Since some laws have been abbreviated, you must consult the Code itself for the full text. This book will be a helpful guide, but not a substitute for the Code. This book will be updated as changes are made by the legislature.

    Who may publish. Notices and proceedings required by Iowa law must be published in a paid circulation newspaper as defi ned in chapter 618, Code of Iowa 2015, which appears in this book. Each individual statute desig-nates the newspaper(s) to be used. In general, notices pertaining to a city must run in some newspaper of general circulation therein; notices pertaining to a school district must run in a newspaper in the dis-trict, and those pertaining to a county, in the offi cial newspapers thereof. However, individual county of-fi cers may select the newspapers to be used for any notice if the Code does not require it to be run in the offi cial newspapers.

    Location. While many newspapers are printed in a central printing plant, a newspaper is considered to be pub-lished at the point where it is entered in the mails, regardless of where the paper is printed. (Attorney General ruling, Jan 26, 1944.) The terms "publish-ing" and "printing" are not synonymous. As used in the trade, printing includes primarily the actual press work. Publishing involves all those factors of management (other than the actual printing) such as control, collection of news and advertising, format, content, circulation, etc.

    Matters of general public importance. Matters of general public importance may be published by any taxing body in any newspaper as defi ned in chapter 618, when such publication is not otherwise required by law. Publication in free shop-pers or free newspapers is not authorized.

    Misdemeanor. The increasing cost of government makes it more important than ever that the taxpayer shall be given full knowledge of where his money goes. To conceal matters which are of record is contrary to public policy. Failure to comply with the laws pertaining to publication is a misdemeanor on the part of the responsible offi cial, and is punishable as such. See section 618.2 in chapter 618 of this book.

    Readability. Legal notices should be readable. Publishers and offi cials should cooperate to make sure that the notices achieve both legibility and economy. Many forms are now being photographed and care should be exercised to make sure these are not enlarged to the point of extravagance, nor reduced in size to the point where legibility is sacrifi ced. While each pub-lisher has the fi nal say on what matter goes into his newspaper, he should work closely with offi cials to make sure that neither economy nor readability is compromised. Cost. A newspaper may not charge more than the legal rate established by chapter 618.11 Code of Iowa 2015. Where photography is used to reproduce original copy, such as complicated tabular forms, newspapers must charge their regular space rate (column inch) which is permissible provided such charge does not exceed the legal rate.

    Padding, abbreviations, etc. Publishers should be careful not to pad any notices, board proceeding, etc. On the other hand, notices, board proceedings, etc., should not be con-densed, or words abbreviated except for standard recognized abbreviations. In some counties and cities the publication of proceedings in the past have been rendered almost worthless by condensation and ab-breviation. Publication should be so clear that the general public may thoroughly understand the expenditure of money and the purpose for which expended. Copy should not be so abbreviated as to cause confusion or misunderstanding. In some instances, claims have been published as "Supplies for C.H." This might be supplies for Court House, County Home, Chester Ham, or any person having such initials.

    Allowance for tabular headings. Unless otherwise stated, ten lines per column are allowed for vertical headings, cut-off inclusive, which are a part of the tabular matter.

    Prompt publication. Prompt publication is not only good public policy, but is mandatory under most Iowa statutes, particu-larly those pertaining to the publishing of minutes of proceedings. The courts have held (Hindman vs. Reaser, 240 Iowa 1375) that it is not necessary to re-quire approval of the minutes prior to the publication. This would constitute "legislation by interpretation." To require such approval would defeat both the letter and intent of the statute. Necessary corrections if any can be made at the next meeting and will appear in a subsequent publication. Publishers may hold offi ce. There is no confl ict of interest when a newspaper publisher holds offi ce in a local taxing body. Bidding is not applicable to legal notices in newspapers des-ignated pursuant to law, and for which the rates are fi xed pursuant to law. See Chapter 68B.3.

    IOWA RATE FOR NOTICES IN NEWSPAPER

    Notices may be run in any paid-circulation newspaper with a second class permit, as defi ned in chapter 618, Code of Iowa. The Iowa rate is not to exceed 46.4 cents for one line of eight point type, two inches in length,"or its equivalent." For second and third insertions of the same notice, the rate is 31.29 cents per line. Thus, the rate varies both according to the size of the type and the length of the line. If the newspaper uses a line which is NOT two inches (twelve picas) in length, the proper rate may be determined from the table beginning on page 33.

