INTRODUCTION

The work under this tender shall be governed by the “Indian Railway

Standard Specification for materials and works 2010 (Vol. I & II)” issued under the authority of Railway Board of the Engg. Dept up to correction slip as on date, IRS Specifications and approved specifications to the relevant IS codes wherever IRS specification is not available. “The regulations for tenders and contracts”, “Special Conditions of Contract”, “Tender Agreement form”, “General Conditions of Contract 2003 corrected up to date of submission of tender”, “The Contract Labour(Regulation & Abolition) Act 1970” and “Central Rules, 1971”, as amended from time to time and specific drawings issued for the purpose of this work govern this contract.

The Special Conditions supplement the General Conditions of Contract and Special conditions of contract applicable to all tenders, areavailable at this office and in thewebsite (www.icf.indianrailways.gov.in)] as amended and/or corrected up to date. 1.0 Schedule of work

1.1 Scope of Work:

It is proposed to outsource unskilled activity to perform the following duties in CMT Organisation.

1. For assisting the testing activities in different laboratoriesduring testing

of the samples. 2. Cleaning and upkeep of equipments/ Machinery, PCs, Laboratory

surroundings and General housekeeping of the laboratory. 3. Movement of samples from workshop to various Labs and back. 4. Assisting Machinist & Fitter in cutting the samples / components to size

of testing. 5. Assisting in bringing the Argon gas cylinder used for both Spectrometer

and Re-melt furnace from Stores. 6. Punching the sample identification on the sample for testing. 7. To wash the glass apparatus after analysis 8. To take the instrument of Chemical Lab to Electrical shop for calibration

and bringing back the same to the Chemical Lab. 9. Assisting the CMS in disposal of scrap. 10. Assisting CMS/CMA to fix test pieces in the Universal Testing Machine

for various tests of periodical evaluation of Welders, Tensile test on first load sample received daily from Shops-10 and 20, weekly from LHB Shop (spot and laser welding)

11. Handing over of butt welded test pieces (225x125x12mm mild steel) for periodical evaluation of welders of „B2‟ Group to NDT laboratory for radiographic test.

12. Getting Carbon-di-oxide-Argon mixture cylinders for conducting periodical evaluation of welders (GMAW) from stores after handing over the empty cylinders with challan with the help of Fork lift from Shop-48

13. To lift and carry heavy samples like side buffer, doors, rolling shutters, brake beam, RTS rods, bars, billets, CP pin housing, tubes of various diameters, plates and sheets, structural sheets etc. to workshop for dismantling and cutting.

14. Assisting the Machinist for lifting to accommodate the job for cutting for the preparation of sample for chemical and mechanical testing and also pour coolant oil for cutting.

15. Collection and segregation of tested samples to put in the respective bins kept for ferrous, non-ferrous, stainless steel samples.

16. Collecting of chips, borings, drillings generated in the cutting machine, lathe and shaping machines to put them into scrap bins

17. Submitting the instruments such as VernierCalipers, screw gauges, dial gauges to Tool Room for calibration and bringing back to the Lab.

18. Submitting the instruments such as Ammeter, temperature indicator cum controller to Meter Room for calibration and bringing back to the Lab.

19. Opening and closing of heavy metal doors during NDT testing. 20. Moving heavy items like bogie frames, axle box housing and other

casting items for exposure and moving back. 21. Regular cleaning of the Radiographic lab including cordoned off area

and the surrounded area. 22. Frequent dusting has to be done as the nearby shop is having blasting

machine is working near to the Lab and dust particles are thrown in the lab.

23. Movement of the springs after shot peening process to the EMCD machine area.

24. Loading the springs with the help of hoist to the EMCD machine for testing.

25. Manually loading/ rolling the accepted/ rejected springs to the specified area.

26. Moving out the End coil of the rejected springs to the rejection bay outside the Shop.

27. Filling 40 litres of water for preparing magnetic Particle bath attached to the EMCD machine, at regular intervals as per the advise of CMS/Spring.

