Attachment E2: BPC Submission on the Dash-8 Flight path on 21 June

As indicated below, a number of considerations informed the decision not to amend the aircraft surveillance plan.

Q1: Aircraft departed at 1321 AEST, were there any reasons for the delayed departure?

Al: Consistent with current contractual arrangements, Cobham Special Mission (CSM) aircraft have a 30 minute discretionary window for departure.

The planned departure time for the Dash-8 on 20 June was 1300 AEST As the aircraft departed at 1321 AEST this 21 minute delay was within the acceptable limits of the contract. Cobham records the departure time for this aircraft as being 1324 AEST. Cobham further advises the difference in planned versus actual departure was attributed to : a refuel delay (19 minutes), and an airspace restriction (five minutes). Both matters were beyond the control of CSM and BPC.

02: What were the actions of BPC in relation to tasking the Dash-8 after 1300 AEST 21 June 2012, and

A2: at approximately 1250 AEST, COMBPC concluded that there was a reasonable basis for an increased level of concern for the safety of the vessel now known as SAP 4106. at approximately 1300 AEST COMBPC directed that arrangements be made to:

• posture the Christmas Island Response vessels (HMAS Wollongong and HMAS Maitland) at the outer edge of the Contiguous Zone (in preparation for possible SAR tasking whilst retaining flexibility to address law enforcement tasks within the Australian Contiguous Zone).

• conduct aerial surveillance as a matter of priority to relocate the vessel.

On receiving direction from COMBPC, AMSOC staff considered the arrangements for aerial surveillance over Christmas Island for the day. Almost concurrent within COMBPC's direction (at 1300 AEST) an aircraft was planned to commence aerial surveillance over Christmas Island, and had already been directed in a pre mission brief conducted at 1143 AEST the same day, to re-locate the vessel now known as SAR 4106.

No revised instructions were provided to the aircraft by AMSOC at that stage.

At approximately 1448, when it was observed via tracking systems in the AMSOC that the aircraft was deviating from its planned flight to investigate COls, AMSOC contacted the aircraft and requested that it:

(i) cover the existing weigh point with radar ; and

(ii) proceed directing to the final weigh point.

(iii) During this conversation, the Dash-8 detected SAP 4106 at 1453 AEST.

03: What were the circumstances that contributed to any decision for the aircraft to fly its pre-planned route?

A2/3: The collective considerations which informed the decision in the AMSOC, not to issue the aircraft with revised flying instructions (until approximately 1448) include:

(i) The fact that the aircraft was about to take off.


(ii) An understanding that BASARNAS maintained coordination for the SAR which was based on communication as follows :

(a) At approximately 1054 AEST on 20 June 2012, RCC Australia informed AMSOC, Indonesian Search and Rescue authority, BASARNSAS had coordination of this incident.

(b) At approximately 1237 AEST, Thursday, 21 June 2012, AMSOC was advised that RCC Australia had provided BASARNAS with up to date information on the vessel's possible location.

(iii) RCC Australia had not sought the release of the Dash-8 for the SAR and as a consequence it was still available for its primary civil maritime security function. (An AMSA liaison officer was present in the AMSOC from approximately 1315 AEST)

(iv)

The importance of the requirement to obtain this situational awareness escalated in view of the confined surface assets available and the potential for SAR tasking a significant distance from BPC primary patrol areas around Christmas Island.

(v) An understanding that the aircraft had been tasked to proceed to the last known location of the vessel (21 June 2012) once it had completed BPC requirements, and that it could achieve both tasks in a reasonable timeframe — ie it was understood that the planned surveillance of the north western approaches could be achieved and the vessel now known as SAR 4106 could be relocated by 1430 AEST

(vi) An understanding that while there was an increased level of concern for the safety of the vessel, there was not yet any confirmation that a genuine and emergency SAR situation existed.

(vii) Pre-planned routes are designed so an aircraft's progress within a 'Designated Surveillance Area' (DSA) can be measured and monitored. Any deviation from the pre-planned and agreed routes requires coordinated planning with regards to:

(a) client agency requirements in relation to the tasking,

(b) Indonesian airspace considerations,

(c) risk management and

(d) flight safety implications.