    CONSTITUTION OF THE STATE OF IOWA

    Article X, Sec. 1. How proposedsubmis-sion. Any amendment to this Constitution agreed to by a majority of the members of the two Houses shall be referred to the Legislature to be chosen at the next general election, and shall be published, as provided by law, for three months previous to the time of making such choice. (See Code, sec. 6.1.)

    CHAPTER 3. STATUTES AND RELATEDMATTERS

    3.7 Acts effective July 1 or August 15. Laws take effect July 1, except those approved by the Governor after that date, which take effect August 15. Laws passed at a special session take effect ninety days after adjournment.

    CHAPTER 6. CONSTITUTIONALAMENDMENTS AND PUBLIC MEASURES

    6.1 Publication of proposed amendment. Whenever any proposition to amend the Con-stitution has passed the general assembly and been referred to the next succeeding legislature, the state commissioner of elections shall cause the same to be published, once each month, in two newspapers of general circulation in each congressional district for the time required by the Constitution. (See Constitu-tion Article X, sec. 1.)

    6.2 Publication of proposed public mea-sure.

    Whenever any public measure has passed the general assembly which under the constitution must be published and submitted to a vote of the entire people of the state, the state commissioner of elec-tions shall cause the same to be published, once each month, in at least one newspaper of general circulation in each county in the state, for the time required by the Constitution.

    CHAPTER 6B. PROCEDURES UNDER EMINENT DOMAIN

    6B.2A Notice of proposed public improve-ment

    If, after making a good faith effort, an acquiring agency is unable to ascertain the owner of records last known address, or the identity of the owner of record is uncertain, or the mail is returned as undeliverable or is refused, the acquiring agency shall cause a no-tice to be published once in a newspaper of general circulation in the county or city where the private property is located.

    6B.3 Applicationrecordingnoticetime for appraismentnew proceedings

    The applicant shall mail a copy of the applica-tion by certifi ed mail to the owner at the owners last known address and to any mortgagee of record at the mortgagees last known address and to any other record lienholder or encumbrancer of the land at the lienholders or encumbrancers last known ad-dress. If service of notice by certifi ed mail cannot be made in the manner prescribed in this section, the applicant shall cause a notice to be published once in a newspaper of general circulation in the county.

    6B.4 Commission to assess damagesThe chief judge of the judicial district shall select

    by lot six persons from the list, two persons who are owner-operators of agricultural property when the property to be condemned is agricultural property; two persons who are owners of city property when the property to be condemned is other than agricultural property; and two persons from each of the remain-ing two representative groups, who shall constitute a compensation commission to assess the damages to all property to be taken by the applicant and located in the county, and shall name a chairperson from the persons selected. The clerk of the district court shall send, by ordinary mail, a list of those persons selected to the applicant and to the owner of the property at the owners last known address. The list shall be provided prior to the mailing, by any party, of a notice of assessment under section 6B.8. If the clerk of the district court is unable to locate an address for the owner of the property, the list shall be published once in a newspaper of general circulation in the county. The applicant shall reimburse the clerk of the district court for the cost of mailing and publication.

    6B.8 Notice of assessmentIf a city or county, or an agency of a city or

    county, is seeking to condemn agricultural land for an industry as that term is defi ned in section 260E.2, the notice shall inform the landowner that the landowner may request that the compensation commission review the application as provided in section 6B.4A. Service of the notice to a person not a resident of this state shall be by certifi ed mail to the persons last known address. At the same time, the applicant shall cause a notice to be published once in a newspaper of general circulation in the county prior to the day fi xed for the appraisement, which day shall be at least thirty days after publication. Service of notice in this manner shall be deemed compete on the day of publication.

    6B.12 Notice when residence unknownIf a persons residence is unknown after a good

    faith effort is made to fi nd the persons last known address, the notice required in section 6B.8 shall be published in a newspaper of general circulation in the county, once each week for at least four successive weeks prior to the day fi xed for the appraisement, which day shall be at least thirty days after the fi rst publication of the notice.

