ARTICLE 19, Campaña Global por la Libertad de Expresión, es una organización
independiente defensora de derechos humanos que trabaja alrededor del mundo en la
promoción y defensa del derecho a la libertad de expresión e información. Toma su
nombre del Artículo 19 de la Declaración Universal de los Derechos Humanos, el cual
garantiza el derecho de toda persona a expresarse libremente y a recibir información.
En el marco del cuarto periodo de sesiones del Examen Periódico Universal1 que se
llevará a cabo del 2 al 13 de febrero de 2009 en Ginebra, Suiza y en el cual México será
examinado, ARTICLE19 pone a disposición de los países miembros del Consejo de
Derechos Humanos el informe ha preparado para esta ocasión.
El presente documento es producto del trabajo ARTICLE19 realizado por más de un
año y medio en México enfocado en el registro, documentación y seguimiento de las
violaciones al derecho a libertad de expresión de quienes ejercen la libertad de prensa.
Finalmente, ARTICLE19 aprovecha esta oportunidad para reiterar su llamado a la
comunidad internacional para que exprese su solidaridad con la defensa irrestricta del
derecho a libre expresión en México.

ARTICLE 19, The Global Campaign for Freedom of Expression, is an independent
human rights organisation that works around the world to protect and promote the right
to freedom of expression and access to information. It takes its name from Article 19 of
the Universal Declaration of Human Rights, which guarantees the right of everyone to
free speech.
On the occasion of the fourth session of the Universal Periodic Review,2that is to take
place from February 2nd
to 13th
2009 in Geneva Switzerland, in which Mexico is to be
examined; ARTICLE 19 is putting forward for consideration to the members of the
Human Rights Council, the report that it has prepared.
The present document is a product of the work of ARTICLE 19 that has been created on
the basis of more than one and a half years of work in Mexico. During this time we have
focused on the registration, documentation, and follow up of violations of the right to
freedom of expression, for journalists and media workers.
Finally, ARTICLE19 would like to take this opportunity to reiterate it call to the
international community to express their solidarity with the defence of the right to free
expression in Mexico, as it is established in international law.

RESUMEN EJECUTIVO
México es actualmente una de los países más peligrosos en el mundo para los
periodistas, la mayoría de los ataques de los que han sido objeto permanecen
impunidad. La administración de Vicente Fox fue señalada por la Comisión Nacional de
Derechos Humanos como “Los 6 años oscuros para el periodismo”. Desde que Felipe
Calderón ha estado en el poder esta situación no ha logrado mejorar. En los últimos
cinco años la “guerra contra las drogas” ha conducido a la militarización en muchas
partes del país, la cual ha dado como resultado un número elevado de muertes, así como
un aumento en la incidencia de la violencia contra periodistas. Principalmente, son
perpetrados por el ejército y las diferentes policías quienes han carecido de la formación
necesaria para tratar a la prensa en este tipo de situaciones. Las autoridades y los
traficantes de drogas siguen siendo las principales amenazas a la libertad de expresión
en el país. A pesar de haber expresado la voluntad política para estas cuestiones, las
autoridades no han tomado medidas contundentes para hacerlo. La violencia y por
consiguiente el clima del temor y la impunidad han llevado a su vez a la autocensura.
Mientras en el 2006 fue el peor año de los 6, cada año se ha registrado un alto número
de ataques, como tal, el problema no muestra signos de ceder. El peor persecutor sigue
siendo el gobierno, sin embargo en los últimos años nuevos grupos de persecutores han
surgido, como los grupos políticos radicales relacionados con los movimientos sociales
y las organizaciones delictivas. Uno de los factores más preocupantes es el número de
desaparecidos. Actualmente hay 8 casos de periodistas, que las autoridades no han
podido resolver.
En respuesta a esta cuestión el Estado ha designado tres órganos para abordar el
problema, el principal es la FEADP. Sus limitadas capacidades y su fracaso para
abordar los problemas han empeorado la situación de impunidad. A la fechas la FEADP
ha llevado a juicio 1 de los 174 casos que ha conocido. A pesar de los avances que se
registraron en la esfera de acceso a la información en el Estado, la información relativa
a la FEADP sigue siendo de difícil acceso, mientras que lo que está disponible no es
claro, y es difícil de entender. En sus 2 años de existencia, la FEADP no ha resuelto el
problema que enfrenta la libertad de expresión. Esto a su vez ha contribuido a la
consolidación de impunidad en la mayoría de los casos.
Las violaciones a la libertad de expresión son más graves cuando son perpetradas por el
Estado. Según nuestro registro de casos para el 2007/2008, los periodistas que cubren
temas relacionados con la seguridad pública y la delincuencia organizada son
particularmente vulnerables. Existen actualmente registrados 10 casos de victimas que

