Introduction The Spanish Constitution of 1978 gives all of Spain’s autonomous

La llei de normalització linguística (1983) Children were entitled to receive primary education in their
language of habitual use, whether it was Catalan or Spanish.
It was compulsory to teach both languages at all levels of non-university education, and that all children in Catalonia should be able to use Catalan and Spanish normally and correctly by the end of primary education.
In the 1992-1993 academic year, 69% of pupils were taught mainly in Catalan. Almost all other pupils were taught partly in Catalan.

In secondary education, Catalan was the main teaching language for 73% of pupils in public-sector schools and 74% of pupils in private schools. It was a compulsory subject in all schools.
In higher education, 83% of the students of the Universitat de Barcelona and 93% of the students of the Universitat Autònoma de Barcelona could speak Catalan in 1991-1992.

La llei de política lingüística (1998) From 1998 onwards, Catalan is established as the normal
language of instruction, without distinction between public or private, or primary and secondary schooling.
This was done because a great number of pupils were leaving the education system with poor competence in Catalan.
The major objective of this policy, is to ensure that all children will know both official languages at equal competency by the end of primary education.
The model relies heavily on linguistic immersion – i.e. the use of instruction in Catalan as a means to ensure that all students learn it.

The Act also allows parents to choose the official language of their children's ‘first education’– which is different from primary education, something that is not free and not compulsory – but it does not permit schools either to separate or to discriminate against students regarding the language of their choice.
In practice, those students who ask to receive their first education in Spanish (typically no more than 100 per year) are given what is called ‘individualised treatment’ (‘atenció individualitzada’), which means that they are taught special individual lessons, apart from the main class.
Consequently, the vast majority of students (81 per cent according to the last available data) receive their whole primary education in Catalan.

Concluding Points The fact that there is now the duty to know Catalan in the new statute and
the fact that is designated as the ‘llengua pròpia’ of Catalonia helps to explain why Catalan is now the only language of instruction in the compulsory education system and why it is also classed as the preferred language in all of the official administration of the region.
These strategies have helped to create social bilingualism in Catalonia, whereby the younger generation are now leaving education with the same competency in both languages and not just in Spanish.
The decision to use Catalan as the ‘normal’ language of instruction in education is justified because Spanish is much easier to learn since it can always be heard on the streets and there is an abundance of Spanish reading material, television programmes and films.
With the decision of the Tribunal Constitucional earlier this year regarding the new statute, one could say that it has cast doubt over the language measures that Catalonia has employed since 1998. However, it is clear that the Catalan language revival in this region has been very successful and it will very likely continue to be.

19th Century – One of the missions of education that developed in the 19th century was the annilhilation of all patois
1951 – Deixonne law. Catalan could be taught as an optional subject in secondary education (one hour per week), although it was not a compulsory subject for the baccalauréat.

In Catalan, BRESSOLA means " cradle". This name was given to the schools created in 1976 which became the starting point of the revival of the Catalan language in Northern Catalonia.
Objectives – Catalan be considered as an everyday language, same level as any other modern means of thought expression and communication.
Therefore, they do not consider the schools as a nostalgic way of keeping a folkloric language alive, but rather as a means to integrate it so that it becomes a normal part of everyday life.

25. LEY 10/1982, DE 24 DE NOVIEMBRE, BÁSICA DE NORMALIZACIÓN DEL USO DEL EUSKERA
TITULO PRELIMINAR
Artículo 1. El uso del euskera y el castellano se ajustará en el ámbito territorial de la Comunidad Autónoma del País Vasco, a lo dispuesto en la presente Ley y demás disposiciones que en desarrollo de esta Ley dicten el Parlamento y el Gobierno Vascos.
Artículo 2. La lengua propia del País Vasco es el euskera
Artículo 3. Las lenguas oficiales en la Comunidad Autónoma del País Vasco son el euskera y el castellano.
Artículo 4. Los poderes públicos velarán y adoptarán las medidas oportunas para que nadie sea discriminado por razón de la lengua en la Comunidad Autónoma del País Vasco.