    CHAPTER 8A. DEPARTMENT OF ADMINISTRATIVE SERVICES

    8A.311 Competitive bidding10. a. When the estimated total cost of con-

    struction, erection, demolition, alteration, or repair of a public improvement exceeds the competitive bid threshold in section 38.3, or as established in section 314.1B, the department shall comply with chapter 38.

    CHAPTER 11. AUDITOR OF STATE

    11.10 Examinations. Auditor shall have the right while making ex-aminations, to examine all papers, books, records, and documents of any offi cers and shall have the right, in the presence of custodian, to have access to cash drawers, and to examine public accounts and a like right, during business hours, to examine public accounts of the county, school, or city, in any deposi-tory which has public funds in its custody pursuant to the law .

    11.11 Scope of examinations. All examinations shall be made without notice to the offi ce examined. Auditor should ascertain that publications have complied with publication laws.

    11.14 Reports--public inspection. A report of such examinatin shall be made in triplicate signed and verifi ed by the offi cers making the examination; one copy to be fi led with the auditor of state, one copy with the offi cer undr investiga-tion, and one copy to the county auditor who shall transmit same to the board of supervisors if a cunty offi ce is under investigation, or with the president of the school board if a school is under investigation, or with the mayor and the council if a city offi ce is under examination. All reports shall be open to public inspection, including copies on fi le in the offi ce of the state auditor, and refusal on the part of any public offi cial to permit such inspection when such reports

    have been fi led with the state auditor shall constitute a simple misdemeanor.

    In addition to the foregoing, notice that the report has been fi led shall be forwarded immediately to each newspaper, radio station or television station located in the county, municipality or school district which is under investigation or audit; except that if there is no newspaper, radio station or television station located therein, such notice shall be sent to the offi cial newspapers of the the county.

    CHAPTER 17. OFFICIAL REPORTS ANDDOCUMENTS

    17.19 Legalizing Acts of local nature. A bill which seeks to legalize the acts of any of-fi cial or board or other offi cial body, in regard to any matter of public nature or for any person or persons, company or corporation, shall not be considered un-til it is printed as a bill and distributed to members of the general assembly, and the printing shall be without expense to the state. The superintendent of printing shall not order any such bill printed until the superintendent has received a deposit to cover the cost thereof at the rate which shall be fi xed under the current contract for legislative printing for the bills, and shall exclude from the journals all such bills and the newspaper publication of such bill shall be without expense to the state, and same shall not be published until the cost of same has been paid to the secretary of state.

    CHAPTER 18 GENERAL SERVICES DEPARTMENT

    18.6 Competitive bidding.9.a. When the estimated total cost of construction,

    erection, demolition, alteration, or repair of a public improvement exceeds twenty-fi ve thousand dollars, the department shall solicit bids on the proposed improvement by publishing an advertisement in a print format. The advertisement shall appear in two publications in a newspaper published in the county in which the work is to be done. The fi rst advertisement for the bids appearing in a newspaper shall be not less than fi fteen days prior to the date set for receiving bids. The department may publish an advertisement in an electronic format as an additional method of soliciting bids under this paragraph.

    18.88 Newspapers. The journals of the general assembly and the

    offi cial register shall be sent to each newspaper of general circulation in Iowa, and editors of newspa-pers in Iowa shall be entitled to other publications on request when they are available.

    CHAPTER 20. PUBLIC EMPLOYMENT RELATIONS (COLLECTIVE BARGAINING)

    20.17 Procedures 3. Negotiating sessions, strategy meetings of public employers or employee organizations, media-tion and the deliberative process of arbitrators shall be exempt from the provisions of chapter 21. However, the employee organization shall present its initial bargaining position to the public employer at the fi rst bargaining session. The public employer shall present its initial bargaining position to the employee organization at the second bargaining session, which shall be held no later than two weeks following the fi rst bargaining session. Both session shall be open to the public and subject to the provisions of chapter 21. Hearings conducted by arbitrators shall be open to the public.

    CHAPTER 23. PUBLIC CONTRACTS AND BONDS

    23.2 Notice of hearing. Before any municipality shall enter into any contract for any public improvement to cost twenty-fi ve thousand dollars or more, the governing body proposing to make the contract shall adopt proposed plans and specifi cations and proposed form of contract, fi x a time and place for hearing at the municipality affected or other nearby convenient place, and give notice by publication in at least one newspaper of general circulation in the municipality at least ten days before hearing.

