SUMMARY

The sub-project of Chau Doc - Phu Chau Connection Line and 110kV Phu Chau Substation Connection Line and 110kV Phu Chau Substation belongs to Distribution Efficiency Projects (DEP). The sub-project will be implemented in the area of Da Phuoc commune of An Phu district, Chau Phong commune, Le Chanh commune, Phu Vinh commune and Long Phu ward of Tan Chau town, An Giang province. The sub-project includes two works: - Construction and installation of 14.895 metre of 110kV transmission lines

from the starting point at G3A position of 110kV Chau Doc – An Phu connection line (under construction) and the ending point at 110/22kV Phu Chau substation (planned to be constructed simultaneously with transmission lines); and

- Construction and installation of 110kV Phu Chau Substation with the capacity of 2x40MVA.

The proposed construction period of the sub-project is 10 months since the commencement date. The commencement date is proposed at the beginning of 2013. The sub-project will affect 98 households (462 people) including 17 households (70 people) of An Phu commune and 81 households (392 người) of Tan Chau commune, An Giang province. The area of acquisition land (permanently affected land) of the households ranges from 0,13% đến 89,67% of the total land area that they possess. Details are shown as bellows: - APs with over 20% of cultivated land being permanently acquired: 03

households (14 people) - APs with less than 20% of cultivated land being permanently acquired: 74

households (350 people) - APs with crops being permanently affected: 77 households (364 people) - APs with cultivated land being temporarily affected: 98 households

The resettlement plan of the sub-project 110kV Chau Doc - Phu Chau connection line and 110kV Phu Chau Substation and Connection Line is prepared on the basis of the approved involuntary resettlement (OP/BP 4.12) of the WB and Resettlement Policy Framework of the Distribution Efficient Project. Compensation for affected households is proposed to start in October 2012. The total cost estimate of the resettlement plan is 11.609.390.000 VND (this amount shall be updated at the time of the sub-project implementation to ensure the compensation on the principle of replacement price). Budget for RP implementation shall be provided by the partner: Vietnam Electricity

INTRODUCTION

1.1 Efficiency Distribution Project (DEP)

Objectives of the Distribution Efficiency Project are to improve the efficiency, availability and reliability in power supply as well as in power use efficiency. These objectives will be achieved through implementation of three components: (i) reinforcement and expansion of the distribution networks of 110 kV voltage, medium voltage and low voltage (including substations); (ii) introduction of smart grid technology in power distribution (focusing on advanced metering systems and automation to improve the efficiency of distribution services); and (iii) provision of technical assistance and capacity building. The three Components will be executed by 05 Power Corporations, and Component No.3 is executed by the Ministry of Industry and Trade. To maximize initial impacts, Component No.2 will start by focusing on key distribution substations and large power consumers. CTF co-financing funds were proposed for this Component and CTF Committee approved this proposal of the sub-project. The Power Corporations co-sponsored by CTF will be selected on the basis of the readiness and capability of Corporations in the preparation and implementation of smart and modern grid projects.

To implement sub-projects components, land acquisition will be required. However, the upgraded rehabilitation and strengthened capability in electricity distribution networks and the existing substations will not cause land acquisition and resettlement at a large scale. In this project, the land acquisition is mainly in the sub-projects of component No.1. The sub-projects in 15 provinces in the south will be implemented by SPC, focusing on the rehabilitation and widening of power distribution network from 110kV, including distribution lines, substations of 110kV; 35kV; 22kV; and 0,4kV. Resettlement Plan of sub-projects of 110kV Chau Doc - Phu Chau connection line and 110kV Phu Chau substation is prepared in accordance with the Policy Framework for Distribution Efficiency Project.

1.2 110kV Chau Doc – Phu Chau transmission line sub-project 110kV and Phu Chau substation

The sub-project of 110kV Chau Doc - Phu Chau connection line and 110kV Phu Chau substation is in areas of Da Phuoc commune of An Phu district, Chau Phong commune, Le Chanh commune, Phu Vinh commune and Long Phu ward of Tan Chau town, An Giang province. (Refer to Appendix 1: Map of site area). The sub-project of 110kV Chau Doc - Phu Chau connection line and 110kV Phu Chau substation aims at achieving these targets: - Providing electricity for Tan Chau town, the radius of power supply will

be shortened - It is possible to connect to TBA 110kV Tan Chau, to create a loop circuit

among three substations Chau Đoc – Phu Chau – Hong Ngu in order to ensure the stability and safety of power supply and strengthen the grid combination capacity for the local power supply.

