4. ProjectDescription:ThepurposeoftheProjectistoreducethefrequencyandseverity
ofcollisionsbyimprovingcurveradiiandincreasingshoulderwidththroughtheProjectarea.TheProjectareaisonStateRoute96(SR96)throughHumboldtCountybetweenpost‐miles(PM)6.2and6.6.Thescopeoftheproposedworkincludesrealignedcurves,widenedshoulders,threeculvertreplacements,andinstallationofabondedwearcourseroadsurfaceoverlay.Caltransisproposingthefollowingactivitiesatthesespecificlocations:
PM6.2‐6.6:Reconstructandwidentheexistingroadwaytoprovide4‐foot
shoulders,restriperoadway,installasphaltconcretedikes,shoulderbacking,andcenterlineandshoulderrumblestrips;
PMR6.3‐R6.40:Realigncurves PMR6.36‐R6.39andPM6.43‐6.47:Constructoversidedrainsandtwobiofiltration
swales; PMR6.29‐R6.33andR6.46‐6.58:Constructguardrail; PMR6.25:Removeexisting24‐inchcorrugatedmetalpipeandreplacein‐kindwith
a24‐inchculvert; PMR6.31:Replaceexisting18‐inchculvertwitha24‐inchcorrugatedmetalpipe
culvert,constructnewculvertinletandoutlet,constructadowndrain,andplacerockenergydissipation(riprap)atthedowndrainoutlet;
PMR6.37:Linetheexisting48‐inchculvertwithahighdensitypolyethyleneslipliner,andreplacetheflared‐endsectionoftheculvertinletwithaheadwall;and
PM6.46:Replacetheexisting24‐inchculvertwitha36‐inchcorrugatedmetalpipe,constructnewflared‐endsectionsatculvertinletandoutlet,andplaceriprapattheculvertoutlet.
ThemaximumdepthofProjectexcavationwouldbeapproximately125feet.Approximately51,000cubicyardsofexcessmaterialwouldberemovedandhauledtotheHoopaValleyAggregatesDisposalSite.Vegetationandtreeremovalwouldberequiredfortherealignmentaswellastofacilitateaccessbyconstructionequipmentandpersonnel.One‐wayreversingtrafficcontrolwouldalsoberequiredduringconstruction.Stagingwouldbelocatedonpavedroadway,existingpullouts,andprivatepropertywithintheProjectlimits.

5. ConstructionTiming:TheProjectisexpectedtorequire70daysofconstruction.TheProjectisproposedtobegininthespringof2016,andbecompletedinthefallof2017.
6. ProjectImpacts:TheproposedProjectwouldresultinapproximately48linearfeet
(0.009acres)ofpermanentimpactstojurisdictionalwatersduetoplacementofriprap.TheproposedProjectwouldresultinapproximately50linearfeet(0.007acres)oftemporaryimpactstojurisdictionalwatersduetoculvertconstructionactivities.TheproposedProjectmayalsoresultinremovaloftwowhitealdersforconstructionaccess.Projectimplementationwouldresultinapproximately0.24acresofnewandapproximately0.76acresofreworkedimpervioussurface.Stormwaterrunofffromroadwayimpervioussurfacescarriespollutantssuchaspetroleumhydrocarbonsandmetals.
7. MitigationforProjectImpacts:Tocompensatefor48linearfeet(0.009acres)of
permanentimpactstojurisdictionalwaters,CaltransisproposingtoremoveinvasiveHimalayanblackberryandplantnativeswordfern(Polystichummunitum)on0.046acresatPMR6.37.Caltransshallrevegetatetemporarilyimpactedareas.
8. DisturbedSoilArea:Projectimplementationwouldresultingreaterthanoneacreof
disturbedsoilarea.CaltransshallapplyforcoverageundertheNationalPollutantDischargeEliminationSystemGeneralPermitforStormWaterDischargesAssociatedwithConstructionandLandDisturbanceActivities(OrderNo.2009‐0009‐DWQ)andprepareaStormwaterPollutionPreventionPlandetailingbestmanagementpractices(BMPs)tocontrolpollutionfromtheProjectareaduringconstruction.AlltemporarilydisturbedareaswithintheProjectareashallbeappropriatelystabilizedand/orreplantedwithappropriatenativevegetation.
