A statement issued by the coun- cil recently stated that the termi- nation was due to incompetence on the part of the contractors it named as Siha Enterprise Compa- ny Limited and Mavonda Compa- ny Limited, both of Dar es Salaam. The statement, signed by the District Executive Director (DED), Mr. Netho Ndilito, said the con- tractors could only implement 30 percent of the project since sign- ing of the contract in January, 2018 for work which was meant to be completed within 12 months. Mufi ndi Council terminates 1.8bn/- water project citing ‘incompetence’ of contractors

Mufi ndi District Council has termi-nated a contract for i m p l e m e n t a t i o n

of a water project at Mtwango Ward worth 1.8bn/- on account of what it called incompetence of the contractors who were im-plementing it, TPJ has learnt.

A statement issued by the coun-

cil recently stated that the termi-nation was due to incompetence on the part of the contractors it named as Siha Enterprise Compa-ny Limited and Mavonda Compa-ny Limited, both of Dar es Salaam.

The statement, signed by the District Executive Director (DED), Mr. Netho Ndilito, said the con-tractors could only implement 30 percent of the project since sign-

ing of the contract in January, 2018 for work which was meant to be completed within 12 months.

According to the statement, the contractor had already pock-eted advance payments amount-ing to more than TZS 270 mil-lion of the project meant serve four villages of Sawala, Mtwan-go, Lufuna and Kibao with a combined population of 14,000.

“The contractor is required to

pay the district council TZS 413 million, of which TZS 254 million is fi ne and TZS 159 million is the balance of the advance payment ef-fected after the signing of the con-tract,” reads the statement in part.

The Public Procurement Act also provides for participation of the special groups in public pro-curement, whereby procuring en-tities are required to allocate 30 percent of their annual procure-ment volume for special groups.

Licha ya ukweki kuwa joint venture inawawezesha washirika kupata fursa ambayo wasingei-pata vinginevyo, mahusiano haya ya kibiashara yanaambata-

Uzoefu uliopo ni kuwa tatizo linalokabili joint ventures nyingi zinazound-wa ili kushiriki zabuni za umma ni kushindwa kuthibtisha uhalali wake kwa kutoambatisha nyara-ka za kula mshirika au pale zin-apoambatishwa zinakuwa na up-ungufu kama vile kuiyoisha muda.

The system facilitates the coun-try’s public procurement and sup-ports various public procurement procedures including user regis-tration, tender notifi cation, ten-der preparation and submission, online tender evaluation, contract awarding, creation and manage-ment of catalogue, creation and management of framework agree-ments and auctions and payments.

Utekelezaji wa mkataba na nidhamu ya mzabuni Na Yoswam Nyongera

Usimamizi thabiti wa utekeleza-ji wa mikataba ya manunuzi ya umma ni hitaji la msingi la kuhakikisha kwamba thama-ni bora ya fedha inapatikana.

Mkataba unaposimamiwa na kutekelezwa vizuri huiwezesha taasisi kutekeleza kwa ufanisi ma-jukumu yake ya msingi na kutimi-za malengo ya kuwapo kwake ikiwamo kutoa huduma bora kwa walengwa na umma kwa jumla.

Hata hivyo, lengo hilo hali-wezi kufikiwa endapo mzabuni atakiuka masharti ya msingi ya mkataba. Kwa sababu hiyo, she-ria ya manunuzi ya umma kwa kutambua hilo, imeelekeza kuwa pale ambapo mzabuni atashind-wa kutekeleza masharti ya mka-taba wa manunuzi atafungiwa na PPRA ili asishiriki katika zabuni za umma kwa kipindi maalum. Mkataba wowote wa manunuzi huainisha na kuweka bayana masharti ambayo yakikiukwa husababisha kuvunjika kwake.

Lengo la makala hii ni kuwafa-hamisha au kuwakumbusha waz-abuni na taasisi nunuzi matendo ya mzabuni yanayosababisha ku-vunjika kwa mkataba na madhara yake pamoja na taratibu za kufua-ta kabla ya kumfungia mzabuni. Mambo ambayo husababisha kuvunjika kwa mkataba ni;

a) Mzabuni kushindwa kuleta vifaa, kutokamilisha kazi au kush-indwa kutoa huduma ndani ya muda uliokubaliwa katika mkataba

b)Mkandarasi kusimamisha kazi kwa muda wa siku 28 bila idhini ya msimamizi wa mradi na kama muda huo haukuteng-wa katika program ya kazi

c)Kushindwa kurekebisha upungufu ndani ya muda ulio-kubalika katika mkataba au ulio-wekwa na msimamizi wa mradi

d)Mkandarasi kush-indwa kuweka dhamana ya utekelezaji wa mkataba

e)Fidia ya uchelewesha-ji kazi kufikia kikomo kabla ya mkandarasi kukamilisha kazi

f)Mkandarasi kujihusisha na vitendo vya rushwa wakati wa mchakato wa zabuni au waka-ti wa utekelezaji wa mkataba

g)Kuhamisha kazi au seh-emu yake kwa mzabuni mwingine bila ruhusa ya mwajiri

Kwa mujibu wa sheria ya ma-nunuzi ya umma, mambo mengine yanayoweza kusababisha kufungi-wa kwa mzabuni ni pamoja na;

a) Kutoheshimu tam-ko la dhamana ya zabuni

b) Udanganyifu wa sifa wakati wa mchakato wa zabuni

c) Pale ambapo mz-abuni atakuwa amefungiwa na nchi nyingine, shirika la kimataifa au taasisi ya kigeni

