Introduction 1.1 Purpose of this Cost Recovery Implementation StatementThis Cost Recovery Implementation Statement (CRIS) provides information on how the Australian Communications and Media Authority (the ACMA) implements cost recovery for its radiocommunications, telecommunications and broadcasting services. Particularly, it documents the proposed changes to the ACMA’s radiocommunications, telecommunications and broadcasting activities outlined in attachments A and B. It also reports financial performance for these activities and contains financial forecasts for this year and three forward years. The ACMA will maintain the CRIS until the activities or cost recovery for the activities have been discontinued.

1.2 BackgroundThe ACMA is a statutory authority within the federal government portfolio of the Department of Communications and the Arts, and is responsible for the regulation of radiocommunications, telecommunications and broadcasting services.

The ACMA’s activities include:> regulating telecommunications and broadcasting services and datacasting services> managing access to radiofrequency spectrum bands through radiocommunications

licence arrangements, and resolving competing demands for that spectrum through price-based allocation methods

> planning the availability of segments of radiofrequency spectrum bands used by broadcasting services, and managing access to that spectrum through broadcasting licence arrangements

> regulating compliance with the relevant legislation, licence conditions, codes of practice, standards, service guarantees and other safeguards

> promoting and facilitating industry self-regulatory and co-regulatory solutions to emerging issues

> facilitating the provision of community information to promote informed decisions about communications products and services

> reporting on matters relating to the communications industry, including its performance

> representing Australia’s communications interests internationally> advising the government on specific matters from time to time.

The ACMA has reviewed its fees for services determined under cost recovery arrangements as the Radiocommunications (Charges) Determination 2007 and the Broadcasting (Charges) Determination 2007 are due to sunset on 1 April 2017. As the methodology for calculation of fees for all the activities under cost recovery arrangements are applied consistently, the fees for other cost recovery activities determined under the following Determinations are also included in this review:> Radiocommunications (Digital Radio Multiplex Transmitter Licences – Application

The policy objective of recovering service costs ensures that those who use government services meet the costs of those activities. The ACMA reviewed its existing activities to assess the ongoing requirement for the activity and the appropriateness of the current level and application of fees. The review has been undertaken in the context of existing legislation that has established the ACMA’s powers to recover the costs of its activities.  

1.3 Who should pay cost recovery charges?The stakeholders who receive a direct benefit from the services provided by the ACMA pay for services that they receive. Table 1 provides a list of relevant stakeholders for radiocommunications, telecommunications and broadcasting services.

For the activities listed in Attachment A, the service users receive a service where the ACMA’s activities can be directly attributed to the benefit that they receive. Therefore, it is appropriate that the service users pay a fee for the service.

2. Policy and statutory authority to cost recover2.1 Government policy approval to cost recover the activityIn 2015–16, the government affirmed the continuing application of cost recovery arrangements for the activities listed in Attachment A as part of the Communications portfolio review.

2.2 Statutory authority to impose cost recovery chargesUnder section 60 of the ACMA Act, the ACMA may, by written instrument, make determinations fixing charges for services provided by the ACMA and in relation to any matter in which expenses are incurred by the ACMA under the specified pieces of legislation. Specific provisions of the Radiocommunications Act and the Telecommunications (Carrier Licence Charges) Act 1997 also empower the ACMA to make instruments for imposing charges. The ACMA has made the charges determinations listed in Table 2 for the fees listed in attachments A and B.

3. Cost recovery model3.1 Outputs of the activity3.1.1 Radiocommunications regulation, planning and licensing The radiocommunications activities are outlined in Attachment A, and include activities in relation to issuing, transferring and renewing licences.

Issue, transfer and renewals of radiocommunications licencesThe ACMA allocates or assigns access to radiofrequency spectrum through one of three types of licences:> apparatus licence> spectrum licence> class licence.

Apparatus licencesApparatus licences are issued to authorise the operation of radiocommunications devices. The fees applicable to the activities involved in issuing or renewing apparatus licences are outlined in Parts 6, 7, 8, 9 and 12 of Schedule 2 to the Radiocommunications (Charges) Determination 2007.

As licence applicants receive a direct benefit from the right to use and/or supply services, these activities are appropriate to be subject to cost recovery arrangements. The types of services that may operate under the apparatus licensing regime include radiocommunications transmitters, mobile communications, amateur services, broadcasting services and land mobile services.