28. Frequently stirring the bath solution to maintain the bath concentration. 29. Manually adjusting the EMCD machine head stock to accommodate

different spring size under the guidelines of the CMS/Spring. 30. Fixing and removing almen strip from the spring fixture for measuring

the intensity of shot peening.

31. Preparing the steel panel for conducting paint testing by using emery paper.

32. Cleaning the brushes and spray gun with thinner/ solvents, which are used in paint testing from time to time.

33. Opening the 20 litre paint drum using crowbar and using mechanical stirring for thorough mixing of the paint.

34. Bringing the 20 litre paint drum from ground floor to first floor for testing and back to ground floor after testing.

35. Mixing of chemicals which are required in large quantities. 36. Regularly carrying distilled / de-mineralized water from shop side for

laboratory use. 37. Any other unskilled jobs as assigned from time to time.

1.2. The scope of work mentioned above is indicative and for general

guidance only. Actual scope of work may vary as per Railway‟s requirement and site conditions.

1.3. The helpers deployed shall be preferably of the age group 20-45 years,

as they are required to lift heavy materials also.

1.4. Preferably same set of helpers may be sent for the contract period of 12 months, as it will be easy for them to coordinate with laboratory work.

1.5. For further details about scope of work, the tenderers may contact ICF.

1.6. The Item of works and quantities given in schedule are only approximate and the Railway accepts no responsibility for their accuracy. It is the responsibility of the tenderer to work out and check the items and quantities correctly according to the type plans site conditions. Any errors discovered in the items / quantities in these Schedules shall not entitle the contractor for any claims later on.

1.7. If there is any minor variation between the description in the tender and

the detailed plans, Dy.CC&M will operate the correct description and his decision is final and binding on the Tenderer / Contractor.

1.9 Wages: Wages will be calculated as the per the number of days of work as

certified by executing officer in the month (treating Saturday as half working day). The payments will be made on monthly basis and limited to 300 full working days without any restriction on the number of days in any month. Wages shall be paid to the helpers by the contractor in accordance with minimum wages prescribed by labour commissionaire, Chennai circle, Tamil Nadu from time to time. Payment to the contractor will be arranged by accounts department based on the bill submitted by contractor on monthly basis.Payment will be made through bank only and in no case cash payment will be made.

2.0 Areas of work: Annexure `A' Provides for the list of locations and specific

activities. 3.0 COMPLETION PERIOD: The contract is for twelve months from the date of

start of work after acceptance of this tender.

4.2. The tender should be in the prescribed form obtainable from the office of the Dy.CC&M, Integral Coach Factory, Chennai, the cost of the Tender form is Rs. 3288/- including GST. The cost of the tender form is to be paid to the Assistant Chief Cashier, Integral Coach Factory, Chennai-600038 in the form of DD and the same will be issued on production of the receipt for the said amount. In no circumstances will the amount paid for the tender form be refunded. If tender form required by post the postage will be Rs.500/- extra to be paid. (non-refundable).

4.3. The tender form is not transferable. 4.4. The tender form will not be issued after 11.00 hrs on 14.09.2018.

4.5. The tender shall be accompanied by the deposit made as DD for the full earnest money mentioned above.

(a) The offer shall be valid for minimum 90 days from the date of opening

of the tender.

(b) After submission of tender document no

addendum/corrections/modification in the tender document is

permitted.

(c) Tender unaccompanied by requisite earnest money deposit will be

summarily rejected.

NOTE: (i) Demand drafts and fixed deposit receipts from nationalized Banks (or)

Schedule banks submitted by the tenderer, should be drawn in favour of Principal Financial Advisor, Integral Coach Factory, Chennai-600038.

(ii) EMD shall be paid in the form of DD only. (iii) It should please be noted that tenders without earnest money

deposit will not be considered and will be summarily rejected.

4.6. Tenders must be enclosed in sealed covers, super scribed “Tender No ICF/CMT/OSUS/2018”, Tender for “Outsourcing of unskilled activity in CMT organization, for one year” and must be sent by registered post to address of Dy. Chief Chemist & Metallurgist, Shell Division, Integral Coach Factory, Chennai 600038, so as to reach this office not later than 14.30 Hours on 14.09.2018 or deposited in the special box allotted for the purpose in the above office on or before 14.30 Hours on 14.09.2018.The tenders will be opened on the same day at 15.00 hours in the office of the Dy.CC&M, Integral Coach Factory, Chennai - 600038.