- Being in accordance with “the Power Development Plan of An Giang province in 2011-2015 period, with consideration until 2020” approved by the Ministry of Industry and Trade

- The sub-project includes 2 works Transmission lines: Construction and installation of 14.895 m of 110kV transmission lines from G3A position of 110kV Chau Doc – An Phu connection line (under construction) to the ending point at TBA 110/22kV Phu Chau (will be constructed in this sub-projects.) - Substation: 110kV/22kV + High voltage level: 110kV + Medium voltage level: 22kV

- Capacity: 02x40MVA = 80 MVA, in the first stage, install 1 machine of 40 MVA.

- The area of constructing the sensation and roads to the substation: 4.716,1m2

1.3 Resettlement Objectives

Resettlement objectives shall: - Avoid or at least minimize reluctant resettlement by selecting appropriate

design alternatives. - In the event that reluctant resettlement is unavoidable, resettlement

activities shall be prepared and executed in accordance with sustainable development programs and provide appropriate assistance and investments, helping APs to benefit from the sub-project. APs will be completely consulted and allowed to participate in the preparation and execution of the Resettlement Plan,

- APs will be compensated for all of their losses, and will be provided with measures for their complete life recovery to better support them on improving or at least maintaining such living standard, production capability and incomes as those before implementing the sub-project.

IMPACTS OF THE SUB-PROJECT

2.1 Determination of sub-project’s impacts

2.1.1 Determination of affected area of the sub-project:

The sub-project will affect Da Phuoc commune of An Phu district; 3 communes namely Chau Phong, Le Chanh, Phu Vinh and Long Phu Ward of Tan Chau town, An Giang province.

The sub-project only affects the following areas: - The area of pier foundation construction (22,68 ÷ 181,25m2 depends on

the position) and the area of substation construction (4.716,1 m2). - The area surround the pier foundation during the construction process, the

temporarily affected area due to wire pulling route – with an average width of 14 metre – only consider cultivated land. The land area can be affected from 1 to 2 months.

Temporary land acquisition for the access road in the construction is not necessary because because the existing domestic roads, alleys, lanes and ROW shall be used in the contruction.

2.1.2 Determination of affected people, units and organizations by the project

(1) Affected organization: No organization is affected by the project.

(2) Affected households and people: According to the survey result, 98 households (462 people) are affected by the sub-project. Affected people include: - People whose cultivated land is partly or completely affected (temporarily

or permanently); - People whose perennial trees and / or crops are partly or permanently

affected (temporarily or permanently); - 9 households (37 people) with women as owners are affected. The

percentage of households with permanently acquired land ranges from 0.11% to 56.2% but there is no household in the vulnerable group.

- The percentage of permanently acquired land of most households is less than 10% except the 2 households at the transformer substation location, this percentage is over 20%.

The result is presented in the following tables (see details in Apendix 5: The inventory of people affected by the project):

2.2 Impact types of the project

Impact types for APs in this project only include: + Permanently acquire three houses with the total area of 200 m2.

+ Permanently acquire cultivated land (including areas of rice, eucalyptus, ponds, fruit trees and farm produce) for pier foundation construction.

+ Temporarily acquire cultivated land (including areas of rice, garden land, ponds and lakes and farm produce) in the construction of each columnar foundation.

+ Permanently affect crops (including rice, farm produce, eucalyptus, fruit trees and plants) and plants in the area of pier foundation construction.

+ Temporarily affect crops (including rice, farm produce, eucalyptus and fruit trees) surrounding the pier foundation, plants in ROW in the area of wire pulling.

+ Affect plants in ROW, trees with the distance of equal or more than 3 metre from the tree tops to the lowest conducting wire will be cut down (as identified in Article 5, Decree No. 106/2005/NĐ-CP dated 17/8/2005).

Plants and farm produce is determined to be affected in the area of columnar foundation construction and in the estimated area of wire pulling with the width of 2 meter in ROW according to the affected length.

