§ India has a well-established legislative, administrative and judicial framework tosafeguard Intellectual Property Rights (IPRs), which meets its internationalobligationswhile utilizing the flexibilities provided in the international regime toaddressitsdevelopmentalconcerns.IndiahasaTradeRelatedAspectsofIntellectualPropertyRights(TRIPS)compliant,robust,equitableanddynamicIPRregime.
§ TheIndianIPsystemmaintainsafinebalancebetweenprivaterightsthroughIPRsononehand,andrightsofthesocietyaspublicinterestontheotherhand.
§ TRIPSAgreementhasallowedpolicyspacetocountriestoevolvearegimethatbestsuitsitscondition.Thispolicyspaceisasinequanonforsustainabledevelopmentofthecountry.
§ IndiaisapartytoDohaDeclarationontheTRIPSAgreementandPublicHealthwhichclarifiesthatTRIPSagreementdoesnotandshouldnotpreventmembersfromtakingmeasurestoprotectpublichealth.
1. NationalIPRPolicy
AcomprehensiveNational IPRpolicyhasbeenapproved thatwillnotonly stimulateinnovationandcreativityacrosssectors,butalsoprovideaclearvisionregardingIPRissues.ThePolicydocumentisavailableonthewebsiteoftheDIPPhttp://dipp.nic.in.
§ Objectives
• IPRAwareness-OutreachandPromotion-Tocreatepublicawarenessabouttheeconomic,socialandculturalbenefitsofIPRsamongallsectionsofsociety.
• GenerationofIPRs-TostimulatethegenerationofIPRs.
• Legal andLegislative Framework -Tohave strong and effective IPR laws,whichbalancetheinterestsofrightsownerswithlargerpublicinterest.
• AdministrationandManagement-Tomodernizeandstrengthenservice-orientedIPRadministration.
• CommercializationofIPRs-GetvalueforIPRsthroughcommercialization.

AnIndiawherecreativityandinnovationarestimulatedbyIPforthebenefitofall;an India where IP promotes advancement in science and technology, arts andculture, traditional knowledge and biodiversity resources; an India whereknowledge is the main driver of development, and knowledge owned istransformedintoknowledgeshared.

§ ImplementationandMonitoring
Since the implementation of the policy requires collaboration at inter-departmentallevelasalsowithvariousstakeholders,anIPRdashboardhasbeencreatedfornodalDepartments/Ministriestoprepareandmonitortheactionplan.
2. StrengtheningofInstitutionalMechanism
§ AllIPRsunderoneumbrella
• The administration of Copyright Act, 1957 and Semiconductor IntegratedCircuits Layout-Design Act, 2000 has been transferred to DIPP. This hasenabledanintegratedapproachandsynergybetweendifferentIPofficesandActs.
§ OneAppellateBoard
• UndertheFinanceAct2017,theCopyrightBoardhasalsobeenmergedwiththeIntellectualPropertyAppellateBoard(IPAB).TheIPABChairmanhasbeenappointedandhehas takencharge.Theprocess forengagingmembershasbeeninitiated.
§ CellforIPRPromotionandManagement(CIPAM)
• Createdtoaddressthe7identifiedobjectivesofthepolicy.
• AprofessionalbodyundertheaegisoftheDepartmentofIndustrialPolicyandPromotion(DIPP)toensurefocusedactiononissuesrelatedtoIPRs.
• AssistinsimplifyingandstreamliningofIPprocesses,apartfromundertakingstepsforfurtheringIPRawareness,commercializationandenforcement.

3. ClearingBacklog/ReducingPendency
§ PendencyinPatentexaminationistargetedtobebroughtdownfromthepresent5to7yearstolessthan18months.Thetechnicalmanpowerhasbeenaccordinglyaugmented.Alreadyforthe1sttimeinthepastfewyears,theactualnumberofpatentapplicationsexaminedexceededthenumberfiledinanyonemonth.
§ Topromoteeaseofdoingbusiness,theofficeofCGPDTMhasintroducedautomaticissuanceofelectronicallygeneratedpatentcertificateandtrademarkcertificate.
§ Pendency in Trademark examination has already been brought down from theerstwhile13monthstojust1month,muchearlierthanthetargetmonthofMarch2017.
§ ThereductioninpendencyisalsoevidentfromtheIPRtrendsenumeratedahead.
4. IncreaseinFilings
§ Patentfilingsincreasedby6%(approx.)in2016-17vis-à-vis2014-15.
§ Trademark filings shotupby40%(approx.) in2016-17 compared to2014-15;reflectingthebuoyancyintheIndianeconomy.

