Given the time constraints whereby written representations from all interested parties are requiredby the deadline of today and following my conversation with Steffan Jones, I attach of copy of theoriginal letter of objection to the proposals dated 16 June 2016, that was submitted to WrexhamCounty Borough Council on behalf of our client Earthworm Energy Limited. As you will be aware,this letter of objection was submitted in response to the Planning Application Ref P/2016/0358 forthe above works. Therefore, on behalf of our client Earthworm Energy plc Limited, please take the attached letter aswritten representations to the forthcoming examination. Underground Gas Pipeline Running For Approx 3500m, To Above Ground Installation Adjacent To, The Maelor Gas Works Off The B5130, LL13 9UT
Planning Reference P/2016/0358 for the Outline Planning Application For The Installation Of An Underground Gas Pipeline Of Up To 400Mm Nominal Bore Set At Least 1.1M Below Ground Level And Extending Approximately 3500M From The Vicinity Of The Maelor Gas Works (Ngr E338373 N348071) To Wrexham
I write on behalf of our client, Earthworm Energy Plc Ltd, regarding the above mentioned planning application submitted by Wrexham Power Limited for the installation of a gas pipeline to connect to the proposed Wrexham Energy Centre.
Earthworm Energy Plc Ltd gained formal planning permission for the “Use of Land for the Erection of Solar Photovoltaic Array to generate up to 4MW, including metering and inverter kiosks, security cameras, fencing and gates and temporary construction of compound and access track” on Land North West of Pickhill Bridge Farm, Holt Road, Cross Lanes, Wrexham, LL13 0UH. I enclose a copy of the planning consent notice and a layout plan.
Our clients are currently in the process of satisfying a number of conditions including protected species licenses and it is envisaged that construction will start later in the year.
You will note that the proposed gas pipe line redline boundary goes directly through the consented solar PV array at Pickhill Bridge Farm.
Our client wishes to formally object to the planning application in its current form due to the interaction between the proposed gas pipe location and the consented solar PV array.
Pickhill solar PV array was consented in August 2015 and therefore the applicants, Wrexham Power Ltd, should have been fully aware of the consent prior to their application submission in April 2016 via a planning application register search.
It is further understood that the applicant was made aware of the solar array by our mutual landowner during initial wayleave negotiations.
Upon reviewing the current planning application it is clear that there are obvious alternatives to the proposal that would completely avoid the solar PV array. These alternatives would be within the possession of the same landowner as the solar array so would potentially negate the need for additional costs relating to extra wayleave negotiations for Wrexham Power Ltd.
It is important to note that should the application gain approval in its current form, it would mean a leaving a 60m working corridor and permanent standoff. This would result in a loss of 20% of the solar array capacity, meaning a reduction in power produced and carbon dioxide saved and potentially making its construction financially unviable.
Our clients have so far been unable to contact the applicant to discuss their proposals in more detail and to highlight the clear impact of the proposed gas line upon the consented Pickhill Bridge solar PV array. Our clients would welcome the chance speak with the applicants with a view to agreeing a revised layout, whilst respecting the solar PV array, in consultation with the landowner.
I trust that the above comments are taken into account prior to the determination of the application.