LEGAL FRAMEWORK AND AFFECTED ENTITLEMENT

Applicable laws and policies for implementing the resettlement and compensation comprise (i) policies of the World Bank, (ii) the current policies of compensation, assistance, resettlement of Government of Vietnam; and (iii) procedures for compensation, assistance and resettlement of local authorities (An Giang province).

3.1 Vietnam’s policies

(1) Regulations of the Government of Vietnam on compensation, assistance and resettlement will be applied in the RP’s implementation of sub-project as follows: - The Constitution of Vietnam, 1992; - Land Law No. 13/2003/QH11 of National Assembly dated November 26th,

2003; - Decree No.181/2004/ND–CP dated 29/10/2004 of Government guiding

3.2 World Bank’s policies

(Main characteristics of OP 4.12 are detailed in Resettlement Policy Framewwork of Distribution Efficiency Project) Compatibility between policies of Government and the World Bank and necessary exemptions: The current laws, decrees and regulations made the policies and resettlement plan of Vietnam’s Government is more consistent with resettlement policies of WB. Differences between the laws and decrees of the Vietnam Government and the World Bank are relating to compensation, resettlement, and how to resolve differences, which are presented in Table 1 of the Policy Framework of Distribution Efficiency Projects (refer to Table 1 in Appendix 2: Policy Framework of resettlement). In the case of inconsistency, policies of the World Bank will be applied. This is in accordance with Decree No. 131/2006/ND-CP on the Regulation on Management and usage of ODA’s refund.

3.3 Principle of compensation and resettlement applied for sub-projects

The principles outlined in the Policy OP 4.12 of the World Bank have been applied in setting up the Policy Framework. Accordingly, the following objectives and principles will be applied:

(a) The land acquisition and other assets as well as activities of relocating / resettling people must be minimized.

(b) All APs living, working, doing business or farming within ROW of transmission line route, around the tower foundations and substation location, construction road of the project up to date of preliminary survey will be provided with appropriate rehabilitation assistance to support them on improving or at least maintaining such the living standards, income as those before executing the sub-project. The lack of legal ownership of affected property will not prevent APs from benefiting from those life restoration measures.

(c) The life rehabilitation measures include: (i) compensation at replacement costs, excluding depreciation, or materials which can be reused for constructing houses and other buildings; (ii) land exchange for equivalent profitable agricultural land for Aps, or compensation in cash, depending on the choice of APs, (iii), by the same land area for affected residential land acceptable to APs or compensation in cash at the replacement value depending on the choice of the APs; and iv) the transportation costs and support allowance..

(d) Paying special attention to households in the definition of vulnearable groups. The specific assistance measures are included in RP.

(e) Replacement of residential and agricultural land as close to the location that the land is acquired for the sub-project as possible and must be accepted by the Aps.

(f) Time for migration and resettlement should be minimized and the rehabilitation measures shall be provided to APs before the commencement date of each respective sub-project area.

(g) Plans for acquisition of land and other assets and recovery measures must be implemented with the involvement of APs in order to minimize disturbance. Benefits must be provided to APs before the commencement date of each respective sub-project area.

(h) The existing public services or resources shall be maintained or improved better than those before implementing the sub-project

(i) Financial resources and materials for the resettlement and rehabilitation should be prepared readily upon request.

(j) Construction contractors shall not be issued any notice of ownership or notice for performance for any sub-projects unless the Government has (a) completely met requirement and complied with approved RP for the sub-project and paid compensation, and (ii) ensured the compensation is made before starting construction. The benefits will be provided to the APs no later than one month before the planned date to commence construction at respective sub-project areas.

(k) The implementation organization must ensure effective and timely design work, plan, public consultation and execution of the RP

(l) Supervision, monitoring and evaluation of the implementation of RP shall be executed timely and effectively. Besides receiving direct compensation, APs have the right to receive subsidy as regulated in Decree No.197/2004/NĐ-CP, Decree No. 69/2009/NĐ-CP, and Decree No. 81/2009/NĐ-CP. Subsidy and assistance include: - Providing land in ROW Residential land and other types of land in the same field with residential land in the safety corridor but not being acquired will be compensated based on particular situations, the assistance is not more than 80% of compensation prices for land acquisition in ROW. - Provide houses in ROW Houses, facilities for daily activities which a part or the whole area is in the ROW, will be compensated equal or less than 70% of its value due to limited use capability and the impact level in daily activities. - Other restoration measures In addition to above information, any affected person can suffer from other impacts which are considered minor. In this case, there will be a series of programs to support the life restoration and the properties are ensured to compensate at replacement cost or the cost for each work. If the work is evaluated according to different types, the value of the most expensive facility will be applied as the compensation standard cost. COMPENSATION AND ASSISTANCE