§ TherehasbeenastratosphericincreaseinTrademarksexaminations:thenumbershave almost doubled in the financial year (F.Y.) 2016-17 as compared to sameperiodin2015-16.
5. BusinessProcessRe-engineering
§ HighlightsoftheAmendmentsinPatentRules
• ThePatentRules,2003havebeenamendedtostreamlineprocessesandmakethemmoreuserfriendly.
• Provisionshavebeenincludedforcondonationofdelayduetowar/naturalcalamities.
• Refund of fees in certain cases has been permitted, as also withdrawal ofapplicationbeingpermittedwithoutanyfees.
• Timelines have been imposed to ensure speedy disposal, the number ofadmissibleadjournmentshavebeenlimited.
• Applications canbe transferredelectronically fromanyof thePatentOfficebranchestoanother.
• ExpeditedExaminationisnowpermittedoncertaingrounds.
• Hearingthroughvideoconferencing.
• Specialprovisionshavebeenmade for startupswhereby theywill get80%rebateinfeesvis-à-visothercompaniesasalsoexpeditetheirapplication.
§ HighlightsoftheAmendmentsinTrademarkRules
• TheTradeMarksRules,2002havebeenrevampedandTheTradeMarksRules,2017werenotifiedon6thMarch,2017.
• 50%lowerfaresforfilingTradeMarkApplicationsbyIndividuals/Startups/SmallEnterprisesvis-à-visCompanies.
• The 74 separate forms and applications have now been replaced by 8consolidatedforms.

• Processofdeterminingawell-knownmarkhasbeenlaidoutforthefirsttime.
• E-filingencouragedthrough10%rebateinfeesfore-filingvis-à-visphysicalfilingofTradeMarkApplications.
• EmailnowrecognizedasaModeofService.
• AllowanceofVideoConferencingforHearings.
• ‘Startup’ and ‘Small Enterprises’ defined. Same applies to both Indian andforeignentities.
• ProvisionsrelatingtoexpeditedprocessingofanapplicationforregistrationofaTradeMarkhavebeenextendedrightuptoregistrationstage(before,itwasonlyuptotheexaminationstage).
• The new Rules have an express provision for filing applications for soundmarks whichmust now be submitted in anMP3 format, not exceeding 30seconds in length. This is also to be accompanied with a graphicalrepresentation of the sound notations. In this regard, the definition of“graphicalrepresentation”hasalsobeenrevisedtoincluderepresentationindigitizedform.
• Numberofadjournmentsinoppositionproceedingshasbeenrestrictedtoamaximumoftwobyeachparty,whichwillhelpdispose-offmattersintime.
• NumberofentriesintheFeeshasreduced.
§ Transparency
• Transparency has been ushered in by providing for dissemination ofinformation through dynamic web-based innovative utilities. This can befreelyaccessedbythepublic.
• Thequeuingsystemhasbeenstrictlyenforcedfortakingupapplicationsforexaminationanddisposal.Acommonqueueisnowbeingmaintainedacrossallpatentoffices,ensuringefficientuseofavailableresourcesandmanpower.
• GrievancesareaddressedthroughtheGovernmentofIndiaportal(CPGRAMS)asalsoTwitterSeva,etc.
• CIPAM’s active presence on the social media like Twitter, Facebook andYouTube also allows for instantaneous feedback and interaction withstakeholders.
§ ExpeditedExaminationofPatentApplications
• PermittingExpeditedexaminationofpatentapplicationsforthefirsttimehasshownremarkableresults.Theshortesttimetakentograntapatentrecentlyhasbeenjust113daysfromthefilingoftherequestforexamination.Ason31st