Kitendo cha kumfungia mzabuni ili asishiriki zabuni za umma ni ad-habu ambayo inalenga kumrekebi-sha na kwa upande mwingine ni fundisho kwa wazabuni wengine, wasitende makosa ya namna hiyo. Madhara kwa mzabuni anapo-fungiwa

a) Uwezekano wa kuathiri-ka kwa hadhi ya mzabuni, heshima ya mtu binafsi na kupoteza imani kwa wadau

b) Kampuni au mtu binafsi kufilisika

c) Kuingia gharama ya fid-ia na kupoteza fursa nyingine za biashara ikiwemo kubadili jina au kufungua kampuni nyingine

Mwongozo wa kufungia mzabuniPPRA imetoa mwongozo wa

kufuata kabla ya kumfungia mz-abuni. Mwongozo huo ambao un-ajulikana kama Debarment Guide-lines umetolewa mwezi Aprili, 2016 na unapatikana katika tovu-ti ya PPRA (www.ppra.go.tz).

Aidha, vigezo vinavyotumika kuanza mchakato wa kumfungia mzabuni, anayetakiwa kuuanzi-sha, anayeruhusiwa kupendekeza ili mzabuni afungiwe, mashar-ti ya kuzingatia wakati wa ku-wasilisha PPRA mapendekezo ya kumfungia mzabuni na hatua anazopaswa kuchukua mzabuni baada ya kupata notisi ya kufungiwa.

Mwongozo wa kumfung-ia mzabuni unaeleza yafuatayo;Sababu za kumfungia mzabuni

i) Pale ambapo baada ya uchun-guzi,ukaguzi au mahakama kuth-ibitisha kwamba mzabuni alihusika katika matendo ya rushwa,udan-ganyifu,kula njama au kutishia wakati wa mchakato wa zabuni au wakati wa utekelezaji mkataba;

ii) Pale ambapo mzabuni atash-indwa kuzingatia masharti ya tamko lake la kinga ya zabuni

iii) Pale ambapo taasisi nunuzi itasitisha mkataba wa un-

unuzi kwa sababu ya mzabuni kukiuka masharti ya mkataba

iv) Pale ambapo mzabuni alidanganya kuhusu sifa waka-ti wa mchakato wa zabuni

v) Pale ambapo mzabuni atakuwa amefungiwa na kuzui-wa kushiriki zabuni na nchi nyingine au shirika la kimataifa

vi) Kwa sababu yoyote ile ambayo PPRA itaona inafaa

Anayetakiwa kuanzisha mchakato wa kufungia mzabuni

Mchakato wa kufungia mzabuni utaanzishwa na PPRA baada ya ku-jiridhisha kuwa sababu zilizotole-wa zina ushahidi wa kutosha.

Anayetakiwa kupende-keza kufungiwa mzabuni

i) PPRA, kwa matakwa yake, baada ya kuridhika na ta-arifa ilizopata, inaweza kum-fungia mzabuni kushiriki katika mchakato wa zabuni za umma

ii) Taasisi ya umma, mtu au chombo chochote chenye taarifa zenye ukweli kinawe-za kuwasilisha PPRA pende-kezo la kufungiwa mzabuni

Masharti ya kuzingatia wakati wa kuwasilisha PPRA mapende-kezo ya kumfungia mzabuni

(a) Mapendekezo yawas-ilishwe ndani ya siku 28 tan-gu siku ya kujua kuwapo sa-babu za kumfungia mzabuni

(b) Endapo taasisi, mtu au chom-bo kitashindwa kuwasilisha ndani ya siku 28 tangu kujua sababu za kufungiwa, anaweza kuomba ku-wasilisha nje ya muda huo kwa kulipa ada ya shilingi laki moja.

(c) PPRA inaweza kutoa ruhu-sa ya kuwasilishamalalamiko au utetezi nje ya muda uliopangwa kisheria endapo muda huo hauzidi siku 14 toka tarehe maombi hayo.

(d)Mapendekezo ya ku-fungiwa mzabuni sharti yawas-ilishwe kwa kutumia fomu maalum iliyoandaliwa na PPRA

e) Mapendekezo ya kufungiwa mzabuni yanaweza pia kuambatana na mapendekezo kwamba mzabuni asimamishwe wakati anasubiri maamuzi juu ya kufungiwa kwake

PPRA, baada yakupokea mapendekezo ya kumfungia mz-abuni, hutoa notisi ya kumtaari-fu mtuhumiwa nia ya kumfungia

Baada ya kupata noti-si hiyo, mzabuni anatakiwa kufanya mambo yafuatayo:

(a) Kuwasilisha PPRA pin-gamizi au maelezo kuonesha kwa nini asifungiwe kushiriki mi-chakato ya manunuzi ya umma

(b)Pingamizi au maelezo sharti yaambatane na taarifa za wakuru-genzi,wanahisa na kampuni tanzu za kampuni inayolalamikiwa

(c)Pingamizi au maelezo sharti yawasilishwe PPRA, ndani ya siku 14 tangu kupokewa kwa notisi

(d) Mlalamikiwa atahaki-kisha kwamba maelezo anayotoa ni ya kweli

(e) Endapo mlalamiki-wa atashindwa kuwasilisha PPRA pingamizi au maelezo anaweza kuwasilisha maelezo hayo nje ya muda uliopangwa kwa kulipa faini iliyowekwa.

