Last year the Board approved a parcel map that was altering a previous map for the parcel that laid out what isknown as the Jensen Trailer Park in Tonopah. During discussions finalizing the proposed parcel map concernswere raised with the previous dedication of Sawtooth Road as a public road. The trailer park map contains adedication of roads, which dedication was accepted by the Board. The applicant disputed Sawtooth Road wasdedicated as a public road when the trailer park was created. Staff is unable to resolve the dispute, whichnecessitates review and action by the Board. Alternative actions include (1) accepting the dedication of allpublic streets on the Jensen Mobile Home Park plot plan map #4005 8 was not intended and direct placement ofnotations on the new parcel map correcting the confusion over the previous dedication or (2) requiringabandonment of the dedicated public right of way.

Doe Simpson, Smoky Valley Mining appeared before the Board to update them regardingRound Mountain and Smoky Valley Mining. Exploratian programs are ongoing, theeconomic situation is going to remain the same or perhaps improve. Expansion willrequire additional construction and personnel. They intend to continue developmentof the housing and will work with the planning department.They are considering oiling the road from the highway to the mine and the crossroadThey are requesting one piece of equipment from the county. a roller. Mr. Simpson
1asked the county to provide the roller and split the cost of the oil which would be$16,000 total for the oil. Mr. Revert stated that he doubted that the county couldhelp with the oil because of the Governor’s tax package, however the county couldassist with labor and equipment.Mr. Simpson advised that an industrial nurse is at the mine, and next week full tinsecurity coverage will be supplied. There are 14 tNT’s on the work force. He requested Chat the ambulance be located at the mine and they would answer all ambulance calls. Mrs. Logan to contact Mike Brawley and Terry Sotak regarding the proposal. If they have no objections, the coamiasfoners would have none.Discussion of the land the county is requesting from the 8124, The Mine is concernedthat the land is in conflict with the mine’s property which has been staked. Mr. Spike Fuson of Coanrenications Engineering appeared to discuss signal improvement for Nye County. ALso present were Loufe Deflamonica and Henry Valdez, representing Mineral County. Since the signals Rye County is getting are from the Cranelators in Mineral County, Mr. Fuson suggested the Nyc County work with and contribute financially, along with Esmeralda County, for better signals.Hr. Valdez presented a detailed history of the development and operation of theMineral County Television District. The equipment is old and needs to be upgraded.An overall estimate of the cost has not been prepared. Coamissioners were advisedthat additional channels would benefit Nyc County. Mr. Yates stated that Mr. JerryAllen of Esneralda had indicated to him that they would be willing to pay their!share. The Board agreed that it would be willing to authorize Nye County’s shareof the cost. A written proposal, including figures would be required.Discussion of piping music into the courthouse. Mr. Fuson stated that the project
feasible and would contact Mr. Sotak for detailsMr. Fuson also agreed to examine the possibility of translating an FM station from!LaS Vegas into Beatcy. An estimate will be prepared in advance!I4ANHATTAN CITIZENS ADVISORY COUNCILp1eecing cancelled
TONOPAI PUBLIC UTILITIESNr. Sotak stated that a one-year maintenance contract for the NCR machine at theTPU would cost $3,725.70. That includes parts and machine disfunction. The hourlyIcost would be $334 for labor. Hr. Sotak recorrmended a maintenance contract. Mr.Roud made a motion to enter into a one-year maintenance agreement, seconded andpassed.