por cubrir eventos relacionados con estos temas han sido sometidos a amenazas,
ataques, o detención arbitraria.
La grave situación que enfrentan los periodistas en México es resultado de la falta de
voluntad política del Estado, para prevenir, investigar y castigar violaciones de libertad
de expresión. Hay una urgente necesidad de ponerle atención a los problemas de la
FEADP, para ampliar y fortalecer sus competencias. Así mismo es necesario capacitar a
las autoridades sobre cómo tratar a la prensa en estas situaciones. La impunidad es
alentada por el fracaso para atender los casos. A pesar del surgimiento de nuevos
autores de crímenes contra la libertad de expresión, los agentes estatales permanecen
como los principales perpetradores.

INFORME SOBRE LA SITUACIÓN DEL EJERCICIO DE
LA LIBERTAD DE EXPRESIÓN EN MÉXICO
CONTEXTO GENERAL
1. México se ha convertido en uno de los países más peligrosos para periodistas en las
Américas. En los últimos ocho años por lo menos veinticuatro periodistas y trabajadores de los
medios han sido asesinados, ocho han desaparecido y decenas han sido amenazados o agredidos
en razón de su oficio. La mayoría de estos casos se encuentra en total impunidad, provocando
un estado generalizado de autocensura.
2. Durante el sexenio del Presidente Vicente Fox, 16 periodistas fueron asesinados. La
Comisión Nacional de los Derechos Humanos (CNDH), describió a ese período como “los seis
años oscuros del periodismo”. La situación no parece mejorar bajo el nuevo gobierno del
Presidente Felipe Calderón. Desde enero de 2007, 8 periodistas y trabajadores de los medios
han caído. Otros ocho periodistas han desaparecido desde 2000. Adicionalmente, en los últimos
ocho años, se ha presentado un sinnúmero de quejas ante autoridades y organizaciones no
gubernamentales por amenazas y agresiones.
3. Durante los últimos cinco años, la guerra entre grupos del crimen organizado se ha
intensificado en México. Aunque en un principio la violencia se concentraba en los estados del
norte, progresivamente se ha extendido al resto del país. Hoy en día, México es uno de los cinco
países con el mayor nivel de delincuencia organizada del planeta, considera la ONU.
4. El 1 de diciembre de 2006, Felipe Calderón del Partido Acción Nacional (PAN), asumió la
presidencia tras una larga disputa por la elección. En sus primeros discursos como gobernante,
Calderón se comprometió a afrontar los delitos violentos, la evasión fiscal, la corrupción y,
sobre todo, asumió un enfoque de tolerancia cero hacia el narcotráfico.
5. Como pilar de su ofensiva contra el narcotráfico, el presiente Calderón desplegó a miles de
efectivos a lo largo del territorio. Pero la militarización ha provocado un incremento en la
violencia. Desde el 2007, por lo menos cuatro mil asesinatos relacionados con el crimen
organizado han ocurrido en México.