9. UtilityRelocations:Utilityrelocationsaffectingjurisdictionalwatersarenotproposed
forthisProject.
10. OtherAgencyActions:Caltranshasappliedforcoverageunderanon‐reportingU.S.ArmyCorpsofEngineersNationwidePermitNo.14,LinearTransportationProjects,pursuanttosection404oftheCleanWaterAct.CaltranshasappliedforaSection1600StreambedAlterationAgreementfromtheCaliforniaDepartmentofFishandWildlife.
11. CEQACompliance:OnApril22,2015,CaltranssignedaNoticeofDeterminationapprovingaMitigatedNegativeDeclarationfortheProject(StateClearinghouseNo.2015021063)inordertocomplywiththeCaliforniaEnvironmentalQualityAct.

303(d)listasimpairedforsedimentandtemperature.TheTMDLidentifiesCaltransfacilitiesasacontributortosedimentinthewatershedandrecommendsimplementationoferosioncontrolmeasuressetforthintheCaltransstatewideNationalPollutantandDischargeEliminationSystemstormwaterpermitandimplementationofroutinemaintenancemeasurestominimizesedimentdelivery.Caltranswouldberequiredtoobtaincoverageunderthestatewideconstructiongeneralpermittocontrolsedimentdeliveryduringconstruction.TheProjectcertificationwouldincludearequirementtoinstallabiofiltrationswaletocaptureroadwaypollutantsafterconstructioniscompleted.
13. AntidegradationPolicy:ThefederalantidegradationpolicyrequiresthatStatewater
qualitystandardsincludeanantidegradationpolicyconsistentwiththefederalpolicy.TheStateWaterBoardestablishedCalifornia’santidegradationpolicyinStateWaterBoardResolutionNo.68‐16.ResolutionNo.68‐16incorporatesthefederalantidegradationpolicywherethefederalpolicyappliesunderfederallaw.ResolutionNo.68‐16requiresthatexistingqualityofwatersbemaintainedunlessdegradationisjustifiedbasedonspecificfindings.TheRegionalWaterBoard’sBasinPlanimplements,andincorporatesbyreference,boththeStateandfederalantidegradationpolicies.ThiscertificationisconsistentwithapplicablefederalandStateantidegradationpolicies,asitdoesnotauthorizethedischargeofincreasedconcentrationsofpollutantsorincreasedvolumesoftreatedwastewater,anddoesnototherwiseauthorizedegradationofthewatersaffectedbythisProject.
14. ThisdischargeisalsoregulatedunderStateWaterResourcesControlBoardOrderNo.
2003‐0017‐DWQ,"GeneralWasteDischargeRequirementsforDredgeandFillDischargesThatHaveReceivedStateWaterQualityCertification,"whichrequirescompliancewithallconditionsofthiscertification.AweblinktothisOrderisincludedattheendofthiscertification.