Spectrum licencesSpectrum licences are a tradeable, technology-flexible (that is, the licence is not normally limited to any particular technology, system or service) right to access specified spectrum for a fixed term. Spectrum licences are generally auctioned, or may be allocated by tender or for a pre-determined price.

The ACMA recovers part of the cost of its spectrum management activities through the imposition of specific cost recovery fees on the beneficiaries as outlined in Part 11 of Schedule 2 to the Radiocommunications Determination.

Class licencesClass licences are essentially issued to authorise the operation of radiocommunications devices with low interference potential. Devices that are currently subject to class licensing in Australia include mobile phone handsets, cordless telephones and a range of other low-power devices, such as garage door openers and wireless identification tags. There are currently 13 class licences issued under the Radiocommunications Act.

The ACMA’s class licensing arrangements provide permission for each operator of such equipment to operate the equipment, without the need to obtain an individual licence. Accordingly, class licences are excluded from cost recovery arrangements.

Testing of devicesThese activities are performed by the ACMA’s Radiocommunications Compliance Laboratory, which conducts quality equipment testing (essentially on radiocommunications devices) traceable to national standards of reference1 (in

accordance with paragraph 182(4)(b) of the Radiocommunications Act. All test reports produced are of an international standard. Testing activities are listed in Attachment A (activities 1 to 69).

The following testing activities have been deleted as they are no longer required:> test or retest a hand held receiver for compliance with AS/NZS 4583

(ref: Attachment A, activity 39)> test or retest a receiver only in a base unit for compliance with AS/NZS 4583

(ref: Attachment A, activity 42).

ExaminationsThere are two different types of examinations conducted for a radio operator’s certificate of proficiency, which are currently provided by external service providers—the Wireless Institute of Australia (WIA) and the Australian Maritime College (AMC) under deeds of agreement: > Examination for amateur radio operator’s certificate of proficiency

The WIA has been providing examination services to the amateur radio community since 1991 and, as part of its service, issues amateur certificates of proficiency and administers call signs.

> Examinations for maritime radio operator’s certificate of proficiencyThese examinations are provided by the AMC, which also publishes handbooks recommended for candidates undertaking examinations for Marine Radio Operator Certificates of Proficiency.

However, the ACMA can also provide amateur radio and marine radio operator examinations (refer Attachment A, activities 74 to 81). This normally occurs in very limited circumstances:> where the ACMA believes on reasonable grounds that a qualified operator would

be unable to achieve satisfactory results if re-examined> if the WIA/AMC has failed to comply with the deed under which it provides services

on the ACMA's behalf> where the ACMA has taken over these services> special examination services for persons with special needs or living in remote

locations.

The ACMA has not conducted amateur radio operator exams since the WIA was delegated the responsibility for this function in 1991. The ACMA retained responsibility for special examinations for marine radio certificates of proficiency but has only conducted one or two per year. From August 2012, the AMC became responsible for conducting all special examinations for marine radio certificates of proficiency under a new deed of agreement.

Interference investigationsThis service is not currently being cost-recovered as the ACMA adopted a policy for the management of interference to terrestrial television and radio broadcast reception using an evidence-based approach. According to the policy, a complainant is required to provide evidence to the ACMA to prove that their broadcast reception problems are not caused by faulty installations or by the viewer attempting to receive a broadcast signal from outside the coverage area.

To better focus investigation activity, the ACMA has proposed a cost recovery fee (see Attachment A, activity 166) for investigating a complaint of interference to television or radio broadcasting reception or with the operation of a device in the following situations, where:

> the source of the interference is wholly or mainly under the control of the person making the complaint about the interference (the complainant), or

> the complainant has the necessary skills or expertise to diagnose the source of the interference.

Other radiocommunications activitiesThe ACMA also issues duplicate instruments, copies of licences and permits for non-standard transmitters under sections 167 and 174 of the Radiocommunications Act (refer Attachment A, activities 70 to 73). All other activities, including transfer of radiocommunications licences and assessment of applications for accreditation, are set out in Attachment A (activities 142 to 149).

Satellite filing and coordination workThe filing and coordination of satellite networks with the International Telecommunication Union (ITU) is considered a spectrum management function under the ACMA Act. These activities are being carried out under deeds of agreement with satellite operators who wish to use frequency to and from a location in space. The fees for these services are contained in Part 5 of Schedule 2 to the Radiocommunications (Charges) Determination 2007 (see Attachment A, activities 82 and 83).

