PROGRESS REPORT ON I MPLEMENTATION OF THE MINIMUM LIST OF NON-PATENT LITERATURE UNDER PCT RULE 34.l(b) (iii) BY THE PROSPECTIVE INTERNATIONAL SEARCHING AUTHORITIES

prepared by the International Bureau

1 . The PCT Interim Committee for Technical Cooperation (hereinafter referred

to as "the Interim Committee"), at its fourth session, held in Geneva from

November 14 to 19 , 1974 , decided that the list of minimum documentation non

patent literature , referred to in PCT Rule 34.l (b) (ii i ) should consist of the

1 69 periodicals listed in Annex II of the Report of that session (see para

graph 12 of same - PCT/ TCO/IV/18).

2 . I t was understood that the prospective International Searching Authorities

(hereinafter referred to as "the prospective Authorities") would, within the

next six months , try to start including into their documentation any of the 169

periodicals which are not presently included in that documentation.

3. In v i ew of some changes which have occurred in the titles of periodicals

and the names and addresses of the publishers of the periodicals included i n

the aforementioned list , which was establi shed on the basis of infor mation

assembled by the International Bureau in 1971, a review of that informatio n has

become necessary.

4. The International Bureau ha~~ndertaken such a revision and has prepared . - .

an updated version ·of the list of periodical s. This updated list was distributed

to all prospective Authorities, including prospective International Preliminar y

Examining Authorities , with circular letter No. 2196, of March 21 , 1975, with

the request to confirm the inclusion in their documentation of the periodicals

s o listed (see Annex A to this document) .

5 . Thi s document reports on the answers received up to July 10, 1 975.

Responses received to Circular No . 2196

6. The following countries and the International Patent Institute have

responded to circular letter No. 2196 : Austr ia, Germany (Federal Republic of) ,

the Netherlands, the Soviet Union , Sweden, the United Kingdom and the United

States of America . Relevant information for Brazi l is known to the International

Bureau through the project for t he modernization of the Brazilian patent system .

I nformation from Japan is expected soon and will be reported on in a separate

document.

7. All responses received so far indicate very positive reactions and serious

efforts to subscribe to the periodicals not yet regularly received . The position

of each prospective Authority is given below , in the English alphabetical order

of their names.

8. Austrian Patent Office

The Austrian Patent Office collects 152 of the 169 periodicals . Efforts

are being made t o include the remaining 17 periodicals.

9 . Brazilian Patent Office (INPI)

Thirty-two (32) periodicals of the minimum list are regularly received.

Efforts are being undertaken to obtain the remaining periodicals of the list .

10 . German Patent Offi ce

The majority of the periodicals have been regularly received already for

years. As far as the remaining periodicals are concerned , the German Patent

Office will, within the framework of the budget funds avai lab l e , endeavor to

ascertain the terms of subscripti on and to include the said periodicals in i ts

documentation .

ll. International Patent Institute (IIB)

The IIB ordered the 30 periodicals which were not included in its docu

mentation upon receipt of the report of the fourth session of the Interim

Committee, document PCT/TCO/IV/18 , which contained the list of 169 periodicals .

At present , 160 of the 169 periodicals are received by the IIB and the publishers

have confirmed that the remaining periodicals ·will be forwarded in the near

future .

12. Netherlands Patent Office

The Netherlands Patent Office is a prospective International Preliminary

Examining Authority and has noted with interest the updated list of periodicals .

13 . Soviet Union Patent Office

Many of the periodical s mentioned in the final list of non- patent literature . ..

are already being . ~sed durin~ · the examination of applications for inventio n s in

the Soviet Union Patent Office . That Office has already done the preparatory

work for the establishment of files of patent associated documents , which we r e

classified in accordance with the Inter national Patent Classification a nd which

were accompanied by abstracts in Russian. The documents relate to all 169

periodicals included in the above- mentioned list.

At present more than 200 foreign periodicals, covering approximately the

same field as those in the PCT list, are included in the documentation of this

Office. In addition, by cooperation with a neighboring institution, the

examiners of this Office have access to practically all the periodicals in the

PCT list. Nevertheless, the Office ' s library is at present in the process of

substituting periodicals now subscribed to with those on the list . Allowance is

made in the Pa tent Office requests for appropriations for the next budget year

for this changeover since, among other reasons, subscriptions must be cancelled

or ordered well · in advance .

15. United Kingdom Patent Office

This Office is a prospective International Prelimi nary Examining Authority

and has at its ready disposal in the Science Reference Library all the 1 69

periodicals of the PCT minimum list, which are regularly subscribed to by the

Library .

16 . United States Patent and Trademark Office

This Office presently subscribes to 16 2 of t he periodica l s listed. This

Office plans to subscribe by July 1975 to the additional seven periodicals of

the PCT list not presently subscribed to .

17 . The full responses received are reprodu ced in Annexes B to I to this

document .

