It's Friday, September 7, 2012. We are going to hear testimony on Resolution 486-31 (COR), it is relative to voicing I Liheslaturan Guahan's (The Guam Legislahire's) continued support for the full implementation of Public Law 110-229; and requesting that the US Secretary of Homeland Security, the Honorable Janet Napolitano, provide for the issuance of a China Visa Waiver Program through

Joining us this morning, to my immediate left is Senator Aline Yamashita, thank you for joining us and good morning; Senator Tony Ada, Senator Sam Mabini, and to my right is Senator Chris Duenas. Good morning and Manana Si Yu'os. Thank you for joining us. We don't have anybody here right now, we do have someone listening in the audience, and to our TV listeners right now. We have received word from the Homeland Security. Mr. Pedro Leon Guerrero who was scheduled to be here this morning but had a change in appointment schedules, so he is providing testimony. I also received word from the Guam Visitors Bureau that both the general manager and deputy general manager will be providing testimony, along with the board of directors from the Guam Visitors Bureau. We also sent invitations out to the folks at, Mr. Bigley, and several folks in the community to provide testimony. They said they would provide testimonies and extended their apologies for not being here this morning. There was due notice that was sent out. Pursuant to 5 GCA, Chapter 8, Subsection 8107, public hearing notices were sent on Friday, August 31, 2012 and on Tuesday, September 4, 2012. If anyone else wishes to present written testimony, they can do so by sending it to 155 Hesler Place, Suite 101, the office of Senator Tina Rose Muna Barnes, legislative secretary, or they can do so by sending it via facsimile at 472-3400 or via email at [email protected]. With that being said, I will open the floor lo my colleagues if they wish to share anything regarding the resolution. I will go ahead and start to my left with Senator Aline Yamashita.

At this point, I really have no comments other than to say that I absolutely support the China Visa Waiver Program and I look forward to studying and supporting whatever needs to be in place to ensure that is safe and secure for all of our people. I do believe that, I was hoping that we would have the people from both the Guam Visitors Bureau and also the Homeland Security Advisory here so that we can hear their testimonies. However, I think once they submit it, we'll be able to get a copy of that so that we'll be able to look it over and ensure that they positively agree with our findings here. Thank you.

Thank you. The only comment I have this morning Madam Chair is that fully am supportive of any industry development. In this case, it's through the China Visa Waiver program and the opportunity to help continue building our tourism market. Of course that will support a bunch of other jobs and so forth. Provided we have all the security means and methods to help build the industry, I fully am supportive of the initiative. Thank you madam Chair.

Senator Duenas Thank you Madam Chair and Madam Secretary. I want to congratulate you and the Vice­Speaker on the introduction of Resolution 486-31. As you know Madam Chair, the Governor was recently in Washington for a number of meetings. One of his primary missions was to discuss with Homeland Security the progress with regards to the China Visa Waiver. From what we understand from media reports and with my discussion personally with him it's moving along nicely. However, in the spirit once again Madam Chair/Madam Secretary, with the One Guam approach, I think it is very important that this legislature continue to demonstrate its unity on this issue in particular and the fact that we can never do too much on all fronts to let the United States government know that we absolutely need and require to have the ability to stand on our own when it comes to economic development. While we appreciate federal dollars that come to Guam and all of our people benefit from that, we also have our own natural resources and Madam Chair which you are very aware of, and that's why you're chairing this very important committee. These natural resources can be marketed greatly to the region. And so this one final piece, as we know the Russian tourist visa wavier now is yielding huge profits because of the expending power and now these China visa waiver would just do the same thing. The hotel are gearing up for it Madam Chair, I'm sure you're aware. And so I just want to congratulate you once again for this effort because we can not do too much to continue to move forward on this issue so thank you for the opportunity to comment on this very important resolution.

Senator Mufi.a Barnes Si Yu'os Ma'ase Senator Duenas. So now, 1'11 just redo a summary of the resolution and its intent. The U.S. Congress passed public law 110-229, the Marianas visa waiver program to sustain the growth of the regions tourism economy. Guam's tourism industry supports over