Emergency locating serviceThis service essentially refers to locating emergency position indicating radio beacons (EPIRBs), which are used by vessels of all kinds in distress to signal their location, or locating personal EPIRBs designed to be attached to a life jacket or carried by an individual. This service is provided only to the Australian Maritime Safety Authority (AMSA) for its search and rescue operations under a Memorandum of Understanding between the ACMA and AMSA (see Attachment A, activity 141).

Data servicesAll data services (including the Register of Radiocommunications Licences database on CD-ROM) are proposed to be deleted as this information is available online. This includes information on apparatus and spectrum licences, including details about who holds the licence, the duration of the licence, technical details such as frequency and power, and where transmitters are located (see Attachment A, activities 162 to 165).

3.1.2 Telecommunications regulation, planning and licensing Issue of licences and permitsCosts incurred by the ACMA in regulating the telecommunications industry are largely recovered under the Telecommunications (Carrier Licence Charges) Act 1997 through the imposition of an annual carrier licence charge. However, a number of services to the telecommunications industry are recovered through fees set out in the Telecommunications (Charges) Determination 2012 (refer to further details in Attachment A, activities 180 to 202).

These include applications for:> a nominated carrier declaration (see Attachment A, activity 180)> a connection permit and labelling certification (see Attachment A, activities 181 to

183)> a facility installation permit (see Attachment A, activities 187 to 191)> a submarine cable installation permit (see Attachment A, activities 192 to 201)> a carrier licence2 (see Attachment A, activity 202).

In addition, the following telecommunications numbering activities are performed by an outsourced service provider—Zoak Solutions Pty Ltd (Zoak): > number allocation—geographic numbers (see Attachment A, activity 184)> CSP registration (see Attachment A, activity 185)> smartnumbers enhanced rights of user (EROU) registration (see Attachment A,

activity 186).

Following a competitive tender process in 2014, the Commonwealth awarded Zoak the contract to provide allocation and administrative services for most of Australia’s telephone numbers specified in the Telecommunications Numbering Plan 2015 (Numbering Plan)3, and to register EROU and CSPs for a period of eight years from 1 August 2015.

The amount of charge imposed on the allocation of a number (Allocation Charge) is ascertained in accordance with a written determination made by the ACMA under section 13 of the Telecommunications (Numbering Charges) Act 1997 (Numbering Charges Act). Allocation Charges are not required to comply with the Commonwealth Cost Recovery Policy4 and are considered a general taxation charge (see the Explanatory Memorandum to the Telecommunications Bill 1997). This review does not consider Allocation Charges, but does consider the charges for the above telecommunications numbering activities which are determined in accordance with section 60 of the ACMA Act under the cost recovery arrangement.

The ACMA Act provides that the ACMA may, by written instrument, fix charges (under the cost recovery arrangement) for services provided by the ACMA and any matter in relation to which expenses are incurred under a range of legislation, including the Numbering Plan. The Numbering Plan generally requires CSPs to pay the amount of charge upon application for allocation of numbers (see, for example, subsection 58(6) of the Numbering Plan).

3.1.3 Broadcasting regulation, planning and licensingIssue of broadcasting licencesThe ACMA issues licences to broadcasters that authorise the provision of broadcasting services within a defined licence area. The fees for these services are separate from the annual broadcasting licence fees established under the Radio Licence Fees Act 1964, Television Licence Fees Act 1964 and Datacasting Charge (Imposition) Act 1998. These annual broadcasting licence fees were not considered as part of this review. This is because the annual licence fee is determined in legislation through a tax calculated as a percentage of gross earnings of the licences from advertising and other matters for the preceding calendar year, rather than on a cost recovery basis.

The administrative activities involved in the issue of international broadcasting licences, datacasting licences and commercial licences, as well as the giving of specified opinions by the ACMA under the Broadcasting Services Act 1992 (the BSA) are listed in Attachment A (activities 203 to 213).

Issue of community radio broadcasting licencesThese activities include the allocation and renewal of long-term community broadcasting licences and the issuing of temporary community radio broadcasting licences under Parts 6 and 6A of the BSA. The licensing arrangements for community broadcasting services aim to enhance the delivery of information and entertainment to local communities across Australia. Imposing a charge for these activities would act as

a disincentive to the provision of an essential service by the community broadcasting sector, which operates on a non-profit basis and is heavily reliant on volunteers. These activities are funded from appropriation and therefore are not cost recovery activities.