PPRA inaweza kutoa ruhusa ya kuwasilishamalalamiko au utetezi nje ya muda uliopangwa kishe-ria endapo muda huo hauzidi siku 14 toka tarehe maombi hayo.

Kwa mujibu wa mwongozo huu, PPRA itatoa taarifa kwa ta-asisi nunuzi na kwa mtu yeyote mwenye haki ya kisheria ka-tika manunuzi husika, juu ya kufungiwa kwa mzabuni. Vi-levile, taarifa hizo zitapelekwa BRELA kwa hatua zao muhimu.

PPRA itachapisha uamuzi wa kufungiwa mzabuni katika jarida la Tanzania Procurement Journal na kwenye tovuti yake, na ku-tunza orodha ya wazabuni wali-osimamishwa na waliofungiwa kushiriki michakato ya manunuzi ya umma kwenye rejista ambayo mtu yeyote anaweza kuiona.Hitimisho

Kitendo cha kumfungia mz-abuni siyo cha kujivunia hata kidogo wala kumfurahisha mtu yeyote. Wazabuni wanaoshiri-ki katika mchakato wa zabuni za manunuzi ya umma wanataki-wa kuzingatia masharti yaliyomo kwenye sheria, kanuni, taratibu na miongozo inayotolewa na Mam-laka husika. Fursa za kushiriki katika mchakato wa manunuzi ya umma wanatakiwa wazitumie vizuri ili lengo kuu la Serikali la kuwajengea uwezo wa kifedha, ki-taalam na uzoefu liweze kutimia.Rai yangu ni kuwataka wazabuni waepuka mambo yanayoweza kusababisha kufungiwa kushiriki michakato ya manunuzi ya umma.

Hata hivyo, mrufani alishin-da kesi hiyo kutokana na ukweli kwamba japo cheti kilikuwa cha kufoji, cheti cha mshirika mwenza katika JV kilikuwa na sifa za kuto-sha hata bila ya cheti kilichofojiwa.

Mshirika katika Joint Venture asiwe amefungi-wa kushiriki Zabuni za Umma ndani au nje ya nchi.

Kifungu cha 62 cha Sheria ya Manunuzi ya umma kimeipa PPRA nguvu ya kuifungia kam-puni kushiriki zabuni za umma iwapo itathibitika kujihusisha na vitendo vya rushwa, kushindwa kuzingatia kiapo cha dhamana ya zabuni, kuvunja mkataba wa ma-nunuzi na pia kufanya udangany-ifu kuhusu wasifu wake wakati wa mchakato. Aidha, kwa mujibu wa kifungu cha 62(2), kampuni il-iyofungiwa kushiriki zabuni nje ya nchi, mashirika na taasisi za kimataifa, moja kwa moja inakuwa imefungiwa kushiriki zabuni za umma, ikiwamo hata kuingia joint venture nchiniTanzania. Kutoka-na na msimamo huu, ni muhimu kujiridhisha kuwa kampuni un-ayoingia nayo joint venture haija-fungiwa kushiriki zabuni ndani au nje ya nchi. PPAA iliweka msima-mo huu katika kesi ya Rufani ya Zabuni kati ya M/s Technofab – Gammon JV na Mamlaka ya Maji Safi na Maji Taka ya Jiji la Dar es Salaam. Katika kesi hii Mamlaka ya Maji Safi na Maji Taka ya Jiji la Daar es Salaam ilitangaza Zabuni za Mchujo (prequalification) kwa ajili ya zabuni ya kumpata mkan-darasi wa kusafisha kinu cha ku-chujia maji cha Chalinze na ujenzi wa kigawa maji. Katika zoezi la uchambuzi wa zabuni hizo zabuni ya mrufani ilikataliwa katika hatua za awali za uchambuzi kutokana na kampuni ya Gammon India Ltd ambayo ilikuwa mshirika wa Mru-fani katika zabuni hiyo kuwa iliku-wa imefungiwa kushiriki zabuni

katika jimbo la Bira nchini India kwa kushindwa kukamilisha mra-di wa maji katika makao makuu ya jimbo hilo licha ya kuongezewa muda wa kukamilisha kazi. Mr-ufani alikataa rufaa bila mafani-kio kuanzi kwa Afisa Masuuli na hata PPAA kwa mujibu wa sharia ya Manunuzi ya umma na Ka-nuni zake, kampuni iliyofungiwa kushiriki zabuni za Umma nje ya Tanzania inakuwa pia imefungiwa kushiriki zabuni za umma nchini Tanzania ikiwa ni pamoja na kuko-sa sifa ya kushirikiana na kampuni nyingine kuunda joint Venture.