4.1 Compensation

Project announcement date: taken while conducting the survey, dated 21/12/2011 and 22/12/2011; has been notified to the relevant local authorities since the first with community meetings at project related communes. Persons who encroach and move into the area that proposed to be affected area after the project announcement date will not be entitled to compensation and resettlement. They will be requested to dismantle affected structures, cut trees or harvest crops for land clearance of the project; however, they will not have to pay any fine. The project announcement date and terms “no compensation” for the encroachers have been announced clearly in the public meetings. Replacement cost: In this sub-project, the damages are only lands, perennial trees and crops. Survey result has shown that lines and the substation in the sub-project will be built in rural areas of stable gardening and crops. There is no trading of land, plants and crops (Mostly land is transferred to their children and relatives). Through consultation with local agencies (An Phu district, Tan Chau town and other communes and wards), compensation prices of land, plants and crops will be applied according to the price regulated by the People’s Committee. The compensation price was announced in the community consultation meeting and accepted by affected households. - Decision No.56/2011/QĐ-UBND dated 21/12/2011 on the issuance of

regulations of land price list in An Giang province. - Decision No. 25/2010/QĐ-UBND dated 29/4/2010 on the issuance of

regulations of compensation, assistance and resettlement when the State claims land in An Giang province.

- Decision No.1491/2005/QĐ-UBND dated 23/5/2005 of An Giang People’s Committee on the issuance of compensation price list of plants and animals when the State claims land in An Giang province.

- It should be noted that land unit prices applied in this KT is only for estimation (at the time of compiling this RP). At the time of implementation of RP (expected to start in late 2012), land compensation unit price will be updated to ensure that affected people will be compensated according to replacement cost for their losses.

- Compensation for trees and crops is applicable to farm produce and annual plants (rice) in the permanently occupied areas for the construction of tower foundation and substation.

Remark: The above decision gives different prices for plants of different ages (usually from 3 to 8 types according to the age of trees), the highest compensation price frame for affected perennial trees is applied as in the above table. 4.1.4 Compensation for removed houses, tombs in construction site of the substation

It applies Articles 24 and 25 in Decision No.25/QĐ/2010/QĐ-UBND on 29/4/2010 issued by An Giang People’s Committee. According to the project policy framework, at the time implementing the RP, Relevant agencies under An Giang People’s Committee and independent supervision agencies will conduct surveys on replacement cost of land, plants and farm produce. The compensation price will be adjusted (if necessary) by An Giang People’s Committee in order to ensure that the compensation price is equal to replacement price and the compensation for plants and farm produce is equal to the market price.

4.2 Assistance in life recovery for APs

Besides direct compensation for damages, people affected heavily (shall move or lose more than 20% of land area or more than 10% of land area for vulnerable households) shall have the right to receive other assistances (allowances/benefits) under Policy Frame of the sub-project. APs, who lose more than 20% of their total landholdings (or 10% for the ethnic and vulnerable groups, shall be entitled to receive assistance in cash equivalent to 30kg of rice or 300,000VND per month in 6 consecutive months (in case of without removal) and in 12 consecutive months (in case of removal, example: households headed by Nguyen Thi Thuy and Vo Van Cau).If APs lose more than 70% of cultivated land, they will be assisted for 12 consecutive months (in case of without removal, example: households headed by Tran Van Hen). They mainly live in construction site of the substation. All other impacts arising in the course of project execution shall be settled in accordance with the RP’s Framework.