    23.12 Issuance of bonds--notice. Before any municipality shall institute proceed-ings for the issuance of any bonds or other evidence of indebtedness payable from taxation, excepting such bonds or other evidence of indebtedness as have been authorized by a vote of the people of such municipal-ity, and except such bonds or obligations as it may be by law compelled to issue, a notice of such action, including a statement of the amount and purpose of said bonds or other evidence of indebtedness shall be published at least once in a newspaper of general circulation within such municipality, at least ten days before the meeting at which it is proposed to issue such bonds.

    23.18 When bids requiredadvertisement deposit. When the estimated total cost of construction, erection, demolition, alteration or repair of any public improvement exceeds twenty-fi ve thousand dollars, the municipality shall advertise for bids by two publications in a newspaper published in a county in which the work is to be done. The fi rst advertisement for bids shall be not less than fi fteen days prior to the date set for receiving bids.

    CHAPTER 24. LOCAL BUDGET LAW

    24.9 Filing estimatesnotice of hearing amendments. Each municipality shall fi le with the secretary or clerk thereof the estimates required to be made in sections 24.3 to 24.8, at least twenty days before the date fi xed by law for certifying the same to the levying board and shall forthwith fi x a date for a hearing thereon, and shall publish such estimates and any annual levies previously authorized as pro-vided in section 76.2, with a notice of the time when and the place where such hearing shall be held at least ten days before the hearing. Provided that in municipalities of less than two hundred population such estimates and the notice of hearing thereon shall be posted in three public places in the district in lieu of publication.

    For any other municipality such publication shall be in a newspaper published therein, if any, if not, then in a newspaper of general circulation therein.

    (Because counties, cities, drainage districts, townships and road districts are all expressly ex-cepted from chapter 24, its requirements will only apply to other public bodies or corporations which are empowered to levy or certify a tax or sum to be collected by taxation, and then only if the legislation concerning such entities does not itself establish a separate budget publication requirement. Thus, section 24.9 would probably apply in the case of community colleges, school districts, and similar entities. In addition, the budgeting procedure for certain county and city elected offi cials, such as the auditor, may require that the budget process in chapter 24 be utilized.

    CHAPTER 25. CLAIMS AGAINST THE STATE AND BY THE STATE

    25.2 Examination of report - approval or rejection -payment

    On or before November 1 of each year, the director of revenue and fi nance shall provide the treasurer of state with a report of all unpaid warrants which have been outdated for two years or more. The trea-surer shall include information regarding outdated

    warrants in the notice published pursuant to section 556.12 (The Great Iowa Treasure Hunt).

    CHAPTER 26. PUBLIC CONSTRUCTION BIDDING

    26.3 Competitive bids for public improve-ment contracts.

    1. If the estimated total cost of a public improve-ment exceeds the competitive bid threshold of one hundred thousand dollars, or the adjusted competi-tive bid threshold established in section 314.1B, the governmental entity shall advertise for sealed bids for the proposed public improvement by publishing a notice to bidders. The notice to bidders shall be published at least once, not less than four and not more than forty-fi ve days before the date for fi ling bids, in a newspaper published at least once weekly and having general circulation in the geographic area served by the governmental entity. Addition-ally, the governmental entity may publish a notice in a relevant contractor organization publication and a relevant contractor plan room service with statewide circulation, provided that a notice is posted on a website sponsored by either a governmental entity or a statewide association that represents the governmental entity.

    CHAPTER 28E. JOINT EXERCISE OFGOVERNMENTAL POWERS

    28E.6 Additional provisions. 1. If the agreement does not establish a sepa-rate legal entity to conduct the joint or co-operative undertaking, the agreement shall also include: a. Provision for an administrator or a joint board responsible for administering the joint or co-operative undertaking. In the case of a joint board, public agen-cies party to the agreement shall be represented. b. The manner of acquiring, holding and dispos-ing of real and personal property used in the joint or co-operative undertaking. 3. a. A summary of the proceedings of each regular, adjourned, or special meeting of the joint board of the entity created in the agreement, includ-ing the schedule of bills allowed, shall be published after adjournment of the meeting in one newspaper of general circulation within the geographic area served by the joint board of the entity created in the agreement. The summary of the proceedings shall include the date, time, and place the meeting was held, the members present, and the actions taken at the meeting. The joint board of the entity created in the agreement shall furnish the summary of the proceedings to be submitted for publication to the newspaper within twenty days following adjournment of the meeting. The publication of the schedule of

