0l2. The officers are entitled for fixation of pay as per the provisions of CCS(Revised Pay) Rules, 2008 and the MACP guidelines.

03. The 3o/o pay fixation benefits extended on account of Ad-hoc promotions toJTS of ISS vide this Ministry OM No. 12039 IOI l2Ol3 - SSS dated 20thApril 2OLLmay be recovered with all consequential benefits in the light of subsequent OM No.12039 | OI I 2Ot3 - SSS dated 6th Januaryr 2014, if any, before extending thefinancial benefits under 3.4 MACP.

o,4. The Participating Ministries / Departments / Oryanizations of SSS arerequested to fix the pay under higher Grade Pay after due verification of elieibilitvcondition of MACP from the service records of the officers.

Orders relating to 2nd and 3'd MACP, if any, in GP of Rs. 4800 and Rs.5400in respect of these incumbents may be treated as cancelled.

06. The Participating Ministries / Departments I Orgartizations of SSS are

requested to ensure that officer placed in the higher Grade Pay under MACP, is not,rrrd"t suspension or no charge sheet has been issued or no disciplinary Progee{ingor prosecrttiott case for criminal charge is pending against him as on date of MACP.

07. The officer, if any, who is under currency of penalty, will be placed in the nexthigher Grade Pay only on expiry of that period.

The undersigned is directed to refer to this Ministry's OM of even number dated20th April ?011 vide which it was clarified that 3olo pay fixation benefit is allowed to lhoseincumbents of $$$, who have been granted 1'r ?n0 or 3* MACP in the GP of Rs. 4800and Rs. 5400 {PB-z} and subsequently they were promoted as Assistant Director (JT$of l$S) in the GP of Rs. 5400 (PB-3).

2. The above issue has been re-examined in consultation with DOP&T and Ministryof Finance and it has now been decided that:

(i) The OM of even number dated 20th April 20t 1 {Copy enclosedf standswithdrawn with retrospective effect from the date of issue and the benefit of 3o/o

pay fixation shall not be admissible, on account of promotion as JTS of l$S in GPof Rs. 5400 (PB-3), even on change of Pay Band, in the light of condition 4 ofMACP Scheme. However, only the difference of GP, if any, shall be payable.

(ii) The'excess payment, already made shall be recovered from the coneernedincumbents in three equal rnonthly installments, In case an official is going to$uperannuate earlier, the duration of recovery may be reduced accordingly.However, it may be ensured that the excess payment, in any case, has to berecovered before his superannuation.