PUBLIC CONSULTATION AND INFROMATION DISCLOSURE

5.1 Public consultation and participants

Public consultation is carried out under two forms: (i) providing leaflets Outstanding issues on policies on compensation, clearance and power safety of the project; (ii) public consultation meeting. The leaflet “Outstanding issues on policies on compensation, clearance and power safety” of Distribution Efficiency Project has been prepared (in the forms of Questions–Answers and Pictures) and distributed to 100% of total households affected and disclosed publicly at project’s areas (December 2012). This is basis for community and APs to participate in other stages of the project. The document includes two main parts: (1) Frequently Asked Questions of APs; (2) Pictures showing measures to prevent power accidents and protection of ROW. Based on information in the leaflets, results of surveys on damages and losses, implementation plan for compensation and assistance, entitlement matrix and relevant works of compensation, local community and APs shall be participated in supervision activites of this Plan directly and effectively. District Compensation Council shall hold meetings with the relevant communes/hamlets to announce all information relating to the sub-project. In addition, local authorities shall also announce local people in relation to the sub-project about potential impacts of the sub-project, especially about the Entitlement Matrix During the preparation of RP, Consultant held public consultation meetings at commune and ward levels with the participation of APs and representatives from People's Committee of communes and wards Public consultation meetings were held at:

5.2 Information disclosure

Resettlement Plan report in Vietnamese will be disclosed at the People's Committee of project affected districts and communes for accessible and understandable purpose of local people and relevant organizations. Resettlement Plan report in English and Vietnamese will be sent to Vietnam Development Information Center at 63 Ly Thai To, Hanoi for purpose of supporting all interest objectives whom have need to read, unsderstand and give comments on this document; Resettlement Plan report in English shall be sent to and displayed at InfoShop of WB in Washington DC.

5.3 Complaints and grievances

APs shall reserve the right to complain relating to their entitlements and responsibilities in the project’s implementation such as entitlement of compensation, compensation policies, compensation unit price, land acquisition, resettlement and other entitlements related to assistance programe and livelihood stabilization. The grievance can relate to safety issues in construction duration and problems causes in construction works. All grievances must be recorded, recognized and treated by the relevant authorities/organizations. The grievance mechanism is as follows: The first step – at Ward/Commune level If any AP is not satisfied with any aspect of the resettlement and rehabilitation program, he/she can give an oral or written grievance to ward/commune PCs. They will resolve the issue within fifteen days from the date of its receipt of the complaint. The second step– at District level If any AP is not satisfied with the decision in the first step, he/she can appeal the complaint to the District PC. The District PC will make a decision within thirty days of from the date of its receipt of the complaint. The third step – at Province level If any AP is not satified with the decision of the District PC, he/she can appeal to Province PC. The Province PC will make a decision on the appeal within thirty days from the date of its receipt of the complaint. The fourth step – at Court level If the AP is still not satisfied with Province PC, he/she can submit its case to the People’s Court of the District. The APs will be exempted from all administrative and legal fees. In addition, APs can use the account held by the third party to pay resettlement in case of resolving the grievance, avoiding serious delay for the sub-project while

ensuring the payment for compensation after completely resolving the grievance. All questions, suggestions, grievances and solutions must be recorded and sent to the Power Company and relevant organizations for monthly monitoring. All costs for establishment and grievance solving shall be included in the sub-project’s cost.

REPORT, SUPERVISION/MONITORING AND EVALUATION

The implementation of RP will be periodically supervised and monitored by PMB with close cooperation with PC of different levels, and independent monitoring agencies. The findings will be recorded in quarterly reports to be submitted to EVN, SPC, An Giang Power Company and the World Bank.

6.1 Internal monitoring and supervision

Internal monitoring and supervision for the RP’s implementation shall be the responsibility of PMU. The supervision and internal monitoring will: - Verify that the basic information of all APs has been collected and that the

valuation of assets lost or damaged, and the provision of compensation, resettlement and other rehabilitation entitlements have been carried out in accordance with the provisions of the Policy Framework and this RP.

- Oversee the RP implementation according to approved design. - Verify that funds for implementation of RP are provided to the HPPMB in a

timely manner and in sufficient amounts for their purposes, and that such funds are used by HPPMB in accordance with the provisions of the RP and policy framework.

- Record all grievances and their resolution and ensure that complaints are dealt in a timely manner.

