SECTION 1: GETTING STARTED WITH THE CANNABIS TRACKING AND LICENSING SYSTEM (CTLS)

CTLS Overview

Health Canada’s Cannabis Tracking and Licensing System, or CTLS, is a public facing web application that enables the submission of new license applications as well as requests for amendments and license renewals.

This guide provides a walkthrough of CTLS and the industrial hemp licence application using a series of instructions and screenshots of the system.

The following icons appear throughout this guide to highlight specific information of interest:

1. Access to the CTLS

Requesting access to the system is comprised of three main steps:

1. Access the CTLS though a GCKey or a Service Partner (who provides sign-in partner credentials).

2. Request an Access Code to the system.

3. Redeem the Access Code, which Health Canada will provide through email.

Requesting access to the system is a one-time activity, provided that you log into the system at least once every five years. Otherwise, your account will expire and you will need to re-create an account.

This guide will walk you through the above steps as well as how to create a GCKey if you require one. For questions regarding creation of an account, please contact Health Canada at 1-866-337-7705 or at [email protected].

The CTLS can be accessed directly through the following link: https://ctls-sscdl.hc-sc.gc.ca.

You should see the following screen when you first access the site:

2. Connect to CTLS Using a GCKey or Sign-In Partner Account

To access the CTLS you have two options: to sign in with a GCKey or through a Sign-In partner. If you already have an existing GCKey for other Government Services you can use the same GCKey and do not need to create a new one.

To access CTLS through GCKey, CLICK the “Continue to GCKey” button, and proceed to Option A, on the next page. To access CTLS through a Sign-In Partner, CLICK the “Continue to Sign-In Partner” button, and proceed to Option B on Page 5.

Option A: Connect to CTLS Using GCKey

What is GCKey?

GCKey is a standards-based authentication service provided by the Government of Canada, providing secure access to online information and government services, assisting Canadian federal government departments in managing access to their on-line programs.

The GCKey itself is a unique, anonymous credential that protects communications with online government programs and services.

If you selected “Continue to GCKey”, you should see its Home Page:

If you have an existing GCKey account: 1. ENTER/TYPE your GCKEY Username & Password, in the space indicated by RED

ARROWS above. 2. CLICK the button, highlighted by the GREEN BOX above. 3. Continue to the instruction on the next page on how to connect to the CTLS using

GCKey. OR: If you do not have a GCKey account:

1. CLICK the button, indicated by the RED BOX above, and 2. Follow the instructions to sign up for a new GCKey account.

You won’t be able to log-in to CTLS until you have an active registered GCKey or Sign-In Partner Account and Password.

After signing in with GCkey, You should see the following “Welcome” Page:

CLICK the button to connect to CTLS and then PROCEED to “Registering for a New CTLS Account” on page 7.

Option B: Connect to CTLS Using a Sign-In Partner

This is also known as Secure Key Concierge, the Sign-In Partner Account option that allows you to connect via a Banking/ Financial/Credit Union Service, select Credit Card services, as well as through a Service Provider, such as a Cellular Service. What is SecureKey Concierge?

SecureKey Concierge offers you a convenient way to access government services. Instead of creating/managing a User ID for access, you can access these services by signing in with your online bank, credit card issuer or other participating "Sign-In Partner".

Once you sign in with your Sign-In Partner, you are returned to the government service. No passwords or personal information (i.e.: name, address, date of birth, etc.) are exchanged during this process.

How does SecureKey Concierge Work?

SecureKey Concierge is simple, convenient, and secure. When visiting a government services website that offers SecureKey Concierge, select the “Sign-In Partner Login” option. Choose your bank or service and login as usual.

How do I Obtain a Service Partner (Online Banking) Username/Password?

First, you need to register with your partner service institution (banking, etc.). Once registered, you can use that service’s login/password to access government sites. When you choose to connect via Sign-In Partner, you will see a service selection screen:

CLICK on a SERVICE LOGO to select a service.

The screenshot below is one example. However, each banking service will use different login screens to connect to their system(s) and may not look like the screenshot below.

After selecting the service, you should see a “Secure Login” page:

ENTER your Username and Password, and CLICK the button.

