188 du t r a i t é de paix,, l a d é c l a r a t io n de M. Spal&ïko -

v itoh . que l a B u lg a r ie a u r a i t r e fu s é de nommer un a r b i t r e

p o u r le T ribunal mixte devant «e prononcer s u r le s d i f

f é r e n d s su rg is e n t r e r e s s o r t i s é a n t s serbes e t bulgares

En ce qui concerne l e s doléances de M, S p a la f -

kovitch r e l a t i v e s aux pou rsu ite s des personnes accusées d 'a

v o ir commis des ac te s c o n t r a i r e s aux l o i s e t coutumes de l a

guerre , l a Bélégatêon bulgare e s t en é t a t d 'a f f i r m e r que

depuis l a s igna tu re du t r a i t é de p a ix nombre d ’o f f i c i e r s et

f o n c t io n n a i r e s bu lga res ont été t r a d u i t s devant l e s t r ib u -

naux e t condamnés nonobstan t l a d e r n iè r e p a r t ie de l ' a l in éa I

de l ’a r t . 118. Si le nembre des ju g é s n ’a pas é t é p lus grand

l ’e x p l i c a t io n do it ê t r e recherchée dans le f a i t que l a l i s t e

des ac c u sé s n ’a été rem ise au gouvernement bulgare que ré -

cemment e t que, dans 1*i n t e r v a l l e , l a Bulgarie a é té engagée

dans des p ou rpar le rs en vue d ’ o b te n i r le jugement des coupa

bles p a r l e s tr ibunaux nationaux b u lg a r e s . La D élégation bul

gare e s t heureuse de pouvoir a j o u t e r que ces p o u rp a r le r s ont

déjà a b o u t i au r é s u l t a t d é s i ré en c e qui concerne l a Grèce e t

la Roumanie.

Des d o u te s ayant é té formulés concernant la

manière d o n t l a Bulgarie s ' a c q u i t t e de ses o b l ig a t io n s r e l a

t ives à l ’o rg a n isa t io n de ses fo rc e s m i l i t a i r e s l a Délégation

bulgare s a i s i t c e t te occasion pour r é i t é r e r sa d é c la r a t io n

l u e i« g o u v e r n e m e n t b u lg a re a mis comme un point d 'honneur a

rem plir scrupuleusement l e a clause*, m i l i t a i r e s .n a v a le s e t aé

r ien n es du t r a i t é . Le a f o r c e s m i l i t a i r e s du pays prévues pa r

l e budget qui v ie n t d ' ê t r e v o té ne dépassen t par le maximum

f i x é . En même temps une grande p a r t ie d ’ armes e t de m u n i t io n

o n t é té l i v r é e s aux P u issan ces S ig n a ta i r e s du t r a i t é .

Dans c e t t e p o l i t iq u e l e gouvernement b u lg a re

a é té constamment Inspiré p a r l ' i d é e émise dans l e préambule

de l a p a r t ie IV du t r a i t é que l e s o b l ig a t io n s luijincombant

de par ce t r a i t é ne sont que l a p ré p a ra t io n d'une l i m i t a t i o n

généra le des armements de t o u t e s l e s n a t i o n s .

De ce qui p récède 3.es membtes de l a Sous-Com-

m isa ie n Voudront bien se p e rsu a d e r que l a Bulgarie a non seu

lement donné d e s g a ran t ie s e f f e c t iv e s de son in ta t io n s in c è re

d* observer s e s engagements tmais que su r nombre de p o in t s l e

gouvernement bu lgare e s t d é j à en tré dans l e domaine des r e a -J-tff m _

l i s a t io n s ^ c o n t r a c té e s . A

Aussi la D é lég a t io n bu lgare a im e - t - e l l e à c ro i

r e que la demande de la B u lg a r ie d ' ê t r e admise au s e in de l a

S o c ié té des N ations t ro u v e ra un accueil favorab le a u p rè s des

membres de 1 ’ Asseâblée.

In Addition to the s ta te m e n t la id by th e Bulgarian

D e leg a t io n before th e Sub- Committee over which Your E xcellen

c y p r e s id e s and in r e p l y to the q u e s t io n s r a i s e d during the

s i t t i n g o f Wednesday la®t,we have th e honour to communicate

the fo l lo w in g supplementary in fo rm a t io n .

As regards the carry ing o a t of a r t i c l e 188 of the

Peace T r e a t y , the s ta tem en t of Mons. S p a la ik o v i tch th a t BulgaS

r i a h as re fused to nominate a member to the Mixed A rb i t ra l

T r ibuna l which s h a l l decide a l l q u e s t io n s w ith in i t s compe

tence u n d e r Sections I I I , IV,V,VII and V II I ,a s between S erb ian

and B u lgar ian eubjec ts ,m u e t be due to some m isunderstanding.