Attachment E3: AMSA Submission on the appropriateness of AMSA's hand-off to BASARNAS on 20 June given what was known on their capability,

RCC Australia considerations before handing over coordination responsibilities to BASARNAS. AMSA and BASARNAS carry out their functions according to their capabilities. These may result in different approaches in terms of use of assets by each agency but each agency is best placed to assess how to manage an incident within its search and rescue region. 4106 occurred in the Indonesian SRR and in accordance with the SAR Arrangement, the agency that is first notified of the incident retains coordination until the agency responsible for the region where the incident occurs accepts coordination. Transfer of coordination from RCC Australia to BASARNAS took place when the position of the vessel was established.

Under ITSAP, AMSA has been engaging with BASARNAS with the aim of improving maritime and aviation search and rescue in Indonesia since 2007. Various conferences and meetings take place as part of this project. AMSA conducts an annual Search and Rescue Exercise (SARIE() which exercises joint SAR coordination procedures.

In addition, AMSA has provided SAR Mission Coordinator (SMC) training and SAR Officer secondment to RCC Australia for BASARNAS officers under ITSAP. Two BASARNAS officers have been seconded to RCC Australia for the past three years, most recently in March 2012.AMSA has also provided technical support and training in-country regarding the satellite detection of distress beacons.


A great range of options for practical management of an incident exist. AMSA will offer to support BASARNAS when an incident occurs within its SAR region and vice versa. If an incident has occurred in the BASARNAS SAR region and the RCC has responded by tasking assets, BASARNAS may accept coordination but request that the RCC continue to manage the response. If, on the other hand, the incident has occurred in the Indonesian SAR region (SRR) and BASARNAS has accepted coordination before the vessel can be located or where a vessel has contacted the RCC but is assessed not to be in distress, assets will not be tasked by AMSA.

Yet another possible option, evidenced by another event occurring on 21 June, on the same day as this 4106 incident, is where BASARNAS responds first to a beacon alert and seeks assistance from RCC Australia because the vessel reportedly in distress sin close to the Australian SAR region boundary. Through contact with a third country's rescue coordination centre, RCC Australia and BASARNAS were advised that the beacon had been inadvertently activated by the master of a fishing vessel.

These examples are provided as demonstrating a few of the many practical options for managing an incident.

An example of the competency of the Indonesian agency is the recent SAR incident at Prigi Beach in 18 December 2011where a refugee vessel capsized 40 nautical miles from the Indonesian coast off Prigi Beach. BASARNAS fully coordinated this incident which resulted in the rescue of 25 persons and the tasking of two BASARNAS rescue launches, a BASARNAS helicopter and two naval vessels and local fishing boats.

AMSA offered assistance but this was not needed as BASARNAS was responding with appropriate assets. RCC Australia did assist with the provision of drift modelling and some planning.

Australia and Indonesia also cooperate at an international level to work towards increased search and rescue capability in the Asia/pacific region. An example of this is the discussion at the recent meeting of the ICAO's Asia Pacific Air Navigation Planning and Implementation Regional Group's sub-group on ATM/AIS/SAR held in Bangkok from 25 to 29 June 2012 where Australia presented a paper proposing the establishment of an Asia/Pacific Regional SAR Workgroup to enhance cooperation between and collaboration with neighbouring and regional RCCs to ensure the best possible SAR response. This paper was strongly supported by Indonesia and other countries. Indonesia referred to the support through discussions in 2011 in an ASEAN meeting for the establishment of a forum to strengthen cooperation, information and experience. The paper resulted in a draft decision for approval by the parent body of that the working group be established.

In addition to Indonesia Australia shares its search and rescue region with eleven countries including Antarctic Treaty nations, RCC Australia does not hold records on or comment on any of these countries capability to conduct SAR, noting that each incident is different and the best determination of how incidents are managed in a countries search and rescue region is that country.

The decision for RCC Australia to transfer coordination to BASARNAS is in accordance with international protocols and the SAR Arrangement. The decision for RCC Australia to have coordination transferred from BASARNAS to RCC Australia following the capsize of the vessel was also in accordance with international protocols. RCC Australia became best placed to coordinate Australian assets and merchant vessels.

RCC Australia unilateral decisions (for eg broadcasts to shipping, requesting BPC support) for the period where BASARNAS coordinated the SAR.

AMSA acted in accordance with requests for information from BASARNAS, as the responsible SAR authority, throughout the incident.

The AMSA log shows ongoing interaction with BASARNAS and GPO throughout the incident, including offers of broadcasts and updates of all information received from the vessel.