CAPITULO II. DEL USO DEL EUSKERA EN LA ENSEÑANZA Artículo 15. Se reconoce a todo alumno el derecho de recibir la enseñanza tanto en
euskera como en castellano en los diversos niveles educativos. A tal efecto, el Parlamento y el Gobierno adoptarán las medidas oportunas tendentes a la generalización progresiva del bilingüismo en el sistema educativo de la Comunidad Autónoma del País Vasco.
Artículo 16 1.- En las enseñanzas que se desarrollen hasta el inicio de los estudios universitarios,
será obligatoria la enseñanza de la lengua oficial que no haya sido elegida por el padre o tutor, o, en su caso, el alumno, para recibir sus enseñanzas.
2.- No obstante, el Gobierno regulará los modelos lingüísticos a impartir en cada centro
teniendo en cuenta la voluntad de los padres o tutores y la situación socio-lingüística de la zona.
3.- Los centros privados subvencionados con fondos públicos que impartan enseñanzas
regladas tomando como base una lengua no oficial en la Comunidad, impartirán como asignaturas obligatorias el euskera y el castellano.
Artículo 17. El Gobierno adoptará aquellas medidas encaminadas a garantizar al
alumnado la posibilidad real, en igualdad de condiciones, de poseer un conocimiento práctico suficiente de ambas lenguas oficiales al finalizar los estudios de enseñanza obligatoria y asegurará el uso ambiental del euskera, haciendo del mismo un vehículo de expresión normal, tanto en las actividades internas como externas y en las actuaciones y documentos administrativos.
Artículo 18. Los planes de estudio se adecuarán a los objetivos propuestos en los artículos
15, 16 y 17.
Artículo 19. Las Escuelas Universitarias de Formación del Profesorado, adaptarán sus planes de estudio para conseguir la total capacitación en euskera y castellano de los docentes, de acuerdo con las exigencias de su especialidad.

Artículo 20
1.- El Gobierno, a fin de hacer efectivo el derecho a la enseñanza en euskera, establecerá los medios tendentes a una progresiva euskaldunización del profesorado.
2.- Asimismo, determinará las plazas o unidades docentes para las que será
preceptivo el conocimiento del euskera, a fin de dar cumplimiento a lo previsto en los artículos 15 y 16 de la presente Ley.
Artículo 21. Los alumnos que hayan iniciado sus estudios de E.G.B. fuera de la
Comunidad Autónoma del País Vasco, o aquellos que justifiquen debidamente su residencia no habitual en la Comunidad Autónoma, podrán ser eximidos de la enseñanza del euskera según el procedimiento que se establezca a tal efecto.

Mención al Capítulo II. Art.20, de la 25. LEY 10/1982, DE 24 DE NOVIEMBRE, BÁSICA DE NORMALIZACIÓN DEL USO DEL EUSKERA:
145. Ley 2/1993, de 19 de febrero, de Cuerpos Docentes de la Enseñanza No Universitaria de la Comunidad Autónoma del País Vasco.
Se establece esta ley con motivo de ofertar una enseñanza de calidad al alumnado en ambas lenguas.
Se establece la regulación del personal docente de la CAPV, según bases, normas, derechos y deberes del mismo, la regulación de provisión de puestos de trabajos para funcionarios tanto de la Administración Pública Vasca y de otras administraciones, la estructura y ordenación de los órganos educativos y según los requisitos generales y específicos de dicho personal, en el que se incluyen requisitos de tipo lingüístico con respecto al euskera.
Existe un compromiso por parte de la Administración educativa por el cual se exige cierta capacitación lingüística de su personal, así como la realización de un plan plurianual de euskaldunización del profesorado.
Mención a las disposiciones transitorias acerca de: a)el régimen de acceso a funcionario del personal docente interino por un sistema de selección, respetando los principios de igualdad y reconociendo los méritos acreditables de éste; b) el acceso a la función pública del personal docente de las ikastolas.

