A PROCLAMATION TO AMEND THE COMMERCIAL REGISTRATION AND BUSINESS

LICENSING PROCLAMATION '

WHEREAS, it has became necessary to amend the Commercial Registration and Business Licensing Proclamation No. 686/20 I 0;

NOW THEREFORE, in accordance with Article 55( I) of the Constitution of the Federal Democratic Republic of Ethiopia, it is hereby proclaimed as follows:

1. Short Title

This Proclamation may be cited as the "Commercial Registration and Business Licensing (Amendment) Proclamation No. 801/2013".

2. Amendment

The Commercial Registration and Business Licensing Proclamation No. 686/2010 (as amended by Proclamation No. 731/2012) is further amended as follows:

1/ sub-article (6) of Article 6 of the Proclamation is deleted and replaced by the following new sub-article (6):

"6/ Any person viho, whether registered or not registered in the commercial register in accordance with the laws which were in force prior to the coming into force of this Proclamation, has been carrying on a commercial activity under a license from any government body, shall be registered within 12 months from the effective date of this Proclamation; provided, however, that the Ministry may undertake registration

in cases where in relation to investment p~jects or due to adjudication of disputes or due to other cases deemed appropriate by the Ministry the registration has not been made within the 12 months period."

2/ sub-article (7) of Article 10 of the Proclamation is deleted and replaced by the following new sub-article (7):

"7/ the title deed of his business premises, if he owns it, or the authenticated contract of lease, if it is leased, or where such requirements could not be fulfilled, a written verification of its address from the local administration."

3/ sub-article (1) of Article 18 of the ~roclamation is deleted and replaced by the following new sub-article (1):

"1/ Renewal of commercial registration shall be made for every budget year or for the future five budget years altogether, within the budget year following the expiry of the period of registration or renewal."

4/ sub-article (5) of Article 30 of the Proclamation is deleted and replaced by the following new sub-article (5):

"5/ An export or import license may not be validly used unless the business category or type is clearly indicated in the license when it is issued by the Ministry pursuant to sub-article (2) of this Article."

3. Effective Date

1/ This Proclamation shall enter into force on the date of publication in the Federal Negarit Gazette.

2/ Notwithstanding the provisions of sub­article (1) of this Article, the amendment made under. Article 2(1) of this Proclamation shall be applicable to late" registrations conducted after the 24th day of July, 2012.