Accordingly,basedonitsindependentreviewoftherecord,theRegionalWaterBoardcertifiesthattheStateRoute96SugarBowlRanchCurveProject(WDIDNo.1B15133WNHU),asdescribedintheapplicationwillcomplywithsections301,302,303,306and307oftheCleanWaterAct,andwithapplicableprovisionsofstatelaw,providedthatCaltranscomplieswiththefollowingtermsandconditions:

2. CaltransshallimplementtheSimpleRevegetationPlan(Plan),datedSeptember2015.Uponcompletionofmitigationconstruction,CaltransshallsubmitareportwithphotosdocumentingthecompletedrestorationactivitiesnolaterthanJanuary1,2018.Additionally,Caltransshallsubmitmonitoringreportsonyears1,3,and5,followingtherevegetationcompletiondate.Themonitoringreportsshallincludephotos,plantcounts,andsuccesscriteriaforsurvivalcountsconsistentwiththerevegetationplan.MonitoringreportsshallusethefollowingperformanceandsuccesscriteriaforsurvivalcountsfromthePlan:
i) Year1:Atleast70%ofinstalledcontainerplantswillbealiveinmonitoringyear1,withatleast3survivingplants(includingvolunteers)beingwhitealder;
ii) Year3:Atleast60%ofinstalledcontainerplantswillbealiveinmonitoringyear3,withatleast3survivingplants(includingvolunteers)beingwhitealder;and

4. AllProjectactivitiesandBMPsshallbeimplementedaccordingtothesubmitted
applicationpackageandthefindingsandconditionsofthiscertification.SubsequentchangestotheProjectthatcouldsignificantlyimpactwaterqualityshallfirstbesubmittedtoRegionalWaterBoardstaffforpriorreview,consideration,andwritten

concurrence.IftheRegionalWaterBoardisnotnotifiedofanalterationtotheProjectthatresultsinanimpacttowaterquality,itwillbeconsideredaviolationofthiscertification,andCaltransmaybesubjecttoRegionalWaterBoardenforcementactions.
5. AllconditionsrequiredbythiscertificationshallbeincludedintheContractDocumentspreparedbyCaltransforthecontractor.Inaddition,CaltransshallrequirecompliancewithallconditionsincludedinthiscertificationinthebidcontractforthisProject.
6. CaltransisprohibitedfromdischargingwastetowatersoftheState,unlessexplicitly
authorizedbythiscertification.Forexample,nodebris,soil,silt,sand,bark,slash,sawdust,rubbish,cementorconcreteorconcretewashings,weldingslag,oilorpetroleumproducts,orotherorganicorearthenmaterialfromanyconstructionorassociatedactivityofwhatevernature,shallbeallowedtoenterintoStatewaters.
7. Exceptfortemporarystockpilingofwastegeneratedduringdemolitionoperations
(“temporary”inthisinstancemeansgeneratedandremovedduringthesameworkingday),wastematerialsshallnotbeplacedinamannerwherethematerialsmaybetransportedintowatersoftheState.Wastematerialsshallnotbeplacedwithin100linearfeetofStatewaters.Exceptionstothe100‐footlimitmaybegrantedonacase‐by‐casebasisprovidedCaltransfirstsubmitsaproposalinwritingthatisfoundacceptablebyRegionalWaterBoardstaff.
8. Caltransisliableandresponsiblefortheproperdisposal,reuse,and/orrecyclingofallProject‐generatedwasteincompliancewithapplicableStateandFederallawsandregulations,andasdescribedinCaltrans2010StandardSpecifications13‐4.03D,WasteManagement.Additionally,whenhandling,transporting,disposing,reusing,and/orrecyclingProject‐generatedwaste,Caltransandtheircontractorsshall:
i) ProvidetheRegionalWaterBoardwithacopyoftheSolidWasteDisposalandRecyclingReportpreparedforCaltransbythecontractorperCaltrans2010StandardSpecification14‐10.02A(1),Submittals.ThesereportsshallbeprovidednotlaterthanJanuary31foreachyearworkisperformedduringthepreviouscalendaryear.AcopyofthefinalSolidWasteDisposalandRecyclingReportshallbesubmittedtotheRegionalWaterBoardwithin30daysafterbeingreceivedbyCaltransfromthecontractor.
ii) Forwasteotherthansolidwaste,obtainevidencethatwastehasbeenappropriatelydisposed,reused,and/orrecycled.Evidenceshallincludetypeandquantityofwasteandmayinclude,butnotbelimitedto,propertyowneragreements,permits,licenses,andenvironmentalclearances.EvidenceshallbeprovidedtotheRegionalWaterBoarduponrequest;and
iii) Forwasteotherthansolidwaste,ensuretheResidentEngineerhasgiven

9. Asphalt‐concretegrindingsshallnotbeplacedinanylocationwheretheymay,atany
time,bedirectlyexposedtosurfacewatersorseasonallyhighgroundwater,exceptasphalt‐concretegrindingsmaybere‐usedandincorporatedintohotmixasphaltproductsorencapsulatedwithintheroadwaystructuralsection.