18,000 jobs and over 30% of Guam's economic base and Japanese visitors account for approximately 70% of the visitor travel to Guam. I want to say that industry experts have estimated that Japanese visitor arrivals to Guam may decrease by 15-30% in the short time. Policy leaders in Guam and Washington must take strong and proactive steps to avert an economic downturn. I want to say that in December of 2011, the Department of Homeland Security granted visa parole authority for Russian visitors to come to Guam and stay [inaudible] spanning ... our local community and the federal government continue to work closely with agencies within the Obama administration to realize a visa waiver program that will allow our regular scheduled airlift from the people's republic of China to Guam, absent a full China visa waiver for Guam, the use of parole authority with a reduced notification period, linked with effective pre-screening of the people's republic of China visitors may be a viable option. Under a model currently used by the Australian government, the PRC visitors are required to undergo pre-clearing process prior to departure, potentially settling the national security issues. Guam's inclusion in a China visa waiver program will provide our island with that economic stability required for continued growth and expansion of our current tourism market. Our neighbors in the northern Marianas, CNMI, have already been granted parole authority allowing the government of the Northern Marianas to presently receive visitors from China. This parole authority was granted to provide CNMI with a measure of economic stability in their most difficult financial times. I do want to say that visitors from China and other areas that may be of concern to the Department of Homeland Security already have access to the island by way of regular visas temporary foreign workers programs, which we use as the H2 worker program. U.S. employers are able to hire foreign workers on a temporary or permanent basis to fill jobs in the United States [inaudible] jurisdictions as will be the case in support of the impending military buildup here on Guam. I also want to note that the secretary of Homeland Security has granted the CNMI a China/Russia visa waiver program by a parole authority and in - so doing has demonstrated the security concerns regarding the presence of Chinese or Russian nationals on U.S. soil has already been adequately resolved and that the congressional intent of Public Law 110-229 must be fully recognized as the existing mandate of the land and should therefore be fully executed. I also want to note for my colleagues that during a meeting with Congressional Joe Wilson on August 8, who came at the invitation of our Congresswoman Madeline Z. Bordallo, potential options were discussed that would work to address any security issues with the U.S. Department of Defense, Department of Homeland Security and U.S. Department of State has had with the waiver program. I also want to say that it was discussed that a congressional resolution to be introduced by Congressman Joe Wilson and Congresswoman Bordallo support Guam's push for the inclusion of China in the Guam visa waiver program. That conversation was very, very productive. I did receive word back from Congressman Joe Wilson and he is awaiting our intent on this resolution. The intent of this resolution is to petition the Honorable Janet Napolitano immediately exercise her parole

authority and permit Guam's inclusion in a China visa waiver program thereby recognizing again, the congressional intent of the use of Public Law 110-229. I also want to state that several months ago, in early March of this year, we had the opportunity to visit Russia based on the authority that was provided to us, and in doing so, I had the opportunity to meet with the folks, the Ambassador to Russia for the United States. I just want to say that in their efforts also to promote and advocate visit USA, our efforts are being included in their fighting efforts to try and reach all these outbound travelers from Russia and China was very crucial and very critical to the visit USA concept. As Guam is America and Asia, and we are United States soil, I think it's important and it's a critical ingredient that we be included in this. We will never stop asking. It is something that is due to us. Our neighboring island has been afforded this opportunity and Guam is a part of that US jurisdiction and I think we should be able to continue to collaborate and integrate our efforts and work closely together. With that being said, I know that the concerns of the U.S. Department of Defense, the U.S. Department of Homeland Security along with our Guam Homeland Security, our Guam Customs and Quarantine and with our hotel industry and our Guam Visitors Bureau working and collaborating together, I know that we will continue to look for a win/win for our community. With those impacted groups being mentioned today, we continue to be fully engaged with all of them and we hope for full support from all our colleagues.

With the introduction, working closely with Vice-Speaker Cruz, I ask that my colleagues be able to share their interest in having their names put on also as sponsors. I know that that will be very fruitful and I hope to get it on the next session agenda.

B. Testimony (Submission via Facsimile - see attached) Joann G. Camacho, General Manager - Guam Visitors Bureau Tourism is the largest single industry in Guam's economy and generates 60% of the island's revenue. It is one of two main external economic drivers for the island, contributing millions to the local economy. Tourism also accounts for thousands of jobs in Guam, about 35% of the island's employment. China represents the largest and fastest growing potential for tourism in the world with an estimate 50 million citizens capable of travelling and 100 million by the year 2020. GVB Chinese Visitor exit surveys conducted throughout the year estimates approximately $1,200 per day spend per Chinese Visitor. However, Guam is in a disadvantage position because of the current visa situation, which is expensive and time consuming for potential Chinese travelers. Using the most conservative projections, including China and Russia into Guam-CNMI Visa Waiver Program would result in approximately $144.5 million in additional annual revenues for the government of Guam in the year 2020, a 22% increase in government revenues. As we continue to diversify our current markets and attract new markets to Guam, we fully lend our support for Resolution No. 486-31. Si Yu' os Ma' ase and we