6. La estrategia militar y policial de combate al crimen organizado que desarrolla el gobierno
federal, arroja ya ataques directos a comunicadores. Agentes de esas instituciones han
amenazado, agredido y detenido a periodistas locales injustamente. En parte esto se debe, a la
falta de capacitación de militares y agentes policiacos, que no estaban entrenados para tener
contacto permanente con las comunidades y los periodistas.
7. La delincuencia organizada, el narcotráfico y, principalmente, los abusos de autoridad siguen
siendo las principales amenazas para el ejercicio de de la libertad de expresión. La gran mayoría
de estos delitos siguen sin ser castigados. Aunque funcionarios de alta jerarquía del gobierno
federal han declarado que existe la voluntad política para resolver estos delitos, en realidad no
han se ha tomado ninguna medida eficaz para abordarlos.
8. Los ataques, el miedo y la impunidad han tenido efectos nocivos en la prensa, ya que los
reporteros asignados a la cobertura del crimen organizado, la violencia vinculada al narcotráfico
y/o a la relación de éstos grupos con las autoridades, se autocensuran cada vez con mayor
frecuencia. Ocasionando que estos temas no sean investigados por los periodistas y los medios.
9. El clima que se vive en México es de terror, afirman muchos de los y las periodistas. Los
ataques armados y las explosiones en las instalaciones de medios locales, así como los
asesinatos y las desapariciones de colegas han tenido un fuerte impacto sobre los reporteros.
Esto ha generado una percepción de desprotección y abandono, tanto por el Estado como por
los directivos de los medios, ante ello cada vez son más quienes optan por la autocensura como
única vía de autoprotección.
REGISTRO Y DENUNCIAS DE AGRESIONES
10. De los últimos ocho años, 2006 ha sido el peor para los profesionales de la comunicación en
México en materia de ataques a la libertad de expresión en general. A partir de 2003 se ha
registrado un incremento sostenido en el número de casos de agresiones violentas (amenazas,
lesiones, privación ilegal de la libertad, desapariciones etc.) En ese año fueron registrados un
total de 76 casos, seguido por 92 en 2004. La situación permaneció “estable” en 2005 con 93
casos; en 2006 las cifras se dispararon de nuevo con 131 casos de agresiones violentas. La
información aún más preocupante es la que se desprende del número de asesinatos. Mientras
que del 2001 al 2003 tuvieron lugar los asesinatos de siete periodistas, del 2004 al 2006 el
número de asesinatos subió a 20 casos. De estos 20, 10 ocurrieron durante 2006, convirtiéndolo
en el año con el mayor número de asesinatos de periodistas en los últimos 15 años.

11. A pesar del discurso oficial del Estado mexicano, los agentes estatales (42% de los casos
registrados) continúan siendo el principal agente persecutor contra de los periodistas y medios
de comunicación, distribuidos de la siguiente manera: policial (24%), servidores públicos
(12%), instituciones de seguridad pública (3%) e instituciones gubernamentales (3%).
Ciertamente, en los dos últimos años se ha presenciado el surgimiento de nuevos agentes
persecutores. El número de casos en donde grupos radicales involucrados en conflictos sociales
son los presuntos responsables, constituyen el 15% del total de números de ataques registrados
en 2006 (19 casos en total a diferencia de cinco registrados en 2005). Los grupos del crimen
organizado han sido señalados como responsables del 11% de los ataques registrados el año
pasado (14 casos), situación que ha ido incrementando en los últimos cuatro años. Otro dato
destacable es la incapacidad de las autoridades mexicanas en señalar a las y los presuntos
responsables en el 81% de entre el total de casos registrados en 2006.
12. En 2007, se registraron un total de 64 ataques contra periodistas, 21.34% de ellos fueron
amenazas, 16% agresiones materiales (robo de equipo etc.) y 15% fueron agresiones contra la
integridad física de las y los periodistas. De acuerdo con el registro de ARTICLE 19 y Cencos,
de estos 64 casos, en el 15% existe la participación de alguna autoridad, mientras que el crimen
organizado es presuntamente responsable en el 11% de los casos. El estado con el mayor
número de casos registrados es Oaxaca, seguido por el Distrito Federal, Puebla, Tamaulipas y
Sonora. El incremento notable de casos de agresiones en el estado de Oaxaca coincide con las
movilizaciones sociales que tuvieron lugar durante ese año.
13. Uno de los elementos más alarmantes de la situación que se vive en México es la existencia
de personas desaparecidas. Un total de ocho periodistas han desaparecido, sin que hasta ahora
las autoridades hayan establecido las razones o circunstancias que motivaron estos hechos:
– En Veracruz, el locutor de Radio MS-Noticias Jesús Mejía Lechuga desapareció el
10 de julio de 2003.
– En Sonora, el periodista Alfredo Jiménez Mota, del periódico El Imparcial, fue visto
por última vez el 2 de abril de 2005.
– Rafael Ortiz Martínez, reportero del diario Zócalo y conductor de un noticiero
radiofónico en Monclova, Coahuila, fue secuestrado el 8 de julio de 2006, desde
entonces se ignora qué pasó con él.
– Desde el 20 de noviembre de 2006 se desconoce el paradero de José Antonio
García Apac, director de Ecos de la Cuenca de Tepaltepec del estado de
Michoacán.
– Rodolfo Rincón Taracena, del periódico Tabasco Hoy, desapareció el 21 de enero
de 2007.
– En Monterrey, Nuevo León, Gamaliel López Candanosa y Gerardo Paredes Pérez
colaboradores de la televisora TV Azteca, fueron vistos por última vez el 10 de
mayo del mismo año.
– El reportero y fotógrafo de La Opinión de Apatzingán de Michoacán, Mauricio
Estrada Zamora, desapareció el 12 de febrero de 2008, cuando salía de las oficinas
del periódico, alrededor de las 23 horas.