6.2 Independent Monitoring

Organization or individual of the independent monitoring consultant shall sign a contract with SPC for periodically monitoring of site and evaluation of the RP’s implementation. The independent organization may be an institute or academic research, non-governmental organizations or other independent consulting firms with a qualified and experienced staff and all they shall execute according to terms and conditions which are accepted by the WB. The independent monitoring consultant shall execute the monitoring from the commencement date of the project up to date completion of the sub-project. The SPC shall sign a contract for all the sub-projects on independent monitoring works. The scope of work and terms of reference will be prepared and submitted by the SPC to the WB for further consideration. The independent monitoring consultant will:

(a) Identify the procedures for the participation of the APs, whether the compensation and other benefits will be implemented in accordance with the Policy Framework of the World Bank or not; and

(b) Evaluation of the Policy Framework objective of improving or at least ensure the standard of living and income for APs that is reached or not.

(c) Collect the quality indicators of the socio-economic impact when the sub-project implementation to the APs.

(d) Provide opinions on adjustment of procedures implementing RP depending on cases that may achieve the objectives and purposes of the Policy Framework.

6.3 Reporting

Internal monitoring agency will prepare quarterly report with detail of its implementation schedule, this report shall send to EVN/SPC, WB and external monitoring agency. The terms of external monitoring agency shall detail in contract of the both parties (the external monitoring agency and PMU) A Resettlement Plan cannot be considered complete until a completion audit or survey confirms that all entitlements have been received by beneficiaries and livelihood restoration is progressing on schedule.

Vietnam Electricity (EVN): EVN is responsible for management and organization of investigation, design, budget allocation, payment and supervision of RP implementation. Board of Business and Rural Electricity of EVN will be assigned as a Department/Unit who is directly in charge of the DEP. EVN SPC: EVN SPC is responsible for hiring competent consultant to prepare a RP’s report; assigning skilled labours on social safety at office of EVN SPC and PMU and dispatching this labours to participate in Resettlement and Compensation Council. Power Project Managament Board (PMU): PMU of SPC is responsible for daily management of the project including: planning, program, finance flow, and collaboration, monitoring of compensation, resettlement, design, implementation, supervision, assessment and coordination with EVN and WB. District People’s Committee: Instruct relevant organizations to implement RP, approve the compensation unit price, support and establish appraising council, compensation council at levels and approve the compensation land, resolve queries, complaints of APs at the district level. district People’s Committee: To instruct the compensation activities in the district: - Instruct relevant organizations to conduct surveys of impacts, consultation

meetings, information disclosure on RP policy and implementation. - Establish the District Compensation Council. - Check the legal status of land use right or ownership of other real estate. - With jurisdiction, assess and approve compensation plans for APs. - Promulgate regulations and procedures to address issues related to

administration of compensation, support and resettlement of the sub-project in the district.

- Settle complaints of APs in the district. District Compensation Council (DCC): DCC is headed by Vice president of District People’s Committee. DCC includes representatives of Finance, Environment and Natural Resources (Housing and Land Division), Planning and Investment, Trade and Industry Departments, affected People’s Committee, APs, and PMU. DCC is the key agency in charge of implanting RP in their territory and responsible for: - Checking the compensation unit prices applied in RP, proposing the

adjusted unit price in accordance with market prices / replacement prices (if necessary).

- Coordinating with PMU to organize meetings with APs and community to deliver information documents on compensation and resettlement, detail schedule and benefit frame of APs.

- Basing on the policies and procedures approved in PR, to make detail implementation plans (quarter, six month and annual plans) and coordinate with PMU to pay interests to APs timely.

- Paying due attention to demands and requests of special community group (ethnic groups) and sensitive community groups (children, the old/women led household/single).

- Solving grievances of affected persons, difficulties during RP’s implementation and proposing solutions for shortcoming issues to province people’s committee.

Commune People’s Committee: The Commune People’s Committee is responsible for: - Assigning specialized officer to assist all activities of compensation and

resettlement at commune areas. - Participating in population survey, statistics and detailed drawing for the

purpose of assistance of agencies of population survey, replacement cost and other compensation and resettlement activities of RP.

- Coordinating with the DCC in community consultation meetings, information disclosure and payment of compensation/assistance for affected persons.

- Checking and confirming legal status of affected properties such as land, houses and structures and other assets of APs.

- Taking part in activities related to land acquisition, land allocation, resettlement, living restoration as other social development support activities.