10. CaltransandtheircontractorsshallcomplywiththeactivityrestrictionsdetailedinCaltrans2010StandardSpecifications13‐4.03C(1).Inaddition,fueling,maintenance,storageandstagingofvehiclesandequipmentshallbeprohibitedwithinwatersoftheState(e.g.,gravelbars,seeps,ephemeralstreams)andriparianareas.
11. Fueling,maintenance,and/orstagingofindividualequipmenttypeswithinwatersoftheStateorriparianareasmaybeauthorizedifCaltransfirstpreparesaplanforreviewandapprovalbyRegionalWaterBoardstaffthat:
i) Identifiesthespecificpieceofmachinerythatmayrequirefueling,maintenance,and/orstagingwithinwatersoftheStateorriparianareas;
ii) Providesjustificationfortheneedtorefuel,maintain,orstagewithinStatewatersorriparianareas.Thejustificationshalldescribewhyconductingtheactivityoutsideofjurisdictionalwatersisinfeasible;and
iii) IncludesanarrativeofspecificBMPsthatshallbeemployedtopreventdischargestoStatewatersandriparianareas;
12. CaltransshallnotuseleakingvehiclesorequipmentwithinStatewatersorriparian
areas.13. Only100‐percentbiodegradableerosionandsedimentcontrolproductsthatwillnot
entraporharmwildlifeshallbeused.Photodegradablesyntheticproductsarenotconsideredbiodegradable.IfCaltransfindsthaterosioncontrolnettingorproductshaveentrappedorharmedwildlife,personnelshallremovethenettingorproductandreplaceitwithwildlife‐friendlybiodegradableproducts.Thisconditiondoesnotprohibittheuseofplasticsheetingusedinwaterdiversionordewateringactivities.CaltransshallrequestapprovalfromtheRegionalWaterBoardifanexceptiontothisrequirementisneededforaspecificlocation.
14. Workinflowingorstandingsurfacewaters,unlessotherwiseproposedintheproject
descriptionandapprovedbytheRegionalWaterBoard,isprohibited.
15. Non‐stormwaterdischargesareprohibitedunlessthedischargeisfirstapprovedbythe

RegionalWaterBoardandincompliancewiththeBasinPlan.Ifdewateringofgroundwaterisnecessary,thenCaltransshalluseamethodofwaterdisposalotherthandisposaltogroundorsurfacewaters,suchaslanddisposal.GroundwaterdisposedoftolandshallnotenterStatewaters.Alternatively,CaltransmayapplyforcoverageundertheLowThreatDischargePermitoranindividualNationalPollutantDischargeEliminationSystem(NPDES)Permit.IfCaltransappliesforcoverageundereitherofthesepermits,thendischargeisprohibiteduntilCaltranshasreceivednotificationofcoverageundertherespectivepermit.
16. GravelbagsusedwithinStatewatersshall:
i) ComplywithCaltrans2010StandardSpecificationssections13‐5.02Gand88‐1.02F;
ii) Beimmediatelyremovedandreplacedifthebagshavedevelopedoraredevelopingholesortears;and
iii) Befilledonlywithcleanwashedgravel.
ExceptionstothesecriteriaaresubjecttothereviewandacceptanceofRegionalWaterBoardstaff.
17. Thiscertificationdoesnotauthorizedraftingofsurfacewaters.
18. CaltransshallprovideaccesstotheProjectconstructionsiteuponrequestbyRegional
WaterBoardstaff.