If your Username and Password are correct, you should now be connected to the CTLS. PROCEED to “3. Registering for a New CTLS Account” on the next page.

3. Registering for a New CTLS Account

Once you have connected to CTLS using GCKey or a Sign-In Partner, you need to register for a new CTLS account before you can use the system.

To do so, SELECT the “No, I would like to create a Cannabis Tracking and Licensing System Account ID” option and CLICK the button:

You should see the following “Register” page. ENTER your personal information on this page:

The following table describes the personal information required to register a CTLS account:

At the bottom of this page, you should see a series of three Security Questions:

CLICK each drop-down menu to select each question.

CLICK each textbox and TYPE the answer to each selected question.

CLICK the button to submit the information.

All fields marked by a red asterisk * are mandatory and must be completed before submitting the information.

After registering, you will see a “Pending Verification” screen and will receive an Access Code by e-mail in approximately 1-2 days.

To DISCONNECT from CTLS, CLICK the “Exit” hyperlink highlighted above.

4. Redeem your CTLS Access Code

The following are instructions on how to verify your CTLS account through the Access Code.

BEFORE YOU BEGIN REDEEMING YOUR ACCESS CODE: You MUST have your GCKey or Sign-In Partner account details available to Login. You MUST have received your CTLS Access Code details by e-mail from Health Canada.

First, proceed to the Health Canada CTLS Web-Site directly through the following link: https://ctls-sscdl.hc-sc.gc.ca.

If you have not yet received your Access Code, you may see the following message after signing in:

If you have received your Access Code, you will see the following page outlining the terms and conditions for use of the system:

At the bottom of the Terms and Conditions, you will see the following:

CLICK the “I Accept” checkbox. CLICK the “Access Code” textbook and ENTER your CTLS Access Code:

After redeeming your Access Code, your CTLS account will be verified and you will see the following “Welcome” Page:

5. Access & Record your CTLS Account ID

The following are instructions on how to access and record your CTLS Account ID for corporation personnel management/staffing purposes. See SECTION 2 of this guide for more information on how to create a Corporate Profile and add personnel to the Corporate Profile.

Accessing Your CTLS Account ID

LOG IN to CTLS (See “Access to the CTLS” on page 2 for details).

On the “Welcome” Page, CLICK the “Account” tab highlighted below:

You will see the following “Account” page:

Recording Your CTLS Account ID

You will find your Account ID at the top of this page under “Personal Information”. Account IDs are needed for adding personnel in a Corporate Profile (see SECTION 2 of this guide) and for selecting the Responsible Person in the application (see SECTION 3 of this guide). You may want to record your Account ID by printing this page, writing it down on a piece of paper, or typing it into a document on your computer.

SECTION 2: STARTING A NEW CTLS LICENCE APPLICATION A potential applicant may submit a number of different applications covering different purposes. The information in this section outlines the process of creating a new licence application and corporate profile.

1. Creating a New CTLS Licence Application

LOG-IN to the CTLS using your CTLS Account’s Login ID and password, and CLICK the

button.

On the CTLS Main Page, you should see hyperlink choices for “Licensing” and “Reporting”:

After CLICKING on the “Licensing” hyperlink, you will move to the following page:

To access licence applications, CLICK the “Licence Applications” hyperlink shown above.

You will then move to the “Licence Applications” page:

CLICK the button shown above to create a new licence application.

In the next page, you will be required to select the Licence Class:

Select “Industrial Hemp” as the Licence Class by CLICKING on the radio button shown above,

and then CLICK the button to start the application.

See SECTION 3 of this guide for information on how to complete an Industrial Hemp Licence Application.

DRAFT applications refer to applications that have been created but are INCOMPLETE/IN-PROGRESS. SUBMITTED applications refer to COMPLETE applications that have been submitted and are/will be undergoing review and processing by Health Canada.

2. Creating a Corporate Profile in CTLS

When applying for a licence as a corporation, partnership, or cooperative, the organization must first create a Corporate Profile in CTLS before it can be selected as the Licence Holder in the “Licence Ownership” page of the application. If applying for a licence as an individual, skip this section and PROCEED to SECTION 3 of this guide.

A. Corporate Profile Creation

After LOGGING IN to CTLS, CLICK the “Corporate Profiles” hyperlink found in the Left-Hand Navigation Bar.