Details of calls and positional information were also passed to BPC during the incident, AMSA is unaware of actions taken by BPC, but noting the existence of the protocol 'Protocols for vessels with a changed state' it was AMSA's understanding that whilst no initial information was known any change in state information received by BPC would be passed to AMSA, operation of the protocol in affect was observed by AMSA personnel at the PSOG meeting of the Wednesday 20 June and resulted in advice to AMSA on the morning of Thu 21 June of a possible changed state.


RCC Australia responded in accordance with the SAR MOU and guidelines contained in the IAMSAR manual at paragraph 5.2. On receipt of information RCC Australia requested assistance from Border Protection Command. BPC advised that nothing was known on the vessel, AMSA is unable to comment on the internal arrangements taken by BPC in providing this advice to AMSA.

AMSA communicated with BASARNAS during the incident via telephone and message, from these communications AMSA was aware of the following:

BASARNAS, Indonesian maritime police, TN1-AL and BAKORKAMLA were aware of the incident

(ii) BASARNAS was provided vessel details and location before accepting coordination of the incident

(iii) BASARNAS advised that they were coordinating with a local RCC and Navy and had issued a broadcast to shipping via Indonesian coast radio station, navy and marine Police

(iv) Having accepted coordination BASARNAS advised at 201342 AEST that the only requirement for RCC Australia was to keep BASARNAS updated on information received via telephone call from the vessel

Noting this request and that appropriate Indonesian authorities were involved and issuing broadcasts to shipping RCC Australia continued to support BASARNAS as requested, this included the offer by RCC Australia to issue a broadcast to shipping at 202129 AEST which was not taken up by BASARNAS.

Attachment E4: BPC submission on the type of surveillance of the 4106 vessel on 20 June

The decision making and reasoning which informed the surveillance profile of the aircraft included the following considerations:

The objective of the surveillance was to enable an assessment of the condition of the vessel without causing the people onboard to change the state of the vessel due to sighting the surveilling aircraft.

Previous and recent experience is characterised by a number of occasions in which people on SIEVs who have become aware that they have been observed by Australian authorities — either by aerial surveillance or surface surveillance - may precipitate a rescue requirement. There have been a number of occasions on which SIEVs have stopped their engines and stopped in the water having sighted an Australian government response asset. By way of example, on 19 June 2012 the BPC-assigned Dash-8 aircraft based at Christmas Island re-located a COI (now known as SIEV 356) approximately 113 nm west of Christmas Island. The COI stopped in the water once the Dash-8 aircraft was observed. The Dash-8 was directed to leave the location and continue to conduct covert surveillance of the vessel. After adopting a covert posture, the vessel was observed to recommence its track and was intercepted on 20 June 2012, approximately 7 rim north west of Christmas Island.

The precipitation of a SAR event, or stopping in the water is problematic from a number of perspectives:

(i) It is very difficult to accurately assess the condition of vessel which is stopped in the water.

M A vessel which is stopped in the water is inherently more unstable than a vessel which is underway.

On 20 June 2012, the vessel (now known as SAR 2012/4106) was in a geographically isolated position approximately 164 nm north of Christmas Island and a significant distance from available BPC surface response assets. Consequently, the risk of precipitating a SAR incident was an active consideration in the decision regarding the manner in which surveillance was conducted. This risk was heightened by the fact that BPC assets were a distance away from the vessels location,


Reporting and assessments during the surveillance mission, including the imagery, did not indicate it was necessary to alter the surveillance profile. The report indicated that the vessel was underway in a southerly direction at 4 knots, which is average speed for a SIEV. The vessel was not reported as displaying any signs of distress. Although reported as being low in the water, this observation is not unusual in relation to SIEVs and would not necessarily indicate a distress situation. In all respects, it presented as a usual SIEV arrival.

Attachment E5: BPC submission on the appropriateness of BPC not searching for the vessel earlier on 21 June

(a) Assessment of maritime SAR incident and security threats on 21 June on 21 June 2012 (up to approximately 1250 AEST) the cumulative

assessment of relevant Government authorities as understood by BPC was that a distress situation did not exist.

Imagery and observations of from the 20 June 2012 Dash-8 crew had been forwarded to the competent SAR authority for assessment and AMSA was in contact with the vessel. BPC did not receive any request from AMSA, or other SAR authority, for the provision of air or surface response assets. BPC had been advised that AMSA's RCC Australia had requested BASARNAS take coordination of any SAR response, given the location of the vessel within the Indonesian Search and Rescue Region.

