·The Department of i-:h~h and Game (DfG) has revie,.,ed the request for informal consul \~a ti on pursuant to the Cal-if ornia Endangered Species Act f'i-c::!:-.'!-:!o.·•;," State Lands Commission (SLC) to determine if the proposed Lyori-lir ... wkins pier extension pro~ect APN 97-182-07 ,,08 would jeopardiz~ ~~e.~a~oe yellow c~ess (Rorippa subumEellata). The Tahoe yellow (.:res.s is .a State-listed Endangered species and a Federal Candid:i't~ species that is found only on sandy beach­habi tats on the·' shores of Lake Tahoe. Pier construction and .ma-intenance activities :r.t<l¥ seriously im1>act existing populations and ha bi tat for .th, is species. --

If' potential or existing h~bi·t~t. is p~e!~en~ on the pr~:t~ct. site, the DFG rnust make a determination of J ec1pardy until such time ,as the Roripaa habitat mana~ement plan has been completed and has identif ie appropriate mitigation ~easur~s which will offset adverse impact_s. to Rorippa. ~he Ly;')_h-Ha-wl.dn~ Proj e~t J.=>ropose~ the reconstruction and extension cf ,an e-xisting open piling pier. All construction would be completed fro~ the lakeside. A wooden retaining wall is ~pproximately at the' ~~an high wa'ter level elevation (6,229 feet). Lakeward of the retaining wall the substratum is almost entirely small cobbles (diameter 2~s inches). The depth of-the.cobbles is generall¥ 6-8 inches with sand or gravel intermixed. The onshore, ~rea is sparsely vege~ated ~ith shrubs and wildflowers.