    bills allowed shall include a list of all salaries paid for services performed, showing the name of the person or fi rm performing the service and the amount paid. The publication of the schedule of bills allowed may consolidate amounts paid to the same claimant if the purpose of the individual bills is the same. However, the names and gross salaries of persons regularly employed by the entity created in the agreement shall only be published annually. b. An entity created which had a cash balance, including investments, of less than one hundred thousand dollars at the end of the previous fi scal year and which had total expenditures of less than one hundred thousand dollars during the prior fi scal year is not required to publish as required in paragraph "a." However, such an entity shall fi le without charge, in an electronic format, the information described in paragraph "a" with the offi ce of the county recorder in the most populous county served by the entity. The county recorder shall make the information submitted available to the public, which information shall also include access to a copy of the agreement creating the entity. c. This subsection shall not apply to an entity created in an agreement that includes public agencies from more than one state or to a contract entered into pursuant to section 28E.12.

    28E.17 Transit policyjoint agreement city debt.

    3. A city which is a party to joint transit agency may issue general corporate purpose bonds for the support of a capital program for the joint agency in the following manner:

    a. The council shall give notice and conduct a hearing on the proposal in the manner set forth in section 384.25. However, the notice must be published at least ten days prior to the hearing, asking that the question of issuing the bonds be submitted to the qualifi ed electors of the city, the council shall either by resolution declare the proposal abandoned or shall direct the county commissioner of elections to call a special election to vote upon the question of issuing the bonds. Notice of the election and its conduct shall be in the manner provided in section 384.26.

    CHAPTER 28J PORT AUTHORITY

    18 b. Except as provided in paragraph "c", when the cost of a contract for the construction of a build-ing, structure, or other improvement undertaken by a port authority involves an expenditure exceeding the competitive bid threshold in section 38.3, or as established in section 314.1B, and the port authority is the contracting entity, the port authority shall make a written contract after notice calling for bids for the

    award of the contract has been given by publication twice, with at least seven days between publications, in a newspaper of general circulation in the area of the port authority.

    CHAPTER 28M REGIONAL TRANSIT DISTRICTS

    28M.4 Regional Transit District Commis-sion 8. Immediately following a regular or special meeting of a commission, the secretary of the com-mission shall prepare a condensed statement of the proceedings of the commission and cause the state-ment to be published not more than twenty days following the meeting in one or more newspapers which meet the requirements of section 618.14. The statement shall include a list of all claims allowed, showing the name of the person or fi rm making the claim, the reason for the claim, and the amount of the claim. If the reason for the claims is the same, two or more claims made by the same vendor, supplier, or claimant may be consolidated if the number of claims consolidated and the total consolidated claim amount are listed in the statement. However, the commission shall provide at its offi ce upon request an unconsolidated list of all claims allowed. Salary claims must show the gross amount of the claim except that salaries paid to persons regularly employed by the commission, for services regularly performed by the persons, shall be published once annually show-ing the gross amount of the salary.

    CHAPTER 29C. DISASTER SERVICES AND PUBLIC DISORDERS

    29C.9 Joint county-municipal administra-tion. 2.c. No later than November 15 of each year any joint disaster services provided for by this chapter shall prepare a budget. All expenditures subject to the provisions of chapter 24, Code of Iowa.

    CHAPTER 37. MEMORIAL HALLS ANDMONUMENTS FOR SOLDIERS, SAILORS, AND

    MARINES

    37.4 Notice. Notice of the election shall be given by publica-tion in one newspaper published or having general circulation in the city as provided in section 362.3. The notice shall state the purpose of the memorial proposed as outlined in section 37.18.

    CHAPTER 38 STRUCTURE DEMOLITION PROJECT

    38.3 Competitive bids for public improve-

    ment contracts. 1. If the estimated total cost of a public improve-ment exceeds the competitive bid threshold of one hundred thousand dollars, or the adjusted competi-tive bid threshold established in section 314.1B, the governmental entity shall advertise for sealed bids for the proposed public improvement by publishing a notice to bidders as provided in section 362.3. Ad-ditionally, the governmental entity may publish a notice in a relevant contractor organization publica-tion and a relevant contractor plan room service with statewide circulation, provided that a notice is posted on a website sponsored by either a governmental entity or a statewide association that represents the governmental entity. The notice to bidders shall be published more than twenty days but not more than forty-fi ve days before the date for fi ling bids.

