LOCAL GOVERNMENT ACT 1995 Shire of Boddington

DOGS AMENDMENT LOCAL LAW 2007 Under the powers conferred by the Dog Act 1976 and under all other powers enabling it, the Council of the Shire of Boddington resolved on 7 August 2007 to make the following local law.

1. Citation This local law may be cited as the Shire of Boddington Dogs Amendment Local Law 2007.

2. Principal Local Law In this local law, the Shire of Boddington Dogs Local Law published in the Government Gazette (Special) No. 253 of 29 November 2000 is referred to as the principal local law. The principal local law is amended as follows.

3. Clause 5.2(1) amended Clause 5.2(1) is amended by deleting sub-paragraph (a) and inserting the following— “ (a) all foreshore reserves, other than between the signs prohibiting dogs at

either end of the recognised Hotham River Picnic Area; (b) Farmers Reserve and Bluegum Park; and ” renumbering sub-paragraph “(b)” to “(c)”.

Under the powers conferred by the Local Government Act 1995, and all other powers enabling it, the Council of the Shire of Gnowangerup resolved on 22 August 2007 to make the following local law.

1. Citation This local law may be cited as the Shire of Gnowangerup Repeal Local Law 2007.

2. Operation This local law will come into operation fourteen days after the day on which it is published in the Government Gazette.

3. Repeal The following local laws are repealed—

RWWA RULES OF THOROUGHBRED RACING 2004 In accordance with Section 45(1)(a) of the Racing and Wagering Western Australia Act 2003, notice is hereby given that the Board of Racing and Wagering WA on 31 August 2007 resolved that, the RWWA Rules of Thoroughbred Racing 2004 be amended as follows with effect from 28 August 2007.

RACING AND WAGERING WESTERN AUSTRALIA (ADOPTED TABCORP BETTING RULES)

NOTICE (NO. 1) 2007 Made by Racing and Wagering Western Australia under section 59(6)(c) of the Act. 1. Citation This notice is the Racing and Wagering Western Australia (Adopted TABCORP Betting Rules Notice (No. 1) 2007. 2. Interpretation In this notice—

“the Act” means the Racing and Wagering Western Australia Act 2003; “the Rules” means the rules described in clause 3, adopted by Racing and

Wagering Western Australia. 3. Rules adopted under section 59(4) of the Act (1) In a meeting held on 21 February 2005and a further meeting held on 26

April 2005, Racing and Wagering Western Australia resolved to adopt and operate under rules relating to a combined totalisator scheme in accordance with section 59(4) of the Act.

dated 27 August 2007. (2) Those further amendments to the Rules are published in the Schedule to

this notice for public information, as required by section 59(6)(c) of the Act. Schedule 1—Amendments to Adopted Rules

1. Rules 3.5 through 3.8 are amended as follows— Renumber rules to read 3.6 through 3.9 respectively.

2. After rule 3.4 insert rule 3.5 as follows— 3.5 FLEXI BETS 3.5.1 In the case of a Flexi Bet, the minimum amount that may be invested

on a totalizator in a single bet is the greater of— (a) 1 cent for each combination covered by the bet; or (b) an amount determined by the Betting Operator. 3.5.2 Flexi Bets are available on a Trifecta, First 4, Quaddie or any other

totalizator as otherwise determined by the Betting Operator. 3.5.3 The amount invested on each combination covered by a Flexi Bet is

determined by dividing the total amount of the Flexi Bet by the number of combinations covered by the Flexi Bet (with any fractions rounded down to the nearest ten thousandth of a cent (i.e. rounded down to four decimal places)).

3.5.4 Any amount resulting from rounding down the amount covered by a combination covered by a Flexi Bet to the nearest ten thousandth of a cent forms part of the investment pool of the relevant totalizator upon which the Flexi Bet is made.

RG303 RACING AND WAGERING WESTERN AUSTRALIA ACT 2003

RWWA RULES OF HARNESS RACING 2004 In accordance with Section 45(1)(b) of the Racing and Wagering Western Australia Act 2003, notice is hereby given that the Board of Racing and Wagering WA on 31 August 2007 resolved that, the RWWA Rules of Harness Racing 2004 be amended as follows. Local Rule 92 be inserted to read and shall apply from 31 August 2007 until 3 September 2007—

“For the purpose of determining the age of any horse under Rule 92 for the period commencing 1 September 2007 up to and including 2 September 2007, the age of a horse shall be reckoned as beginning on 3rd September in the racing year in which it is foaled provided however that if a horse if foaled in New Zealand between 1 August and 2nd September inclusive its age shall be reckoned as beginning on 3rd September next following”

Amend definition of “Racing Year” as follows— “For the period 1 September 2007 up to and including 2 September 2007, “Racing year” means the period commencing 1 September 2006 ending 2 September 2007” “For the period 3 September 2007 up to and including 31 August 2008, “Racing year” means the period commencing 3 September 2007 ending 31 August 2008”

Shire of Dandaragan FIREBREAK ORDER 2007/2008

Notice to all owners and/or occupiers of land in the Shire of Dandaragan.