You will move to the “Corporate Profiles” page:

CLICK the button shown above to create a new Corporate Profile.

After clicking on the button, you will move to the “Create Corporate Profile” page:

Complete the above page by CLICKING INSIDE the text boxes and ENTERING/TYPING the information. The text boxes that are marked by a red asterisk * are mandatory fields that must be filled.

Partnerships may enter “N/A” for the incorporation number.

If the applying organization is owned by a parent corporation, it must be linked to its parent corporation in its Corporate Profile in the field shown below:

The linking of a parent corporation to an applying organization requires that the parent corporation’s Corporate Profile be first registered in CTLS. After registration, the parent corporation will be assigned a Corporation ID that can be then entered in the applying organization’s Corporate Profile to establish the link.

In this page, the organization must also enter its Business Address:

CLICK the button to save the information. You should now see a message informing you that your Corporate Profile was created:

CLICK this checkbox if the Business Address entered above is the same as the Mailing Address. If NOT the same, you will be required to also enter the Mailing Address in another section below.

You should notice that your Corporation ID is now displayed as highlighted above. You should record this code and keep it somewhere safe so it can be referenced later if needed for Parent Corporation link(s). The created corporation will now be displayed under “Corporate Profiles” as shown below:

To EDIT the information of a corporation, CLICK the button. To DELETE a Corporate Profile from CTLS, CLICK the button.

B. Attaching Corporate Profile Supporting Documents Creating a Corporate Profile in CTLS also requires supporting documents to be uploaded for the organization. The supporting documents required will differ depending on whether the organization is a corporation, partnership, or cooperative: Organization type Required supporting documents Corporation 1. A copy of the Certificate of Incorporation

2. A list of all officers and directors in the corporation, including their full legal names and dates of birth

3. A copy of a valid government-issued photo ID displaying the name and date of birth for each officer and director

Partnership 1. A copy of the Partnership Agreement 2. A list of all partners in the partnership,

including their full legal names and dates of birth

3. A copy of a valid government-issued photo ID displaying the name and date of birth for each partner

Cooperative 1. A copy of the Certificate of Incorporation 2. A list of all officers and directors of the

cooperative, including their full legal names and dates of birth

3. A copy of a valid government-issued photo ID displaying the name and date of birth for each officer and director

If applying as an individual, a copy of a valid government-issued photo ID displaying the name and date of birth of the applicant must be uploaded in the application. See SECTION 3 of this guide for more details on where to upload this document in CTLS.

Supporting documents can be uploaded near the bottom of the current “Create Corporate Profile” page. To UPLOAD a supporting document, CLICK on the “Choose a File” buttons shown below and select the document from the computer:

Once selected, the document can be UPLOADED by CLICKING the button.

The uploaded document should be displayed in the respective documents section and can be removed by clicking the button, as shown below:

Certificates of Incorporation should be uploaded in the “Certificate of Incorporation” section. The list of officers and directors, or the list of partners as well as their photo IDs should be uploaded in the “Organizational Chart” section.

Only a maximum of 5 documents can be uploaded in each section. Therefore, in-cases where the number of documents exceeds this limit, they should be combined and uploaded as one document.

C. Managing Corporate Profile Personnel/Staffing Employees in key positions need to be identified as part of your Corporation Profile. While you do not need to add every last employee, all officers and directors of a corporation, or all partners of a partnership, should be listed in the Corporation Profile.

Each officer and director of a corporation, or each partner of a partnership, need to have a user account created in CTLS in order for them to be added in the Corporation Profile. Please see SECTION 1 of this guide on how to create a user account in CTLS.

When creating a Corporate Profile in CTLS, it is important to know the Names and Account IDs of all officers and directors associated with the corporation in order to add them to the Corporation Profile.

To add personnel in the Corporate Profile, CLICK the button in the “Personnel” section at the bottom of the page:

The following window will appear:

Enter the Account ID of the officer/director/partner by CLICKING INSIDE the text box and ENTERING/TYPING the information. After entering the Account ID, CLICK the button to validate the ID and then select the role by CLICKING on the checkboxes.

If the organization is a partnership, its partners should be listed as “Directors”.