December2017,225ofthe323expeditedapplicationsreceivedhadalreadybeen examined and 45 Patents granted; of these, 9 have been granted tostartups.
§ GuidelinesonComputerRelatedInventions
• The office of the Controller General of Patents Designs and Trademarks(CGPDTM) in August, 2015 issued guidelines for the examination of patentapplicationsinthefieldofCRIswithanaimtofosterunanimityandconsistencyin the examination of such applications. However, after proponents of opensourcesoftwareexpressedconcernstotheseguidelines,theywerestayedandfreshguidelineswereissuedinFebruary,2016.
• DIPPreceivedrepresentationsfromseveralstakeholders,includinglawfirms,inthisregard.Acommitteewasconstitutedtore-examinetheseguidelinesaftertakingintoconsiderationviewsofstakeholders.Thecommitteesubmitteditsreport.
• Thereportwasexaminedandthematterwasdiscussedwithstakeholders.Thenewguidelineswereissuedafterconsultationswithallthestakeholderson30thJune,2017.Theterm‘novelhardware’hasbeendeletedfromtheManual.
§ WIPOCASEandDAS
• India is already anAccessingOffice forWIPOCASE, and is in the process ofbecomingaDepositingOffice.
• The IndianPatentofficewill soonbeable toaccessPrioritydocuments fromWIPODAS,forwhichnecessarystepsareunderway.
• IndiasignedanMoUwithWIPOinOctober2017onDataExchangeandDataQuality.
6. AugmentationofHumanResources
§ TheGovernmentofIndiaisseriousontheaugmentationofmanpowerinIndianPatentOffices.459newtechnicallycompetentPatentExaminersinvariousfieldsoftechnologyhavebeenappointedonregularbasisinadditiontotheexisting130.Also,27postsofDeputyControllersand49postsofAssistantControllersinPatentOffice,havebeenfilledupthroughpromotion.Thisexponentialincreaseisalreadybringingdownthependency.
§ Manpower has also been augmented manifold on the trademark front withrecruitmentof4SeniorExaminersand55Examinersbeingmadeinadditiontoexisting63.Apartfromthis,servicesof84TrademarkExaminersarebeingutilizedoncontractualbasis.Thishasalreadycutdowntheexaminationtimedrasticallyfrom13monthstojust1month,asalsopendencyatlaterstages.

7. CreatingIPRAwareness
§ CIPAMinpartnershipwithindustryassociationshasconducted19IPRawarenessroadshowsin18statesintheyear2016.
§ TheIPRAwarenessCampaigninschoolswaslaunchedincollaborationwiththeInternationalTrademarkAssociation(INTA).IPRAwarenessprogramshavebeenconductedin49schoolstillnow.ThecampaignusespresentationsandcreativelyillustratedpostersandpamphletswhichcoverthebasicsonIPRsandtheneedtoprotect IPRs. More awareness programs are planned in Jawahar NavodayaVidyalayas,KendriyaVidyalayasandSavodayaVidyalayas.
§ SimilarprogramsforColleges/Universitiesandindustryarealsobeingtakenup.One suchworkshopon IPRAwarenesswasorganized inKingGeorge’sMedicalUniversity,Lucknow.CIPAMalsopartneredforworkshopsatAmityUniversityandShardaUniversity.
§ 51 Programs have been conducted by RGNIIPM and 2 programs have beenconductedincollaborationwithWIPO,tillNovember,2017byO/oCGPDTM.
§ Firstbatchofthe‘TrainingofTrainers’wasconductedincollaborationwithTIFAC.ThesecertifiedTrainerswillinturnconducttheawarenessworkshopsinschools,collegesandindustries.
§ CIPAMhastiedupwithAgastyaInternationalFoundationtoconductawarenessprograms in school. The first batch of Training of Trainers of Agastya wasconductedinDelhi,whointurnwillconductprogramsinschools.
8. IPRsinSchoolSyllabus
§ ContentonIPRisbeingincludedintheNCERTcurriculumofCommerceforClassXII. Also, a chapter on ‘IPR, Innovation & CreativeWorks’ is being included inNCERT’s“HandbookonEntrepreneurshipforNortheastRegion(NER)”.
§ WorkisongoingtoincludeIPRsinotheracademicstreamstoo.
9. IPREnforcementToolkitforPolice
§ CIPAMinassociationwithFederationofIndianChambersofCommerce&Industry(FICCI)hasmadeanIPREnforcementToolkitforPolice,whichwaslaunchedbyCommerceandIndustryMinister.
§ ThisToolkitaidspoliceofficialsindealingwithIPCrimes,inparticular,TrademarkcounterfeitingandCopyrightpiracy.AsmiliarToolkitforCustomsisintheprocessofbeingmade.
10. PoliceTrainingPrograms
§ 26ProgramsfortrainingofPoliceofficialsonIPEnforcementhavealreadybeenundertaken by CIPAM. In association with IP experts from law firms and the

