proposed billboards, signs, and other structures associated with the project or plan must maintain minimum clearances to the existing
overhead or underground electrical distribution system as specified by the applicable standards, codes and acts referenced.
In the event that construction commences, and the clearance between any component of the work/structure and the adjacent existing
overhead and underground electrical distribution system violates the Occupational Health and Safety Act, the customer will be responsible
for 100% of the costs associated with PowerStream making the work area safe. All construction work will be required to stop until the
safe limits of approach can be established.
In the event construction is completed, and the clearance between the constructed structure and the adjacent existing overhead and
underground electrical distribution system violates the any of applicable standards, acts or codes referenced, the customer will be
responsible for 100% of PowerStream’s cost for any relocation work.
