    INVITATION TO TENDER FOR STANDING TIMBER

    Geulan, Pennant Nr Llanbrynmair, Powys

    REFERENCE: GEULAN 2018-1 Description:

    Coupe: Approximately 3,325 tonnes of Japanese larch, Scots pine and Mixed conifer on variable terrain across several small scale coupes. A proportion of the larch is subject to a Statutory Plant Health Notice and MUST BE FELLED. As this coupe contains “Phytophthora-affected wood”, the purchaser will be required to hold a movement license and to move the larch to a licensed processor.

    Timing: Tenders should be received by 12 noon on 12 February 2018, by email to

    The contract will be based on a single price per tonne. Felling must commence no later than 12 March 2018 to ensure all larch in compartment 4d is felled no later than 31 March 2018.

    Volumes: The tonnage has been estimated by the manager from the compartment data. There has been no pre-sale crop measurement on this coupe.

    Hazards: Hazards are detailed on the attached plan. Environment: Purchasers will require to submit a Diffuse Pollution mitigation plan to the

    woodland manager for review and approval prior to commencement on this site.

    Felling License / STATUTORY PLANT HEALTH NOTICE:

    Felling: All conifers in the sale area should be felled unless instructed by the

    woodland manager. All material above 5cm diameter is to be removed from the site by the purchaser. All larch in or adjacent to the coupe is to be felled regardless of diameter. Any larch to remain in the coupe should be snedded, where required, so that the main stem is laid directly onto the ground. Conifer stumps will be treated with urea supplied at the purchaser’s expenses unless specifically agreed with the woodland manager prior to commencement of harvesting.

    Brash: Brash is to be kept clear of all watercourses during the felling operations.

    Purchasers should state their proposals for leaving the site clear and ready for replanting following discussion with the woodland manager and brash should be cut into lengths of less than 2 metres.

  • Access, Extraction and Stacking:

    Coupe: The site is partially subject to biosecurity measures, please refer to guidance in appended Statutory Plant Health Notice. Stacking areas must be agreed with the woodland manager. No stacking is permitted on the public road. No cross-loading is permitted for any Larch loads from compartment 4d, unless the cross-loading facility is already licensed for the movement of Phytophthora affected wood. Wagons to be brushed down before exiting the Phytophthora control zone. Marked on attached plan. Before moving machines between sites biosecurity measures must be undertaken as per below: • Machines, plant and any road vehicles that have been driven off hard surfaced roads onto an infected site must be cleaned on a hard standing beside a surfaced forest or council road. A pressure washer should be used, preferably one that uses hot water or steam. Care must be taken to ensure that any water run-off does not enter watercourses. • This cleaning should focus on removing as much mud and needle debris as possible focusing on tyres, wheels, mud flaps, sills, wheel arches, guarded areas and anywhere else where mud and needle debris may have accumulated. Cab floors and pedals should also be checked and cleaned. • After cleaning, tyres should be disinfected with Propellar™ or other disinfectant approved for use against Phytophthora. LOADS ARE NOT TO BE MIXED. Ideally compartment 4d timber should be fully dispatched before haulage commences for the remaining coupe. Stacking areas must be agreed with the woodland manager.

    Payment: Payment terms are to be on a monthly basis with the purchaser producing

    self billing invoices based on weight tickets or as otherwise agreed between the parties. A down payment may be payable before entry and offset against the penultimate payment or as otherwise agreed between the parties.

    Contract: An Agreement will be required to be signed by both parties. A copy is

    available on request.

    Although the vendor intends to sell the timber, the vendor will not be bound to accept the highest or any other offer.

  • Viewing: The timber may be viewed at any reasonable time during daylight hours, as long as a copy of this document is carried. Please contact the woodland manager to arrange a viewing.