- Assisting affected persons in resettlement activities and livelihood restoration and together signing (confirming) compensation documents of affected persons.

- Determining list of poor and difficult APs. - Ensuring available and proper mechanism of grievances solutions. Solving

grievances at commune level and appealing all opinions of affected persons to DCC to give solutions for the remaining issues (if any). Giving evidences of affected persons and maintaining grievance report. Helping and consulting affected person in prompt grievance solutions.

- Assisting local residents to deal with difficulties in construction period, helping them to repair their house. Arranging lands in case of compensating land for the APs.

Affected persons by the sub-project: APs prepare documents relating to RP, such as Land Use Registration Certificate, ownership of other real estates. APs are responsible for checking carefully affected properties associated with compensation rights for in-time land clearance. External independent monitoring agency: To monitor and assess the implementation of Resettlement Plan. The External independent monitoring agency shall submit the periodical report of compensation and resettlement process and recommend the resolutions on recognized PMU and WB.

COST AND BUDGET

8.1 Budget

The budget for RP’s implementation is SPC’s budget. SPC will allocate this budget to PMU, the PMU and An Phu district and Tan Chau Town Compensation Councils are responsible for: (i) Compensation payment for affected persons, and (ii) Payment for all activities of RP.

8.2 Costs of RP implementation

Costs of RP Implementation include:

8.2.1 Cost of RP preparation

At the beginning of RP implementation, a survey team shall be established to (a) study design and survey the project site, (b) prepare forms of survey and statistics (preliminary measurement of real estates and property statistics), (c) organize community consultation meetings and distribute Leaflets/Questionnaire relating to the project etc. … (d) analyze data and (e) prepare RP for approval. PMU of SPC has signed contract with consultant to carry out the above tasks: Consultant contract value : 176,000,000 VND

8.2.2 Cost of compensation

- Compensation for permanently and temporarily acquired land. - Compensation for permanently and temporarily affected trees and crops. (Refer item 4.6. Total compensation costs for project)

8.2.3 Cost for Compensation Council (Management cost)

Preparation of RP implementation, the support groups of the District Compensation Council shall be mobilized to implement (a) preparation of detailed mapping and statistical table, documents and information on resettlement, (b) organizations community meetings, (c) detailed mapping and

Temporarily estimated cost for independent monitoring: 200,000,000 VND.

8.2.5 Provisional cost

Pursuant to the proposed period for RP’s implementation (proposed in 2012) and experiences of other sub-projects with similar natures/scope, which have been implemented and being implementing, the provisional costs are estimated about 10% total cost of compensation and RP preparation.

3 Temporary impact on residential and garden land. Partial house/building within ROW and the demolished area does not impact to the remaining house/building. Residential land and garden land outside of ROW is sufficient for re-organizing (not less than 60 m2).

- DP can opt for : i) Remain their houses or building in ROW with the conditions regulated by Article 6 of the Government Decree 106/2005/ND-CP dt.Aug 17th, 2005 on the protection of the high voltage networks and additional issues as stated in decree 81/2009/ND-CP, dated on October 12, 2009, revising and supplementing a number of articles under decree 106/2005/ND-CP. Subsidy allowance for fireproof materials and lightning arrestors for the existing house/building; or ii) Cash compensation for the directly affected rooms at the replacement cost and cost for demolishing an affected room.

- House and building have to be demolished or could be existed are regulated by Article 5,6 of the Government Decree 106/2005/ND-CP dt.Aug 17th, 2005 on the protection of the high voltage networks and additional issues as stated in decree 81/2009/ND-CP, dated on October 12, 2009, revising and supplementing a number of articles under decree 106/2005/ND-CP.

For DP losing Residential and garden land:

With respect to garden land or ponds which are attached to the affected residential land, and the affected agricultural land which is located within the residential/settlement area, the Project will provide an assistance of 50% of price of the neighboring residential land in addition to compensation at replacement cost for agricultural land as regulated by the laws.

With respect to residential land, DP will be entitled to:

- If remaining land is sufficient for reorganizing (not less than 60 m2):

DP who are eligible to restoration for their options and prepare proposal for restoration programs in the period of RAP implementation.

- DPs will be granted with Land Use Right Certificate

without payment of administrative fees.