RESPUESTA ESTATAL
14. Ante la exigencia de diversas organizaciones nacionales e internacionales preocupadas por
la situación que impera en México para el ejercicio del derecho a la libertad de expresión, el
Estado ha respondido con la creación de tres instancias especializadas. El Programa de
Agravios a Periodistas y Defensores Civiles de Derechos Humanos adscrito a la Comisión
Nacional de Derechos Humanos (1991); la Fiscalía Especial para la Atención de delitos
cometidos contra Periodistas, FEADP (2006) adscrita a la Procuraduría General de la
República; la Comisión Especial de Seguimiento a Agresiones contra Periodistas y Medios
de Comunicación de la Cámara de Diputados.
15. A continuación se hace analizan los logros y limitaciones de la FEADP, instancia encargada
de consignar ante un Juez a las y los posibles responsables de las agresiones en contra de
periodistas y medios de comunicación. Como se podrá corroborar posteriormente, sus limitadas
facultades, así como las limitaciones de tipo estructural que aquejan prácticamente a la totalidad
del sistema de justicia en México, la convierten en un elemento clave de la impunidad que
impera en la mayoría de los casos registrados.
16. Desde su creación hasta el día de hoy, la FEADP ha consignado solamente un caso de los
174 que ha conocido desde su creación.3 Desde 2007, de acuerdo a un comunicado de prensa
institucional, la FEADP había atendido 163 casos4. Sin embargo, al pasar a los datos contenidos
en el cuerpo del comunicado de prensa, la fiscalía solo ha atendido un total de 54 directamente.
Mientras que la Subsecretaria de Control Regional, Procedimientos Penales y Amparo
(SCRPPA) tienen 87 de estos casos, la Subprocuraduría Investigadora Especializada en
Delincuencia Organizada (SIEDO), 21 y la Subprocuraduría de Control Regional y Procesos
Penales 1 caso.
17. En estos casos (112) en donde las agresiones a periodistas son atendidas por otras instancias
de la PGR, la actuación de la FEADP es en realidad muy limitada quedando reducida a un papel
de observador privilegiado sin incidencia directa en la conformación de expedientes, semejante
a las acciones que emprende el programa de agravios a periodistas como parte del sistema
ombudsman-no jurisdiccional de derechos humanos desde hace 17 años.