Firebreaks Pursuant to the powers contained in Section 33 of the above Act, you are hereby required on or before the 1 November 2007, to clear all inflammable materials and/or install firebreaks in accordance with the following, and thereafter to maintain the firebreaks clear of all inflammable material up to and including the 29 March 2008.

Rural Land 1. Clear of all inflammable material, firebreaks at least three (3) metres wide inside and within

fifty (50) metres of all external boundaries of all improved and unimproved land owned or occupied by you. For the purpose of this section, all Road Reserves are to be taken as boundaries.

2. Where the bush on the land owned or occupied by you has been bulldozed, chained or prepared in any similar manner for clearing by burning (whether you intend to burn the bush or not), clear of all inflammable materials, firebreaks not less than twenty (20) metres wide immediately inside the external boundaries of the land on which bulldozed, chained or otherwise prepared bush is situated.

3. Where there is standing timber on land owned or occupied by you and it is intended to burn such timber, to clear of all inflammable material, firebreaks not less than six (6) metres wide immediately inside the external boundaries of the land on which the timber is standing.

Townsites Pursuant to the powers contained in Section 33 of the aforementioned Act, for property owners within the townsites of Jurien Bay and Cervantes, you are hereby required on or before 15 November 2007, to clear all inflammable materials, install firebreaks and/or remove any fire hazards in accordance with the following, and thereafter to maintain the property clear of all inflammable materials up to and including the 29 March 2008.

Rural Residential/Special Use The townsites of Badgingarra and Dandaragan plus areas such as Alta Mare, Jurien Bay Heights, Marinefields and Hill River shall comply with the aforementioned requirements on or before the 1 November 2007, and shall maintain the property clear of all inflammable materials up to and including the 29 March 2008. Owners and/or occupiers of any land within the townsites of Dandaragan, Regans Ford, Badgingarra, Cervantes and Jurien Bay on all undeveloped and/or vacant properties shall comply with the following—

That within all townsites, on all undeveloped lots, that a two (2) metre wide firebreak is slashed around all boundaries of each lot and that all inflammable materials are removed from the property. Council may from time to time recommend that all the townsite’s undeveloped lots be totally slashed to reduce the fire hazard on the blocks. All properties, which have buildings or structures upon the property, shall remove all/any inflammable materials from the property. Inflammable material is defined for the purpose of this notice to include bush, dry grasses, timber boxes, cartons, paper and similar flammable materials, rubbish and any combustible matter, but does not include green standing trees or growing bushes and plants in gardens or lawns.

General If, for any reason, it is considered impractical to comply with the requirements of this notice, you may apply in writing to the Council or its duly authorised officer by no later than the 13 October 2007, for permission to provide alternative fire hazard reduction within the property and include details outlining these alternatives. If Council, or its duly appointed officer, does not grant such permission, you shall comply with the requirements of this notice. 1. Persons who fail to comply with the requirements stated in this order may incur penalties,

either by way of infringements or prosecutions, as defined in the Bush Fire Act 1954 Regulations. In addition, should property owners fail to comply with this order, Council can, at any time after the specified dates, enter the property and carry out the required work, where the owner(s) of the property will be liable for all penalties and costs incurred.

2. If the requirements of this order are carried out by burning, such burning must be carried out in accordance with the relevant provisions of the Bush Fire Act.

3. The requirements of this notice are considered to be minimum standard of fire prevention to protect not only individual properties, but also the district generally. In addition to this order, the Shire of Dandaragan may issue separate special orders on owners or occupiers if a particular fire hazard removal is deemed necessary.

4. The Council no longer installs firebreaks for ratepayers. Council recommends the owner(s) of vacant properties contact local contractors as soon as possible to ensure the requirements of this notice are carried out.