GENERAL INFORMATION SUMMARY

Raymond G. & Grace Elaine Jensen — Owners, AP #08-261-48located in Tonopah (PM-12-0005); 2) request for one waiver as follows:a. Requested Action: Approval of the parcel map and waiver request
Property Location: Tonopah
Case History: In 2011 Public Works staff requested a legal opinion from the Nye County DistrictAttorney’s office on the status of dedications shown on the “Plot Plan Map” of the Jensen Mobile HomePark F#40058 recorded April 8, 1981. A legal opinion from Charles Watkins, Deputy District Attorneyregarding the easement dedications in the Jensen Mobile Home Park was provided to public works andplanning staff.
Portions of road right of way that were shown on the “Plot Plan Map” of the Jensen Mobile Home Parkf#40058 recorded April 8, 1981 are also shown on this parcel map application.
Nye County Code 16.20.115.A.13 Maps Form and Contents: The status of any road and/or street rightsof way previously dedicated and accepted shall be so noted with reference to the previous map orresolution wherein the road and/or street right of way was accepted.
The status of the subject road rights of way on this parcel map application are labeled as “offered fordedication and accepted per F#40058” pursuant to Charles Watkins, Deputy District Attorney’s legalopinion.
WAIVER REQUESTS
request for a waiver of the requirement to provide contour information pursuant to Nye CountyCode 16.20.115.A.6 (WV-12-0003)
Public Works staff recommends approval of the waiver request because no new road construction isbeing proposed on the application.
RECOMMENDATIONS/FINDINGS
Should you elect to approve, disapprove, or add additional conditions, based upon the staff analysis,comments received, and the site inspection, staff offers the following motion(s) for your consideration:
Motion to Approve:I move to approve the Jensen parcel map, subject to the conditions as outlined in the “Conditions ofApproval” section of this report, after having made the findings outlined in the staff report.
Motion to Disapprove:I move to disapprove the Jensen parcel map.
Findings:1. Consistency. The Parcel Map application is consistent with the goals, objectives and policies of
the Nye County Comprehensive Plan. There currently are no restrictions prohibiting thisproposal.
2. Improvements. Adequate utilities, roadway improvements, sanitation, water supply,drainage, and other necessary facilities are available, or will be provided by thedeveloper.
3. Site Suitability. The site is physically suitable for the type and intensity of thedevelopment.
Motion to Approve or Disapprove the Waiver Requests:
I move to approve or disapprove the following waiver request on the map submittal:
a. WV- 12-0003 request for a waiver of the requirement to provide contour information pursuant toNye County Code 16.20.1 l5.A.6
Nye County Code 16.20.070 WAIVERS AND VARIANCES
A. Where the Board of County Commissioners finds that strict compliance with the requirements ofthis Chapter is impracticable or the purposes of this Chapter may be served to a greater extent by analternative proposal, it may grant such waivers of document submittal requirements and variancesfrom the design or improvement standards required for approval with respect to reversions ofdivided land into acreage, boundary line adjustments, and division of land applications as may bereasonable and within the general purpose and intent of the provisions of this Chapter, provided thatthe waiver or variance shall not have the effect of nullifying the intent and purpose of this Chapterand further provided the Board shall not approve waivers or variances of the requirements unless itshall make findings based upon the evidence presented to it in each specific case that:
1. The granting of the waiver or variance of requirements will not be detrimental to the publicsafety, health, or welfare or injurious to other property nor shall the waiver or variance have theeffect of nullifying the intent and purpose of this Chapter;
2. The conditions upon which the request is based are unique to the property for which the waiveror variance is sought or would result in an opportunity for improved planning that wouldbenefit the community.
3. In addition to sections A. I and A.2 above, in the case where strict compliance with therequirements of this Chapter is impracticable the Board must also find that, because of theparticular physical surroundings, shape, topographical conditions or established use of thespecific property involved the strict adherence to the requirements of this Chapter would beimpracticable.
ROAD/STREET DEDICATION RECOMMENDATIONS
Internal street - South Prospect Street is being offered for dedication on this map. Staff recommendsaccepting the offer of dedication at this time.
Physical access to the subject parcel(s) is provided by California Avenue; a paved Nye Countymaintained street. California Avenue was quitclaimed from the Nye County Board of CountyCommissioners and Nye County Treasurer to the Unincorporated Town of Tonopah; ExchangeConveyance document prepared by William P. Beko, Nye County District Attorney and recorded onApril 6th, 1967 Book 95 Pages 286 & 287 Nye County official records.
SITE PLAN/ PROJECT ANALYSIS
The initial Jensen preliminary parcel map was received July 19, 2012 but considered an incompleteapplication due to omitted information on the map submittal. Version 1 of the map was receivedOctober 22, 2012 and considered a complete application on October 23, 2012.
The application was field reviewed by Planning & Engineering staff on July 19, 2012 and deemedincomplete. The application was field reviewed again on October 29, 2012 wherein no concerns werenoted.
The parcel map proposal creates two lots; Parcel 1A (.62 acres) with one existing mobile home & shedand Parcel 2A (3.34 acres) the Jensen Mobile Home Park. All proposed new parcels have existing waterand sewage disposal service by Tonopah Public Utilities.
The subject parcel map does not constitute a subsequent parcel map (NCC 16.20.1 80.A AdditionalRequirements: Subsequent parcel maps shall be prohibited, unless a period of five (5) years has passedfrom the recordation date of the previous map) and (NRS 278.464.6) A governing body may consider ormay, by ordinance, authorize the consideration of the criteria set forth in subsection 3 of NRS 278.349 indetermining whether to approve, conditionally approve or disapprove a second or subsequent parcel mapfor land that has been divided by a parcel map which was recorded within the 5 years immediatelypreceding the acceptance of the second or subsequent parcel map as a complete application).
The parcel is located in flood zone X (unshaded - not a special flood hazard area) FEMA FloodInsurance Rate Map #32023C4955E dated february 17, 2010.
LAND USE SUMMARY
Land Use Designation(s): There is no land use designation in this area of Nye County.
Conformance with the Comprehensive Plan: This application conforms to the Nye CountyComprehensive Plan.
AGENCY COMMENTS, PUBLIC COMMENT AND/OR PROTEST
This application was submitted to the following agencies:
Nye County Public Works/Road Department: none
Tonopah Town Manager & Tonopah Public Utilities: James Eason, Tonopah Town Manager maderecommendations of street numbers, addresses and space numbers for lots on review of the initialversion and requested that the information be shown on the parcel map. On October 16, 2012 CharlesCassano, Surveyor advised James Eason and I that he chose not to show the information the Townrequested as it is not required by Nye County Code.
The Town of Tonopah requested address, lot and block information to assist the Town, EMS, Fire,County staff and residents with addresses in Tonopah. A Nye County Street Naming & PropertyNumbering Code does not currently exist in any areas of Nye County outside the Pahrump RegionalPlanning District. Without Nye County Code in place for property numbering; staff is unable to requireaddress information on recorded maps.