18. Para mayo, de 2008 la Fiscalía ha recibido 79 denuncias: 40 en el 2006, 28 en el 2007 y 14
en lo que va del 2008. Aunque no tenemos datos suficientes para establecer una tendencia,
podemos llamar la atención respecto a la disminución de los casos que recibe la FEADP desde
su creación a la fecha que contrasta con el aumento en el número de agresiones registradas, a
partir de lo cual podemos establecer como posible conclusión que es por la pérdida de confianza
en la institución de las víctimas de delitos contra el ejercicio de la libertad de expresión y de
información.
19. A pesar de los avances registrados en materia de acceso a la información pública, al
incorporar este derecho humano a la Constitución Federal (20 de julio de 2007), la ruta de
acceso a la información pública sobre la Fiscalía resulta compleja y de difícil acceso. Además
de que la información publicada por la Fiscalía relativa a sus resultados es sumamente confusa y
tiene el claro objetivo de publicitar y no de informar.
20. Estos resultados solamente nos pueden llevar a sostener que en dos años de actuación de la
Fiscalía no ha tenido un solo efecto considerable sobre la protección de la libertad de prensa ni
sobre la impunidad que prevalece en todos estos casos; al contrario, estos resultados de la
Fiscalía pueden ser alentadores para los perpetradores de crímenes contra la libertad de
expresión y en contra la de la labor periodística.
AGRESIONES DE AGENTES ESTATALES CONTRA PERIODISTAS
21. Las agresiones a periodistas y medios de comunicación son un hecho de por si lamentable,
pero cuando estas agresiones provienen de funcionarios del Estado mexicano encargados de
salvaguardar el orden, este hecho se agrava. De acuerdo con el registro de casos de 2007 y 2008,
existe una clara situación de vulnerabilidad de las y los periodistas que cubren temas
relacionados con las acciones instrumentadas por el Estado mexicano en materia de seguridad
pública y combate al crimen organizado, a través de la Policía Federal Preventiva (PFP), la
Agencia Federal de Investigación (AFI), Policía Federal Judicial y la Secretaría de la Defensa
Nacional (SEDENA) en las diferentes entidades federativas del país.
22. Hasta el momento existen 10 casos en donde las víctimas se encontraban cubriendo distintas
acciones instrumentadas por los cuerpos de seguridad en el marco de la política de combate al
narcotráfico y crimen organizado, situación que en ningún momento puso en riesgo la seguridad
de los agentes destacados o las personas que se encontraban en el lugar; al contrario ellos se
encontraban realizando su trabajo para proveer de información a la sociedad. Sin embargo, su
actividad periodística ocasionó que los reporteros fueran objeto de maltratos, amenazas, golpes

y en algunos casos se llegó al extremo de privarlos de manera ilegal y arbitraria de su libertad
por varias horas.
23. La inexistencia de criterios públicos, claros y transparentes para la cobertura de las acciones
de las fuerzas de seguridad pública y nacional en el marco de la política de combate al
narcotráfico y crimen organizado, deja a juicio del funcionario encargado del operativo el
valorar el comportamiento de las y los periodistas en el terreno de operaciones.
CONCLUSIONES
24. La grave situación que enfrentan las personas que ejercen el periodismo en México, tiene su
origen en la falta de voluntad política del Estado en prevenir, investigar y castigar las agresiones
que tienen lugar dentro de su jurisdicción.
25. En los últimos ocho años por lo menos veinticuatro periodistas y trabajadores de los medios
han sido asesinados, ocho han desaparecido y decenas han sido amenazados o agredidos en
razón de su oficio. La mayoría de estos casos se encuentra en total impunidad, provocando un
estado generalizado de autocensura.
26. Resulta inaplazable el fortalecimiento de la FEADP, esto es: ampliar y clarificar sus
facultades, así como la capacitación de los agentes investigadores en materia de libertad de
expresión. Resulta evidente que el estado generalizado de impunidad tiene su origen en la
incapacidad de la Fiscalía para investigar los casos y consignar a los responsables ante un Juez.
27. A pesar del surgimiento de nuevos agentes persecutores como grupos del crimen organizado
y grupos radicales vinculados a movimientos sociales, los agentes estatales siguen siendo el
principal agresor de periodistas y medios de comunicación.

Executive Summary
Mexico is currently one of most dangerous countries in the world for journalists, and the
majority of the attacks that they are subjected to are met with impunity. The presidency of
Vicente Fox was dubbed by the National Commission for Human Rights (CNDH) as “the 6 dark
years for journalism”. Since Felipe Calderón has been in power this situation has failed to
improve. In the last five years the “war on drugs” has lead to militarization in many parts of the
country. High numbers of deaths have resulted, as have increased incidences of violence against
journalists. Primarily, these are perpetrated by the military and the police who have been
provided with no training on how to deal with the press in such situations. The authorities and
the drug traffickers remain the principle threats to freedom of expression in the country. Despite
having expressed the political will to address these issues, the authorities have failed to take the
necessary practical measures to do so. The violence and the resulting climate of fear and
impunity have lead in turn to self censorship
While 2006 was the worst year in last 6, each year has seen a high number of attacks, as such
the problem shows no sign of abating. The worst persecutor remains the government, however
in the last few years new groups of persecutors have emerged, such as radical political groups
related to social movements, and criminal organizations. One of the most worrying elements in
this is the number of disappeared. There are 8 such cases of journalists currently ongoing in the
state, which the authorities have been unable to resolve
In response to this issue the state has established three bodies to address the problem, the main
one being the FEADP. Its limited capabilities and failure to address the problems have in fact
worsened the situation of impunity in the state. To date the FEADP has brought to trial one of
the 174 cases that have been brought before it. Despite registered advances in the area of access
to information in the state, information relating to the FEADP remains difficult to access, while
what is available is unclear, and difficult to understand. In its 2 years in existence, the FEADP
has had no effect on the problems facing freedom of expression. This in turn has lead to an
increase in impunity in the state.
Freedoms of expression violations are even more serious when perpetrated by the state.
According to our register of cases for 2007/2008, journalists covering issues such as those
related to public security and organized crime are particularly vulnerable. There are currently 10
cases registered of victims covering related events having been subjected to threats, attacks, or
arbitrary detention.