TÍTULO V. De la Normalización Lingüística.
Artículo 48. De acuerdo con lo establecido en el artículo 12 de la ley de la Escuela Pública Vasca, se garantizará en ésta el derecho de todos los alumnos a recibir enseñanza tanto en euskera como en castellano en los diversos niveles educativos. El ejercicio de este derecho y la acción de los poderes públicos en este ámbito se desarrollan en el marco de lo previsto en el título III de dicha ley y en la Ley 10/1982, de 24 de noviembre, Básica de Normalización del Uso del Euskera.
Artículo 49 1.- A los efectos previstos en el artículo anterior, los puestos de trabajo docentes al
servicio de la Administración educativa vasca tendrán asignado su correspondiente perfil lingüístico. El perfil lingüístico determinará el conjunto de los niveles de competencia lingüística en euskera necesarios para la provisión y desempeño del puesto de trabajo. En tanto el perfil lingüístico no fuera preceptivo, servirá exclusivamente para determinar la valoración que, como mérito, habrá de otorgarse al conocimiento del euskera.
2.- A partir de su fecha de preceptividad, el cumplimiento del perfil lingüístico se constituirá como exigencia obligatoria para la provisión y desempeño del correspondiente puesto de trabajo. Ello no obstante, el Gobierno Vasco, a propuesta de la Secretaría de Política Lingüística, determinará reglamentariamente los supuestos en que, con carácter excepcional y por circunstancias objetivamente apreciables, el titular de un puesto de trabajo pueda ser eximido del cumplimiento del perfil lingüístico asignado al mismo y, en su caso, a otros que tengan asignado el mismo perfil. En ningún caso se podrá eximir del cumplimiento del perfil lingüístico a aquellos docentes que ocupen puestos de trabajo que tengan asignado un perfil lingüístico cuyo contenido exija la competencia lingüística necesaria para utilizar el euskera como lengua de enseñanza. 3.- El cumplimiento del perfil lingüístico para el acceso a la función pública docente se regirá por lo establecido en la disposición adicional decimoquinta de la presente ley.

Artículo 50. 1.- El Gobierno Vasco, a propuesta de la Secretaría General de Política Lingüística y del Departamento de Educación, Universidades e Investigación, determinará los perfiles lingüísticos, así como los criterios para su aplicación a los distintos puestos de trabajo.
2.- La creación, modificación o supresión de un modelo lingüístico habrá de ir seguida de la correspondiente adecuación de los perfiles lingüísticos.
Artículo 53. 1.- Para la acreditación del cumplimiento de los distintos perfiles lingüísticos, la Administración educativa determinará el contenido y forma de las pruebas destinadas a la evaluación del conocimiento del euskera necesario en cada caso. Un representante del Instituto Vasco de Administración Pública formará parte de los tribunales que se constituyan a estos efectos.
Artículo 54. 1.- La Administración educativa vasca procurará la adecuada capacitación lingüística del personal a su servicio, adoptando las medidas necesarias para ello. 2.- De acuerdo con lo establecido en el apartado anterior, el Departamento de Educación, Universidades e Investigación llevará a cabo un plan plurianual de euskaldunización del profesorado. Este plan, cuya materialización buscará la adhesión voluntaria del profesorado y contará con el respeto a sus condiciones laborales, tendrá carácter flexible y se revisará anualmente. Tanto el plan como sus revisiones serán sometidos a informe del Consejo Escolar de Euskadi.

Disposición adicional. Quinta La Administración educativa impulsará la creación de centros superiores de formación
del profesorado en los que se impartan los estudios conducentes a la obtención de los distintos títulos profesionales establecidos en relación con las actividades educativas, así como las actuaciones de formación permanente del profesorado que se determinen.
Disposición adicional. Octava La Administración educativa vasca fomentará convenios con las Universidades a fin de
facilitar la incorporación a los departamentos universitarios de los profesores de los cuerpos docentes a que se refiere esta ley.
Disposición adicional. Décima 1.- Para impartir determinadas áreas o materias de la formación profesional
específica se podrá contratar como profesores especialistas, atendiendo a su cualificación y a las necesidades del sistema, a profesionales que desarrollen su actividad en el ámbito laboral.
2.- El profesorado a que se refiere el apartado anterior podrá impartir excepcionalmente enseñanza en el bachillerato, en materias optativas relacionadas con su experiencia profesional, en las condiciones que se establezcan.
Disposición adicional. Decimoquinta Sin perjuicio de las excepciones que reglamentariamente se determinen, el personal
que acceda por primera vez a la función pública docente deberá acreditar el cumplimiento del perfil lingüístico que dicha norma reglamentaria establezca.
Disposiciones Finales Primera. El Gobierno dictará cuantas disposiciones sean necesarias para la
aplicación de la presente ley.Los sindicatos y organizaciones sindicales participarán en la elaboración de estas disposiciones a través del Consejo Vasco de Función Pública, en los términos previstos en el artículo 8 b) de la Ley 6/1989, de 6 de julio, de la Función Pública Vasca.