Approval of the updated version of the list of 169 periodicals

18 . As far as the contents of the updated version of the list o f 169 periodicals

are concerned , the attention of the Interim Committee is drawn to the f o llowi ng

clarification, already submitted to the prospective Authorities (see Circular 2196 ,

page 2, first paragraph) :

"The original titles of a majority of the periodicals (163 of 1 69) have not substantially changed and hence t he alphabetical order of the periodicals in the minimum lis t remains practically the same . Four periodicals have merely changed their title, but their scope has remained t he same. Two periodicals have been absorbed by other publications, one of which was already included in the list (i.e., Journal of the Chemica l Society of Japan: Industrial Chemistry Section) . As far as that Japanese periodical is concerned, the International Bureau has tentatively , and subject to the Interim Committee ' s approval at its next session in 1975 , included in its place another periodica l suggested to it by the Japanese Patent Office (i . e ., the Bulletin of the Pharmaceutical Society of Japan) ,"

19. Furthermo r e , the International Bureau has amplified the information about

each of the 169 periodicals , wherever this was needed and information was avail

able. For instance , the names and addresses of the publishers of the original

editions of Russian periodicals are indicated in addition to those of the cover - to

cover tr anslat ions into Engli~h~ ~F~~ further details, please refer to the

"Explanatory No tes " · tnat precede the updated list (see Annex A to this document) .

20 . It could prove to be us e fu l, with a view to ensuring uniformity of citing

references, t o include at t he end of the updated list an index of t i tle abbre

viations to be used when referring to any of the minimum list periodicals in a

PCT search report . For this purpose, the I nternational Bureau would follow ISO

Standard 833: "Documentation - International list of title word abbreviations . "

21. A certain amount of continuous updating of the list would seem to be

required. Many periodicals exist exclusively on the basis of selling copies,

and have to adapt the subject coverage to keep in line with technological

development . Changes may occur also due to market contingencies: mergers ,

absorptions. Other periodicals simply stop existing. Periodicals published

by learned societies, industrial organizations or other bodies evolve with

time and changes occur in their names, in the names a nd address of publishers,

or in their coverage . It would seem to be useful for the International Bureau

to keep track of any changes of this nature and inform the Interim Committee

f rom time to time about such changes, if any .

to take note of this report and express

its opinion :

(i) on the amendments made in the list

of 169 periodicals as referred to in

~aragraphs 18 and 19 of t his report ;

(ii) on the preparation of an index of

title abbreviations , as explained in

paragraph 20 of this report ;

(iii) · ·ari the updating of the lis t of 169

periodicals , as referred to in

paragraph 21 of this Report .

Sir,

' I have the honor to call your attention to a decision taken by~ the Patent Cooperation Treaty (PCT) Interim Committee·· for Technical Cooperation, at its fourth session, held in G~neva from November 14 t o 19 , 1974. The Interim Committee decided (see paragraph 12 of the Report of the fourth session , document PCT/TCO/ IV/18) that t he list of minimum documentation non-patent literature , referred to i n PCT Rule 34.1 (b) (iii) should consist of the 169 periodicals listed in Annex II t o the said Report.

It was the understanding of the Interim Committee that the prospective International Searching Authorities would, within the next six months, include into their documentation any of the 169 periodicals contained in the list which are not presently included in that documentation . Within the same period , INSPEC would try to cover those periodicals of the 169 which they do not presently cover, but which lie within the technical fields covered by the full-text PAL Service.

The titles of the periodicals , and names and addresses o f the publishers of the periodicals included in the aforementioned list are mainly based on information assembled by the International Bureau in 1971. In view of the changes which have occurred since that time, a review of that information has become necessary before preparing a final

Four periodicals have merely changed their title, but their scope has remained the same . Two periodicals have been absorbed by other publications, one of which was already included in the list (i . e ., Journal of the Chemical Society of Japan: Industrial Chemistry Section) . As far as that Japanese periodical is concerned , the International Bureau has tentatively, and subject to the Interim Committee ' s approval at i t s next session in 1975 , included in its place another periodical suggested t o it by the Japanese Patent Office (i.e., the Bulletin of the Pharmaceutical Society of Japan).

It is hoped that the updated version of the list will be of assistance to all prospective International Searching Authorities in their efforts to start including into their documentation by June 1975 any of the 169 periodicals which at the present time they do not collect.

Annex to Circular No 2196

PCT MINIMUM LIST OF

NON- PATENT LITERATURE under PCT Rule 34 . l(b) (iii)

1. This Annex sets forth the alphabe tical lis t of 169 periodicals constituting "published items of non- patent literature " within the meaning of PCT Rule 34.l(b) (iii). This list was agreed upon by the PCT Interim Committee for Technical cooperation at its fourth session in Geneva from November 14 to 19, 1974 (see document PCT/TCO/IV/18 , paragraph 12), on the bas i s of listings dating back in part several years. The present list updates the bibliographic data of the 169 periodicals , that is their title, name and address of the present publisher. Further details are clarified below.

2 . The structure of the alphabetical list is as follows:

(i) entries in the list are numhered consecutively by PCT serial number ;

(ii) each entry is concerned with one periodical only and gives for each periodical

- the original title of the periodical - the publisher - the address of the publisher ;

(iii) the language of the periodical is indicated opposite the title: E stands for English, F for French , G for German , I for Italian, J for Japanese, Pt for Portuguese, R for Russian, Sp for Sp anish, Sw for Swedish; ·

(iv) where the periodical is published in two or more parts, or sections, these are indicated under the title (with a short indication of the fields covered by each one, if not obvious from their subtitle) .