In the absence of a request for SAR assistance, BPC assets were tasked consistent with BPC's mission of civil maritime security.' The SIEV 221 Coronial Inquest finding reinforces that the 'responsibility for intercepting SIEVs entering any of Australia's contiguous zones rest with BPC'. BPC surface response asset positioning is determined by the requirement to achieve necessary surveillance and response to Irregular Maritime Arrivals within the zones where Australian laws apply (24 nm from Australian territorial sea baseline for the purposes of the Migration Act).

1. BPC does not have an obligation to ensure the safe passage of any vessels in Australian waters, Let alone that obligation in international waters. This was recognised by the Western Australia Coroner in the matter of SIEV 221 and the following is an extract from his findings:

In closing submissions on behalf of the Commonwealth of Australia it was contended that 23.2 —

There is no domestic or international expectation or obligation that BPC or other Australian assets will

be postured for the purpose of saving SIEVs that may place themselves in dangerous situations.

This point was again made in the submissions at para 121 —

But, as stated in paragraph 23 above, it is plain that Australia does not have and cannot have any legal,

moral or other obligation to ensure safe passage for vessels illegally entering Australian waters.

While it is not the purpose of this inquest to determine whether Australia has any Legal obligation to mitigate potential disasters occurring within Australian wafers and it is accepted that Australia does not have an obligation to ensure safe passage for vessels illegally entering Australian waters, in my view it is clear that right thinking Australian people will act to save human life in the event that a major tragedy is otherwise likely to occur.

This is, however, a very different concept and necessa* involves lesser expectations from the situation where there is a duty to act. It is also more difficult to determine when such an expectation exists or the extent of any such expectation. The un-alerted arrival rate for June 2012 was 33 percent of total arrivals. In practice, this means asset disposition for law enforcement purposes must provide residual capacity to respond to the real possibility of un-alerted arrivals.


A number of incidents where vessels were first detected very close to Christmas Island reinforced the need to maintain adequate surveillance assets near Christmas Island.

(b) Capacity for BPC to search earlier on 21 June

It would have been possible to task the ACPBs and Dash-8 to proceed to search for the vessel earlier. In relation to the Dash-8 it is relevant to note the following:

• On 20 June 2012, the Dash-8 completed its routine surveillance of the Christmas Island search area (approaches the Christmas Island) at approximately 2030 AEST Approximately one hour later, the Dash-8 crew completed its routine sign-off commitments.

• There is a minimum stand-down between sign-off and the next sIgn-on, so the earliest sign-on time for this crew was approximately . With the routine mission planning (this can be approximately halved for an emergency), the aircraft could have departed at approximately . This option would have required the crew being given notice prior to sign-off on the 20 June 2012 mission.

• In this case, the crew with allowance.

to sign-on and mission planning time, the aircraft could have departed at approximately 0900 Christmas Island time (1200 AEST).

Over period 17 through 21 Jun 2012, the two ACPBs at Christmas Island had been involved in responding to a number of arrivals. SIEVs 354 and 355 were intercepted by BPC assets in vicinity of Christmas Island at 0605 AEST and 0750 AEST on 20 June 2012. Concurrent arrivals increase the risks for a single response asset to safely manage the situation. Both surface response vessels were required near Christmas Island to safely manage these arrivals.

2. The un-alerted arrival rate for June 2012 was 33 percent of total arrivals. In practice, this means asset disposition for law enforcement purposes must provide residual capacity to respond to the real possibility of un-alerted arrivals.


At 1250 AEST 21 June 2012, the time at which COMBPC directed that response vessels at Christmas Island preposition at the northern edge of the Australian Contiguous Zone, both HMA Ships Larrakia and Wollongong were reconstituting after a 36 hour period of continuous operations/boardings, and a late night transfer of the people from SIEV 356 at Christmas Island. HMAS Larrakia was at Flying Fish Cove buoys refuelling. HMAS Wollongong was patrolling in vicinity of Flying Fish Cove but had a boarding party on the hulk of SIEV 356 to assess if the vessel was at risk of sinking at the buoys. HMAS Larrakia was required to slip from moorings, and HMAS Wollongong needed to recover her boarding party from hulk of SIEV 356. Despite tasking associated with the earlier arrivals, the two ACPBs were near the northern edge of the Contiguous Zone as ordered at the time when the vessel (now known as SAR 2012/4106) was observed as capsized by the Dash-8.