Artículo 30. El Gobierno velará por la unificación y normalización del euskera en su condición de lengua escrita oficial común en el ámbito territorial de la Comunidad Autónoma del País Vasco, sin perjuicio del respeto a los diversos dialectos, parte esencial del patrimonio cultural del País Vasco, en las zonas en que son hablados.
Disposiciones Adicionales
Primera
El Gobierno, en el ámbito de sus competencias, establecerá vínculos culturales con aquellas instituciones o poderes que, actuando fuera del ámbito territorial de la Comunidad Autónoma, realicen actividades de investigación, protección y fomento del euskera.
Segunda
El Gobierno elaborará el mapa de planificación socio-lingüística del País Vasco que será revisado periódicamente, previa información al Parlamento Vasco.
Tercera
El Gobierno Vasco promoverá, de acuerdo con los órganos competentes, la adopción de medidas tendentes a la progresiva normalización del uso del euskera en la Administración del Estado en la Comunidad Autónoma del País Vasco, en lo regulado en los artículos 6, 8, 11, 13 y 14 de la presente Ley.

Disposiciones Transitorias Primera Todos aquellos procedimientos y expedientes que hayan sido iniciados en las
distintas administraciones públicas con anterioridad a la entrada en vigor de la presente Ley, continuarán hasta su conclusión en la lengua en la que se hayan iniciado.
Segunda El Gobierno, a instancia de los poderes públicos locales, y atendiendo
especialmente a la situación socio-lingüística de la zona, podrá exceptuar temporalmente en el ámbito de su competencia, la explicación de artículos de la presente Ley que no resulten de obligado cumplimiento por imperativo constitucional o estatutario.
Disposición Derogatoria Quedan derogadas cuantas disposiciones de igual o inferior rango se opongan a lo
dispuesto en la presente Ley. Disposición Final Se autoriza al Gobierno para dictar las disposiciones de carácter reglamentario
necesarias para el desarrollo y aplicación de la presente Ley, que entrará en vigor al día siguiente de la publicación en el Boletín Oficial del País Vasco.

Ley Foral 18 (1986), 15 Diciembre, del Vascuence Titulo II: De la Enseñanza
Capitulo I, disposiciones generales
Art. 20. El Gobierno de Navarra regulará la incorporación del vascuence a los planes de enseñanza y determinará los modos de aplicación a cada centro, en el marco de lo dispuesto por esta Ley Foral para las distintas zonas.
Art. 22. Las Administraciones Públicas proporcionarán los medios personales, técnicos y materiales precisos para hacer efectivo lo dispuesto en los artículos anteriores.
Art. 23. Los planes oficiales de estudio considerarán el vascuence como patrimonio cultural de Navarra y se adaptarán a los objetivos de esta Ley Foral
Capitulo II: De la Enseñanza en la Zona Vascófona
Art. 24.1. Todos los alumnos recibirán la enseñanza en la lengua oficial que elija la persona que tenga atribuida la patria potestad o la
tutela o, en su caso, el propio alumno.2. En los niveles educativos no universitarios será obligatoria la enseñanza del vascuence y del castellano, de tal modo que los
alumnos, al final de su escolarización básica, acrediten un nivel suficiente de capacitación en ambas lenguas.3. Los alumnos que hayan iniciado sus estudios de Educación General Básica fuera de la zona vascófona o aquellos que
justifiquen debidamente su residencia no habitual en la misma, podrán ser eximidos de la enseñanza del vascuence
Capitulo III : De la enseñanza en la zona mixta
Art. 25. 2. En los niveles educativos no universitarios se impartirán enseñanzas de vascuence a los alumnos que lo deseen, de tal modo que al final de su escolarización puedan obtener un nivel suficiente de conocimiento de dicha lengua.
Capitulo IV: De la enseñanza en la zona no vascófona
Art. 26. La enseñanza del vascuence será apoyada y, en su caso, financiada total o parcialmente por los poderes públicos en criterios de promoción y fomento del mismo, de acuerdo con la demanda.
