((Instructions & Provisions for Introducing/Using Wireless Jammers in Iraq))

Article (1)

Interference aims mainly at impacting negatively on wireless communications through

broadcasting a similar frequency-range signal, but with higher power, to cover the targeted

frequency signal. Interference location and source can be detected by using special devices to

monitor, diagnosis, and compare between interference frequency and the licensed frequency

affected.

Article (2)

((Jammers Instructions and Provisions)): is the set of instructions and provisions issued by the

CMC under the powers enshrined in Order 65 of 2004, which instructions and provisions must

be observed by Applicant to obtain jammer approvals from CMC.

Article (3)

"CMC" means the Iraqi Communications & Media Commission

"Application": is an Applicant's request to obtain necessary approvals to introduce and use

jammers inside Iraq in accordance with CMC instructions and provisions.

"Jammer" is a device used to impede wireless communications through broadcasting signals

to affect frequencies on which other wireless communications operate.

"Interference" is the process to obstruct, isolate, alter or modify a signal when transmitted

from source to receiver.

"Authorized Person" is the Applicant's official representative responsible for the application

and jammer.

"Jammer Approval" means the approval issued by the CMC to introduce and use jammers

within a specified area for an identified party and an identified period.

"Usage License" is a temporary license issued by CMC to use jammer in accordance with

CMC instructions and provisions.

"Licensee" is any Applicant with a jammer temporary Usage License.

"Licensed Networks" are networks permitted by the CMC to establish, operate, and manage a

public communication network; provide communication services; or use certain radio

frequencies.

Article (4)

Jammers introduction/importation is confined to Applicants which applied to obtain CMC

jammer approval.

Article (5)

CMC jammer approval is integrated; i.e. it includes both introduction and usage. Applicant's

application shall meet provisions of importation as well as usage in accordance with Article (8)

hereunder.

Article (6)

Type approval shall be issued by CMC to introduce/import telecommunication devices in

accordance with CMC provisions in this regard.

Article (7)

Entities allowed to apply are:

1. Presidencies of Republic, Premiership, and Federal parliament. 2. Ministries and official security departments. 3. Embassies and diplomatic corps

Article (8)

Applicant shall submit an official letter to CMC, in which it seeks approval to introduce/use

jammers with justification of the Application. The following shall be enclosed herewith:

1- Filled and signed type approval form

2- Declaration of Origin or a certified report that contains details and results of lab tests made on the devices. Such report shall contain:

a) Safety aspects

b) EMC, EMI, and RF Test c) Health Standards of the equipment

3- Filled and singed jammer usage license form

4- Technical specifications and catalogues

5- Credentials of the Authorized Person whose information details included in the form

6- Authorization Letter for the Authorized Person

7- Certified check issued by governmental bank in the amount of IQD 100,000.

Note: In case devices hold different specifications and models, attachments of items 1,2,3 and 4

above shall be included for each device.

Article (9)

Upon completion of the requirements above by the Applicant, CMC shall issue a 2-phase

introduction/usage approval: Phase I - introduction approval; Phase II 6-month temporary

usage license following conformity of specification inside CMC headquarters and license fee

payment. The following shall be identified in the temporary license:

1- Holder of license

2- Serial no. of device(s)

3- Geographical area covered by the device.

4- Frequency range of effect

5- Jammer power and radius

6- License validity period

Article (10)

1- Introduction/usage license issued by CMC shall be confined to jammers whose data and serial

no. herein stated in the Application form, and which are tagged with sticky marks to indicate

CMC approval. Similar jammer with a different serial no. shall not be included.

2- It is impermissible to use licensed jammers in areas other than those approved in the license.

3- Usage of licensed jammers shall be confined within frequencies assigned for mobile and fixed

public communications services.

4- Usage of licensed jammers shall be confined to Licensees only.

5- Upon usage and set up of licensed jammers, consideration must be taken to not affect other

communication services outside jammer effect areas.

6- Fixed jammer radius shall not exceed (30) m.

7- Mobile jammer radius shall not exceed (20) m.

Article (11)

1- In case no change was made in license data, documents, or credentials, the license shall

be renewed upon a request to CMC (15) days prior to expiry date. The request shall confirm

that no changes have been made. Expired license letter shall be enclosed with the renewal

request.

2- In case a change has been made to license data, documents, or credentials, the license

shall be renewed immediately, and a new application shall be submitted with the new

changes.

Article (12)

The license shall be considered void or shall be suspended in the following cases, noting that

the device(s) must be reserved:

1- Any violation of the instructions and provisions herein stated

2- Any changes in the license data, documents or credentials prior to expiration of validity date

3- Expiry of validity date without renewal

4- CMC has the right to revoke or suspend the license for reasons related to national security,

requirements of work, or huge impact on public communications services.

Article (13)

CMC must be notified in the following cases:

1- If jammer is no longer needed due to expiry without renewal, or is damaged (with the

necessity to preserve it)

2- If jammer was stolen or lost.

Article (14)

Entities which obtained type approval to introduce/use jammers are not allowed to transfer

ownership, or lend devices and approvals to other parties.

Article (15)

CMC shall charge the following through certified check issued by a governmental bank:

1- IQD 100,000 application review fee (One hundred thousand Iraqi Dinar), non-refundable

whether the request was approved or otherwise.

2- The following fees shall be charged for First-time licensing or upon renewal:

a. For one fixed Jammer: IQD 500,000 (Five hundred thousand Iraqi Dinar).

b. For more than one fixed Jammer: as per the following equation (500,000 x 2x), where

(x) represents the number of devices.

c. For mobile jammer: the figure 500,000 in Para. (2) of this Article (15) shall be replaced with 750,000.

Article (16)

In the following instances, entities approved to introduce/use jammers shall be fined equal

amounts to the fees set out in Para. (2) of Article (15) above, in addition to license revocation

or suspension:

1- If violated any of the instructions and provisions of introducing/using jammer devices.

2- If made changes in the license data, documents, or credentials without notifying CMC.

3- If failed to notify CMC that jammer is no longer needed due to period expiration without

renewal, or is damaged

4- If failed to notify CMC that the device was stolen or lost

5- If sold or lent the device.

Article (17)

It is impermissible to sell or purchase jammers inside Iraq. It is also not allowed to introduce or

use jammers without CMC approval/license in accordance with CMC regulations.

Article (18)

Due to security caveats and implications, which jammers might cause, CMC shall be in

continuous contact with ministries and relevant federal, regional, and provisional security

departments, and shall provide them with the information and data of the Application, device,

Applicant, usage location, and approvals once issued.

Article (19)

Licensee's obligations and pledges: Licensee pledges that:

1- Jammers shall be used in accordance with provisions and representations on which issuance

of CMC approval was based.

2- It shall inform CMC in case of changes in license data, documents, or credentials to enable

CMC to take the necessary action.

3- It shall be responsible for jammers safety, and shall inform CMC immediately if stolen, lost

or broken down.

4- It shall notify CMC if a jammer is no longer needed prior to expiration of validity date.

5- Upon request by CMC, It shall provide CMC with the necessary assistance and facilitations

to detect jammers.

6- It shall comply with applicable regulations in Iraq, and shall provide competent authorities

with any information and data about jammers.

7- It shall comply with CMC provisions and decisions, and any other future amendments in

this regard.