Nakala ya makubalia-no ya kuingia joint ven-ture ni lazima yaambatishwe kwemye zaombi ya Zabuni

Joint venture kama tulivyoo-na hapo juu ni makubaliano ya kuungana baina ya kampuni ili kuunda ushirika wenye sifa na uwezo wa kushindania kandara-si, ambayo vinginevyo mshirika mmoja mmoja asingeweza kushiri-ki. Makubaliano haya ni lazima yathibitishwe na uwepo wa mkata-ba baina ya washirika katika joint venture.Mkataba huu kwa upande wa joint venture zinaoundwa kwa minajili ya kushindania kandara-si za ujezi ni lazima ni lazimazi-idhinishwe na Bodi ya Usajili wa wakandarasi. CRB husajili joint venture baada ya kujiridhisha kuwa muunganiko wa washirika katika joint venture husika unaku-wa na sifa zinazokidhi matakwa ya kandarasi inayoshindaniwa kwa maana ya daraja la usajili. Math-alan muunganiko wa rasilimali za mkandarasi wa daraja la pili na da-raja la saba unaweza kuunda joint venture yenye hadhi na sifa za mkandarasi wa daraja la kwanza. Yatosha kusems kuwa makubalia-no ya joint venture ni lazima yathibitiswe na mkataba ulioidhin-ishwa na CRB na kuambatish-wa katika maombi ya zabuni.

Zabuni inayowasilishwa na joint venture inapaswa kuonye-sha majukumu ya kila mshirika

Kifungu cha 9(10) c kinaeleke-

za kila zabuni inayoletwa na joint venture kuonyesha sehemu ita-kayotekelezwa na kila mshirika katika joint venture na kila mshiri-ka atathminiwa kulingana na ma-jukumu atakayotekeleza katika mkataba kusudiwa. Tukichukulia mfano wa joint venture kwa aji-li ya usimamizi wa mradi wa jin-go, washirika katika joint venture wanaweza kuwa ni kampuni ya wachoraji, wahandisi na wakadi-riaji majengo. Katika hali kama hii kila joint venture itatakiwa kuainisha bayana majukumu ya kila mshirika na hata katika zoezi la uchambuzi wa RFP litazingatia majukumu ya kila mshirika.Aidha katika mkataba utakaosainiwa na joint venture majukumu ya kila mshirika hayawezi kubadilish-wa bila idhini ya kimaandishi ya mwajiri kwa mujibu wa kifun-gu cha 9(10)f. Hata hivyo uzoefu unaonyesha kuwa mchanganuo wa majukumu baina ya washiri-ka katika Joint venture umekuwa ukifanyika katika zabuni za kuta-futa wataalamu washauri tofauti na zile za ukandarasi wa ujenzi.

Dhamana/ Kiapo cha Dha-mana ya Zabuni ni lazima iwe kwa jina la Joint Venture

Kampuni zinapoungana na ku-unda joint venture zinakuwa kitu kimoja na kuwajibika kwa pamo-ja, hivyo hata jina la ushirika wao huwa moja. Aidha, iwapo katika zabuni inayokusudia kushiriki ina-hitaji dhamana ya zabuni au kiapo cha dhamana ya zabuni, ni lazima dhamana hiyo au kiapo hicho kiwe kwa jina la joint venture iliyoundwa kwa mujibu wa kifungu cha 9(10) a cha sheria ya manunuzi ya umma . Aidha, kwa mujibu wa kifungu cha 17.9 cha Maelekezo kwa Wazabuni katika nyaraka sanifu ya zabunni kwa ajili ya kazi za ujenzi, dha-mana ya zabuni inatakiwa kuwa katika jina la joint venture ila kati-ka mazingira ambayo mkataba wa joint venture haujakamilika wakati wa zoezi la kuomba zabuni, she-ria inaelekeza dhamana hiyo iwe kwa majina ya washirika watara-

jiwa katika joint venture hiyo. Ku-tokana na maelezo hayo hapo juu iwapo dhamana au kiapo cha dha-mana ya zabuni hakitakuwa kwa mfumo ulioainishwa na sheria san-jari na nyaraka sanifu ya zabuni, basi zabuni ya mwombaji inakuwa katika hatari ya kukataliwa kati-ka hatua za awali za uchambuzi. Msimamo huu uliwekwa bayana na PPAA katika kesi ya Rufani ya Zabuni ya M/s Technofab – Gam-mon JV na Mamlaka ya Maji Safi na Maji Taka ya Jiji la Dar es Sa-laam,ambapo zabuni ya ukaraba-ti wa kinu cha kuchujia maji cha Chalinze, iliyoletwa na ushirika wa Jain Irrigation System- Gannon Dinkley 7 Co Ltd ilikataliwa na mwajiri kwa sababu haikuwa na jina la jointventure na badala yake ilikuwa na jina la mshirika mmoja.

HitimishoJoint venture ni ushirika baina

ya kampuni zenye lengo la kuwa-fanya washirika kuwa pamoja kwa lengo la kuongeza uwezo na sifa za washirika ili kwa umoja huo waweze kushindania fursa za ma-nunuzi, ambazo vinginevyo mshiri-ka mmoja mmoja asingeweza kwa kupungukiwa sifa. Joint venture ni matokeo ya jitihada za Serika-li kupitia sera na sheria mbalim-bali zikiwemo za manunuzi, ili kuwawezesha wafanyabiashara wadogo na wa kati kushiriki fur-sa mbalimbali za kibiashara. Hata hivyo, uundaji na ushiriki wa joint venture katika fursa hizo za kib-iashara hususani zabuni za ma-nunuzi ya umma, unakabiliwa na changamoto kadhaa kubwa zikiwa ni uundwaji wake na, taratibu za ushiriki wa zabuni kama joint ven-ture.Yatosha kusema kuwa kidole kimoja hakivunji chawa, umoja ni nguvu wakati utengano ni udhai-fu, hayo siyo maneno ya mwan-dishi bali ya wahenga kusisitiza umuhimu wa joint venture baina ya wakandarasi wadogo na wa kati.