The grave situation confronting journalists in Mexico results from the lack of political will of
the state to prevent, address, and punish violations of freedom of expression. There is an urgent
need to look at the problems of the FEADP, and to extend and strengthen its powers. Likewise
there is a need to train authorities on how to deal with the press in these situations. Impunity is
only encouraged by the failure to try cases. In spite of the rise of new perpetrators of crimes of
freedom of expression, state agents remain the principle perpetrators.

REPORT OF THE SITUATION OF THE EXERCISE OF
THE RIGHT TO FREEDOM OF EXPRESSION IN
MEXICO
GENERAL CONTEXT
1. Mexico has become one of the most dagerous countries for journalists in the Americas.
In the last 8 years at least 24 journalists and media workers have been assisinated, 8
more foricibly disappeared, and many more attacked or threatened due to the exercise of
their profession. In the majority of these cases, total impunity prevails. This results in a
general state of self-censorship in the media.
2. During the six years of the Vincente Fox presidency, 16 journalists were assisinated.
The National Comission on Human Rights, described this period as “the six dark years
for journalism”. The situation does not seem to have improved under Calderon. Since
January 2007, 8 journalists and media workers have been killed. Another 8 journalists
have been forcibly disappeared since the year 2000. In addition to this, in the last 8
years there have been a huge number of formal complaints to government authorities
and non governmental organisations regarding threats and agressions against the media.
3. In the past five years, the war between drug cartels has intensified in Mexico. Although
at the beginning the violence was concentrated in the northern states, it has
progressively spread across the rest of the country. Today, according to the United
Nations, Mexico is one of the five countries with the highest level of organised crime in
the world.
4. On December 1st 2006, Felipe Calderón of the National Action Party (PAN) took over
the presidency following a lengthy dispute on the results of the elections. In his first
speeches as President, Calderón committed to take on violent crime, lawlessness,
corruption, and above all to adopt a zero tolerance approach to drug trafficking.
5. As a central component of his offensive against drug traffiking, the President deployed
the military in large numbers, all over the country. However, militarazation has actually
resulted in an increase in the violence. Since 2007, at least four thousand murders
related to organised crime have taken place in Mexico.
6. The political and military strategy for combating organized crime developed by the
Federal Government has resulted in direct attacks on the media. Agents from these
institutions have illegally threatened, attacked, and detained local journalists. The
military are not trained to deal with journalists on a daily basis; their lack of training in
this area is partly to blame for this.