1 BE IT RESOLVED BY THE COMMITTEE ON RULES OF I MINA'

2 TRENTAl UNU NA LIHESLATURAN GUAHAN:

3 WHEREAS, the US Congress passed Public Law 110-229, "The Marianas

4 Visa Waiver Program" to sustain the growth of the region's tourism economy; and

s WHEREAS, Guam's tourism industry supports over 18,000 jobs and over

6 thirty percent (30%) of Guam's economic and

7 WHEREAS, Japanese visitors account for approximately seventy

8 (70%) of visitor travel to Guam; and

9 WHEREAS, recent natural disasters in the form of a powerful earthquake, a

10 massive tsunami, and the potential for widespread radiation

11 continued to test the resilience and resolve of the Japanese people

12 economy; and

1 WHEREAS, these disasters have understandably impacted the willingness

2 of the Japanese economy and its people to engage in outbound recreational

3 and

4 WHEREAS, industry experts have estimated that Japanese visitor mrivaJs

7 WHEREAS, policy leaders in Guam and Washington must take strong,

1 WHEREAS, this parole authority was granted to provide the CNMI a

2 measure of economic stability in difficult financial times; and

3 \VHEREAS, Guam must inclusion in a China Visa Waiver Program to

4 access an estimated $I .3 billion in tourism revenues; and

s WHEREAS, the US Congress, through its original construction of the

6 "Guam only Visa \Vaiver Program" recognized conditions unique to Guam~ and

7 WHEREAS, in recognition of these unique conditions, Congress authorized

8 the 0 broad application of the mainland program" when considering the criteria

9 to add countries to Guam's Visa waiver list; and

10 WHEREAS, a country under the fom1er "Guam Only Visa Waiver

11 Program" would be considered for addition to Guam's waiver program as long as

12 that country had a US visa denial rate of 16.9o/o or lower; and

13 WHEREAS, the aforementioned allowance was not continued under the

14 existing Marianas Visa Waiver Program and that shortcommg may be mitigated

1s through the use of parole authority thereby allowing a China Waiver Program for

16 Guam; and

17 \VHEREAS, each military base in Guam has its own perimeter and internal

18 security, thereby providing a protection to external threats, security is not limited

19 to the Guam International Airport, but also at each military facility; and

20 WHEREAS, visitors from China and other areas that may be of concern to

21 the Department of Homeland Security already have access to the island by way of

22 regular and the temporary foreign worker program - lJ.S. employers are able

23 to hire foreign workers on a temporary or permanent basis to fill jobs United

24 States or its jurisdictions as will be the case in support of the impending mil

2s buildup in Guam; and

26 WHEREAS, the Secretary of Homeland Security has granted the CNMI a

27 China Russia Visa Waiver Program by parole authority, and in so doing, has

1 demonstrated that security concerns regarding the presence of Chinese or Russian

2 nationals on U.S. soil has already been adequately resolved; and

3 WHEREAS, the congressional intent of Public Law 110-229 must be fully

4 recognized as the existing mandate of the land and should therefore be fully

s executed; now, therefore, be it

6 RESOLVED, that the Committee on Rules of I Mina' Trentai Unu Na

7 Liheslaturan Guahan does hereby, on behalf of the people of Guam, petition the

8 Secretary of Homeland Security, the Honorable Janet Napolitano, to immediately

9 exercise her parole authority and pe1mit Guam's inclusion in a China Visa Waiver

10 Program thereby recognizing the congressional intent of Public Law 110-229; and

11 be it further

The Guam Visitors Bureau is in receipt of your letter dated September 04, 2012 regarding Resolution No. 486-31: Relative to voicing I Uheslaturan Guahan's (The Guam Legislature's) continued support for the full implementation of Public Law 770-229; and requesting that the U.S. Department of Homeland Security, the Honorable Janet Napolitano, provide for the issuance of a China Visa Waiver Program through her parole authority and the issuance of a broader final rule for the Marianas Visa Waiver Program.

Tourism is the largest single industry in Guam's economy and generates 60% of the island's revenue. It is one of two main external economic drivers for the island, contributing billions to the local economy. Tourism also accounts for thousands of jobs on Guam, about 35% of the island's employment.

China represents the largest and fastest growing potential for tourism in the world with an estimated 50 million citizens capable of traveling and 100 million by the year 2020. GVB Chinese Visitor exit surveys conducted throughout the year estimates approximately $1,200 per day spend per Chinese Visitor. However, Guam is in a disadvantageous position because of the current visa situation, which is expensive and time consuming for potential Chinese travelers. Using the most conservative projections, including China and Russia into the Guam-CNMI Visa Waiver Program would result in approximately $144.5 million in additional annual revenues for the government of Guam in the year 2020, a 22% increase in government revenues.

As we continue to diversify our current markets and attract new markets to Guam, we fully lend our support for Resolution No. 486-31.
