CITY COUNCIL TAKES A STAND ON VAPING BY MINORSThe U. S. Surgeon General Jerome Adams declared that the use of vaping products by teens has reached “epidemic” portions. Many users of vaping products do not realize that they contain nicotine.

Concerned about the unprecedented rise in the use of vaping products by our City’s youth, City Council revised City Ordinance 40.150A that covers smoking and selling tobacco products to minors to include language to prohibit the sales and use of vaping products to persons under the age of 18 years. Here are a few of the highlights of the law.

WHAT IS THE INTENT AND PURPOSE OF THE NEW LAW?The City finds that persons under the age 18 are prohibited by law from purchasing or possessing cigarettes and other tobacco products and retailers are prohibited from selling them, to minors. However, tobacco-less products commonly referred to as “electronic cigarettes,” “e-cigarettes,” “mods,” and “vape or e-pens,” allow the user to simulate cigarette smoking and ingest nicotine. These products may be purchased by minors and are being marketed without age restrictions or health warnings and come in different flavors that appeal to young people. Studies by the FDA have determined that e-cigarettes can increase nicotine addiction among young people and contain chemical ingredients known to be harmful, which may expose users and the public to potential health risks. With these findings in mind, City Ordinance 40.150A was adopted for the purpose and with the intent to protect the pubic health and safety of the City and its

residents by prohibiting minors from possessing and using tobacco products and vapor products and prohibiting the sale of tobacco products and vapor products to persons under the age of 18.

WHAT IS A VAPOR PRODUCT?Vapor product means a noncombustible product containing nicotine that employs a heating element, power source, electronic circuit, or other electronic, chemical, or mechanical means regardless of shape or size that can be used to produce vapor from nicotine in a solution or other form (note the various types of vapor products in the picture on the right).

WHAT IS THE RESPONSIBILITY OF THE SELLER?Generally, no person may sell, give or furnish a tobacco product or a vapor product to a minor, including, but not limited to, through the use by a minor of a vending machine. A person who violates this law is guilty of a misdemeanor punishable by a fine of not more than $50 for each violation. This does not apply to the handling or transportation of a tobacco product or vapor product by a minor under the terms of the minor’s employment. That means that a minor can stock the shelves/vending machine with tobacco/vapor products if the minor is employed by the store.

Before selling, offering for sale, giving, or furnishing a vapor product to an individual, a person must verify that the individual is at least 18 years of age by asking to see a government-issued photographic identification such as a driver’s license. For sales over the internet, the seller must obtain age verification through an independent, third-party age verification service.

The seller is also required to post a sign close to the point of sale that states: The purchase of a tobacco product or vapor product by a minor under 18 years of age and the provision of a tobacco product or vapor product to a minor are prohibited by law. A minor who unlawfully purchases or uses a tobacco product or vapor product is subject to criminal penalties.

WHAT CONDUCT IS PROHIBITED BY A MINOR?• A minor cannot purchase or attempt to purchase a tobacco or vapor product.

• A minor cannot possess or attempt to possess a tobacco or vapor product. A minor cannot use a tobacco or vapor product in a public place or on school property.

• A minor cannot present or offer to an individual a false, fraudulent or not actually his or her own proof of age.

WHAT ARE THE PENALTIES FOR A VIOLATION OF THE LAW?The first violation is a municipal civil infraction punishable by a fine up to $500. The fine will be $50 for each violation if the individual completes a health promotion and risk reduction program approved by the St. Clair Shores Police Department, either within 30 days of receiving the citation or prior to entering a plea of responsibility at the district court.

For minors under the age of 17, a second violation or more is a municipal civil infraction punishable by a fine up to $500 for each violation. The fine will be $50 for each violation if the individual performs not less than 20 hours of community service, either within 30 days of receiving the citation or prior to entering a plea of responsibility at the district court.

For minors age 17, a second or more violation is a misdemeanor, punishable by a fine up to $500. The court may order the individual to complete a health promotion and risk reduction program and perform not more than 40 hours of community service.

Our City-owned, 18-hole golf course was designed in 1973 by golf course architects W. Bruce Matthews and Jerry Matthews (past president of the American Society of Golf Course Architects). The course opened for play on May 19, 1975. Designed to appeal to golfers of varying ages and abilities, it is one of the busiest 18-hole municipal courses in the state. The St. Clair Shores Golf Club rests on approximately 100 acres with four sets of tees measuring from 4,848 yards(forward tees) to 6,015 yards (back tees).