The d i f f e r e n c e in o p in io n between th e two Governments does

not a f f e c t the c r e a t i o n of the T r ib u n a l i t s e l f , but werely

concerns the place where the members of the T r ib u n a l are to

meet. While the Governement of the Serb-C roat-S lovene S ta te

propose Belgrad jo r t h i s pu rpose ,B u lgar ia esteems that i t

wonld be b e t t e r to f e l lo w the p reced en t c rea ted by Greece and

Roumania and to e n t r u s t th i s ta sk to the a r b i t r a t o r s who are

to e i t i n P a r is Unnecessary expenses w i l l thus be avoided

through the reduc tion of the p e rso n n e l .

Concerning th e complaint o f Monsieur S p a la ikov itch

about th e d e l iv e ry o f l i v e - s to c k u n d e r a r t . 127 o f the Peace

This Commission ,however,hos not yet met a t S o f ia ,w ith o u t

Bulgaria being in any way answerable f o r the delay.

With respect to a r t . 125 which d e a ls with th e r e s

t i t u t i o n of o b jec ta of any n a tu re and s e c u r i t i e s t a k e r away,

se ized or s e q u e s t r a te d in the t e r r i t o r y invaded in G reece ,

Roumania or S e rb ia , th e com p la in ts of Monsieur Spa la ikov i tch

are equally unfounded. The a r t . in q u e s t io n lays down as p re

l im inary c o n d i t io n the communication by the Government a t

Belgrade of a l i s t of the o b je c ts and s e c u r i t i e s which can be

id e n t i f ie d Such a l i s t had u n t i l quite r e c e n t l y not y e t been

rece ived in S o f ia . On the o th e r hand,the o b l ig a t io n which a r-

t i d e 125 l a y s on Bulgaria to p a s s a i t h i n three months from

the coming i n t o force o f th e Treaty of N e u i l ly (9 th August

1920 ) has been a lready complied with by the Bulgarian Gover

nment .

The Bulgarian D e leg a t io n esteem s i t n ec e ssa ry to

add tha t f a r from w aiting fo r compliance with f o r m a l i t i e s of

procedure o r fo r e x p i r a t io n o f s t i p u l a t e d d e lay s , th e Bulga

r i a n Government haa in some re sp e c ts h a s te n e d the performance

o f i t s o b l ig a t io n s under the Treaty. Numbers of o b j e c t s and

s e c u r i t i e s which could be e a s i l y i d e n t i f i e d have been a lread y

re tu rn e d . More e s p e c ia l ly as regards the r o l l i n g stock, ta k e r

during the o ccu p a t io n ,th e Bulgarian a u t h o r i t i e s have re tu rn e d

to the Serb-Croat-S lovene S ta te hundreds of railway t ru c k s

and scores o f engines. In consequence o f a l e t t e r from géné

r a l de Fourtoux, head of the I n te r - A l l i e d M il i ta ry M iss ion at

S o f ia . r e q u e s t in g tha t such r e tu r n s sohould be stopped u n t i l

the a r r iv a l o f the I n t e r - A l l i e d Commission,this p r a c t i c e was

f o r a time i n t e r r u p t e d ; - b u t i t w il l be again resumed as in

a subsequent communication genera l de Fourtoux has e x p la in e d

t h a t l e t t e r d id not apply to the r o l l i n g s to ck .

As re g a rd s the com plaint of Monsieur S p a la ik o v i tc h

about the p e rso n s accused of having committed ac ts in v io l a

tion o f the laws arid customs of w a r , the Bulgarian Delegation

is in p o s i t i o n to d e c la r e th a t s in c e the s ig n a tu re of the Pe

ace T re a ty numbers o f o f f i c e r s and o f f i c i a l s have been a r r a y

ed b e fo re the law c o u r t s and sen ten ced no tw iths tand ing the

l a s t p a r t of paragraphXof a r t . 118. I f the number i s not b ig

ger, th e reason must be sought in th e c ircum stance tha t the

l i s t o f the accused was communicated to the Bulgarian Govern

ment o n ly q u i te r e c e n t ly and th a t du r ing the i n t e r v a l Bulga

r i a was occupied in n e g o t ia t in g f o r the judgement of the

g u i l ty p a r t i e s by the Bulgarian la w -c o u r t s . The Bulgarian De

l e g a t io n i s happy to be able to s t a t e th a t theoe n e g o t ia t io n s

have a l r e a d y led to th e desired r e s u l t in the c a s e with Gree-

and Roumania.

