tempt, lint the authorities agree inthe main that in order to sustain thecharacter of a constructive contempt,the publication must have a tendencyto obstruct or hinder the progress ofjustice in some particular case.

Were we to Proceed alone uponthe common law, the contention ofthe counsel for respondent wouldseem to be sustained by authority.

liut we have a statute which, sofar as we have learned, is peculiar tothis country, and which describesand enumerates certain acts and circumstances as contempts and makesthem punishable upon indictmentand conviction by a jury and alsosummarily. These acts are not classi-fied in the statute as direct and con-structive contempts. Some of theseacts would fall under one head andsome under the other as generallyclassified. By our penal law, how-ever, they are all contempts and pun-ishable either su mmarily or upon in-

dictment or in both ways.The Legislature in enacting the

law of 1888 bad in mind, withoutdoubt, the then recent cases decidedby this Court in which certain pub-lications, avowedly not of the char-acter enumerated in the Penal Codeas contempts, were construed by theCourt to be contempts, and these theLegislature declared to be no longerpunishable as such. The first andthird sections of the act of 1888strengthen this view.

The publication in question declares in substance that certain Justices of this Court now in office areguilty of an nnexpiated crime, andare therefore unworthy to sit in judgment upon others, thus attacking theJ ustices in the exercise of their ludicial functions. This language fitsexactly the words of the statute. It is" publishing of malicious invectivesagainst a Court tending to bringsuch Court (and) or the administration of justice into ridicule, contempt, discredit or odium." DISSENTING OPINION OF M'CULLY, J.The statute authority for treating

this publication as a contempt ofcourt is the clause in Section 18 ofChapter 29 of the Penal Code. Quoting from the semi-colo- n it reads thus :" ; or by knowingly publishing anunfair report of the proceedings of acourt, or malicious invectives againsta court or jury or the administrationof justice into ridicule, contempt,discredit or odium, snail be punished," etc.

It is contended by the Attorney- -General and it is the view of theCourt that these words, the latterpart particularly, apply to the articlepublished by the defendant, in thatit tends to bring the court and theadministration of justice into contempt, etc. But in my view theycannot be considered to apply tolibelous words published in respectto the justices of the court chargingthem with unfitness to hold office andtry cases, in a general way and notwith reference to a pending case.Bishop on Crim. Law, bee. 245, Vol2, gives this summary of doctrine:" According to the general doctrineany publication, whether by partiesor strangers, which concerns a causepending in court,and has a tendencyto prejudice the public respectingits merits and to corrupt the administration of justice, or which reflectson the tribunal or its proceedings oron the parties, the jurors, the witnesses or the counsel, may be visitedas a contempt." . This language iscited by Lawrence, C.J., in the People vs. Wilson, 64 111., p. 213, as thecommon law definition. See alsoBishop, Sec. 253 of Vol. 2. It is ne-cessary in order to bring the case atbar within our statute to hold thatit goes beyond the common law doc-trine and beyond the usual statutesbased upon the common law. Butthese statutes have never extendedthe power of courts and judges inregard to contempts but have ratherlimited power.

In my view the context of our statute does not support a constructionthat publications charging a generalunfitness or a general corruption ofthe persons holding the judicialoffice can be treated as contempts ofcourt. And this view is confirmedby what I have quoted above as thecommon law doctrine, for I do notbelieve that a modern statute wouldhave been allowed to extend a powersomewhat odious. The section (18)refers in the beginning to a judge orjustice in the lawful exercise of hisjudicial functions; every otherclause in it refers to proceedings inor of a court in pending businessunless the latter part of the clausefirst cited and relied upon in thiscase can be detached from all therest of the section, and it closes bythe proviso that every judicial tri-bunal acting as such, and everymagistrate acting by authority oflaw in a judicial capacity may sum-marily punish for contempt. In theclause in question the term used iscourt (or jury) by which can only beunderstood the tribunal and not thepersonal jiidgo, and that it is a mali-cious invective upon its proceeding

! and tending to bring the administration of justice in a case (for onlyin cases as they occur do courtsadminister justice) into contempt,ridicule, discredit or odium. Itwould certainly require 6ome ex-plicit distinction from the other pro-visions of the section in which it isincorporated to show that it intendsa distinct province of contempt.