4.7. The offer shall be filled in the format in Annexure B

4.8. The tenderer should sign in all the pages of tender documents.

4.9. Credential: 4.9.1 The tenderers are required to submit the following in support of their

credentials

3 Statutory requirement

Licence for engaging helpers for unskilled activities in ICF

Successful tenderer shall produce a copy of the licence from Factory inspectorate for engaging no of helpers for unskilled activities in ICF as per this tender before signing the agreement.

((#) Last three financial years 2015-16 to 2017-18 & current financial year 2018-2019) 4.9.2 All documents to show credentials in the field of execution should be

furnished along with the tender and should be available at the time of tender opening. No post tender communication, in any form will be made or entertained, after opening of tenders, in this regard.

4.9.3 For the purpose of similar nature of work, certified copies of relevant

Experience Certificate are to be enclosed.

4.9.4 Tender Committee may at their discretion call for the originals of the credentials for verification from the tenderers or any clarifications / confirmations on the contents of the documents submitted.

4.9.5 In case the Certificates/Documents produced are proved to be false /

fabricated, the entire earnest money is liable to be forfeited in addition to banning their business with the organization for a specified period of not less than one year at the discretion of the Administration.

5.0 Documents to be submitted along with the tender.

a) Organisation details with complete address and ownership of the firm. b) List of works completed in the last three financial years giving

description of work, organization for whom executed, approximate value of contract at the time of award, date of award and date of scheduled completion of work. Date of actual start, actual completion and final value of contract should also be given

c) List of works on hand indicating description of work, contract value,

approximate value of balance work yet to be done and date of award. Note:-

i. In case of items (b) and (c) above, supportive documents/certificates from the organisations with whom they worked/ are working are to be enclosed.

ii. Certificates from private individuals for whom such works are

executed / being executed will not be accepted

6.0. Submission of EMD amount in any other form will not be entertained. 7.0. For other details, terms and conditions, the tenderers are advised to refer

to the GCC available in the website of ICF. 8.0 The attention of Contractor is invited to understand the nature of work

inside the factory premises that Factories Act is applicable for working inside the Shell/Furnishing factory area. The permission of the RPF is required to enter inside the factory. Safety guidelines are to be followed scrupulously inside the factory premises as stipulated by the Chief Safety Officer and work permits are required to be obtained from the Chief Safety Officer before starting the work.

9.0 PAYMENT :-

The payment of wages shall not be less than the minimum wages fixed time to time by the Labour Commissionaire of Chennai, Tamil Nadu as per payment of minimum wages Act.

Monthly bill submitted by the contractor shall be enclosed with Bank statement in proof of payment to helpers engaged for this work along with challan payment slip for ESI and EPF if applicable (which is applicable only when 20 or more helpers are engaged),failing which payment for payment will not be processed. In addition all helpers are to be provided with Prime Minister‟s Jeevan Jyoti Bima Yojana (PMJJBY), wherein the insured receives Rs 2 Lakh cover against an annual premium of Rs 330. A proof of this has to be submitted before submission of first bill. Failure to adhere the above will be a serious lapse on the part of the contractor and the security deposit will be fortified and contract is also liable for termination.

The helpers should be available in the premises during the working hours of all the working days for taking instructions from the respective C&M Supdts., The agency should maintain daily attendance with performance report (Annexure E) from the respective C&M Supdts., for the work given to them and the same shall be certified by the respective C&M Supdts., for effecting payment.

10.0 Statutory Variation Clause:- Any upward statutory variation of excise duty/GST except due to change in turnover, taking place during the original contract period may be claimed extra, duly supported by documentary proof. The benefits of downwards statutory variations, if any shall be passed on to the purchaser without any reference to any time limit.