MakalaUmuhimu wa makundi maalum ya kijamii kushiriki katika manunuzi ya umma

Serikali hutumia pesa nyingi sana katika sekta ya manunuzi ya umma na hivyo inatambua

umuhimu wa kuwavutia wa-nanchi kushiriki katika kujenga uchumi wa nchi kwa kupitia ush-iriki wao katika zabuni za umma.

Kupitia maboresho ya Sheria ya Ununuzi wa Umma ya mwaka 2016, makundi maalum ya kijamii yamepewa fursa ya kushiriki kati-ka manunuzi wa umma. Makundi haya ambayo ni pamoja na wana-wake,vijana,wazee na watu wenye ulemavu hapo awali yalikuwa yanakosa uwezo wa kushindana na makundi mengine na watu wenye nguvu za kifedha na kitaalam. Kwa sheria ya ununuzi wa umma ku-tambua makundi haya kutasaidia kwa kiasi kikubwa ushiriki wa makundi haya katika ununuzi wa umma na hatimaye kukuza uchu-mi wa nchi na ustawi wa jamii.

Tafiti nyingi duniani zinaone-sha kuwa ushiriki wa makun-di maalum katika ununuzi wa umma ni wa kiwango cha chini na moja ya sababu inayochan-

Umuhimu wa kusaini fomu za viapo (covenant form) kwa wajumbe wa kamati ya tathminiKwa mujibu wa Kifun-

gu 40 (1) cha Sheria ya Ununuzi wa Umma ya Mwaka 2011, afisa ma-

suuli anatakiwa kuunda kamati ya tathmini kwa ajili ya kucham-bua zabuni na kuandaa ripoti am-bayo itawasilishwa kwenye kiten-go cha usimamizi wa ununuzi.

Kifungu kidogo cha 2, kinaelekeza kuwa wajumbe wa kamati ya tathmini watapende-kezwa na kitengo cha ununuzi na kuthibitishwa na afisa masuuli na kwamba idadi ya wajumbe wa kamati hiyo inategemea ukub-wa wa kazi na umuhimu wake.

Kifungu cha 40 (6) cha sheria hiyo kinaeleza kwa kina kuwa wajumbe wa kamati ya tathmini lazima wasaini fomu za viapo vya uadilifu (code of ethics) kuthibiti-sha kwamba hawana maslahi bin-afsi na tenda watakayo tathmini.

Katika taasisi nyingi, fomu hizi zimekuwa zikijazwa kwa mazoea, kwa maana ya kwamba wengi wa wajumbe wanaoteu-liwa wamekuwa hawajazi fomu

Na Keneth Runji za viapo au wanasaini mara baa-da ya kumaliza kufanya tathmini.

Umuhimu wa kuja-za fomu hizo ni pamoja na;

Kuwaweka huru wajum-be wakati wa kufanya tathmini

Wajumbe wa tathmini wanataki-wa kuwa huru muda wote wanap-ofanya tathmini, na kusaini fomu za viapo kunawapa uhuru wa ku-fanya kazi, wakiwa na uhakika kuwa wanaongozwa na sheria ili wafanye kazi kwa uadilifu. Pia, ki-fungu cha 41 kinaelezea kwamba mjumbe atafanya kazi katika bodi ya zabuni, kitengo cha ununuzi, idara nunuzi na timu ya tathmini bila kuingilia uhuru wa mwenzake.

Kuongeza uaminifu wa timu ya tathmini kwa taasisi nunuzi

Taasisi nunuzi inapotanga-za zabuni inakuwa na matu-maini ya kupata wazabuni wenye kukidhi vigezo vilivyowekwa, ili kuweza kuleta matokeo chanya kwa taasisi husika. Kwa kuzin-gatia hilo taasisi inaamishia ma-tumaini yote kwa timu ya tath-mini na kwa kusaini fomu ya kiapo, taasisi inaamini timu itafan-

ya kazi kwa uaminifu na uadilifu.Kutambulika kwa mjumbe mmo-

jammoja aliyeshiriki katika tathminiKwa kuwa kila zabuni inakuwa

na wajumbe wake, kama mjumbe alifanya kazi iliyopita kwa uamin-ifu na kuleta matokeo chanya, ni rahisi kutambulika na kutumiwa mara kwa mara katika tathmini ya zabuni mbalimbali, hii inatokana na matakwa ya sheria kifungu namba 40 (4) na (5) ambapo mjumbe laz-ima awe na uzoefu kutegemeana na thamani, ukubwa wa zabuni.

Kupunguza malalamiko yan-ayohusisha rushwa na viten-do visivyo vya uaminifu kati-ka utoaji wa tuzo za mikataba

Malalamiko mengi yahusuyo zabuni mbalimbali katika taas-isi hapa nchini, lawama nyingi zinaelekezwa kwa timu ya tath-mini na bodi za zabuni kwa ku-toa zabuni kwa upendeleo kwa wazabuni wasio na sifa. Kwa hiyo kwa kusaini fomu za viapo itapunguza malalamiko kwani itawezesha timu kufanya kazi kwa kuzingatia sheria na uadilifu.