APPEAL
Nye County Code 16.20.150 Appeals - An applicant or any other person aggrieved by any decisionrelating to this Chapter may appeal in accordance with Nye County Code Chapter 16.36.
Nye County Code Chapter 16.36.080 Procedures1. Appeal of Decisions Related to Parcel Maps, Final Large Parcels Maps, Tentative and final
Subdivision Maps.D. The decision of the Board is a final decision for the purpose ofjudicial review.E. Any person who is aggrieved by a final decision of the Board may appeal that decision to the
District Court by filing a petition for judicial review within twenty-five (25) days after thedate of filing of notice of the decision with the Clerk of the Board.
RECOMMENDED CONDITIONS Of APPROVAL

2. All jurat sheet signatures with the exception of the Nye County Treasurer, the Planning Directorand the Nye County Surveyor must be present prior to submission of the Mylar.
Special Conditions of Approval
3. A label at South Prospect Street shall be shown indicating “offered for dedication on this map”(NRS 278.466.3.e).

The area that will receive the mostattention due to this parcel map application is the proposed 30’ wide access and public utilityeasement. That portion of the property is relatively flat. The public utilities, (water and sewer)are already in p]ace. There will be little or no disturbance of the existing contours in this area.No activity is planned on the “uphill portion” of the proposed Parcel 2A as a result of this parcelmap application. At our meeting at the Tonopah Utilities Office August 29, 2012 you explained youraddressing system. Along with you and myself, also present, were Joe Westerlund and RayJensen. Although the system may be valuable for your purposes I do not agree that it should beincorporated on maps to be recorded.After our meeting I discussed the addressing system with Wally Boundy, long timesurveyor in Nye County and former Nye County Surveyor. Wally and I have been informalpartners for the last eight years doing most of our maps, submitted during that time, jointly.Wally was adamantly against including this information on maps to be recorded. Some of ourmaps are crowded already and we do not have room for it; secondly, the block (or range)designation is confusing and cannot be explained within the Nevada Revised Statutes (N. P.. S)and Nye County Codes that ultimately govern our maps in Nye County.We respectively submit this opinion qualified by our combined experience oPapproximately 70 years as professional land surveyors.
