Program of training course "Fundamentals of Law" is made in accordance with the educational professional program for foreign students of humanities specialization "Law" at the preparatory department of International Education Institute for Study and Research, V.N. Karazin Kharkov National University.

1. Description of the course

1.1. The purpose of the course is receiving systematic knowledge in the field of theory of state and law; acquaintance with the basic concepts of law and the foundations of individual sectors of Ukrainian legislation; creating a high level of legal awareness and legal culture, the assimilation of specific legal terms.

1.2. The main task of the course: achieving by foreign students understanding regularities of building a democratic state of law; the formation system of legal knowledge, scientific outlook and jurisprudential lexicon among future Jurists ; laying the foundation for the ability to make informed decisions on legal issues related with their future professional activity.

1.3. Amount of credits: -

1.4. Total number of hours: program is designed for 256 hours, contains three sections and 27 topics.

Learning Achievement Criteria

Current control of students’ knowledge:

· Is carried out during practice classes, which assess the level of knowledge

and skills of students. In practice classes during the semester (1 and 2) can get from 1 to 40 points.

· Is carried out during the performance of control work and consist in the

evaluation of the students’ assimilation of part of the studying material. It is conducted in writing form. The maximum number of points for one control work is 10:

10-8 points – complete answer, independent thinking on the topics;

7-5 points – overall correct, concise answer;

4-2 points – not complete answer to the questions;

1 points – a fragmentary answer;

0 points – no answer.

Final control of knowlege Assessment ( credit and exam)Final control of knowlege assessment (credit) is carried in a combined form. The maximum points is 40. 40-30 points – full detailed answer; 29-19 points – complete answer with minor errors; 18-8 points – answer with significant mistakes;7-1 points – partial answer to the question; 0 points – wrong or missing answer.

1. Human rights belong to all, without exception, the rights of a citizen - only to their own citizens of the state. The scope of rights and freedoms granted to a person, as well as the duties assigned to her, depends on his citizenship (citizenship), his presence or absence. Carriers of rights and freedoms in full are only citizens of the state.

The rules governing the institute of citizenship of Ukraine are contained in the Constitution of Ukraine, the Law of Ukraine “On Citizenship of Ukraine”, by-laws and legal acts, and international treaties. The legislation of Ukraine on the citizenship of Ukraine is based on the principles of a single citizenship (citizenship of the state of Ukraine), the prevention of cases of statelessness, the inability to deprive automatic acquisition or loss of citizenship of Ukraine; equality before the law of citizens of Ukraine regardless of the time and grounds for acquiring citizenship of Ukraine, as well as on the principle of maintaining citizenship of Ukraine regardless of the place of residence of a citizen of Ukraine.

Accordingly, a citizen of Ukraine is a person who has acquired citizenship of Ukraine in the manner prescribed by the laws of Ukraine and international treaties of Ukraine.

Citizens of Ukraine are:

- all citizens of the former USSR who at the time of the declaration of independence of Ukraine (August 24, 1991) were constantly living in Ukraine;

- persons, regardless of race, color, political, religious and other beliefs, gender, ethnic and social origin, property status, place of residence, language or other signs, which at the time of entry into force of the Law of Ukraine “On Citizenship of Ukraine” (13 November 1991) lived in Ukraine and were not citizens of other states;

- persons who arrived in Ukraine for permanent residence after November 13, 1991 and who entered the entry “Ukrainian citizen” in the passport of a citizen of the former USSR of the 1974 model, as well as the children of such persons who arrived with their parents in Ukraine if at this point of arrival they did not come of age;

- persons who have acquired citizenship of Ukraine in accordance with the laws of Ukraine and international treaties of Ukraine (Article 3 of the Law “On Citizenship of Ukraine”).

2. Citizenship of Ukraine is acquired: by birth, by territorial origin, as a result of citizenship, as a result of restoration of citizenship, as a result of adoption, as a result of guardianship of a child or guardianship, as a result of guardianship of a person recognized by the court as legally incompetent, in connection with the stay in Ukraine citizenship of one or both parents of the child, due to the establishment of paternity, as well as on other grounds provided for by international treaties of Ukraine.

3. Citizenship of Ukraine is lost if:

- a citizen of Ukraine after reaching the age of majority voluntarily acquired the citizenship of another state;

- a foreigner acquired the citizenship of Ukraine by naturalization and did not file in the prescribed manner a document on the termination of foreign citizenship or a declaration of renunciation of it;

- a foreigner acquired the citizenship of Ukraine and used the rights or fulfilled the duties that foreign citizenship grants or imposes on him;

- the procedure for accepting citizenship of Ukraine occurred as a result of the person presenting false information or false documents;

- a citizen of Ukraine without the consent of state bodies of Ukraine voluntarily entered the military service, to work in the security service, law enforcement agencies, justice bodies, public authorities or local authorities of another state.

Civil law is a set of norms, rules of conduct established by the state for equal entities that are endowed with subjective civil rights and subjective and civil duties in personal non-property and property relations. Civil law is a system of legal acts of various legal force, regulates civil relations. The acts of civil legislation of Ukraine are a set of structurally ordered legal norms in certain areas of legal regulation. One of the most important acts is the Civil Code of Ukraine (hereinafter CC).

2. The subject of civil law regulation is settled by her public relations, which comprise two groups of relations: personal non-property and property relations. Entering the same relationship, entities acquire property and personal non-property rights. Property relations are specific strong-willed economic relations regarding ownership, use, transfer of means of production, commodities and other material goods.

Personal non-property relations arise in connection with the exercise of personal rights for benefits that are inseparable from the person: life, health, honor, dignity, name, authorship, which individualize a person, embody its moral assessment by society.