industry, trainings have been organized in the states of Andhra Pradesh, UttarPradesh,WestBengal,MadhyaPradesh, Telengana,Haryana, Jharkhand as alsotwo rounds of trainings in the North-East Police Academy (which includedparticipantsfrom9states)andthreeroundsatSardarVallabhbhaiNationalPoliceAcademy,Hyderabad.
§ Anadvisoryhasbeen issuedby theMinistryofHomeAffairs to all StatePoliceAcademiestoincorporateIPRintheirtrainingcurriculumforbothregularandin-service police officers. CIPAM has written to all State Police Academies toundertake these trainingprogamsand include IPRasasubject in their trainingcurriculum.
§ CIPAM, DIPP organized a three day “National Workshop on Enforcement ofIntellectual Property Rights” in August, 2017 for state police officals, publicprosecutorsandrepresentativesfromindustryandacademia.TheworkshopwasinauguratedbyHon’bleUnionMinisterofHomeAffairs.
11. SensitizationProgramsforJudiciary
§ The training of Judges on IP Enforcement and adjudication has also beenundertaken.
§ TwocolloquiumsoncommerciallawsforHighCourtJudgeswereheldatNationalJudicialAcademyofBhopal.DIPPofficialssensitizedtheparticipating judgesongovernmentpoliciesvis-à-visIPRs.Further,trainingprogramsarebeingplannedin conjunctionwith National Judicial Academy (NJA) and various State JudicialAcademies.DIPPincollaborationwithWIPOandNJAorganizeda3-dayconferenceforHighCourtJusticesonIPRsinNovember,2017.
12. CombatingOnlinePiracy
§ Tocounteronlinepiracy,CIPAMcollaboratedwithNationalInternetExchangeofIndia(NIXI)topulldown80infringingwebsitesonthebasisofincompleteKYC(referredtoasWHOIS)and6websiteshavesubmittedtheirWHOIScredentials.
§ CIPAMlaunchedanAnti-PiracyVideoCampaignincollaborationwithViacom18MediaPvt.Limitedusingthepopularcartooncharacters–MotuandPatlu,toraiseawarenessinkidsonpiracy.
13. TechnologyandInnovationSupportCentres(TISCs)
§ AServiceLevelAgreement (SLA)hasbeen signedbetweenDIPPandWIPO forestablishingTechnologyandInnovationSupportCentre(TISC)networkinIndia.
§ ThefirstTISChasbeenestablishedatPatentInformationCentre(PIC),PunjabandsecondTISChasbeenestablishedatAnnaUniversity,Chennai.