• Instructions and badge follows the regulations of Learn to Skate USA.

• Proper fitting skates are required...no double blades.

• Helmet, mitten/gloves are required for children 6 and under. A helmet with a cage is highly recommended.

St. Clair Shores – What a resilient community! High water, sandbagging, water over the road…all adding to resident and City employee’s work. Thank you to the hundreds of volunteers from the schools, businesses, service groups, scouts and, well,

just kind & concerned people for pitching in (sandbag filling and distribution)! The hallmark was, without asking, everyone helped whoever requested it and most certainly those who absolutely needed it!

With all this adversity happening, we still had an opening day Baseball Ceremony, a huge Nautical Coast Clean-up, a Bike Fest (that raised money for Cops for Kids and the Baseball/Softball Association), the planting of the SCS Community Garden, the first Farmers’ Market of the year, a Call to Courage that honored our men and women on the Police force and a beginning-of-Summer “Blessing of the Fleet”. Concerts in the Park started on June 12th.

I love this city! We are off and running for another great summer season! As we continue to watch the water levels, it is clear that volunteers across every walk of life contribute to the success of a thriving St. Clair Shores. We are lucky, fortunate or just smart to live somewhere where people love to get involved. The many service groups and committees are always looking for members and if you are looking for something to do, it’s right in your back yard! If you are retired or a new resident or someone who just wants to stay busy here are the service groups who are always helping out:

Independence Day is almost here, and as usual, I like to take time to reflect on what independence means.

Depending on what context you are considering, independence can have slightly different meanings. As a father of three rapidly maturing children, independence takes a bittersweet quality. The idea of my children being on their own is somewhat sad. My wife and I have worked to instill our values in our children, and we are confident that when the time comes, they will be responsible adults.

When I think of independence as my own freedom, I am happy to be a citizen of the United States, with the freedom to come and go wherever and whenever I choose. Sometimes, because we are so accustomed to living in a free society, we fail to recognize how big a deal our freedom is. The old saying is, “you don’t know what you’ve got till it’s gone.”

I really appreciate the ideals America was founded on. It is good to live where I can worship God in the way that I so choose. It is hard to imagine that religion is outlawed in some places, but that is reality in other places in the world. I am glad to live in a country where we have the right to disagree. I cannot fathom what it would be like to live in fear of the government, in fear of disagreeing, and being punished for it…but that is a sad fact in some parts of the world.

Truthfully, I think of all the freedoms we cherish, the most precious just might be the right to free speech. The right to disagree is really at the heart of the American system of government. At the time that those 56 men signed their names to the Declaration of Independence, it was treason to disagree with the King. They risked nothing short of their lives in signing that document, and to say it was a brave thing to do is a colossal understatement! These men who we call the “founding fathers” were willing to lose all their worldly goods and even their lives to gain the right to disagree with the government.

As your Mayor, I don’t expect everyone to agree with everything I say or do. I expect residents to come and address Council without any fear of “retribution.” Not only is it the right of citizens to do so, I would suggest that it is our duty. Government must be watched carefully!

It is my hope that today we cherish the right we have as residents to be heard by our government, even if (and when!) we disagree with what is going on in that government. In my opinion, that is the least we can do as Americans.

• 3 – Years in a row. This month the department once again received the Mission Lifeline Award from the American Heart Association. This year’s level was GOLD-PLUS. This program recognizes organizations like your fire department for the outstanding work they do for cardiac patients transported within our City.

• 680 – Calls for service. In the month of May, 2019 your Fire Department responded to 680 Fire and EMS calls.

• 75% – of those calls are Medical or Trauma related calls.

• 1 – New Ladder Truck in its first 6 months of service proudly displayed in the Memorial Day Parade (See picture below...view from the top of the Quint 1.)

• Your 50 Firefighters and Fire Officers continue to respond to calls 24hrs a day 365 days a year. We never close and we still make house calls.

• Over 450 smoke detectors installed working with the State Fire Marshal’s office and a Federal grant to provide smoke detectors and 75 CO Detectors in resident’s homes.

• 530 Hours of training completed in the month of May to ensure that St. Clair Shores has the best trained and prepared firefighters able to respond at a moments notice.

With the 4th of July only a couple of weeks away, many residents are planning their own fireworks display to celebrate the holiday. City Ordinance 40.160 details what you can and cannot do when setting off fireworks within the City limits It attempts to reconcile your rights under the Michigan Fireworks Safety Act, MCL 28.451 with the rights of citizens and families to live in a safe, peaceful and harmonious community.

