NY Rising Interim Mortgage Assistance Program

Homeowners who are eligible participants in the NY Rising Housing Recovery Program and are paying both payments for their primary home mortgages and temporary housing costs may be eligible to receive assistance from the Interim Mortgage Assistance (IMA) Program. The assistance amount is the lesser of the monthly mortgage payment or the temporary housing payment, up to $3,000 per month up to 20 months in total, 6 of which can be retroactive from the date of the applicable storm to the date the of submitted IMA application. You cannot receive assistance for months during which you received rental or mortgage assistance from another source. If you are not currently displaced, but will be once construction starts, you may still submit an application, however you will not receive any payments until you are displaced from your primary residence and incurring both mortgage and temporary rental housing expenses. If you were displaced in the past, you can apply to receive retroactive reimbursement for a total of 6 non- consecutive months of incurred rental or mortgage expenses from the date of the applicable storm to the date the of submitted IMA application.

A denial letter does not necessarily mean that an applicant is ineligible for assistance. It may mean that the information provided is incomplete. An applicant also has the right to appeal a denial in writing within 60 days from the date of the decision of the letter. Homeowners affected by Superstorm Sandy will need to comply very soon with an upcoming “proof of loss” requirement under the flood insurance program. You will not be able to sue your insurer if you do not comply on time. Touro Law HEART Program advises victims to (1) submit the three forms listed below on time, (2) sign them and complete them fully, and have each notarized, (3) state specific dollar amounts on the forms and not “to be determined” or something of that nature, (4) state what you believe to be the full value of your claim, (5) attach all supporting documentation, and (6) meet all requirements in section VII(J) of the flood policy. [The flood policy (Dwelling and General Property Forms) are at http://www.fema.gov/national-­­flood-­­insurance-­­ program/standard-­­flood-­­insurance-­­policy-­­forms#1.] The three forms, available at http://www.fema.gov/forms-0 are: 1. The standard “Proof of Loss,” used to support the full value of your claim. [Proof of Loss, FEMA Form #86-­­0-­­9 ]. Even if an insurance adjuster asked you to sign a Proof of Loss, the policy states that this is for “courtesy only.” Chances are that if you are reading this, it also undervalued your loss. Therefore, you will need to submit another Proof of Loss on time that complies with all of the items enumerated above. 2. The “Increased Cost of Compliance Proof

FEMA has extended the Proof of Loss DEADLINE to twenty-four (24) months after the date of loss. For example, when the date of loss for the Hurricane Sandy flood claim is October 29, 2012, the policyholder must send a complete signed and sworn-to proof of loss, attaching all documentation to fully support the claim, so that it is RECEIVED by the insurer on or before October 29, 2014. Similarly, if the date of loss is October 30, 2012 – all documents must be received by the insurer on or before October 30, 2014.

The “Statement as to Full Cost of Repair or Replacement,” used to claim your full actual or estimated costs to rebuild, repair, or replace the property. [Statement as to Full Cost of Repair or Replacement, FEMA Form #86-0-12]. Although this third form does not state “Proof of Loss” in its title, this checklist will refer to it as part of the proof of loss forms and requirement.

Recommendation: Submit all proof of loss forms with supporting documentation so that they are RECEIVED by the deadline or earlier whenever possible . Comply on time if you have not received all flood insurance money that you feel you are owed. Comply on time even if your claim, supplement, or other paperwork is still pending with the insurer.

Disaster Housing Assistance Program - (DHAP-Sandy)

On March 25, 2013, HUD and FEMA executed an Interagency Agreement (IAA) to implement DHAP-Sandy. The DHAP-Sandy provides monthly rent subsidies, security deposit assistance, and utility deposit assistance to assist eligible New York State residents displaced by Hurricane Sandy. The New York State’s Office of Homes and Community Renewal (HCR) will administer DHAP-Sandy to eligible residents of the State of New York. The HCR will make rental assistance payments, on behalf of eligible families, to participating landlords for a period of up to 12 months commencing from the effective date of the initial Disaster Rent Subsidy Contract (DRSC). To be eligible for DHAP-Sandy, the family must have been displaced by Hurricane Sandy and referred to HUD by FEMA. FEMA is solely responsible for determining if the family is initially eligible to receive assistance under DHAP-Sandy. Under DHAP-Sandy, HCR will assume responsibility not only to provide a monthly rent

DHAP-Sandy is a temporary housing assistance program that terminates on December 31, 2014. In order to prepare the family for this eventuality, Disaster Case Management is provided and required for the entire duration of DHAP-Sandy.

FEMA Rental Assistance

Storm survivors who lost their home because of damages caused by Hurricane Sandy may be eligible to receive rental assistance. FEMA offers funds to rent alternative housing for a limited period of time while repairs are made to the dwelling.

United Way of Long Island – Boiler Program

Application is via homeowner’s Disaster Case Manager only. Homeowners in need of boiler replacement should contact their Disaster Case Manager regarding application. If a DCM does not have an application, they should contact their supervisor or United Way. Applications will not be sent directly to homeowners. Disaster Case Managers may submit applications and supporting documentation on behalf of their clients. Applications will not be accepted directly from homeowners.

United Way of Long Island has received a limited donation of high-efficiency, gas-fired, steam boilers from US Boiler Company available to low/moderate income households in owner occupied homes where the existing boiler was damaged by Hurricane Sandy and requires replacement. Boilers must be compatible with homeowners existing heating system and square footage of home. Homes must have existing gas service and projects must be ready for installation. Home inspection required and homeowner must secure licensed/insured contractor. Low income guidelines (80% HUD) apply.

Applications will be on a first come first served basis until all boilers have been committed and approved by United Way.

The Health & Welfare Council of LI, the United Way of Long Island and other agencies across Long Island are initiating a Long Island Hurricane Sandy Unmet Needs Roundtable designed to assist low/moderate income families whose disaster-related needs could not be met by any other insurance, government or nonprofit agency source. This tool, frequently used after federally declared disasters, connects donors with storm victim cases in which all other means of assistance have been exhausted. In this model, trained case workers present selected cases to a round table of funders, who then determine whether they will meet the expressed needs based on predetermined criteria. Any funding provided by the donors goes directly to whatever vendor can meet the need — for example, a contractor or a landlord — ensuring a transparent system for aid. Only Disaster Case Managers apply to the Roundtable on behalf of their clients.