11.0 Provisions of Employees Provident Fund and Miscellaneous

Provisions Act, 1952: 11.1 The Contractor shall comply with the provisions of Para 30 & 36-B of the

Employees Provident Fund Scheme, 1952; Para 3 &4 of Employees‟ Pension Scheme, 1995; and Para 7 & 8 of Employees Deposit Linked Insurance Scheme, 1976; as modified from time to time through enactment of “Employees Provident Fund & Miscellaneous Provisions Act, 1952”, wherever applicable and shall also indemnify the Railway from and against any claims under the aforesaid Act and the Rules.

11.2 The contractor is required to comply with the provisions of EPF & M&P Act,

1952 and obtain code number from the concerned authorities wherever workmen employed by him are 20 or more. He shall also indemnify Railways from and against any claim, penalties, recoveries under the above Act and Rules. Contractors should get the code number (if applicable)under the EPF so as to enable the PF Commissioners to extend the social security benefits to the workmen engaged by the Railway contractors.

12.0 PENALTY :- 12.1 The following penalties will be imposed for the violation indicated against

each.

(i) If sufficient numbers of workers (13 persons) are not employed as per schedule attached and found to be absent from the work premises on any working day part or full, an amount of Rs. 500/- perday per person will be levied, in addition to the deduction of wages per person absent.

(ii) If the helper failed to perform the work as per the instructions of C&M Supdt., in charge (in addition to deduction of payment minimum wages fixed by the labour commissioner) an amount of Rs.2000/- per instant case will be levied as penaltyin-addition to the recoveries as per relevant clauses, by Dy.CC&M.

(iii) If any damage occurs to the railway property, arising from the work of the helpers, actual expenses will be recovered from the contractor.

12.2 The clause 17(B) of GCC provides for recovery of liquidated damages from the contractor for delay in completion of works. Under such circumstances, the Competent Authority of Railways would consider levy of token penalty as deemed fit, based on the merits of the case.

12.3 The contractor shall issue identity cards to labourers and supervisor and ensure the availability of minimum number of workers/labourers as listed inAnnexure A at each work station and keep a daily attendance register signed by the Dy.CC&M‟s representative and representative of the Contractor, daily.

12.4 If any of the workers is absent in any day, penalty for the same will be

levied on the contractor bill as follow - Minimum wages fixed by labour commissioner from time to time will be levied as penalty and same will be deducted from the contractor bills. Apart from the above, being a cleanliness contract, proper maintenance as per the scope of work is the very important. Performance of the contract will be assessed based on proper cleanliness and upkeep of the surroundings. In case of frequent defaults and penalties levied, the Administration have all the right to terminate the contract.

13.0 SECURITY DEPOSIT: 13.1 The successful tenderer has to pay a Security Deposit is @ 5% of the

tender value all inclusive value of the contractin the form of DD in favour of Principal Financial Advisor, Integral Coach Factory, Chennai-600038,before entering with the contract agreement. The Earnest Money Deposit already made, can be retained as part of payment of the Security Deposit or will be returned on payment of the full security deposit for due fulfilment of the Contract.

13.2 In case, the Security Deposit is not paid fully, the rate of recovery will be at

the rate of 10% of the bill amount till the full security deposit is paid., in which case, the Security deposit will be recovered only from the running bills of the contract services and no other mode such as in the form of instruments like Bank Guarantee, Fixed Deposit etc. shall be accepted towards security deposit

Note: No interest will be payable on the Earnest Money and Security Deposit or amounts payable to the contractor under the consultancy services.

14.0 PERFORMANCE GUARANTEE CERTIFICATE (PGC): 14.1 PERFORMANCE GUARANTEE CERTIFICATE (PGC): The successful

tenderer has to execute irrevocable bank guarantee certificate for an amount of 5% of the contract value of the tender inclusive of all taxes, within 30 (thirty) days from the date of issue of Letter of Acceptance (LOA).

