Determination of tariff for the Fourth and Fifth (w.e.f, 01.04.2014 to 31.03.2016) tariff years of the first control period.

The Authority, vide Direction No. 04/2010-11 dated 10.01.2011, had issued the Guidelines [The Airports Economic Regulatory Authority of India (Terms and Conditions for Determination of Tariff for Services provided for Cargo Facility, Ground Handling and Supply of Fuel to the Aircraft), Guidelines, 2011] prescribing procedures, terms and conditions for determination of tariff for the above mentioned regulated services being provided by Independent Service Provider(s). As per the Guidelines, the service providers are required to submit Multi Year Tariff Proposal (MYTP) for the five year control period and Annual Tariff Proposal (ATP) for individual tariff years of the Control Period .

The Authority had considered the Multi Year Tariff Proposal (MYTP) submitted by M/s Celebi Delhi Cargo Terminal Management India (Celebi) in respect of Cargo Handling Services provided at Indira Gandhi International Airport, New Delhi, for the first control period of 5 years commencing w.eJ. 01.04.2011. After due stakeholder consultation, the Authority issued a Multi-Year Tariff Order (MYTO) vide Order no . 14/2011-12 dated 07.10.2011 wherein, inter-alia, it was decided that the services provided for courier cargo facility at IGI Airport, New Delhi are "material but competitive." and hence "light touch approach" be adopted for determination of tariff. Pursuant to issue of above, the Authority considered the Annual Tariff Proposal (ATP) for the first, second and third tariff years and after due stakeholder consultation, determined the tariffs vide ATO(s) No. 11/2012-13 dated 03.08.2012 for the 1st and 2 nd tariff years and vide Order No. 35/2013-14 dated 06.12.2013 for the 3rd tariff year.

3. Celebi, vide letter dated 08.09.2014 submitted its ATP for fourth tariff year 2014-15 (to be effective from 01.10.2014) for the first control period along-with the relevant documents as per the Authority's Guidelines. Celebi had also submitted the minutes of meeting of the user consultation held on various dates with stakeholders on the propo sed tariff revision.

4. The Authority considered this ATP and issued a Consultation Pap er No. 18/2014-15 on 09.03.2015. The last date of receipt of comments was 23.03.2015. In response to the proposal contained in above consultation, no comments have been received.

proposed average increase in tariffs by 12% in each of the components of TSP, Demurrage, Cargo handling and other charges for both import and export and transhipment cargo.

6. The Authority noted the follo~ing from the presentation of Celebi:

(i) There is a shortfall of over 30% in the projected revenue of Celebi vs ARR projected during MYTP filing.

(ii) Actual volumes for DIAL and Celebi have been consistently lower than the projected volumes.

(iii) New facilities and services are being introduced resulting in significant time and cost savings for its customers

(iv) Inspite of substantial capital expenditure, realized revenues are much lower than ARR requirements based on volumes projections given by DIAL.

(v) There has been a significant increase in cost of operations due to inflationary pressures and increase in cost of manpower, utilities etc. such as electricity charges.

7. The Authority further noted that there have been no comments from the stakeholders in response to the aforesaid Consultation Paper. The Authority observed that Celebi has levied tariffs in the 4th tariff year/ till date as per Authority's Order No. 35/2013-14 dated 06.12.2013 approved for the 3rd tariff year.

8. Upon careful consideration of material available on record, the Authority, in exercise of powers conferred by Section 13(1)(a) of the Airports Economic Regulatory Authority of India Act, 2008, hereby orders that:

(i) The Annual Tariff Proposal for the fifth tariff year (w.e.f. 01.04.2015 to 31.03.2016) of the first control period submitted by Celebi Delhi Cargo Terminal Management (1) Private Limited for providing cargo handling services at IGI Airport, New Delhi is determined as at Annexure - I.