Dou& hav ing been exp ressed about the way in which

B ulgaria was performing i t s o b l ig a t io n s concerning the orga

n i s a t i o n of i t s m i l i t a r y f o r c e s , the Bulgarian D elegation ava

i l s i t s e l f of the p re s e n t o p p o r tu n i ty to r e i t e r a t e i t s former

s ta tem ent t h a t the B u lga r ian Government has made i t a point

of honour sc rupu lous ly to comply w i th the m i l i t a r y ,n a v a l and

a i r c l a u s e s . The m i l i t a r y forces o f the country as fixed by

the r e c e n t l y passed budget do not exceed the maximum s t i p u l a

ted . At th e same time g re a t q u a n t i t i e s of arms and ammunition

have been de livered to the Powers s ig n a to r y of th e Treaty. In

pursuing t h i s policy, the Bulgarian. Government h a s been cons

ta n t ly in s p i r e d by th e idea, form ulated in the preambule of

Part IV of the Treaty, t h a t the o b l ig a t io n s which the Treaty

lays on Bulgaria are on ly a step tow ards the g é n é ra l l im i t a

t ion of th e armaments of a l l c o u n t r i e s .

The members of the Sub-Committee w i l l s e e from what

precedes t h a t Bulgaria has not only g iven e f f e c t i v e guaran

tees of i t s sineere i n t e n t i o n to obse rve i t s o b l i g a t i o n s ,but

th a t in many re sp ec te the Bulgarian Government h as a lready

begun to c a r ry out th e assumed o b l ig a t io n s .U n d e r these c i r -

oumatancea th e Bulgarian D e lega t ion v e n tu r e s to hope that, the

re q u e s t of B u lg a r ia to be adm itted to th e membership o f the

League of N a t io n s w i l l meet w i l t a fav o u rab le r e c e p t io n on

the part of the members o f the Assembly.

As regards the carrying out o f a r t ic le 188 of the

Peace T reaty ,the statement of Mons. Spolaikovltch that Bulga*

r la has refused to nominate a member to the Mixed Arbitral

Tribunal which sh a ll decide a l l q u estion s within I t s compe

tence under Sections III,IV ,V ,V II and VIII,ae between Serbian

and Bulgarian subjects,m ust be due to some misunderstanding.

The d if fe r e n c e In opinion between th e two Governments does

not a f f e c t the creation o f the Tribunal I t s e l f , but merely

concerns the place where the members o f the Tribunal are to

meet. While the Governement of the Serb-Croat-Slovene State

propoee Belgrad $or t h i s purpose,Bulgaria esteems that It

would be b e t te r to f e l lo w the precedent created by Greece and

Roumanie, and to entrust th is ta e l to the a rb itra to rs who are

to e l t In P a r is . Unnecessary expenses w i l l thus be avoided

through the reduction o f the personnel.

Concerning the complaint o f Monsieur Spalalkovitch

about the delivery o f l iv e - s to c k under art, 127 o f the Peace

Treaty,the Bulgarian Delegation ventures to draw the atten

tion of the members o f the Sub- Committee to the fa c t that

Do util having been expressed about the way in which

Bulgaria wae performing i t e o b lig a t io n s concerning the orga

n is a t io n of Ite m il ita r y fo rces ,th e Bulgarian Delegation ava

i l s I t s e l f o f the present opportunity to r e i t e r a t e i t e former

statement that the Bulgarian Government has made i t a point

of honour scrupulously to comply w ith the m ilitary ,n ava l and

air c la u s e s . The m il ita r y forces o f the country, as fixed by

the r e c e n t ly passed budget, do not exceed the maximum s t ip u la

ted. At the same time great q u a n t it ie s of arms and ammunition

have been delivered to the Powers s ignatory of the Treaty. In

pursuing th is policy, the Bulgarian Government has been cons

tantly Inspired by the idea, formulated in the preambule of

Part IV o f the Treaty, that the o b lig a t io n s which the Treaty

lays on Bulgaria are only a etep towards the généra l l im ita

tion o f the armaments o f a l l c o u n tr ie s .

The members of the Sub-Committee w il l s e e from what

precedes that Bulgaria has not on ly g iven e f f e c t iv e guaran

tees of i t s sincere in te n t io n to observe i t s o b l ig a t io n s ,but

that In many respects the Bulgarian Government has already

begun to carry out the assumed o b li gat ion s . Under these c ir -