7. Organized crime, drug trafficking, and abuses by authorities remain the principle threats
to the exercise of the right to freedom of expression. The great majority of these crimes
remain unpunished. Even though high ranking government officials have stated that the
political will exists to solve these crimes, in reality no effective measures have been
taken to do so.
8. The attacks, the fear, and the impunity, have had damaging effects on the press.
Reporters assigned to cover organized crime, violence linked to drug trafficking, and/or
the relationship of these groups to the authorities are self censoring more and more all
the time. This results in these subjects not being covered by the media.
9. Many journalists have stated that the climate that currently exists in Mexico is one of
terror. Armed attacks and explosions in the offices of a number of local media, as well
as the assassinations and forced disappearances of colleges have had a strong impact on
reporters. This has generated a perception of lack of protection and abandonment, from
both the state itself, and also from their respective employers. All the time more and
more journalists are opting for self censorship as the only means of protection available
to them.
REPORTING AND REGISTRATION OF AGRESSIONS.
10. Of the past eight years, 2006 has been the worst for media professionals in Mexico in
relation to freedom of expression. Since 2003, a substantial increase in the number of
cases of aggressions (threats, injuries, arbitrary detentions, forced disappearances etc.)
has been registered. In 2003 alone there were a total of 76 cases, this was followed by
92 in 2004. The situation remained at the same level in 2005, with 93 cases registered;
in 2006 the numbers were raised even further with a total of 131 cases of aggressions.
What is even more worrying is the number of assassinations. While from 2001 to 2003
7 journalists were assassinated, from 2004 to 2006 the number rose to 20 cases. Of
those 20, 10 occurred during 2006 alone, making it the year with the highest number of
assassinations in the past 15 years.
11. Despite the official discourse of the Mexican State, the State agents remain the principal
perpetrators of crimes against journalists and the media, with 42% of cases registered
being attributed to them. The police follow with 24%, public servants came next with
12%, public security institutions follow that with 3%, and finally government
institutions with 3%.
The last two years have seen the emergence of new perpetrators of such aggressions.
The number of cases where radical groups involved in social conflicts are allegedly
responsible constitute 15% of the total number of attacks recorded in 2006. The total
number of cases rose to nineteen from five in 2005. Organized criminal groups were
identified as responsible for 11% of the attacks in 2006 with a total of 14 cases.
Incidences of organized criminal groups as perpetrators have been increasing over the
past four years, mainly in the northern states of the country. Another notable issue is the
inability of the Mexican authorities to identify those responsible for these crimes. In
only 19% of the cases registered in 2006 was a perpetrator identified.

12. In 2007, a total of 64 attacks against journalists were registered. 21.34% of these were
registered as threats, 16% material aggressions (stealing of equipment etc.), and 15%
were physical attacks against journalists. According to the register of ARTICLE 19 and
Cencos, of these 64 cases, in 15% a state authority was registered as the perpetrator,
while criminal organizations are presumed responsible for only 11% of the cases. The
state with the highest number of registered cases is Oaxaca, followed by Mexico City
(the Federal District), Puebla, Tamaulipas, and Sonora. The notable increase in
aggressions in the state of Oaxaca is largely due to the serious social unrest that took
place in the state during the year.
13. One of the most alarming elements of the situation that exists in Mexico is the instances
of forced disappearances. A total of eight journalists have been forcibly disappeared, to
date none of these victims have been found.
– In Veracruz the presenter of Radio MS-Noticias Jesús Mejía Lechuga disappeared
on June 10th, 2003.
– In Sonora, the journalist Alfredo Jiménez Mota, of the newspaper El
Imparcial, was last seen on April 2nd, 2005.
– Rafael Ortiz Martínez, reporter from the newspaper Zócalo and host of the radio
news show, Radiofónico in Monclova, Coahuila, was kidnapped on July 8th, 2006,
he has not been seen since.
– Since November 20th 2006 José Antonio García Apac has been missing. He was
the director of „Ecos de la Cuenca‟ of the municipality of Tepaltepec, in the state of
Michoacán.
– Rodolfo Rincón Taracena of the newspaper Tabasco Hoy in the south of the country
disappeared on January 21st, 2007.
– In Monterrey Nuevo León, Gamaliel López Candanosa and Gerardo Paredes Pérez
who worked for the major Mexican television station TV Azteca were last seen on
May 10th of the same year.
– The reporter and photographer of the newspaper the Opinion of Apatzingan of the
state of Michoacán, Mauricio Estrada Zamora, disappeared on February 12th, 2008
when he left the offices of his newspaper at around 11 o‟clock at night.
STATE RESPONSE
14. Following the demand of a number of national and international organizations worried
about the state of freedom of expression in Mexico, the state has responded with the
creation of three special bodies to address these issues. The Programme of Offences
against Journalists and Human Rights Defenders was established as a subsidiary of
the National Human Rights Commission in 1991. The Office of the Special Prosecutor
for Attention to Crimes Committed against Journalists, FEADP was set up by the