Industry monitoring and compliance activitiesProvision of opinions by the ACMA under sections 21 and 74 of the BSA are subject to cost recovery charges, and were included as part of this review. Opinions given under section 21 provide clarity to existing and proposed broadcasters about the category or categories of broadcasting services of their existing or proposed services. Section 74 opinions advise an applicant whether a person is in a position to exercise control of a licence for a newspaper or a company. These activities are included in Attachment A (activities 212 and 213).

Other activities include monitoring of compliance with licence conditions, standards and codes of practice. These include compliance with the anti-siphoning rules, internet industry codes of practice, children’s television standards and disclosure standards. In these instances, the identified beneficiary of the monitoring and compliance activity is the general community which benefits from conditions on industry behaviour that promote the provision of diverse and appropriate content. This review considered that cost recovery was not appropriate for these activities as they benefit the broader community. Accordingly, it is considered that these activities should continue to be appropriation-funded.

Broadcasting investigations activitiesThese activities provide benefit to audiences and the general community, rather than an individual who has initiated a complaint or an individual licensee. It is not possible to identify a distinct group of beneficiaries of these activities, which would allow a fee to be developed. Therefore, it is considered appropriate that the activity continue to be funded through appropriation.

Other broadcasting activitiesThe ACMA previously recovered the costs of assessing and approving implementation plans for the Commercial Television Conversion Scheme 1999. However, as the Commercial Television Conversion Scheme 1999 was automatically repealed5 on 1 October 2015, these activities have been deleted as they are no longer required (see Attachment A, activities 210 and 211).

3.2 Costs of the activityThe costs incurred by the ACMA in executing its functions include direct, corporate and support costs. Direct costs are those costs that can be directly attributed to the ACMA’s service provision. Direct costs include direct staff salaries and other expenses (for example, contractors, consultants, suppliers, office consumables, travel) for the operational areas in carrying out the activities.

The corporate and support costs are the costs incurred by the ACMA’s support services, such as information technology, finance, human resources, facilities, legal and other corporate services. These costs are allocated to activities using a number of cost drivers, which include average staffing levels, the value of assets and an estimation of consumption of resources to reflect the appropriate support costs. The costs include all support staff salaries and other expenses (for example, contractors, consultants, suppliers, depreciation, occupancy) for corporate support services.

3.2.1 Hourly rates (see Attachment B)The ACMA’s standard hourly rate has been updated to reflect its current costs and as a result it has increased from $197 to $202 (that is, a 2.5 per cent increase). The figure

is based on the cost of services incurred by the ACMA in executing its functions for the financial year 2015–16. This rate was established by taking the net cost of services of the ACMA’s business units for 2015–16, including an attribution of all corporate and support costs, and dividing this cost by the average staff hours spent by the business units during the financial year 2015–16. Although the costs are not subject to indexation, the increase in the hourly rate is in line with the increase in the Consumer Price Index for all groups from the start of the CRIS (that is, 1 July 2014).

In the converging markets for communications and media, the ACMA’s business units’ activities exhibit more common characteristics when compared to traditional communications and media activity groups such as radiocommunications, telecommunications and broadcasting services. The effort required by the ACMA’s staff for each activity group under this converging environment is similar as it uses almost the same level of staff across these groups. The rate has been consistently applied to all fees, except those related to type testing activities and field operations.

The Type Testing Unit performs a discrete activity and two separate rates apply—one for the testing of devices for compliance and the other for assessment and advice on compliance without testing of devices. These separate hourly rates reflect unique costs associated with the operation of the testing equipment. These rates were calculated with reference to the total costs incurred by the Type Testing Unit and the average hours spent in type testing activities for the financial year 2015–16. The existing hourly rates have increased by 2.1 per cent, from $289 to $295 (special hourly rate A) for testing of devices for compliance, and from $270 to $276 (special hourly rate B) for assessment and advice on compliance without testing of devices.

In addition, a separate hourly rate (special hourly rate C) has also been established for radiocommunications field operations and interference investigation activities. The proposed hourly rate includes the operational costs associated with special purpose vehicles (19 in total) fitted with technical equipment, which are used by field operations staff. Accordingly, the hourly rate for field operations and interference investigation activities has increased by 16 per cent (from $197 to $229) as the additional cost had not been factored in previously.

