APPLICATION OF AVIOR Al LINES, C.A. FOR AN AMENDED EX MPTION

By Notice of Action Taken by the Departm nt on December 6, 2006, 1 Avior

Airlines, C.A. ("Avior'') was granted exemption authorit to engage in scheduled foreign air

transportation of persons, property and mail between I Barcelona, Venezuela and Miami,

FL. Since that time, and despite the economic hardship! and difficulties faced in Venezuela,

Avior, a private airline, has managed to maintain itsl service and provide an important

benefit to the traveling public. Avior requests this exe ption authority be amended so it

may operate scheduled foreign air transportation o person, property and mail from

Caracas, Venezuela, to Miami, Florida in order to uti ize new aircraft that are unable to I

operate to Barcelona. This additional exemption aufhority is consistent with the U.S.-

Venezuela Air Transport Agreement of August 14, ~953 ("Agreement") and with the I

broader public interest.2 !

In support of this application, Avior states as f~llows: 1. Avior currently holds exemption authorif y to conduct:

a. scheduled foreign air transportat1tn of persons, property, and mail between Barcelona, Venezuela, a d Miami, Florida, either directly or via intermediate points in other co ntries, with or without stopovers;3

b. charter foreign air transportation of persons, property and mail, between any point or points in Ven zuela and any points in the United States, directly or via intermediat points in other countries, with or without stopovers, and beyond; an other charters pursuant to 14 CFR Part 212 of the Department's regul tions.4

Specifically, Avior requests the Depart~ent amended its scheduled foreign I

air transportation exemption to provide services as fol ows:

3. Avior requests this additional exempti9n authority because of its plans to

move its operations to Simon Bolivar International Airport ("CCS") due to the inability of

General Jose Antonio Anzoategui International Airpo~ ("BLA") to accommodate Avior's

two new Airbus 340-300 aircraft, which it plans to use far its US operations. Specifically,

the runway at BLA cannot accommodate an A340 an9 expansion plans for the runway at

BLA have been delayed. Avior requires this limited a~endment to its traffic rights in order I

to maintain its continued operations to the U.S.

4. Avior is a 22-year old, privately owned ~enezuelan company and receives

no financial assistance from the Government of Vene~uela. All of its outstanding shares

are held by Jorge Aftez Dager, a citizen of Venezuel~. As a privately owned company,

Avior is not associated with the Government of Venez~ela. i

5. The proposed exemption authority is fonsistent with the public interest. I

Granting Avior's request for expanded service will telp a privately-owned enterprise,

provide needed competition in the U.S. - Venezuela lmarket and will assist in promoting I

the local Miami economy. It will also enhance service pptions for travelers.

6. Although Avior acknowledges some of lhe difficulties that have been faced

by U.S. carriers serving Venezuela, the public interest .nevertheless supports granting this i

application, which is limited in scope and driven[ by commercial and operational i

exigencies. It should be noted that the Governmen~ of Venezuela recently approved i

Dynamic International Airways' application to condubt passenger flights between New I

i

York (JFK) and CCS. On August 2, 2016, DOT appr~ved the Application of Transcarga i I

International Airways to conduct certain Venezuelatu.s. all-cargo charter operations

based on reciprocity established by the Venezuelan! government. As Avior has been

serving the U.S. market for over 10 years, this is m~rely a continuation of an existing

service, with the amendment required to enable Avior to maintain a viable U.S. operation, i

and to service the growing needs of American corp~rations like Chevron with a strong !

presence in the oil market

7. Avior holds an Aircraft Operator Ce~ificate ("AOC") from the Institute

Nacional de Aeronautica Civil - Venezuela ("INAC"), w~ich has regulatory jurisdiction over i

the carrier. INAC's address is Urb. Altamira Sur, Av. ~ose Felix Sosa c/ Av. Luis Roche, I

Torre Britanica de Seguros, Pisos 2 al 8. Chacao, Car~cas 1060, estado Miranda.

8. Avior has a strong management team. !~formation on all directors, officers, !

and key management personnel is located in Exhibit ~·

9. Attached in Exhibit B is a list of aircr~ift 100% owned and operated, by I

Avior. Avior's aircraft are maintained in Venezuela ~Y Avior and in Miami, Florida by I

Miamitech. I

12. Avior has insurance coverage that m~ets or exceeds the liability limits of I

13. Avior has had no fatal accidents or tari~ violations in the past five years. I

14. Avior's current Air Operator Certificate is attached in Exhibit E. !

Avior will continue to conform to the statutory provirions and the Department's rules,

regulations, and requirements and will accept and ,bide by all terms, conditions, and

limitations that the Department normally attaches to F?reign Air Carrier Permits.

WHEREFORE, for the foregoing reasons, A~ior respectfully requests that the

Department grant the requested amended exemption ~uthority. Avior further requests any i