    38.12 When hearing necessary If the estimated total cost of a public improvement exceeds the competitive bid threshold in section 38.3, or as adjusted in section 314.1B, the governmental entity shall not enter into a contract for the public improvement until the governmental entity has held a public hearing and has approved the proposed plans, specifi cations, and form of contract, and estimated total cost of the public improvement. Notice of the hearing must be published as provided in section 362.3.

    CHAPTER 39. ELECTIONS, ELECTORS,APPOINTMENTS, TERMS AND OFFICERS

    39.6 Notice of special election. A proclamation shall be issued before any election ordered by the governor, designating the offi ce to be fi lled or the public question to be submitted at the elec-tion and designating the time at which such election shall be held. The commissioner of each county shall give notice as provided in section 49.53.

    CHAPTER 43. PARTISAN NOMINATIONS-- PRIMARY ELECTION

    43.62 Publication of proceedings. The published proceedings of the board of super-visors relative to the canvass shall be confi ned to a brief statement of: 1. The names of the candidates nominated by the electors of the county or subdivision thereof and the offi ces for which they are so nominated. 2. The offi ces for which no nomination was made by a political party participating in the primary, because of the failure of the candidate to receive the

    legally required number of votes cast by the party for such offi ce.

    43.92 Date of caucus published. The date, time, and place of each precinct caucus of a political party shall be published at least twice in at least one newspaper of general circulation in the precinct. The fi rst publication shall be made not more than fi fteen days nor less than seven days before the date of the caucus and the second shall be made not more than seven days before and not later than the date of the caucus. Such publication shall also state in substance that each voter affi liated with the specifi ed political party may attend the precinct caucus. Publication in a news item or advertisement in such newspaper shall constitute publication for the purposes of this section. Cost of publication shall be paid by the political party.

    CHAPTER 47. ELECTIONCOMMISSIONERS

    47.5 Purchasing by competitive bidding. 2. When it is proposed to purchase any goods or services, other than data processing services, in connection with administration of elections, the com-missioner shall publish notice to bidders, including specifi cations regarding the goods or services to be purchased or a description of the nature and object of the services to be retained, in a newspaper of general circulation in the county not less than 15 days before the fi nal date for submission of bids.

    This also applies to data processing, except that if the needed services can be provided from the state at a lower cost, the board shall publish notice twice in a newspaper of general circulation in the county of its intent to accept such a bid and the difference in the amount of the bid and cost of purchasing the needed services from the department of general services data processing facilities through the registrar.

    The printing of ballots is not subject to the bid-ding process.

    CHAPTER 49 METHOD OF CONDUCTING ELECTIONS

    49.53 Publication of ballot and notice.1. The commissioner shall not less than four

    nor more than twenty days before the day of each election, except those for which different publication requirements are prescribed by law, publish notice of the election. The notice shall contain a facsimile of the portion of the ballot containing the fi rst rota-tion as prescribed by section 49.31, subsection 2, and shall show the names of all candidates or nominees and the offi ce each seeks, and all public questions, to be voted upon at the election.     tion of the commissioner be reduced in size relative to the actual ballot but such reduction shall not cause upper case letters appearing in candidates' names or in summaries of public measures on the published sample ballot to be less than nine point type. The notice shall also state the date of the elec-tion, the hours the polls will be open, the location of each polling place at which voting is to occur in the election, and the names of the precincts voting at each polling place, but the statement need not set forth any fact which is apparent from the portion of the ballot appearing as a part of the same notice. The notice shall include the full text of all public measures to be voted upon at the election.

    2. The notice shall be published in at least one newspaper, as defi ned in section 618.3, which is published in the county or other political subdivi-sion in which the election is to occur or, if no news-paper is published there, in at least one newspaper of substantial circulation in the county or political subdivision. For the general election or the primary election the foregoing notice shall be published in at least two newspapers published in the county. However, if there is only one newspaper published in the county, publication in one newspaper shall be suffi cient.