CLICK the button to save the current personnel and add a new one. If finished adding personnel, CLICK the button.

When you return to the “Corporate Profile” page, you should see the list of personnel at the bottom of the page:

To EDIT the information of personnel, CLICK the button. To DELETE personnel, CLICK the button.

Once a corporate profile is created and staffed with personnel, it can be linked to a licence application in the “Licence Ownership” page. Go to SECTION 3 of this guide for more information on how to complete an Industrial Hemp Licence Application.

SECTION 3: COMPLETING A CTLS INDUSTRIAL HEMP LICENCE APPLICATION

1. Application Index

When creating a CTLS Application, it’s helpful to use the INDEX function, available via the button, found at the BOTTOM of the application pages.

The “Index” page of the application provides an overview of the application pages that are COMPLETE or INCOMPLETE .

2. Licence Ownership

After creating an industrial hemp licence application in CTLS, you will see the first page of the application – Licence Ownership:

DO NOT select the third option – “Partnership / Cooperative” in the application. Partnerships and cooperatives should select the – “Corporation” option so the Corporate Profile can be linked to the application.

There are two primary scenarios for licence ownership:

A. The applicant is seeking a licence as an individual.

B. The applicant is seeking a licence as an existing corporation, partnership, or cooperative

Follow the next instructions based on the scenario identified:

Scenario A – Applicant is seeking a licence as an individual Select “Individual” as the Licence Holder by CLICKING on the radio button.

After selection, the applicant’s name will appear as the Licence Holder.

When applying for a licence as an individual, the applicant will be automatically selected as the Licence Holder. This cannot be changed.

Scenario B – Applicant is seeking a licence as an existing corporation, partnership, or cooperative

A Corporate Profile needs to be created before assigning the corporation as the owner of the licence. See “Creating a CTLS Corporate Profile” in SECTION 2 on how to create a Corporate Profile.

Select “Corporation” as the Licence Holder (even if the applicant is a partnership or cooperative) by CLICKING on the radio button.

Then, click on the “Corporation Name” drop-down menu and select the appropriate corporation, partnership, or cooperative.

Identifying the Responsible Person The licence application also requires the identification of the Responsible Person. This is the individual who is responsible for completing and submitting the licence application.

When applying as an individual, the applicant will be automatically selected as the Responsible Person. When applying as a corporation, partnership, or cooperative, however, the applicant has to manually select the Responsible Person.

Select the Responsible Person by CLICKING on the button at the bottom of this page:

Account ID can be found under “Personal Information” by CLICKING on the “Account” tab found in the Left-Hand Navigation Bar.

A new window will appear to enter the Account ID:

Enter the Account ID of the Responsible Person by CLICKING INSIDE the text box and ENTERING/TYPING the information. After entering the Account ID, CLICK the button to validate the ID, and then CLICK the button to SAVE AND CLOSE the window. Once finished selecting the licence ownership and identifying the Responsible Person, CLICK the

button to PROCEED to the next application page.

All information entered on this page will be lost if the application window is closed without saving.

3. Mailing Address

After completing the “Licence Ownership” page, you will see the following page for “Mailing Address”:

This is the mailing address of the Licence Holder. Please ensure that the correct mailing address is entered or the Licence Holder may not be able to receive mail from Health Canada.

Complete this page by CLICKING INSIDE the text boxes and ENTERING/TYPING the correct mailing address. The text boxes that are marked by a red asterisk * are mandatory fields that must be filled.

Once finished, CLICK the button to PROCEED to the next page.

All information entered on this page will be lost if the application window is closed without saving.

After completing the “Mailing Address” page, you will see the following page for “Site Details”:

The site address is the main address where industrial hemp will be stored. This address cannot be a PO Box.

Enter the storage site address by CLICKING INSIDE the text boxes and ENTERING/ TYPING the correct information. The text boxes that are marked by a red asterisk * are mandatory fields that must be filled.

Next, answer the following question regarding cultivation of industrial hemp by CLICKING the drop-down list highlighted below and SELECTING “YES” or “NO”.

