MEETING OF THE BOARD OF MEDICAL EXAMINERS OF THE STATE OF NORTH CAROLINA The Velvet Cloak Inn and the Raleigh Civic Center Raleigh, North Carolina December 4-8, 1977 The Board of Medical Examiners of the State of North Carolina met at The Velvet Cloak Inn and Raleigh Civic Center on December 4-8, 1977 for the purpose of administering examinations for licensure, interviewing applicants for license by endorsement of credentials, and conducting other business. Drs. E. Wilson Staub, President, Charles B. Wilkerson, Jr , Secretary-Treasurer, Bruce B. Blackmon, David S. Citron, Bryant L. Galusha, J. Jerome Pence, Jr. , Joyce H. Reynolds were present. Also present were Mr. Bryant D. Paris, Jr. , Executive Secretary, Mrs. Betty Joe Barick, Assistant Executive Secretary, Mrs. Diane G. Dr. Staub advised the Board he had contacted the Governor's Inn and it appeared to be a good location for the meeting. Dr. Citron moved that the March meeting be held at the Governor's Inn at the Research Triangle Park, N. C. , n the same dates as already set. , if and when satisfactory arrangements can be made. Seconded by Dr. Galusha and duly passed. RE: Dr Karl K Namv Havre De Grace, Md. Board discussed Dr. Namvary's application for license by endorseement of credentials, and his pending malpractice suit and his being indicted, tried and found guilty' on 38 counts of false pretense regarding Medicaid payments, and his not advising the Board of any of this infor- mation in his application for licensure, nor in his personal interview before the Board. Dr. Pence moved that Dr. Namvary's application for licensure be denied. Seconded by Dr. Wilkerson and duly passed. Executive Secretary instructed to sub- mit this information to the Federation of State Medical Boards, the American Medical Association and any other agencies that are usually notified of this"information. Executive Secretary instructed to get the necessary information from the appropriate people in State government regarding the State's longevity pay plan, and present this to the Board at the January, 1978 meeting. Meeting adjourned until 11s00 a. m. , Monday, December 5. REs Re rt of m etin of oint subcommittee —Board of Medical Examiners andBoard of Nursing. Dr. Citron reported that the subcommittee had approved two newprograms for registered nurses performing med1cal acts: University of South Carolinaat Spartanburg and the Medical College of Virginia PNP program, Richmond, Virginia.This brings the total of approved programs considered by the joint subcommittee to 21.

Also discussed in this meeting was the "Proposed Memorandum of UnderstandingRegarding Physician Extenders" prepared by Dr. Harvey Estes, wh1ch will be discussedfurther at the January subcommittee meeting. Also, a liaison committee from the N. C.Medical Society and the N. C. Nurses' Association has been formed to consider theissue and problems regarding the 1977 legislation for FNP's and assistants to physicians.The subcommittee plane to request a written report from this committee following itsmeeting later in December. In addition, the subcommittee discussed the upcomingFederation of State Medical Boards meeting at which meeting the three members onthe joint subcommittee from the Board of Medical Examiners (Drs. Citron, Pence andReynolds) will present a program dealing with the "processes, problems and pitfalls"and the future potential for physician extenders.

REs Offic of Em r n Ne 1 al S ice —Mr. Chris Gentile and Colonel CharlesSpeed, Chief of the Office of Emergency Medical Services, appeared before the Boardto discuss the information and action taken by the OEMS regarding the performanceof certain medical acts by the Assistant Chief of the Ce'eenville Fire and RescueDepartment. Nr. Gentile reviewed correspondence on this matter and the eventsleading up to it. Mr. Gentle to%3 the Board that tne OEMS has the authority toissue a certification to an EMT, which the Board of Medical Examiners does notreview, but the rules and regulations as of this date do not cover revocation ofthat cert1fication. However, he indicated that regulations are being prepared andare in committee of the Advisory Council to be transmitted to the North CarolinaMedi. cal Care Commission regarding the revocation of EMT certificates when necessary.One of the regulatione would cover revocation of certification when an EMT hasperformed functions outside of the purview of a basic EMT certification.

Nr. Gentile also requested that the Board, i.f they are in agreement, appointone of their members to serve as a liaison representative to the Office of EmergencyMedical Services. He said he and Dr. Herbert Proctor, Clinical Director for theOEMS, both felt it would be very helpful to have at least one Board member to dis-cuss problems and questions with either before presenting them to the full Board,or even sometimes avoid having to involve the full Board in a minor problem orquestions. Dr. Joyce Reynolds was appointed, and agreed to serve, as liaisonrepresentative, and the President of the Board, Dr. E. Wilson Staub, vill assi. stif needed or in Dr. Reynolds absence.

RE: A si tant to sicians —statement of understanding regarding thecurrent status of assistants to physicians and registered nurses performing medicalacts. Dr. Citron moved that the statement be accepted, with the deletion of theword "of" on the second line from the bottom and the deletion of the initials "P.'A "and "N.P ~" wherever used, as submitted by Dr. Staub. Seconded by Dr. Pence andduly passed. (statement attached to these minutes)

The following is, a,statement of policy of the Board of Medical Examiners with

respect to the approval of applications of assistants to physicians and registered: nurses . performing medical acts approved under the General Statute 90-18 (13) and

'(«):Applications for assistants to physicians and registered nurses performinq

medical acts shall be accompanied by the standing orders which each will

use whenever performing medical acts without prior communication and

approval of the supervising physician. The independent administering and

prescribing of medi cations are limited by the formulary already anprnved

by the Board. The Board will not approve an application unless the Board

is satisfied with the nature and extent of the standing orders .

The foregoing requirement shall apply to all initial applications and to allapplications for annual re-registration. No standing orders shall be filed unlessthe standing orders have been approved by the Board.