19. InitialwaterpollutioncontroltrainingdescribedinCaltrans2010StandardSpecifications13‐1.01D(2),Training,shallapplytoallCaltransemployees,contractors,andsub‐contractors.InitialwaterpollutioncontroltrainingtopicsshallincludeRegionalWaterBoard401certificationandconstructiongeneralpermitrequirements,identificationofstatewatersandriparianareas,andviolationavoidanceanddischargereportingprocedures.
20. CaltransshallmaintainlogsofallCaltransstaff,contractors,andsub‐contractorstrainedpursuanttotheCaltrans2010StandardSpecifications13‐1.01D(2).Thelogsshallincludethenamesoftrainees,trainingdates,andsummaryofthescopeoftraining.CaltransshallprovideevidenceofthisdocumentationupontherequestoftheRegionalWaterBoard.
21. Ifanunauthorizeddischargetosurfacewaters(includingwetlands,riversorstreams)occurs,oranyotherthreattowaterqualityarisesasaresultofProjectimplementation,theassociatedProjectactivitiesshallceaseimmediatelyuntilthethreattowaterqualityisotherwiseabated.IfthereisadischargetoStatewaters,theRegionalWater

22. UncuredconcreteshallnotbeexposedtoStatewatersorsurfacewatersthatmaydischargetoStatewaters.Concretesealantsmaybeappliedtotheconcretesurfacewheredifficultyinexcludingflowforalongperiodmayoccur.Ifconcretesealantisused,watershallbeexcludedfromthesiteuntilthesealantiscured.Ifgroundwatercomesintocontactwithfreshconcrete,itshallbepreventedfromflowingtowardssurfacewater.
23. Groundandsurfacewaterthathascomeintocontactwithfreshconcrete,andallother
wastewater,shallnotbedischargedtoStatewatersortoalocationwhereitmaydischargetoStatewaters;thewastewatershallbecollectedandre‐usedordisposedofinamannerapprovedbytheRegionalWaterBoard.
24. Allimportedfillmaterialshallbecleanandfreeofpollutants.Allfillmaterialshallbe
importedfromasourcethathastheappropriateenvironmentalclearancesandpermits.Thereuseoflow‐levelcontaminatedsolidsasfillon‐siteshallbeperformedinaccordancewithallStateandFederalpoliciesandestablishedguidelinesandmustbesubmittedtotheRegionalWaterBoardforreviewandconsiderationofacceptance.
25. CaltransshallprovideacopyofthiscertificationandStateWaterResourcesControlBoard(SWRCB)OrderNo.2003‐0017‐DWQ(weblinkreferencedbelow)tothecontractorandallsubcontractorsconductingthework,andrequirethatcopiesremainintheirpossessionattheworksite.Caltransshallberesponsibleforworkconductedbyitscontractorandsubcontractors.
26. Thevalidityofthiscertificationisconditionedupontotalpaymentofanyfeerequired
undertitle23,CaliforniaCodeofRegulations,section3833.Thetotalapplicationfeeis$200.TheRegionalWaterBoardreceived$200fromCaltransonSeptember29,2015.
27. Thiscertificationwillbesubjecttoannualbillingduringtheconstructionphase(“AnnualActiveDischargeFee”)andduringthemonitoringphaseoftheProject(“AnnualPostDischargeMonitoringFee”),perthecurrentfeeschedule,whichcanbefoundonourwebsite:http://www.swrcb.ca.gov/northcoast/water_issues/programs/water_quality_certification.shtml.ThesefeeswillbeautomaticallyinvoicedtoCaltrans.