3. The titles are arranged alphabetically, subject to t he following :

(i) where the title of the periodical contains the name of a l earned society, associati on or organization, etc., the title appears in the listing under the name of the learned society , association , or organization , etc . , e . g . Journal of the American Ceramic Society appears under American Ceramic Society, Journal;

(ii) the only secondary publication included as an exception in this list is indicated after the listing of the primary publications under PCT serial number 169 ;

(ii i) when several editions of a periodical exist in different languages (e.g. by cover- to- cover translation) , the periodical is listed according to the title of the English edition , if any , with the original title given in parenthesis . If no En glish edition exists, t he original title is kept for purposes of the alphabetical list ;

(iv) where the title has changed , the entry appears in full under ·the new title, the fo rmer title pr eceded by "ex-" being indicated in parenthesis next to or below the new title. For ref~{ence purposes , the former titles are reproduced in the present list in their correct alphabetical order , but in parenthesis with a cross- reference indication of the new title. The entry of the former title carries no PCT- Serial Number.

4. The names of Japanese publishers are indicated in English , followed by the transliteration of the Japanese name into Latin characters in parenthesis.

5. The names and addresses of the publishers of the original editions of Russian periodicals are indicated below the names and addresses of the publishers of cover-to-cover translations into English. The language of each edition of the periodical is indicated in this case in accordance with the corresponding publisher.

6. Whenever the periodical contains, in addition to the full -text articles in the language , or languages , in which it is published, also translations of abstracts, or of abstracts and part of the text into other languages, this fact is indicated by one or two asterisks next to the indication of t he language (see paragraph 2(iii) above) as follows:

* only abstract in this language ** abstract and part of text in this language .

7. The alphabetical list is followed by a catchword index, subdivided into t hree main parts as follows:

The Austrian Patent Office collects 152 of the 169 periodicals of the NPL-minimum documentation as decided by the PeT-Interim-Committee for Technical Cooperation.

Efforts are beeing made to include the remaining 17 periodicals . A detailed information on the present state of periodicals included in the search documentation of the Austrian Patent Office will be provided if t~e nec essity of a comparative study of this nature arises .

I herewith should like to express the satisfaction I had in learning that , at its Geneva session in November 1974 , the Interim Committee for Technical Cooperation on the basis of several surveys and in consideration of new criteria cropping

up again and again, succeeded in establishing the PCT minimum list which seems acceptable to all members of the Interim

Committee and contains 169 periodicals selected from over 6 . 000 d i fferent periodicals as collected by the individual prospective International Searching Authorities .

The German Patent Offi ce has been regularl y receiving for years a majority of these periodicals . As far as the remaining periodicals are concerned, the German Patent Office will ,

within the framework of the budget funds available, endeavor to ascertain the terms of subscription and to include t he sai d

periodicals i n its documentation .

literature, we ' d like to inform you of the following .

As soon as we received the list, with reference PCT/TCO/IV/18

of novembre 26 , 1974 , we ordered for the 30 periodicals which

were not included in our documentation at that moment.

At this moment , 160 of the 169 periodicals mentioned in the

minimum list are in our possession and we received the

confirmation from the publishers that the remai ning reviews

would be forwarded to us before long.

In your letter o f Ma rch 21 , 1975 yo11 refer to th~ recommendation by the PCT Interim Committee for Technical Cooperation dated November , 1974 to include by June, 1975 in the documentation of prospective International Searching Authorities 169 periodicals listed by that committee . You ask fo r confirmati on a t the time such inclusion ls made .

On account of this I would like t o give the following statement . The Swedi sh Patent Office , which t s a prospective International Searching Au thority ,

·includes in its documenta tion as of now more than 200 foreign periodicals covering appr. the same fields as those in the recommended list . The titles are t hus well above the number on the list . In addi tion, by cooperation with a neighoouri ng institution the examiners have access t o practically all the periodicals on your list . To all effects and pu r poses we a re the refore already now ins position to take into r egard these periodical s in our search .

Nevertheless , our library is now in the process of substituting periodicals now subscribed to with those on the li:.:t . For technico.l re().!:'0n" , mRinly th~ fAct that subscri ption must be cancelled or order~d well in advance , this operation can natur:' l.ly not he concl uded within the short period recommended . An investigation must ~l•o ba made with recard to tho~e non-lis t ed periodicals , now s ubscr iced t o , which t he examiner~ li ke to retain. Allowance is therefore made in the Patent Office reques t $ for appropriation" for the next bucget year for thi s ch9nbe-over.

Finall y we want to s uggest that t he question whether subscrip t ion to the listed periodicals could be considered covered by the INPADOC service perhaps should be settled before a subscription to the complete lis t is definitely required . In t he present situation we have felt that a subscription to the PAL-service should await decisions on this point .

Although in certain ways this confi r mation is qualified , I hope that it neve rtheless will satisfy your request.