    49.54 Cost of publication. Cost of the above shall not exceed an amount determined by the director of the state department of general services or his or her designee. The current rule is that the facsimile portion of the ballot, which must be photographed, shall be charged at not more than the newspaper's regular display rate by the column inch. The reader or straight matter portion may be charged at the legal rate, by the line. Note the limitation on reduction in size; the candidates' names must be published in at least nine point type. In a city in which no newspaper is published and with a population of 2,000 or less, a maximum cost for the publication of the ballot has been established. The maximum cost for a quarter-page sample ballot must not exceed $250 and maximum cost for a half-page sample ballot must not exceed $350.

    49.56 Maximum cost of printing. The cost of printing the offi cial election ballots and printed supplies shall not exceed the usual and customary rates that the printer charges its regular customers.

    49.57 Method and style of printing ballots.Ballots shall be prepared as follows:1. They shall be on paper uniform in color, through

    which the printing or writing cannot be read.2. In the area of the general election ballot for

    straight party voting, the party or organization names shall be printed in upper case and lower case letters using a uniform font size for each political party or nonparty political organization. The font size shall be not less than twelve point type. After the name of each candidate for a partisan offi ce the name of the candidate's political party shall be printed in at least six point type. The names of political parties and nonparty political organizations may be abbreviated on the remainder of the ballot if both the full name and the abbreviation appear in the "Straight Party" and "Other Political Party" areas of the ballot.

    3. The names of candidates shall be printed in upper case and lower case letters using a uniform font size throughout the ballot. The font size shall be not less than ten point type.

    3A. In no case shall the font size for public mea-sures, constitutional amendments, and constitutional convention questions, and summaries thereof, be less than ten point type.

    4. On the ballots that will be counted by electronic tabulating equipment, ballots shall include a voting target next to the name of each candidate. The posi-tion, shape and size of the targets shall be appropriate for the equipment to be used in counting the votes. Where paper ballots are used, a square, the sides of which shall not be less than one-fourth of an inch in length, may be printed at the beginning of each line in which the name of a candidate is printed, except as otherwise provided.

    5. A portion of the ballot, which can be shown to the precinct offi cials without revealing any of the marks made by the voter, shall include the words "Offi cial ballot," the unique identifi cation number or name assigned by the commissioner to the ballot style, the date of the election, and a facsimile of the signature of the commissioner who has caused the ballot to be printed pursuant to section 49.51.

    6. The offi ce title of any offi ce which appears on the ballot to fi ll a vacancy before the end of the usual term of the offi ce shall include the words To Fill Vacancy.

    49.63 Time of printinginspection and correction

    Ballots shall be printed and in the possession of the commissioner in time to enable the commisioner to furnish ballots to absent voters as provided by sections 53.8 and 53.11. The printed ballots shall be subject to the inspection of candidates and their agents. If mistakes are discovered, they shall be corrected without delay, in the manner provided in this chapter.

    CHAPTER 52. ALTERNATIVE VOTING SYSTEMS

    52.35 Equipment tested. Within fi ve days before the date of any election at

    which votes are to be cast by means of an electronic voting system and tabulated at a counting center established under section 52.34 , the commissioner in charge of the counting center where votes so cast are to be tabulated shall have the automatic tabulating equipment tested to ascertain that it will correctly count the votes cast for all offi ces and on all public questions. The procedure for conducting the test shall be as follows:

    For any election to fi ll a partisan offi ce, the county chairperson of each political party shall be notifi ed in writing of the date, time and place the test will be conducted, so that they may be present or have a representative present. For every election, the com-missioner shall publish notice of the date, time, and place the test will be conducted. The commissioner may include such notice in the notice of the election published pursuant to section 49.53. The test shall be open to the public.

    CHAPTER 68B. CONFLICTS OF INTEREST OF PUBLIC OFFICERS AND EMPLOYEES

    68B.3 When public bids required. No offi cial, employee, member of the general as-sembly, or legislative employee shall sell any goods having a value in excess of fi ve hundred dollars to any state agency unless pursuant to an award or contract let after public notice and comptitive bidding. This section shall not apply to the publication of resolu-tion, advertisements, or other legal propositions or notices in newspapers designated pursuant to law for such purpose and for which the rates are fi xed pursuant to law.