3. The subjects of civil legal relations or participants in civil legal relations may be:

1) individuals who are citizens of Ukraine, as well as foreigners and stateless persons (a necessary condition for participation is the presence of a civil legal personality, that is, a social and legal ability to be participants in civil relations). Foreigners and stateless persons enjoy the same property and personal non-property rights as citizens of Ukraine.

2) legal entities - domestic, foreign, joint, domestic with foreign investment and others, the features of which are, in particular, that they:

- created on the basis of the law, unlike the “physical” person, created by nature and materially lives in time and space.

- exist as social reality, as a separate complex, which is an independent carrier of rights and obligations.

- are independent carriers of not only rights, but also interests that meet the interests of its founders, but are not identified with them.

- with civil legal capacity, that is, have civil rights and obligations;

- are endowed with civil legal capacity, that is, they can acquire property and personal non-property rights and bear obligations on their own behalf;

- may be the plaintiff and defendant in court.

- their activity is controlled by various means by the state.

4. Any violation of the civil rights of an individual may result in civil liability. Civil liability is a type of legal responsibility that lies in the occurrence of negative property consequences for the offender as provided by law. Civil liability has certain features in comparison with other types of legal liability. First of all, it has a predominantly property character. This is explained both by the peculiarity of the relationship, it protects civil liability - they are mainly of a property nature, and by the fact that one of the main tasks of this type of responsibility is compensation for losses, losses, restoration of violated rights. Civil liability has an additional character for the violator - after all, bringing to civil liability does not exempt from the fulfillment of an obligation, violation of which led to prosecution.

Lecture 3. Fundamentals of housing legislation (2 hours)

General characteristics of housing law.

One of the human rights enshrined in the Constitution of Ukraine is the right to housing. The procedure for satisfaction by citizens of the right to housing, housing rights and obligations of citizens is regulated by housing law.

Housing law - a set of rules governing social relations to meet the needs of citizens in housing, its use, storage, operation and repair in the state, cooperative and private housing stock of Ukraine.

Sources of housing law are the Constitution of Ukraine, the Housing and Civil Codes of Ukraine, as well as a number of laws of Ukraine, in particular the Law of Ukraine “On Privatization of the State Housing Fund”, “On the Housing Fund for Social Purpose”, “On Property”, “On Pledge”, etc. It should be noted that the Housing Code of Ukraine is one of the oldest current codes of Ukraine, it was adopted back in 1983 and requires significant changes or the development and adoption of a new housing code.

The subjects of housing relations are citizens who exercise their right to housing, as well as legal entities - homeowners.

The totality of all residential premises, regardless of the form of ownership, including residential buildings, apartments, office buildings, other residential premises in other buildings suitable for living, constitute the housing stock of Ukraine.

Now, many citizens of Ukraine have privatized their housing, getting it into private ownership. Accordingly, a new group of housing stock appeared - private housing stock. Note that, in addition to housing, there are many other premises. This is the premises of shops, workshops, office premises, etc., which are located both in residential buildings and outside them. They are intended for commercial, domestic and other non-industrial needs.

From the Housing Code of Ukraine:

Article 9. Housing rights of citizens. Citizens have the right to receive indefinite use in accordance with the established procedure of housing in the houses of the state or public housing stock or to receive, at their request, monetary compensation for their housing for the categories of citizens defined by law, or houses of housing cooperatives. Provision of permanent housing to citizens who, in accordance with the law, are entitled to receive it, can be carried out by building or purchasing affordable housing by providing state support in the manner established by the Cabinet of Ministers of Ukraine. Citizens have the right to privatize apartments (houses) of the state housing stock or to acquire them in housing cooperatives, at stock exchange tenders, through individual housing construction or to obtain ownership on other grounds provided for by the legislation of Ukraine. No one may be evicted from the occupied dwelling or limited in the right to use the dwelling except on the grounds and in the manner prescribed by law. Housing rights are protected by law, unless they are exercised contrary to the purpose of these rights or in violation of the rights of other citizens or the rights of state and public organizations.

Article 10. Residential duties of citizens Citizens are obliged to take care of the house in which they live, to use the living space in accordance with its purpose, to observe the rules for using living quarters, and to economically use water, gas, electric and thermal energy. Dwelling houses and premises cannot be used by citizens to the detriment of the interests of society.

Lecture 4. Fundamentals of labor law (2 hours)

General characteristics of the labor legislation of Ukraine.

One of the socio-economic rights guaranteed by the Constitution of Ukraine is the right to work.

Labor law regulates relations related to the labor activity of people, its subject is individual labor relations for concluding, amending and terminating an employment contract, rationing labor and its payment, working time and rest time, and the like.

A feature of labor relations is that their participants are employees and owners of enterprises or bodies or individuals authorized by them, with which labor contracts are concluded.

Labor relations arise as a result of the conclusion of an employment contract, an act of appointment issued by an authorized body (ministry, other state authority or local government), election to a post, and the like.

The main normative act in the field of labor law is the Labor Code (Labor Code). It should be noted that the Labor Code is one of the oldest among the current codes of Ukraine - it was adopted back in 1971. Now many of its standards are outdated and do not correspond to the socio-economic situation of society. That is why the Verkhovna Rada of Ukraine is considering and in the future should adopt the Labor Code of Ukraine, which will change the current Labor Code. Labor relations are also regulated by other laws of Ukraine, in particular: “On holidays”, “On labor remuneration”, “On labor protection” and others. Labor relations are regulated not only by laws, but also by-laws.

The law establishes minimum guarantees for workers. Any enterprise can provide its employees with better conditions - shorter working hours, longer vacations, additional benefits and payments, and the like. However, it is impossible to worsen the conditions of workers in comparison with the norms of the Labor Code. Any agreements, contracts that worsen the situation of workers in comparison with the norms of the Labor Code are recognized as invalid.