The following is a guide to the safe discharge of fireworks in St. Clair Shores:

WHO CAN DISCHARGE FIREWORKS LEGALLY IN THE CITY?You must be 18 years of age, or older, to discharge fireworks in the City. A minor cannot possess, use, discharge or ignite any consumer fireworks —such as bottle rockets, Roman candles, helicopter/aerial spinners —at any time. A minor cannot use, discharge, or ignite any low-impact fireworks— such as sparklers, smoke cones — or novelty fireworks —such as snakes, party poppers— unless under the supervision of a parent or guardian.

WHEN CAN FIREWORKS BE DISCHARGED LEGALLY IN THE CITY?The City only allows the use/discharge of legal consumer fireworks, low-impact fireworks, or novelty fireworks the day before, on and after a legal public holiday. Since the 4th of July is on a Thursday this year, that means they are legal to use on Wednesday, July 3, Thursday, July 4 and Friday, July 5.

In addition, fireworks cannot be discharged between the hours of 11:00 p.m. and 7:00 a.m., or after dusk, whichever is earlier.

ARE THERE ANY LOCATIONS THAT ARE PROHIBITED? Yes. Here are a few restrictions you should be aware of:

1. Unless authorized, the use, discharge or ignition of any fireworks at anytime (including days and times considered “legal”) is prohibited on public property.

2. Fireworks cannot be ignited within 20 feet of an open flame, a burner, gasoline, ignited gas or electric grill or in any enclosed structure, garage, tent, or shed, or under any canopy, or overhanging cover, of any type.

3. No consumer fireworks may be ignited, launched or discharged within 200 feet of a residential building or vehicle.

WHAT OTHER RESTRICTIONS SHOULD I BE AWARE OF?Above all, excessive use of fireworks that results in the disruption of residents is prohibited. Excessive use is defined as conduct that includes the continuous or intermittent ignition of fireworks continuing for more than 20 minutes.

No display fireworks—fireworks that are made of highly explosive materials meant for large fireworks displays—are allowed unless approved by City Council. The petitioner must apply to the City Clerk providing proof that the display and applicant are adequately insured and bonded.

WHAT IS THE PENALTY IF FIREWORKS ARE DISCHARGED ILLEGALLY?Any violation of City Ordinance 40.160 is

a civil infraction, punishable by a fine of up to $500, plus the costs of prosecution. The City may also dispose of or destroy any fireworks confiscated by the City and the violator must pay the disposal costs as well.

What determines my bill?The City of St. Clair Shores bills water byunit-one unit equals 100 cubic feet or 748gallons. As you know, we buy all of ourwater from the Detroit Water and SewerageDepartment and are at their mercy for priceincreases. Every penny that you pay onyour water/sewer bill is used to buy waterfrom DWSD and maintain our seventy-plus-year old water system. Like the roofon your home or your car, our watersystem needs constant maintenance.

What is the City doing toreduce my water bill?Reducing your water bill really comesdown to water consumption and waterloss.

Water Consumption:The City of St. Clair Shores Contract withthe DWSD includes two new ordinancesdesigned to help the City regulate its peakhour water consumption to assure thelowest possible rates from the DWSD.The first ordinance restricts waterconsumption during a water supplyemergency. The second ordinancerestricts irrigation to odd/even numbereddays during the summer months. Whenfollowed, these actions result in a largesavings to the City because it keeps ourwater rates from DWSD down and a largesavings to the customer because it keepsyour water bills down.

Water Loss:The water that we purchase from the DWSDalso goes through a metering system similarto what you have in your home orbusinesses. Water loss is the result of theamount of water we buy from the DWSDminus the amount of water we sell to ourresidents and businesses. Our Water

Department continually and successfullyworks toward reducing water loss numbers.Leak detection remains one of our toppriorities. We are constantly maintainingvalves and hydrants, replacing seals, nutsand bolts. Whenever possible, we replaceold, worn-out, stopped or slow-reading watermeters with new state-of-the-art meters thatare not only more accurate, butelectronically alerts the Water Department ofa leak. Residents and businesses areusually unaware of problems until somethinghappens that gets their attention...a highwater bill, no water coming out of thefaucets, low or no water pressure. TheWater Department remains vigilantinvestigating each complaint of a high water bill.