14.2 The successful tenderer shall submit the performance Guarantee (PG) in

any of the following forms: 1). A deposit of DD; 2). Irrevocable Bank Guarantee; 3). Government securities including State Loan Bonds at 5% below the market

value; 4). Deposit Receipts, Pay orders, demand drafts and guarantee bonds. These

forms of performance guarantee could be either of the State Bank of India or of any of the Nationalized banks;

5). Guarantee bonds executed or Deposits receipts tendered by all Scheduled Banks;

6). A deposit in the Post Office Saving Bank; 7). A Deposit in the National Savings Certificates; 8). Twelve years National Defence Certificates; 9) Ten years Defence Deposits 10) National Defence Bonds; and 11) Unit Trust Certificates at 5% below market value or at the face value

whichever is less.

Also, FDR in favour of PFA/ ICF, (free from any encumbrance) would be accepted.

The performance Guarantee shall be submitted by the successful tenderer after the Letter of Acceptance (LOA) is issued, but before signing of the contract agreement. This PG shall be initially valid upto the stipulated date of completion plus 60 days beyond that. In case, the time for completion of work gets extended, successful tenderer shall get the validity of PG extended to cover such extended time for completion of work plus 30 days.

The value of PG to be submitted by the contractor will not change for variation upto 25% (either increase or decrease). In case during the course of execution, value of the contract increase by more than 25%of the original contract value, an additional Performance Guarantee amounting to 5% (five percent) for the excess value over the original contract value shall be deposited by the contractor.

15.0 VARIATION OF QUANTITY

a) Individual items in contracts shall be operated with variation of plus or minus 25% in quantity and payment would be made as per the agreed rate based on actual work.

b) Quantities operated in excess of 125 % and upto 140% of the agreement quantity of the concerned item will be paid 98% of the rate awarded for that item in the particular tender.

c) Quantities operated in excess of 140% and upto 150% of the agreement quantity of the concerned item will be paid 96% of the rate awarded for that item in the particular tender.

d) Execution of quantities beyond 150% of the overall agreemental value may done by negotiating with existing contractor.

e) In case where decrease in quantity is involved the contract signing authority can decrease the items upto 25 % of individual item.

16.0 VITATION CLAUSES

a) In case of vitiation arising due of variation up to 25 % quantities with respect to the rates of the first three valid tenderers, the same will be applicable to the contractor‟s account.

b) the contractor shall adhere to the rules, regulations, and minimum wages act etc. in existence. Staff should use the personnel protective equipments and should not indulge in any unsafe practices of safety.

c) The contractor should maintain housekeeping in the work premises and to avoid objectionable dumping of material in the work spot.

d) The contractor should take care of the medical treatments if required for their staff in case of my any injuries happens. .

e) The payment by the Administration shall be subject to reduction of any amount for which the contractor is liable under this contract in respect of which the President of India is the Purchaser. The contractor need to submit the bills along with details of acknowledged Vouchers in a prescribed format to make payments.

f) No claim shall lie against the Administration in respect of interest of

Cash Deposits or Government Securities or in respect of depreciation thereof. The Administration shall be entitled to deduct

from the said deposit any loss or damage which the Integral Coach Factory may be put to reason of any wrongful act of default on the part of the contractor and recovered from contractors account under this any other contract and to call upon the contractor to maintain the deposit at its original limit by making further deposits.

g) In case the contractor fails to commence the work in time i.e., on the

date stipulated in the order or in the event of the contractor stopping the work in the course of the contract period, thereby making the Administration to incur any extra expenditure by letting the work done by any other alternative agency the extra expenditure will be recovered from contractor, without prejudice to any other penalties to which the contractor may be subjected under this contract.

h) If the contract be delayed at any time in the progress of the work by

any act of the Administration or by any other contractor employed by the Administration or by any causes beyond the contractor‟s control then the time of completion of the works may be extended for such reasonable time as the Administration may decide. Such extension of time granted by the Administration shall in no way affect or vitiate the contract or alter the character thereof or entitle the contractor to damages or compensation thereof

17.0 ARBITRATION :

Procedure for Arbitration when ever required is applicable as per Clause 64 of modified GCC of Indian Railways with latest amendments.

18.0. PAYMENT DURING ARBITRATION

Work under the contract shall unless otherwise directed by Dy.CC&M continue during the Arbitration proceedings and no payment due to or payable by Dy.CC&M shall be withheld on account of such proceedings. Not with standing anything contained herein, the Arbitrators as the case may be shall have full authority to direct withholding of any payment if such action is considered fit and proper at any time.