    NOTICE REQUIRING ONE OR MORE MEASURES TO BE TAKEN WITHIN THE WALES DISEASE LIMITATION ZONE

    Under the powers conferred by Article 30 of the Plant Health (Forestry) Order 2005, the land at Esgair Geulan 2, near Pennant (OS Grid Reference SN853973), has been inspected and Natural Resources Wales has reasonable grounds for suspecting that Phytophthora ramorum is present or is likely to be present on larch trees identified within the areas marked by the red boundary on the attached Annex 1 Map Accordingly Natural Resources Wales in pursuance of Article 31(4) of the Plant Health (Forestry) Order 2005, hereby give notice requiring you to take the measures within the time period specified in Schedule 1. Under the powers conferred by Article 35 of the Plant Health (Forestry) Order 2005, you are required to inform a Natural Resources Wales inspector no later than : 31 March 2018 that the measures specified in Schedule 1 have been complied with and the details of the steps taken in order to comply with them. This information must be provided to NRW Tree Health Team, who can be contacted either in writing at the office address detailed below; or using email address [email protected], quoting reference number 17/05729/01 Please note that if the land is not re-stocked with trees or maintained as woodland, it may be considered as a change of land use under the Environmental Impact Assessment (England and Wales) (Forestry) Regulations (1999) and NRW’s consent may be required. In such cases you should seek advice from NRW’s Regulatory Woodland Officers (0300 065 3000).     The Plant Health (Forestry) Order 2005 Article 31(4) Notes: General

    1. Phytophthora ramorum is a tree pest referred to in Article 31(5)(b) of the Plant Health (Forestry) Order 2005, which is not normally present in Great Britain and in respect of which there is a danger of its spreading or being spread in Great Britain.

    2. Under Article 43(1) a person shall be guilty of an offence if without reasonable excuse, proof of which shall lie with him he contravenes or fails to comply with a provision or condition of a Notice served, or licence granted or of any direction given, under this Order; or he intentionally obstructs an inspector or any person authorised by an inspector in exercise of his powers given by or under this Order.

    3. Under Article 44 a person guilty of an offence under this Order shall be liable on summary conviction to a fine not exceeding level 5 on the standard scale.

    4. Under Article 36(1) if any person fails to comply with a Notice served under this Order then, without prejudice to any proceedings consequent upon such failure, an inspector may, on production if so required of his authority, at all reasonable times for the purposes of this Order enter any premises in which any tree pest or relevant material to which the Notice relates may be present and take or cause to be taken such steps as appear to him to be necessary either to ensure compliance with the requirements of the Notice or to remedy the consequences of the failure to carry them out.

    5. Under Article 36(2) an inspector entering any premises under paragraph (1) may take with him such other persons, including representatives of the European Commission, and such equipment and vehicles as he considers necessary for the purposes of facilitating the exercise of his powers under that paragraph, and such other persons whether or not accompanied by the inspector and on production, if so requested, of their authority given in that behalf by Natural Resources Wales, may remain on the premises and from time to time re-enter the premises with any equipment or vehicles that person considers necessary, and carry out such work and in such manner as the inspector may direct.

    6. Under Article 36(3) where an inspector takes any steps pursuant to Article 36 paragraph (1), Natural Resources Wales may recover all reasonable costs of taking such steps as a debt from the person on whom the Notice was served.

    7. This Notice shall remain in force unless amended or revoked by Natural Resources Wales.

    8. You may wish to seek independent legal advice.

    Appeal provisions This is a notification and as such there are no grounds of appeal against the service of this Notice. Legislation note In this document “Natural Resources Wales” means the Natural Resources Body for Wales established by Article 3 of the Natural Resources Body for Wales (Establishment) Order 2012. NRW regulate Plant Health Order (Forestry) 2005 on behalf of Welsh Government through a Section 83 Arrangement issued under of the Government of Wales Act 2006.

    Measures to be taken By date

    1. The Phytophthora ramorum infection described in this Notice and marked red on the attached Annex 1 Map, is located within the Wales Disease Limitation Zone and therefore must be destroyed by tree felling, chemical injection or by any other effective means.

    2. In addition to the infected larch trees specified in this Notice, you may fell additional larch trees within the agreed boundary marked red on the attached Annex 1 Map, in order to reach a wind firm edge or to facilitate the extraction of wood products from the area specified in this Notice.

    3. All work undertaken to achieve the requirements of this Notice should comply with industry best practice and meet all environmental legislation relevant to the land specified in this Notice.

    4. All work undertaken to achieve the requirements of this Notice must comply with industry best practice bio-security protocols relevant to the land specified in this Notice.     5. No soil, plants or parts thereof of any susceptible genera and species shall be removed from the land specified in this Notice without first obtaining a Forestry Commission (Great Britain) Movement Licence, which permits the safe and legal passage of infected material to a licenced processing facility.