3.3 Design of cost recovery feesThe calculation of fees was based on the ACMA’s hourly rate multiplied by the estimated time taken to conduct each activity. This methodology has been applied to all the fees outlined in Attachment A. In addition, the broadcasting fees include specific costs, such as the costs of gazettal and public notifications for issuing licences, where appropriate. Overall, the calculation methodology for all fees has not changed from the methodology adopted in an earlier review in 2014.6

The ACMA has recently completed the introduction of a new radiocommunications licence management system for apparatus and spectrum licencing activities. In the last review, during the financial year 2014–15, the ACMA changed the pricing mechanism from a variable rate to a standard rate for various radiocommunications licensing activities (this included activities related to the issue, transfer or renewal of apparatus and spectrum licences as part of the implementation of the new licensing system).

As a next step, the ACMA is now considering establishing relevant standard times and pricing mechanisms, using a suitable study based on the performance of the licensing activities under the operation of the new system. This study is expected to take up to six months and therefore its outcome will be considered in the next review of fees.

The majority of the changes in the fees have resulted from the increase in the hourly rates as set out above. Apart from the hourly rate increase, the fees for certain activities have either increased or decreased as a consequence of the changes in the estimated time required to perform the activities. These changes are outlined in the following sections.

3.3.1 Changes to fees for testing of devicesThere are a few changes in the estimated time required to perform the testing of devices, due to revision of the following testing standards:> standard AS/NZS 4268 is currently being reviewed by Standards Australia. The

revised standard will require less time to perform testing activities. As a result, the estimated time required to perform testing in accordance with this standard has reduced by 17.8 per cent. The proposed fee has dropped by 16.1 per cent (see Attachment A, activity 2).

> standards AS/NZS 4295 and 4583 were recently updated to incorporate additional testing requirements in line with new European Technical Standards. As these standards have two different specifications for mobiles (including handheld devices) and base devices, a new category has been created for mobiles in order to impose a separate fee based on the required time for testing. Accordingly, the time requirements for these activities have changed, which has resulted in various reductions and increases in fees (reductions up to 63.5 per cent and increases up to 46.7 per cent (see Attachment A, activities 8 to 11 and 38 to 43)).

3.3.2 Changes to assigned licence fee (mobile earth and fixed earth stations)The time required to consider an application or issue an earth licence for the operation of a mobile earth station or a fixed earth station has been increased by 30 minutes. This is due to the average time taken by the satellite coordination team in assessing an application against the ITU’s database. The cost of this extra activity was not previously factored into the existing fees (see Attachment A, activities 87 and 88).

3.3.3 Changes to interference investigations feePreviously, the ACMA charged a fee for domestic interference investigation activities. This was discontinued in 2012, as an evidence-based approach was adopted for the management of interference to terrestrial television and radio broadcast reception.

However, other than in matters where the source of interference is considered a high risk, investigation for interference is now a chargeable activity where:> the interference is to television or radio broadcasting reception or to the operation

of a device> the source of the interference is wholly or mainly under the control of the person

complaining about the interference (for example, it is caused by the complainant’s faulty domestic equipment or the complainant’s own engineering)

> the complainant has the necessary skills or expertise to diagnose the source of the interference.

This activity will be charged at an hourly rate set specifically for the ACMA’s field operations (special hourly rate C), as set out above (see Attachment A, activity 166).

3.3.4 Changes to fees for telecommunications numbering activitiesThe telecommunications Numbering System is automated and, for the majority of transactions, there is no human decision-making or discretion. Accordingly, on 1 August 2015, a flat charge of $19.50 was imposed for all activities (see activities 184, 185 and 186 at Attachment A). That charge was determined by dividing the total estimated annual cost of services by the total estimated annual number of

transactions.

Following its review of the operation of the Numbering System in years one and two, the ACMA has adopted the same approach to determining charges as it did in 2015. However, the flat fee per transaction charge determined by the ACMA has increased to $35, due to the following factors:> accumulated under-recovery and a limited number of system enhancements

means the annual recoverable costs are now estimated at $981,954, which is ~15% higher than in 2015)

> the significantly lower than anticipated number of annual user transactions expected for year two (28,267 in 2016, which is ~35% lower than in 2015).

