Thatwhichisnototherwiselawful,necessitymakeslawful,andnecessitymakesaprivilegewhichsupersedeslaw.Impunityinvitestogreatercrimes.Noonemaycomeintocourtwithuncleanhands.Inthingsobviousthereisnoroomforconjecture.Inagreementstheruleistoregardtheintentionofthecontractingpartiesratherthantheirwords.Incriminalcasesthesilenceofapersonpresentpresumesconsent;incivilcasessometimesthatofthepersonabsent,andevenignorantwherehisinterestlies,doesthesame.Infavoroflife,liberty,andinnocence,allthingsaretobepresumed.Inalegalfictionequityalwaysexists.Hetrulyactsfraudulentlywho,observingtheletterofthelaw,eludesitsspirit.Inlawallthingsarealwaysjudgedfromtheirpresentcondition.Incriminalmatters,theintentionisregarded,nottheevent.Inallcontractswhethernamedornot,anexchangeisunderstood.Equityistoberegardedinallthings,butparticularlyinlaw.Inpresenceofthemajortheminorpowerceases.Inadoubtfulcasethenegative,ratherthantheaffirmative,istobeunderstood.Onemaydowithhisownashepleases,ifhedoesnotinvadetherightsofothers.Itisimproper,unlessthewholelawbeexamined,togivejudgmentoradviceuponaviewofasingleclauseofit.Itisunlawfultojudgeofanypartunlessthewholesentencebeexamined.Theinclusionofoneistheexclusionofanother.Infinityinlawisreprehensible.Amanshouldnotbebenefitedbyhisownwrongdoing.Heisinsanewho,reasonbeingthrownaway,doeseverythingwithviolenceandrage.Ahiddenintentionisbad.Amongmanythings,youwillevenquestionlawsandlearnedmen.Amongequalsnooneisthemorepowerful.Thejudgeshoulddecideaccordingtotheallegationsandtheproofs.Toajudgewhoexceedshisofficenoobedienceisdue.Itisthedutyofajudgetodecideaccordingtothefactsallegedandproved.Itisthedutyofajudgetodeclare,nottomakethelaw.Itisthedutyofajudgetofinishtheworkofeachdaywithinthatday.Itisadecisiontofavorthosethingsthatfavorreligion,thoughwordsbewanting.Thelawsofnatureareunchangeable.Jurorsoughttobeneighbors,ofsufficientestate,andfreefromsuspicion.Bythelawofnatureitisjustthatnoonebecomemorerichbythedetrimentandinjuryofanother.Civillawisthatwhicheachnationhasestablishedforitself.Lawisthescienceofthegoodandthejust.Lawisaruleofright,andwhateveriscontrarytotheruleofright,isaninjury.Rightandfraudneverdwelltogether.Naturalrightisthatwhichhasthesamepoweramongallmen.Thelawofnatureisproperlythedictateofrightreason,bywhichweknowwhatisdishonestandwhatishonest;whatshouldbedoneandwhatavoided.Itisnotsafetoobeyhimwhohasnoright.Apubliclawcannotbechangedbytheagreementofprivateparties.Theformoftakinganoathdiffersinwords,yetagreesinmeaning;foritoughttohavethissense,thattheDeitybeinvoked.Anoathmadeamongothersshouldneitherharmnorprofit.Justiceoughttobeunbought,becausenothingismorehatefulthanvenaljustice;free,forjusticeshouldnotshutout;andquick,fordelayisasortofdenial.Justiceisanexcellentvirtue,andpleasingtotheMostHigh.Justiceshouldbedeniedtonoone.


Justiceisnottobedenied,nordelayed.Justiceknowsneitherfathernormother;justiceregardstruthalone.Wherethelawgivesathing,itgivesaremedytorecover.Thelawfavorsthelifeof&man.Wilfulnegligenceisequaltodeceit.Lawfavorethhonorandorder.Lawfavorethjusticeandright.Lawfavorethlife,liberty,anddower.Lawfavorethtruth,faith,andcertainty.LAWHATETHWRONG.Thecontractmakesthelaw.ThelawofGodandthelawofthelandareallone.Humanlawsareborn,live,anddie.Thelawsofnatureareperfectandimmutable;buttheconditionofhumanlawtendsalwaystoinfinity,andthereisnothinginitthatcancontinueperpetually.Lawsshouldbindthosewhomakethem.Lawsaidthevigilant,notthenegligent.Lawsimposedbythestatefailing,wemustactbythelawofnature.Fictionsarisefromthelaw,andnotthelawfromfictions.Thelawdelightsinequity;itcovetsperfection;itisaruleofright.Thelawalwaysabhorsdelays.Anunjustlawisnotalaw.Thelawworksharmtonoone,anddoesnooneaninjury.Thelawforcesnottoimpossibilities.Thelawdoesnotrequirethatwhichisapparenttothecourttobeverified.Thelawisthemorepraisedwhenitisconsonanttoreason.Lawwillalwaysgivearemedy.Thelawalwaysintendswhatisagreeabletoreason.Thelawregardstheorderofnature.Thelawassiststheignorant.Thelawspeakstoallwithonemouth.Lawassiststhewakeful,notthesleeping.Libertyisaninestimablething.Libertyistherighttoalienateorrestrainone'sownright.Libertyhasnoprice.Libertyismorefavoredthanallthings.Thecivillawsreduceanungratefulfreemantohisoriginalslavery;butthelawsofEnglandregardamailoncemanumittedaseverafterfree.Thebodyofafreemandoesnotadmitofavaluation.Everyoneisfreetoascertainforhimself,ortohaverecoursetocounsel.Naturalallegianceisrestrainedbynobarriers,curbedbynobounds,compressedbynolimits.Longpossessionproducestherightofpossession,andtakesawayanactionfromthetrueowner.Longtimeandlonguse,whichexceedsthememoryofman,sufficesinlaw.Speakastheordinarypeople;thinkasthelearned.Greatneglectisequivalenttofraud.Evildeedsshouldnotremainunpunished;andimpunityaffordscontinualincitementtothedelinquent.Themorecommonanevilis,theworse.Thingsmanifestneednoproof.Amaximissocalledbecauseitsdignityischiefest,anditsauthoritythemostcertain,andbecauseitisuniversallyapprovedbyall.Forceandinjuryarechieflycontrarytopeace.