This article refers to no case andto no court in the exercise of itsjudicial functions.

tween the natives and the Spanishtroops. They attacked the latterunawares, and killed ninety Spani-

ards, including soldiers and Chil-

ians. Tltie natives have shown allthrough this contest a determina-tion to maintain their freedom andto punish the invaders, who, theyclaim, have no right to enter theirterritory with the purpose of sub-jagatio- n.

Such a people, as thePonapeans have shown themselvesto be, deserve their freedom, andmight gain and maintain it werethere any friendly power, to standin the breach and assist them.

On the sworn information of theAttorney-Genera- l the respondent

. was cited to appear before the Courtto show cause why he should not beadjudged guilty of a contempt ofCourt for the publication of an arti-cle in a newspaper published inHonolulu called Ka Leo o Ka La-hui- ,"

in its issue of February 5thinstant.

On the 11th of February respondent moved that the rule be discharged on the grounds:

1. The act complained of in thepetition upon which said rule isbased, is not in law, a contempt ofCourt for which this Court haspower to punish this respondent.

SL This Court cannot legallypunish as for a contempt a publica-tion of the nature of that hereincomplained of made in a newspaperand not done in the immediate presence of the Court.

" 3. No publication out of Courtin relation to the Court or to any ofits individual members amounts, inlaw, to a contempt and the samecannot be punished as such.

4. It is nowhere alleged or inti-mated in said petition or in the ruleissued in pursuance thereof, thatsaid publication was made while thisHon arable Court was sitting as such,nor that said publication was de-signed, or calculated, or had anytendency to obstruct, embarrass orprevent the due administration ofjustice.

"5. If this respondent were in factthe publisher of, or legally respon-sible for said publication, which hedoth in no wise admit to be true,then such fact and offense involvedtherein, are matters concerningwhich this respondent is by the Con-stitution and the statute law entitledto a trial by a jury of his peers."

BY THE COURT.

The Legislature of 1888 enactedthat thereafter constructive con-tempts should not be punishable assuch. It is claimed by the attorneyfor the respondent that the publica-tion of the article in question, if acontempt at all, is a constructivecontempt and is therefore not pun-ishable.

Contempts are generally dividedby jurists into the classes of directand constructive; direct being thosecommitted in the presence of theCourt and constructive being thoseacts which the Court would have toconstrue by some process of reason

sion in the mind of the public inregard to the matter of the opinionof the Justices of the Supreme Courton the Cabinet question the followingstatement is given:

" On the 16th instant, the Cabinetof His late Majesty sent a request tothe Justices of the Supreme Courtfor an opinion upon the questionwhether the Qneen-wa- authorizedby the Constitution to request theirresignations and was free to appointa new Cabinet. .

" On the 17th the CabTnet askedthe Justices to suspend their replyuntil they should be notified to pro-ceed with it- - In the forenoon ofWednesday, the 25th, the Cabinetasked the Justices to proceed withthe consideration of the question.At about 2:30 p. M.the opinion ofthe Justices was handed to the At-torney General, and thereupon theCabinet sent in their resignation tothe Queen, who then appointed andcommissioned a new Cabinet, as fol-

The first difference is the changefrom the King's Cabinet " to theCabinet." One was literally " theKing's," responsible to him. Theother is the people's," responsibleto the Legislature.

The distinction is so radical audmarked, that the meaning cannotbe mistaken.

Under the old Constitution theMinister's held office " during HisMajesty's pleasure;" under thenew one they "shall be removedby him only upon a vote of want ofconfidence."

That the Judges could not perceive the fundamental difference inthe provisions, and plain intent, ofthe present Constitution, is almostpast understanding.

best known to the Judges of theSupreme Court, in giving theiropinions in the Cabinet matter, themajority have disregarded precedent, and have not signed theirreply.

This is not a judgment of theCourt, but a matter of their indi-vidual opinions. Are they, or isany one of them, ashamed of theiror his part in the matter?

In judgments even, where a ma-

jority decide cases, the name of thedissenting justice is always given.And generally he states his groundsof dissent.

The public are entitled to fulland frank action in this matter.

Evasion and shirking of respon-sibility should be beneath the dig-nity of a judge of the SupremeCourt. Citizen.