Further details on numbering charges can be obtained from the Telecommunications (Charges) Determination 20127 and Telecommunications (Numbering Charges) (Allocation Charge) Determination 2015.8

3.3.5 Changes to fee for submarine protection or non-protection zone permitsIn addition to the increase in the hourly rate, the fee for the following telecommunications activities has changed as a result of the changes in the estimated time required to perform the activities:> The estimated time required to consider and process a submarine cable protection

zone permit application has increased due to legislative amendment (to Schedule 3A to the Telecommunications Act 1997 (Telecommunications Act)) in 2014. The process now covers a permit application to install a submarine cable both inside and outside a protection zone. Under this combined process, additional consultation with stakeholders is undertaken, which also increases the time taken to consider stakeholder feedback and to prepare decision-making documentation for the delegate. As a result, the time required to perform this activity has increased by 48 per cent (see Attachment A, activity 196).

> The estimate of the time required to consider and process a submarine cable non-protection zone permit application has decreased as a result of the legislative amendments to Schedule 3A to the Telecommunications Act. This amendment has removed the requirement to consult the Environment Secretary for such applications. As a consequence, the consultation process is more streamlined and requires less staff time to administer. This has reduced the required time by 29 per cent (see Attachment A, activity 198).

> The estimated time required to consider and process an application to extend a submarine cable protection installation (and non-protection) zone installation permit has increased by 133 per cent based on staff experience in processing such applications since early 2014 (see Attachment A, activities 197 and 201).

3.3.6 Changes to application fee for commercial broadcasting licence renewal The introduction of a new licensing system to process an application for renewal of a commercial television or radio broadcasting licence has reduced the processing time by 48 per cent (see Attachment A, activity 206).

3.3.7 Other changesThe description for certain activities has changed to more appropriately reflect the description of the service. These changes are set out in Attachment A in the column headed ‘Proposed description’.

4. Risk assessmentThe ACMA has carried out a risk assessment for this cost recovery arrangement during the review process, based on the assessment of the criteria in the Charging Risk Assessment.9

The overall rating given to this cost recovery arrangement was medium. The type of cost recovery charges are fees only. There are no complexities involved with this charging mechanism as the fees for the services will continue to be charged using the current methodology. The estimated increase in the total annual costs or revenue for the activities is less than $0.12 million. The changes relate to the amount of fees being charged and they are minor in nature, with no change to compliance requirements.

5. Stakeholder engagementThe ACMA consulted with telecommunications carriers and CSPs, broadcasters, radiocommunications licensees and industry associations for six weeks, from 28 November 2016, on the updates to existing ACMA fees covering telecommunications, radiocommunications and broadcasting activities. A separate consultation process was undertaken for the charges associated with the allocation of numbers and the registration activities within the ACMA’s Numbering System (see activities 184, 185 and 186 at Attachment A) for six weeks, from 16 December 2016.

For both consultations, the ACMA published a discussion paper on its website and sought comments as part of the consultation processes. The Numbering Charges consultation paper sought feedback from stakeholders on options for recouping service costs and suggestions on alternate approaches to recoup costs.

Four submissions were received (three from CSPs registered with the Numbering System and one from an individual).

Some of the key issues raised in these submissions were:> preferences for the time period over which an accumulated under-recovery should

be recovered, that is, whether the under-recovery should be collected at the front end or smoothed over the contract life

> proposals that the ACMA consider alternate charging models> a recommendation that care must be taken to set charges, to ensure minimal

impact on the demand for numbers, that is, higher costs may stifle demand.

The majority of submitters preferred the option that smoothed the under-recovery over the contract life (the consultation paper estimated a flat fee of $31 for the allocation of numbers and registration services under this option). In line with this preference, a flat fee charge has been adopted for activities 184, 185 and 186 (see Attachment A). However as described in paragraph 3.3.4, a flat fee of $35 has been set to cater for a further actual reduction in transaction demand.

The ACMA will consult with key stakeholders to explore alternate charging models and acknowledges industry concerns about the impact of price rises on demand for numbers. The ACMA understands that the major users of the Numbering System are actively considering an industry-based numbering system, and the issue of how to recover costs of the Numbering System may become a matter for industry should a numbering scheme manager be determined after amendment to the applicable legislation.

7B Non-financial performanceThe ACMA is responsible for the regulation of broadcasting, radiocommunications and telecommunications. The ACMA’s performance measures for its deliverables are set out in Table 5 below:
