    General Points1. Deductions under chapter VIA are not available from long-term capital gain, short term

    capital gain covered u/s 111A (i.e., STCG on which STT is charged); and casual income likewinning from lotteries, races, etc.

    2. The aggregate amount of deduction under chapter VIA cannot exceed Gross Total Income ofthe assesse excluding long-term capital gain, short term capital gain covered u/s 111A (i.e.,STCG on which STT is charged); and casual income like winning from lotteries, races, etc.

    Consequence in case of violation of lock in periodIf the above lock in period is violated, then entire amount of deduction allowed earlier in anyprevious year, shall be treated as taxable income in the year in which default is made.

    Any authority constituted in India for the purpose ofsatisfying the need for housing accommodation or forthe purpose of planning, development orimprovement of cities, towns, villages or for both.

    business of financing the construction of house; or7. the assessee's employer where such employer isan authority or a board or a corporation or any otherbody established or constituted under a Central orState Act;

    8. the assessee's employer where such employer is apublic company or public sector company, or auniversity established by law or a college affiliated tosuch university or local authority or co-operativesociety.

    Notes: Any expenditure in respect of which deduction is

    allowable u/s 24 is not eligible for deduction.

    Repayments of loan borrowed for acquiringcommercial property are not entitled for deduction.

    Repayment of loan taken for repair, alteration,renovation, addition are not eligible for deduction

    16 Any amount invested in - Debentures of or equity shares in

    an eligible issue of capital; or Eligible issue of capital of any public

    financial institution.

    Eligible issue of capital means an issue made by a publiccompany formed and registered in India or a publicfinancial institution and the entire proceeds of the issueare utilized wholly and exclusively for the purpose of anybusiness referred to in sec. 80IA(4).

    Admission fee: Tuition fees may be at the time of

    admission or thereafterDonation to school, etc: Such payment does notinclude any payment towards any development fees ordonation or payment of similar nature.Private tuition fee is not covered.

    Lock in Period

    Lock in period in following cases:

    Life Insurance Policy: The Life insurance policy (point 1) cannot be surrendered unless

    Salary is chargeable to tax either on 'due' basis or on 'receipt ' basis, whichever is earlier.Place of accrual of salarySalary which is received in India or earned in India shall be taxable in hands of all assesseewhether resident or nonresident in India . Salary is deemed to be earned in India provided -