Mbali na faida hizo, sheria ya un-

unuzi inataka wajumbe wa timu ya tathmini kujaza fomu za maa-dili ( code of ethics). Ushauri un-aotolewa na wataalamu ni kuwa fomu hizo zisijazwe kwa mazoea, bali zijazwe zikiwa na lengo la kufanya kazi kwa kuzingatia she-ria ya ununuzi wa umma na ua-dilifu katika utumishi wa umma.

Kwa upande mwingine, pamo-ja na timu ya tathmini kusaini viapo hivyo, bado wataalamu wa ununuzi wanashauri timu hizi zipewe uelewa wa pamoja ili kuondoa makosa yanayojitokeza na hivyo kupunguza malalamiko.

Baadhi ya makosa yanayoji-tokeza yanaangukia hasa katika tathmini ya kina, hususan katika sehemu ya uzoefu wa mzabuni, katika uwezo wake wa kifed-ha na wa wataalamu, vifaa, na pia katika uhakiki wa hesabu.

Kwa kumalizia, taasisi nunuzi zingetumia wanasheria kati-ka maeneo yao kusimamia via-po vinavyojazwa na wajum-be wa kamati ya tathmini ili kuepuka uwezekano wa wajum-be kujaza fomu kwa mazoea.

Makala hii inalenga katika kuku-za uelewa wa pamoja kwa wadau wa sekta ya ununuzi wa umma kuhusu umuhimu wa kushirikisha makundi yaliyotajwa. Zipo faida nyingi lakini za msingi ni hizi nne:

(i) Kuchochea kukua kwa biashara: Fursa kwa makundi maalum itachangia ukuaji wa bi-ashara kwani kutakuwa na uhakika wa kisheria utakaofanya makundi haya kupata kazi katika zabuni za umma na hivyo kujiongezea kipato

(ii) Kupunguza umaski-ni: Wanawake na wazee ni makundi makubwa yenye uma-skini mkubwa na hivyo fur-sa kwao zitapunguza umaski-ni wa jamii kwa kiasi kikubwa.

(iii) Kushiriki katika ujenzi wa uchumi wa taifa. Upo uwezekano wa kuanzishwa kampuni au vi-wanda vidogo vidogo vinavyomi-likiwa na makundi haya ili kushiri-ki katika fursa za zabuni za umma hivyo kukuza uchumi wa taifa.

(iv) Kukuza sekta ya uwekeza-ji. Uwekezaji katika viwanda vi-dogovidogo ni hatua muhimu katika kukuza uchumi wa taifa.

Maboresho ya sheria yataonge-za kasi ya uzalishaji shughu-li za uchumi zinazofanywa na makundi haya na hatimaye kukua kwa sekta ya uwekezaji. Mfano mzuri ni kiwanda kinachomilik-iwa na vijana, kiitwacho Maswa Family, kinachotengeneza cha-ki mkoani Simiyu. Kiwanda hiki kina uwezo wakuzalisha katoni 2,560 kwa mwezi huku mahitaji ya mkoa ni katoni 677 kwa mwezi. Ni dhahiri makundi haya yana uwezo mkubwa katika kushiri-ki kukuza uwekezaji katika nchi.

Mambo ya kuzingatia ili kuweze-sha utekelezaji wa matakwa ya sheria

(i) Upatikanaji wa taarifa za zabuni: Upatikanaji wa taarifa za zabuni ni jambo muhimu katika kutoa fursa za watu kushiriki ka-tika zabuni husika. Ni jukumu la wadau wote kuhakikisha taarifa za fursa za zabuni za umma zin-ayafikia makundi haya. Kwa kuan-zia kila taasisi ya umma inaweza kuanzisha mfumo wake wa kuwat-ambua wajasiliamali wote walio katika makundi haya waliopo ka-tika maeneo yao kwa ajili ya ku-wafikishia taarifa za fursa. Aidha, ipo haja ya kutengeneza daftari

la kitaifa kwa ajili ya kuweze-sha utambuzi wa makundi haya.

(ii) Elimu na mafunzo juu ya mfumo: Ununuzi wa umma unaongozwa na sheria, ka-nuni na taratibu hivyo elimu na mafunzo yatolewe kwa makundi haya ili kuyaongezea uelewa na hivyo ushiriki wao ka-tika fursa za manunuzi ya umma.

(iii) Upatikanaji wa mitaji: Ta-asisi za fedha kama benki, vyama vya akiba na mikopo, vikoba ni wadau wakubwa katika utoaji wa mitaji ya biashara. Zipo baadhi ya fursa za ununuzi wa umma kwa makundi haya zitakazohitaji mitaji wasiyokuwa nayo. Hivyo basi ni muhimu kwa taasisi za fedha kushiriki katika mfumo huu wa manunuzi kwa ajili ya kufanikisha azma ya Serikali ya kushirikisha kikamilifu makundi haya katika ununuzi wa umma.

Makundi maalum ya ki-jamii ni sehemu muhimu kati-ka jamii. Rai kwa wadau wote wa manunuzi ya umma: Haki-kisheni shabaha kuu ya sheria ya manunuzi ya umma inafiki-wa kwa ajili ya maslahi ya taifa.