    CHAPTER 73. PREFERENCE FOR IOWAPRODUCTS AND LABOR

    73.2 Advertisements for bids - form.In addition to any method of advertisement

    required by law, any executive branch agency, the general assembly, and the judicial branch shall advertise any request for bids and proposals on the offi cial state internet site operated by the information technology department.

    73.7 Bids and contracts. Taxing bodies using over three hundred dollars worth of coal annually shall advertise for bids in a newspaper published in the county. The advertise-ment shall state the date, time, and place the bids shall be received, which shall be not less than fi fteen days after.

    CHAPTER 75. AUTHORIZATION AND SALES OF PUBLIC BONDS

    75.2 Notice of sale. When public bonds are offered for sale, the offi cial(s) in charge of such bond issue shall, by adver-tisement published as provided in section 331.305 of the Code (Page 38 of this Handbook), and shall give notice of the time and place of sale of said bonds, the amount to be offered for sale, and any further information which may be deemed pertinent.

    CHAPTER 80. DEPARTMENT OF PUBLIC SAFETY

    80.39 Disposition of personal property. 1. Personal property, except for motor vehicles subject to sale pursuant to chapter 321.89, and seizable property subject to disposition pursuant to chapter 809 or 809A, in the possession of the department of public safety or a local law enforce-ment agencyshall be disposed of pursuant to this sectionIf the identity or address of the owner cannot be determined, notice by one publication in a newspaper of general circulation in the area where the property was found is suffi cient notice. A published notice may contain multiple items.

    CHAPTER 103A. STATE BUILDING CODE

    103A.11 Rulespublic hearing. 1. Notice of hearings shall be provided by publi-

    cation in at least fi ve newspapers of general circula-tion within separate geographic areas of the state. Public notice shall be given at least seven days prior to the hearings.

    103A.12 Adoption & withdrawalproce-dure.

    A governmental subdivision in which the state building code is applicable may by ordinance, at any time after one year has elapsed since the code became applicable, withdraw from the application of the code. The local governing body shall hold a public hearing, after giving not less than four but not more than twenty days' public notice, together with written notice to the commissioner of the time, place, and purpose of the hearing, before the ordinance to withdraw is voted upon.

    CHAPTER 106. WATER NAVIGATION REGULATIONS

    106.17 Local regulations restricted. Any subdivision of this state may, but only after

    public notice thereof by publication in a newspaper having a general circulation in such subdivision, make formal application to the commission for special rules

    resolution, and the governor.Before the board shall make a fi nding of impera-

    tive and unavoidable public necessity, or shall enter into any amendment to articles of dedication, it shall provide notice of such proposal and opportunity for any person to be heard. Such notice shall be published at least once in a newspaper with a general circulation in the county or counties wherein the area directly affected is situated.

    CHAPTER 112. DAMS AND SPILLWAYS 112.3 Hearingdamages. After the approval the commission, if it wishes

    to proceed further with the project, shall, with the consent of the environmental protection commission, fi x a date of hearing not less than two weeks from date of approval of the plan. Notice of the day, hour and place of hearing, relative to proposed work, shall be provided by publication at least once a week for two consecutive weeks in some newspaper of general circulation published in the county where the project is located, or in the counties where the water eleva-tions are affected, under the tentative plan approved. The last publication shall not be less than fi ve days prior to the day set for hearing.

    CHAPTER 113. FENCES

    113.7 Service of notice on nonresidents. Notice by fence viewers may be served on non-

    residents owners by publication once each week for two consecutive weeks in a newspaper published in the county in which the land is situated.

    CHAPTER 137. LOCAL BOARDS OF HEALTH

    137.6 Powers of local boards.2.a. Rules of a county board shall become effective

    upon approval by the county board of supervisors and publication in a newspaper having general circulation within the county.

    b. Rules of a city board shall become effective upon approval by the city council and publication in a newspaper having general circulation in the city.

    c. Rules of a district board shall become effective upon approval by the district board and publication in a newspaper having general circulation in the district.

    d. However, before approving any rule or regu-lation the local board of health shall hold a public hearing on the proposed rule. Any citizen may appear and be heard at the public hearing. A notice of the public hearing, stating the time and place and the general nature of the proposed rule or regulation, shall be published as provided in section 331.305 in the area served by the board.