Combined State Waters Areas Area L06-10 with T06-1 These areas comprise blocks described below which straddle the baseline dividing the Petroleum Act 1967 from the Petroleum (Submerged Lands) Act 1982. Despite that two statutes are involved, only a single combined application (proposing a unified work program) is necessary. However the application fee in this instance is $7800.00. While two permits will be issued to the successful applicant, those permits will, as far as the legislation allows, be dealt with as one. While these release areas interface the Territorial Baseline and/or three nautical mile limit of coastal waters, they are captured to the AMB Version 2 2006 dataset.

APPLICATION DETAILS Central to any application made is the program of work proposed for each of the years of the six year term. Applications are to be made in accordance with Section 31 of the Petroleum Act 1967 and Section 21 of the Petroleum (Submerged Lands) Act 1982 as appropriate. Consideration of an application for the grant of a Permit shall take into account work programs relative to the whole of the area applied for, the adequacy of the work program and the applicant’s technical and financial ability to undertake the work. Permits are awarded on the understanding that the first two years work commitment will be fulfilled without variation. Where there is more than one applicant to the application, the percentage participating interests of each party to the application is to be supplied including evidence that a satisfactory settlement has been, or can be, reached on a Joint Operating Agreement (a copy of a Heads of Agreement dealing will generally suffice). Applicants should also make themselves aware of the existence of any areas, which have the potential to restrict exploration activities eg, National Parks, Nature Reserves, Marine Parks, World Heritage Areas, Conservation Reserves, Defence Areas and Mining Titles. Insofar as Reserved Land is concerned, entry for exploration purposes is subject to approval by the Minister. In this regard, it should be noted that Government policy, at least, is such that petroleum extraction from within National Parks, Nature Reserves and access to Conservation Estates should not be presumed. In respect to offshore areas, impacts on fishing activities should also be considered. Any applications over the above onshore areas may be subject to the provisions of the Commonwealth Native Title Act 1993 and applicants should be prepared to negotiate with Native Title parties pursuant to the right to negotiate provisions of the NTA. It should, however, be noted that the right to negotiate does not apply offshore. Applicants should also be aware that all the areas available for application are subject (at least in part) to Native Title claims. Plans showing these claim boundaries are available from the Department of Industry and Resources. An information package on the release areas detailing the criteria for assessment of applications and the conditions to apply following the award of a permit, and including a plan of the release areas and an application proforma, is available on CD-ROM. Copies of the CD-ROM can be obtained from the Petroleum and Royalties Division, Department of Industry and Resources by contacting the Senior Titles Officer (Releases) on (08) 9222 3130.

EXEMPTION CERTIFICATE PURSUANT TO REGULATION 2.13 (No. 14 of 2007)

I, Nina Lyhne, WorkSafe Western Australia Commissioner, hereby grant an exemption to Downer EDI Engineering Power Pty Ltd from the requirements of regulation 3.117(1) of the Occupational Safety and Health Regulations 1996 in relation to the requirement to hold a class 1 demolition licence to dismantle tower number 49 on the MU—SHO 91 line. I further grant an exemption from the requirements of regulation 3.118(a) of the Occupational Safety and Health Regulations 1996 in relation to the requirement to ensure that any Class 1 demolition work is done by a holder of a class 1 demolition licence during the dismantling of the above-mentioned tower.

This exemption is subject to the following conditions— • The demolition work is carried out in accordance with Australian Standard AS2601-2001.

• All work is carried out in accordance with requirements under the Occupational Safety and Health Regulations 1996 (other than the above-mentioned regulations) and requirements and instructions of Western Power.

• A safe work plan and JSAs are developed for the work. • All workers are instructed on the safe work plan and relevant JSAs, before any work

commences.

• All workers hold relevant certificates of competency for their required work. • There is adequate supervision for the work.

• An adequate earthing system is fitted to crane while it is in use. This exemption is a once off exemption for the dismantling of the above-mentioned tower and it expires on 31 October 2007

(No. 17 of 2007) I, Nina Lyhne, WorkSafe Western Australia Commissioner, hereby grant an exemption to Alstom Power Limited from the requirements of regulation 4.2(1)(c) of the Occupational Safety and Health Regulations 1996 in relation to the Heat Recovery Steam Generator located at the NewGen Kwinana Power Station, Lot 22 Leath Road, Naval Base insofar that it requires the Heat Recovery Steam Generator bear a code stamp for field assembly work, as required by the American Society of Mechanical Engineers code BPVC-1-2004, and in accordance with its registered design (number WAP 20186). This exemption is granted on the condition that— • The master data report for the complete boiler and separate manufacturer’s data reports for

relevant component parts are supplied with the application for individual item of plant registration.