MakalaMambo ya kuzingatia ili kuongeza fursa kwa makundi maalum katika manunuzi ya umma

Makundi yote ya kijamii nchini yanatakiwa ku-toa mchango ka-

tika ukuzaji wa pato la tai-fa na kuendeleza uchumi. Tanzania inazingatia uchumi wa soko huria unaohitaji uwazi, uwajibikaj na usawa wa fursa.

Serikali inachangia katika up-atikanaji wa fursa kwa kujenga uwezo, miundombinu na kuwa na sera au sheria rafiki kwa washiri-ki wote. Serikali, kwa kutambua kuwa manunuzi ya uma yana sura mbili, ya kudhibiti matumizi na ile ya kuchangia katika kukuza uwekezaji na kukuza pato la tai-fa hivyo inaboresha sera na she-ria ya manunuzi mara kwa mara.

Ufanisi au ubora wa manunuzi ya umma una sura mbili. Sura ya kwanza ni ile ya udhibiti wa ma-tumizi ya rasilimali ili kupungu-za gharama, kuleta ufanisi katika matumizi na kupunguza ongeze-ko la kodi ambayo huchangia ongezeko la uwekezaji, ukuzaji wa mitaji na maendeleo ya uchumi.

Sura ya pili ni kuchangia katika kukuza fursa za kiuchumi na pato la taifa. Sura hii ndiyo chimbuko la fursa za uwekezaji kwa hiyo mfumo wa manunuzi ya umma unatakiwa kuzingatia usawa, uwazi na haki katika upatikanaji wa taarifa, tath-mini na maamuzi kama ilivyoan-ishwa katika sheria ya Manunuzi ya Mwaka 2011 na marekebisho yake ya Mwaka 2016. Marekebisho haya yanajumuisha upunguzaji wa muda ya mchakato, uongezaji wa fursa kwa makampuni ya waza-wa/ bidhaa za kitanzania na kuba-dilisha kifungu -64(2) (i) & (ii) cha sheria ya manunuzi ili kila taasisi nunuzi itenge kiwango kisichopun-gua aslimia 30 mahsusi kwa ajili ya makundi maalumu (vijana, wana-wake, wazee na wenye ulemavu).

Lengo ni kuhakisha kuwa Ser-ikali pamoja na kutengeneza mazingira mazuri ya uwekezaji, inatoa pia fursa kwa makundi haya ili yajijengee uwezo wa kiuchumi hatimaye yatoe mchango kwenye pato la taifa na kukuza uchumi. Fursa za manunuzi ya umma

Manunuzi ya umma ni ununuzi wa nyenzo mbalimabali zinazo-tumika kuhudumia umma, kama dawa, majengo, ushauri na usafi.

Nyenzo hizi hugawanyika katika makundi yaliyoanish-

wa katika Sheria ya Manunuzi ya umma ya mwaka 2011:

• Vifaa kama madawa, madawati, mitambo, magari, nk;

• Huduma zisizohitaji ushau-ri wa kitaalamu kama ulinzi, ufagizi;

• Huduma za kishauri au kita-alamu yaani zile zinazotolewa kwa kuzingatia misingi ya kitaaluuma;

• Ujenzi wa barabara, nyum-ba au miundombinu ya maji.

Utoaji uuduma hizi huongo-zwa na sheria mbalimbali am-bazo huweka viwango vina-vyozingatiwa na wadau wote.

Jinsi fursa zinavyopatikanaFursa hizi hupatikana kwa ush-

indani unaozingatia sheria. Kwa kuzingatia hayo, kila taasisi inawa-jibika kuweka wazi mwelekeo wa manunuzi yake kila mwaka kwa kutoa tangazo la ujumla (general procurement notice-GPN) kwenye tovuti yake pia katika jarida la Tan-zania Procurement Journal (TPJ). Tangazo hili hutoa mpangilio wa manunuzi ya mwaka ili kuwapa taarifa wazabuni au wajasiriamali.

Pia fursa zinaweza kupa-tikana katika utatuzi wa tati-zo la dharura kama maafa au matukio ambayo hayakupangwa.

Vyanzo vingine ni maelezo bin-afsi ya watu au taasisi zilizowahi kufanya kazi na Serikali, ambayo yanatolewa katika maelezo au wasifu wao. Kusambaza wasifu huu kunasaidia katika upatika-naji wa kazi ndogondogo zisizo-hitaji mchakato wa manunuzi. Njia nyingine ni matangazo ya zabuni katika:

1. Magazeti, kama vile Tanza-nia Procurement Journal (TPJ)

2. Tovuti za taasisi za umma3. Mbao za matangazo za taasisi Mwombaji mtarajiwa anapaswa

kujitathmini na kupata malezo ya kina juu ya maelezo yanayotolewa katika nyaraka za zabuni au tenda kwani viwango vitakiwavyo huan-ishwa katika kabrasha la zabuni husika. Kwa hiyo, kila mdau ana-takiwa kujitambua kwa kujipima na awe tayari kutoa uthibitisho wa uwezo wake kwa kutumia njia itakayoanishwa katika tangazo au nyaraka zinazotolewa katika kualika uwasilishwaji wa tenda. Changamoto za makundi maalum