GUIDELINES TO TENDERERS 1. Tenderers shall hold the offer open for acceptance for a minimum period ninety days

from the date of opening of the tender. 2. If the date of receipt and opening of tender is declared a holiday at a later date,

the tenders will be opened on the next working day. 3. Tender form is not transferable and the amount once paid is non-refundable. 4. All tenders should necessarily furnish required earnest money deposit along with the

tender in favour of Financial Advisor & Chief Accounts Officer, Integral Coach Factory, Chennai-600038 in the form of cash pay orders, demand drafts, Deposit Receipts. Earnest money deposit in the form of DD will be accepted by the Assistant Chief Casher, Shell division, Integral Coach Factory, Chennai-600038.

5. Cheques, war bonds, Government securities and guarantee bonds will not be

accepted towards EMD. 6. Failure to pay the EMD exclusively for each work will result in offer becoming invalid. 7. Unreleased EMD if any, held with the Railway administration, shall not be

adjusted towards the EMD towards the EMD to be remitted. 8. Discharged instruments towards EMD of other tenders will not be accepted. 9. EMD of the tenderers will be forfeited, if any resile from their offers within the

validity period. 10. If the Tenderer deliberately gives / Tenderers deliberately give wrong information in

his/their tender or creates circumstance for the acceptance of his/their tender the Railway reserves the right to reject such tender at any stage. The entire EMD with Railway will be forfeited. In addition, action will be taken to suspend the business with the tenderer for a period of one year.

11. Tenderers must furnish details of all works on hand with them in Railways, other

public sector undertakings and private sector undertakings in the proforma (Annexure-IV) while submitting their offers.

12. No responsibility will be accepted for delay, loss, damage, non-receipt of late

receipt towards dispatch / receipt of tenders by post in postal transit. 13. The tenders will be opened in the office of the Dy.CC&M/ Integral Coach Factory,

Chennai-600038 at date and time mentioned in the presence of available tenders/their authorized representatives.

14. Tender documents duly completed in all respects shall be dropped in the tender box kept for the purpose before the date and time mentioned in the notice. If the tender booklets are sent by post, tenderers must ensure that the same should reach the office before the tender box is closed.

15. The tender box is kept in the office of the Dy.CC&M, Integral Coach Factory,

Chennai-600038. The tenderers are advised to drop their documents in the relevant tender box to the time on last date of receipt mentioned in the tender document.

16. It is responsibility of the tenderer to drop their tender documents in the correct tender

box marked with date of opening. 17. Tenders will not be considered if dropped in the wrong tender box.

18. All terms and conditions in the tender documents are binding on the tenders. 19. Railways reserve the right to accept or reject any or all the tenders and to award

the work in whole or in part without assigning the reason for any such action. 20. The tenderers are advised to visit the site of work in their own interest and

acquaint themselves with the site conditions and expected quantum of work. 21. Tenderer‟s representatives are advised to bring authorization letter from the

tenderer/firm for attending tender opening. Without which he/she will not be allowed to attend the tender opening.

22. Only one representative /tenderer is permitted to attend the tender opening

irrespective of number of tender documents submitted on a particular day of opening. 23. Tenderers/Representatives are requested to attend the tender opening in time and

also to keep their cell phones switched off while attending. 24. Tenderer/representatives are not permitted to enter the premises after the

prescribed time for opening of tender (ie. after 15.00 hrs). 25. The contractor shall comply with the provisions of the Factories Act, 1948 or the

modifications thereof or any other laws relating thereto and the rules made thereunder from time to time.

26. Should a tenderer find discrepancies in or omissions from the documents or any of

the tender forms or should he be in doubt as to their meaning ,he should at once notify the authority inviting tenders who may send a written instruction to all tenderers .It shall be understood that every endeavor have been made to avoid any error which can materially affect the basis of the tender and the successful Tenderer shall take up on himself and provide for the risk of any error which may subsequently be discovered and shall make no subsequent claim on account thereof.