After selecting the purpose of cultivation, or if the applicant does not intend to cultivate industrial hemp, answer the following question regarding activities other than cultivation:

If “YES” is selected, the “Non-cultivation Sites” section will appear:

The Licence Holder should be a member of the Canadian Seed Growers’ Association in order to conduct the activities of plant breeding and seed (pedigreed seed) production. Both activities also require the industrial hemp to be sampled and tested for THC content and those test results to be submitted to Health Canada.

The new Industrial Hemp Regulations authorize the production of derivative and/or product from only viable grain. Processing of the flowering heads, leaves, and branches requires a cannabis processing licence issued under the Cannabis Regulations. Parts of the cannabis/industrial hemp plant that are listed in Schedule 2 to the Cannabis Act are excluded from the definition of “cannabis” in the Act and therefore do not require a licence to be processed.

5. Site Ownership

After completing the “Site Details” page, you will see the following page for “Site Ownership”:

If not cultivating industrial hemp, or if the site where industrial hemp will be cultivated is not yet known at this time, clearly explain so in a written document and upload the document in place of the declaration below.

There are two primary scenarios for cultivation site ownership:

A. The cultivation site is owned by one or more individuals.

B. The cultivation site is owned by an existing corporation, co-operative, or partnership.

For each cultivation site, follow the steps below based on the scenario identified:

Declaration of land ownership or consent from the landowner(s) should be submitted in this page if the site where industrial hemp will be cultivated is known at the time of application.

Scenario A - Cultivation site is owned by one or more individuals If the cultivation site is owned by the Licence Holder, FIND and PRINT the “DECLARATION OF LAND OWNERSHIP” form in APPENDIX 1.

Otherwise, if the cultivation site is owned by one or more individuals other than the Licence Holder, FIND and PRINT a copy of the “DECLARATION OF LANDOWNER’S CONSENT” form in APPENDIX 2 for each landowner.

COMPLETE the declaration form(s) by filling in all required information. When complete, the declaration form(s) should be SIGNED and DATED by the landowner(s).

To submit the declaration form(s) in CTLS, first SCAN or TAKE a CLEAR PHOTO of the declaration.

Scenario B – Cultivation site is owned by an existing corporation, co-operative, or partnership If the cultivation site is owned by a corporation, co-operative, or partnership, FIND and PRINT a copy of the “DECLARATION OF LANDOWNER’S CONSENT” form in APPENDIX 2 for each landowner.

COMPLETE the declaration form by filling in all required information. When complete, the declaration form should be SIGNED and DATED by the director, officer, or partner who has the authority to bind the Licence Holder or the landowning corporation, co-operative, or partnership.

To submit the declaration form(s) in CTLS, first SCAN or TAKE a CLEAR PHOTO of the declaration.

The Self-Identification page is intended as a way for the Indigenous applicants to self-identify as part of the CTLS licence application process. Indigenous applicants are NOT obligated to disclose their indigenous status.

After checking the application and ensuring that it is complete, return to the submission page by CLICKING on the button and then CLICKING on the title. The “Submission” page should now look similar to this:

Activities such as seed production, importation, preparation (conditioning), and plant breeding have additional requirements that must be fulfilled with the Canadian Seed Growers’ Association and the Canadian Food Inspection Agency. Applicants who wish to conduct these activities must attest that they meet the additional requirements before submitting the application.

Carefully READ the attestations before proceeding to submit the application.

APPENDIX 3: RECORD KEEPING REQUIREMENTS

The following records must be retained at the record keeping address provided in the licence application for at least 1 year:

Activity Records All a) The form in which the industrial hemp is imported, exported,

purchased or sold, and its variety, if applicable. b) The quantity of each form imported, exported, purchased or sold. c) The date on which each shipment of industrial hemp is sent or

received. d) The name of the person that transports, sends or delivers. e) The results of any tests required by the Regulations.

Cultivation a) The quantity of seed sown and harvested for each approved cultivar/variety.

b) Confirmation of the pedigreed status of the seed sown (official seed tag).

Sale a) The name, address and licence number of the licence holder to which any flowering heads, leaves, branches, seed or grain is sold.

b) The name and licence number of the licence holder from which the flowering heads, leaves, branches, seed or grain was purchased, the date on which it was purchased and the quantity of each form that was purchased.

Importation a) The name, address and licence number of the person to which the seed or grain is sold

b) The name of the exporter and their address in the country of export.