Makundi maalumu yanajumui-sha watu wengi ambao aghalabu hawana mitaji, ujuzi au uzoefu wa manunuzi ya umma. Changamo-to nyingine ni hizi zifuatazo:

1. Taarifa zinatolewa mara nyin-gi hazieleweki kwa urahisi. Hata hivyo, makundi haya hayana mi-fumo au mikakati sahihi ya kupata taarifa na kuzitumia kwa usahihi,

2. Wengi wao hawako kati-ka mfumo rasmi na hivyo hu-tumia mazoea au desturi lakini sheria ya manunuzi inatambua makundi au biashara au watu binafsi wenye wasifu unaothibi-tika kwa nyaraka mbali mbali,

3. Sheria imekasimu mipaka ya majukumu na utendaji na hivyo kus-ababisha ukiritimba katika kufanya maamuzi na jambo hili huleta upo-tevu wa muda na gharama kubwa,

4. Tabia ya kuridhika na ku-chukulia mambo kirahisi, iliyo-jengeka miongoni wa watendaji wa umma kufanya taasisi nyingi kuta-ka uzoefu mkubwa hata pale amba-po bidhaa au huduma inayotakiwa inaingia sokoni kwa mara ya kwan-za. Na kwa upande mwingine, wa-jasiriamali wengi hukata tamaa bila hata kuangalia uwezekano wa kushirikiana na mwingine ili kupitia ubia waweze kufikia uwezo au kiwango kinachotakiwa,

5. Mabadiliko ya watendaji katika taasisi za umma ambayo yanalazimu uwasilishaji mpya wa taarifa na uwekezaji wa kuku-za imani katika utendaji na ubo-ra wa bidhaa au huduma, na

6. Dhana potofu kwamba ma-husiano kati ya pande mbili za manunuzi hujengwa kwa takrima au rushwa na hivyo wajasiriamali kushindwa kujenga na kuendele-za misingi ya uaminifu na maadili. Namna ya kushinda changamoto

Awali ya yote ni kutambua uwezo walionao wajasiriama-li ili wapate ujasiri wa kujionye-sha, kujielezea na kuamini kuwa Serikali ni soko la uhakika kwa:

• Kutumia sera na fursa: Ili kusaidia halmashauri kuwat-ambua na kuwatambulisha ka-tika taasisi za umma wananchi walio katika makundi maalum.

• Kuboresha maelezo ya fur-sa: Hii ni pamoja na kuwajen-gea uwezo wananchi walio kati-ka makundi maalum ili wawaze kuyaelewa maelezo kwa urahisi na katika lugha ya mazingira yao

• Kutokubadili taratibu au vi-wango mara kwa mara: Ili ku-wawezesha wajasiriamali wasio na uzoefu waweze kujenga uwezo wa kukidhi vigezo na matakwa ya ununuzi wa umma.

Hii ni pamoja na kuhamasisha wanaosimamia michakato wa manunuzi ya umma kuwa ta-yari kuwasaidia walio kwenye makundi hayo kama ifuatavyo:

(i) Bodi ya taaluma ya ununuzi na ugavi (Procurement and Sup-plies Professionals and Tech-nicians Board (PSPTB): Iandae utaratibu wa kuwatumia wataal-amu wao kwa njia ya kujitolea ili kuwawezesha wazabuni kutumia nyaraka za zabuni vizuri. Bodi nyingine za kitaaluma au kishauri zinatakiwa pia kuwa na mfumo wa namna hii ili kuyasadia makundi haya mfano kuwa na kumbukum-bu nzuri za mahesabu (NBAA) kuingia mikataba yenye mashar-ti yanayotekelezeka (TLS) nk;

(ii) Halmashauri za wilaya, majiji, miji na manispaa: Katika utoaji wa leseni ziwe na mkakati wa kutambua taasisi/watu wenye uwezo wa kufanya biashara na zipi kati ya hizo ni za makundi maalu-mu ndipo uwezekano wa kuyapa fursa uangaliwe. Kwa upande mwingine, halmashauri iangalie namna ya kushirikiana na PSPTB katika kuwajengea uwezo wanan-chi walio katika makundi maalum,

(iii) Mamlaka ya kudhibiti ma-nunuzi ya umma (PPRA): Kushauri juu ya kurahisisha makabrasha ya tenda na taratibu ili taasisi nunuzi ziweze kubuni namna nzuri ya ku-toa fursa kwa makundi maalum;

(iv) Wizara ya Fedha na Mi-pango: Iandae sera sahihi zita-kazosaidia makundi maalum katika manunuzi ya umma

HitimishoKuwezesha makundi maalu-

mu utakuwa ni mchango kwa taifa kwani kutapunguza uma-skini wa makundi haya kwa kuwa watapata pato la kudumu.

Suala la msingi ni kuainisha ni wakina mama, vijana, wa-zee na wenye ulemavu wa aina gani, kila kundi lipewe asili-mia ngapi na kazi au zabuni zipi n.k, tathmini itafanyikaje.

Zaidi ya hapo Serikali pia ihu-sishe taasisi za fedha ili zian-galie namna ya kutoa mikopo nafuu. Huenda jambo hili lika-hitaji mfumo au muundo ambao utashirikisha wadau na kubore-sha ufuatiliaji. Kama hili haliku-tanzuliwa vizuri itakuwa vigumu kupata matokeo yanayotarajiwa.
