• Provided that the person conducting ultrasonography on a pregnant woman shall keep complete record thereof in the clinic in such manner, as may be prescribed, and any deficiency or inaccuracy found therein shall amount to contravention of provisions of section 5 or section 6 unless contrary is proved by the person conducting such ultrasonography;

5. Written consent of pregnant woman and prohibition of communicating the sex of foetus.

1. No person referred to in clause (2) of section 3 shall conduct the pre-natal diagnostic procedures unless—

(a) he has explained all known side and after effects of such procedures to the pregnant woman concerned;

(b) he has obtained in the prescribed form her written consent to undergo such procedures in the language which she understands; and

(c) a copy of her written consent obtained under clause (b) is given to the pregnant woman.

2. No person including the person conducting pre-natal diagnostic procedures shall communicate to the pregnant woman concerned or her relatives or any other person the sex of the foetus by words, signs or in any other manner.

6. Determination of sex prohibited.- On and from the commencement of this Act,—(a) no Genetic Counselling Centre or Genetic Laboratory or Genetic Clinic shall

conduct or cause to be conducted in its Centre, Laboratory or Clinic, pre-natal diagnostic techniques including ultrasonography, for the purpose of determining the sex of a foetus;

(b) no person shall conduct or cause to be conducted any pre-natal diagnostic techniques including ultrasonography for the purpose of determining the sex of a foetus;

(c) no person shall, by whatever means, cause or allow to be caused selection of sex before or after conception.

• Why the case is not registered against the doctor who

conducted the ultrasound????

• Why was the fetal ultrasound done??? The kidney bladder scan which has been asked has not been done properly.

• Whole abdomen scan which has been asked has not been done at all

• Fetal ultrasound which has not been asked has been done in full detail.

Rule 9. Maintenance and preservation of records• All case related records, forms of consent, laboratory

results, microscopic pictures, sonographic plates or slides, recommendations and letters shall be preserved by the Genetic Counselling Centre, Genetic Laboratory, Genetic Clinic, Ultrasound Clinic or Imaging Centre for a period of two years from the date of completion of counselling , pre-natal diagnostic procedure or pre-natal diagnostic test, as the case may be. In the event of any legal proceedings, the records shall be preserved till the final disposal of legal proceedings, or till the expiry of the said period of two years, whichever is later.

• 1) Question asked to C.D.M.O via R.T.I act • 1. According to provision of PNDT Act any

inaccuracy/deficiency in Form"F" is taken as a direct evidence of Sex determination. As per Distt.NW's letter dtd.11.7.8 to Dr.Nitin Seth it is clear that Form"F" was not filled up in Pre-natal ultrasound done on me. On what basis has enquiry comited stated that there is no evidence (direct/circumstantial) of sex determination.

• 2. Why has the Appropriate Authority & Enquiry Committee not taken note of breach of P.N.D.T.(ammendment) act, that the necessary declaration on the Ultrasound report by the concerned Radiologist is not given on the report.

• 3. What excuse has been given for doing the fetal Ultrasound when only K.U.B. Ultrasound was ordered.Which condition specified by Central Supervisory Board explains the need for doing Fetal Ultrasound in my case.

Answer to R.T.I

• Reply under RTI Act 2005 of letter received on 3/1/2009• 1. The Enquiry committe has very categocically stated

under the heading 'Important Findings‘ that Form 'F' for the case in question is not traceble. Apart from this there was no other evidence to suggest Sex Determination.

• 2. No declaration is given on USG report. It is to be given in Form 'F'n which was not traceable.

• 3. No excuse has been given, filled Form 'F' was not available to comment on condition as specified Central Supervisory Board for doing Ultrasound.

• In short_• There is no form F filled up• My name is not in district records also• Nobody has asked for fetal ultrasound. What

has been asked has not been done • My husband has signed an aggreement that

he will never again ask me or force me to undergo sex determination or sex selcetive abotion in future.

• My first complaint to police is before the birth of children, that I am bieng harrassed for abortion, and my life , and my pregnancy are in danger in my in laws house

• And yet according to authorities there is no direct /circumstantial evidence of sex determination???????

• Than what evidence are the authorities looking for??????