General Attorney‟s Office in 2006. Thirdly, the Special Commission for Follow-Up of
Aggressions against Journalists and the Media of was born out of the Chamber of
Deputies in 2005.
15. The following is an analysis of the achievements and short comings of the FEADP, the
body that is responsible for bringing to justice those responsible for attacks against
journalists and the media. Their limited powers, coupled with their structural
constraints, as well as the structural constraints of virtually the entire justice system in
Mexico, are key factors in the impunity that is allowed to prevail in the majority of
registered cases of this nature.
16. From its inception until today, the FEADP has brought to court only one of the 174
cases that have been brought before it. Since 2007, according to a press release issued
by the institution, the FEADP had dealt 163 cases. However, going on the data
contained in the body of the press release, the FEADP dealt with only 54 of those cases
directly. Meanwhile the Sub secretariat of, Regional Control, Criminal Proceedings and
Protection (SCRPPA) dealt with 87 of these cases, the Office of Investigation of
Organized Crime (SIEDO) dealt with 21 and the Office of the Underpresecutor for
Regional Control and Penal Procedure dealt with one case.
17. In the 112 cases where aggressions against journalists were dealt with by other
departments of the PGR, the involvement of the FEADP was in reality very limited.
They played more the role of a privileged observer without direct impact in the
investigation of cases. This in turn results in an institution that is not serving the
purpose for which it was designed, in failing to deal with concerns regarding freedom of
expression and instead passing them over to other bodies within the PGR,.
18. As of May 2008, the Office had received 79 denouncements: 40 in 2006, 28 in 2007,
and 14 so far in 2008. Although we do not have sufficient data to establish a trend, we
can observe the decline in cases received by the FEADP from its inception to date,
which contrasts with the increase in the number of attacks recorded. From this we can
establish as a possible conclusion that victims of crimes against freedom of expression
have lost confidence in the institution and its capabilities.
19. Despite the advances registered in the area of access to public information, to
incorporate this human right into the Federal Constitution (July 20, 2007), access to
public information in FEADP remains unclear and difficult to access. In addition to this,
the information published by FEADP relating to the results is extremely confusing and
appears to serve to promote the organisation rather than to provide accurate
information.
20. These results can only lead us to believe that in the two years of the FEADP´s
existence, it has had no real effect on the protection of freedom of expression, or on the
impunity that prevails in these cases. On the contrary, the results of the FEADP can be
seen as encouraging the perpetrators of crimes against freedom of expression and
against journalism.

AGGRESSIONS BY STATE OFFICIALS AGAINST JOURNALISTS
21. Assaults on journalists and media are bad enough in themselves, however when these
attacks are perpetrated by Mexican authorities, those who are supposedly responsible
for protecting public order, this results in a situation that is even more grave. According
to our registry of cases for 2007 and 2008, journalists covering actions instrumented by
the Mexican State related to the topics of Public Security Forces and combating
organized crime through the Federal Preventive Police (PFP), the Federal Investigation
Agency (AFI), Federal Judicial Police, and the Ministry of National Defence
(SEDENA) find themselves in an extremely vulnerable position.
22. So far, there are 10 cases in which the victims were covering activities implemented by
the security forces to fight drug trafficking and organized crime. In none of these
situations could the explication be offered that the safety of agents, the journalists in
question, or indeed members of the public who were present were in danger as a result
of the journalists actions, on the contrary the journalists were there to cover the events
in question in order to better inform society. However, their coverage of these events
resulted in the reporters being subjected to abuse, threats, and beatings, and in some
cases it even resulted in illegally and arbitrary detentions.
23. No clear and transparent public standards exist for media coverage of federal and local
security forces‟ operations to tackle the issues of drug trafficking and organized crime.
This results in a situation where it is left to the discretion of officers in charge of each
individual operation to evaluate the behaviour of the journalists in the situation in
question, and determine whether or not it is acceptable.
CONCLUSIONS
24. The grave situation that confronts journalists in Mexico is born out of the lack of
political will of the State to prevent, investigate, and punish the aggressions that are
taking place.
25. In the past eight years at least twenty four journalists and media workers have been
assassinated, eight more forcibly disappeared, and many more have been threatened or
attacked as a result of their work.
26. The strengthening of the FEADP is a matter of much urgency. It is necessary to
strengthen and clarify its faculties, as well as providing training to its agents in the area
of freedom of expression. The general state of impunity originates from the incapacity
of the FEADP to investigate the cases and bring those responsible to justice.
27. In spite of the rise in new perpetrators such as criminal organisations, and radical
groups linked to social movements, agents of the State remain the principal aggressors
against journalists and the media.