§ IncollaborationwithWIPO, firstroundof trainingon ‘AccesstoTechnologyforInnovationandEstablishingTISCNetwork’hasbeenconductedatthetwoTISCs.
14. StateEngagements
§ TopromoteIPRcells,tie-upshavebeenestablishedwithUniversitiesinGujarat,Punjab, Uttar Pradesh, Himachal Pradesh and Rajasthan and workshops havebeenconductedforthesame.
§ StateGovernmentshavealsobeentakinginterestinstrengtheningtheIPRregime.Inparticular,RajasthanandJammu&Kashmirhavebeenextremelyactiveinthisregard.
15. GlobalInnovationIndex(GII)
§ In therecently releasedGII-2017report, India’s rankhas improvedby6placesfromthatof2016.India’srankintheyear2015was81standintheyear2017ithasjumped21placestothe60thposition.
§ IndiahasretainedtoprankinInformationandCommunicationTechnologyServiceExportforthelastfouryears.
§ India is the top-ranked economy in Central and Southern Asia and has nowoutperformedoninnovationrelativetoitsGDPpercapitaforsevenyearsinarow.
§ Report mentions that “The emergence of innovative new Asian Tigers, aninnovative India, and better innovation networks in the region are likely to beamongthemostencouragingdevelopmentsforworldwideinnovationinthenextfewdecades”.
§ RecognizingIndia’spotentialtoreachgreatheightsininnovationandcreativity,a Task Force on Innovationwas set up. The Task Force on Innovation had themandate of assessing India’s position as an innovative country, and suggestmeasurestoenhancetheinnovationecosysteminIndiaandthusimproveIndia’srankingintheGII.TheTeam,comprisingofGovernmentoffcialsandexpertsfromprivateorganisations&academia,hascompiledthisReporttoassistIndiainthisjourney.
16. PromotionofGeographicalIndications
§ CIPAMalsolaunchedasocialmediacampaignon‘GeographicalIndications’(GIs)topromoteIndia’sGIsandtherebyprovideaplatformtoshowcasetheworksofourweavers,farmers,artisans,craftsmenandruralcommunitiesofthecountry.
§ AlogodesignandtaglinecontestforGIshadbeenlaunchedonMyGovwebsiteforidentifyinga common tag forall IndianGIs irrespectiveof their categories.918slogansand383logodesignentrieshavebeenreceived,evalutionisinprogress.

17. SocialMediaCampaign
§ CIPAM launched a social media campaign - “LetsTalkIP” which received anoverwhelming response from the IPR fraternity and has helped in the organicgrowthoffollowersonTwitter,FacebookandYouTube.
18. IPRsforStart-UpsandMSMEs
§ ASchemeforfacilitatingStartupsIntellectualPropertyProtection(SIPP)hasbeenlaunchedforencouraginginnovationandcreativityofStartups.
§ TheScheme,runonapilotbasisinitially,isinforceupto31stMarch,2020.
§ TheSchemehasbeendraftedwith a vision toprotect andpromote IntellectualPropertyRightsofstartupsandthusencourageinnovationandcreativityamongthem.Underthescheme,theGovernmentbearstheentirecostofthefacilitator/lawyeroragentwhoassiststhestartupfileforanynumberofPatents,TrademarksorDesigns.
§ Foreffectiveimplementationofthescheme,facilitatorshavebeenempaneledbythe Controller General of Patents, Designs and Trademarks (CGPDTM). TheCGPDTMmayrevisethelistoffacilitatorsfromtimetotime.
§ TheCGPDTMregulatesconductandfunctionsofempaneledfacilitatorsfromtimetotime.
§ TheIPprocesseshavebeenre-engineeredtofacilitatestart-ups.An80%rebateisprovidedtoStartupsonPatentfilingfees.Theycanalsoavailthespecialfacilityofexpeditedexaminationoftheirpatentapplications.
§ UnderthenewTrademarkrules,Startupshavebeengivena50%rebateinfilingfeesvis-à-visothercompanies.
§ 50%feeconcessionisprovidedforMSMEsvis-à-vislargeentitiesonpatentasalsotrademarkfees.

19. DynamicUtilityFacilitiesavailableonWebsiteofO/oCGPDTM
§ TheControllerGeneralofPatents,DesignsandTrademarks (CGPDTM) in2014launched various features to provide online search services for patents andtrademarksinordertomaketheprocesseasier,andtoprovidetransparentandaccurate results. Thewebsite ofO/oCGPDTM is nowupdated toprovidemoreuser-friendlyinterface.
§ The features include innovative tools such as “Stock and Flow”- a utilitywhichexistedforTrademarks,hasnowbeenextendedtoPatentsalso.ReportssuggestthattheIndianPatentOfficeisthefirstintheworldtoachievesuchtransparency.ThestockandflowfacilityhasmadeworkhappeninginthePatentOfficepublicand,showsstockandflowatdifferentlocationsonareal-timebasisontheofficialwebsite.
a. DynamicUtilityFacilityunderPatents
§ Expired/CeasedPatents-ThisisatooltoprovideaccesstothePatentsthathaveceasedtobeineffectundersection53(2)ofthePatentsAct,1970.ThestatusofthepatentisupdateddynamicallyandtheuserhasaccesstothecompletePatentDocumentandE-register.