28. Intheeventofanyviolationorthreatenedviolationoftheconditionsofthiscertification,theviolationorthreatenedviolationshallbesubjecttoanyremedies,penalties,processorsanctionsasprovidedforunderapplicablestateorfederallaw.Forthepurposesofsection401(d)oftheCleanWaterAct,theapplicabilityofanystatelawauthorizingremedies,penalties,processorsanctionsfortheviolationorthreatenedviolationconstitutesalimitationnecessarytoassurecompliancewiththewaterqualitystandardsandotherpertinentrequirementsincorporatedintothiscertification.Inresponsetoasuspectedviolationofanyconditionofthiscertification,theStateWaterBoardmayrequiretheholderofanyfederalpermitorlicensesubjecttothiscertificationtofurnish,underpenaltyofperjury,anytechnicalormonitoringreportstheStateWaterBoarddeemsappropriate,providedthattheburden,includingcosts,ofthereportsshallbearareasonablerelationshiptotheneedforthereportsandthebenefitstobeobtainedfromthereports.Inresponsetoanyviolationoftheconditionsofthiscertification,theRegionalWaterBoardmayaddtoormodifytheconditionsofthiscertificationasappropriatetoensurecompliance.
31. Thiscertificationactionissubjecttomodificationorrevocationuponadministrativeorjudicialreview,includingreviewandamendmentpursuanttoWaterCodesection13330andtitle23,CaliforniaCodeofRegulations,section3867.
32. Thiscertificationisnottransferable.IntheeventofanychangeincontrolofownershipoflandpresentlyownedorcontrolledbyCaltrans,Caltransshallnotifythesuccessor‐in‐interestoftheexistenceofthiscertificationbyletterandshallforwardacopyofthelettertotheRegionalWaterBoard.Thesuccessor‐in‐interestmustsendtotheRegionalWaterBoardExecutiveOfficerawrittenrequestfortransferofthiscertificationtodischargedredgedorfillmaterialunderthiscertification.Therequestmustcontainthefollowing:
i) Requestingentity’sfulllegalname;ii) Thestateofincorporation,ifacorporation;

iii) Theaddressandphonenumberofcontactperson;andiv) Adescriptionofanychangestotheprojectorconfirmationthatthe
successor‐in‐interestintendstoimplementtheprojectasdescribedinthiscertification.
33. Exceptasmaybemodifiedbyanyprecedingconditions,allcertificationactionsare
contingenton:
i) Thedischargebeinglimited,andallproposedrevegetation,avoidance,minimization,andmitigationmeasuresbeingcompleted,instrictcompliancewithCaltrans’sprojectdescriptionandCEQAdocumentation,asapprovedherein;
ii) CaltransshallconstructtheProjectinaccordancewiththeprojectdescribedintheapplicationandthefindingsabove;and
iii) CompliancewithallapplicablewaterqualityrequirementsandwaterqualitycontrolplansincludingtherequirementsoftheWaterQualityControlPlanfortheNorthCoastRegion(BasinPlan),andamendmentsthereto.
AnychangeinthedesignorimplementationoftheProjectthatwouldhaveasignificantormaterialeffectonthefindings,conclusions,orconditionsofthiscertificationmustbesubmittedtotheExecutiveOfficeroftheRegionalWaterBoardforpriorreview,consideration,andwrittenconcurrence.IftheRegionalWaterBoardisnotnotifiedofasignificantalterationtotheproject,itwillbeconsideredaviolationofthiscertification,andCaltransmaybesubjecttoRegionalWaterBoardenforcementactions.
34. Theauthorizationofthiscertificationforanydredgeandfillactivitiesexpiresfiveyears
fromthedateofthiscertification.Conditionsandmonitoringrequirementsoutlinedinthiscertificationarenotsubjecttotheexpirationdateoutlinedabove,andremaininfulleffectandareenforceable.
Condition2isarequirementforinformationandreports.AnyrequirementforareportmadeasaconditiontothiscertificationisaformalrequirementpursuanttoCaliforniaWaterCodesection13267,andfailureorrefusaltoprovide,orfalsificationofsuchrequiredreportissubjecttocivilliabilityasdescribedinCaliforniaWaterCode,Section13268.TheRegionalWaterBoardmayaddtoormodifytheconditionsofthiscertification,asappropriate,toimplementanyneworrevisedwaterqualitystandardsandimplementationplansadoptedorapprovedpursuanttothePorter‐CologneWaterQualityControlActorsection303oftheCleanWaterAct.
